Now PayNearMe founder and CEO Danny Shader says he’s doing the same for cash. Wait, what? The whole point of cash is that it’s the raw unit of legal tender. There’s no mediating, no processing. Cash would seem the form of payment least in need of technological intervention. Cash in hand equals money in your pocket. Yet in a 21st-century U.S. economy driven by digital transactions, relying on cash alone cuts you out of the mainstream. According to a federal survey released last fall, more than 8 percent of U.S. households qualify as unbanked. That means 17 million adults without checking or savings accounts. For them, the cash economy is the economy. Another 24 million households qualified as underbanked, meaning someone in the house had a bank account but within the past year had also used non-bank “alternative financial services” such as payday loans or check-cashing. But cash doesn’t work well for many kinds of payments, Shader says. Rent. Loan payments. Online purchases. Basically money destined for anyone you can’t just walk down the street and hand it to. Shader says his company bridges that physical divide by making paying anyone with cash as easy as going to 7-Eleven. Here’s how it works: Say you’re a tenant in an apartment complex run by a property management company based in another city or another state. Handing over a wad of bills isn’t an option. If that property manager is signed up, you can go to the PayNearMe website, find yourself in the tenant database, and get a barcode (printed on paper or sent to your smartphone). Take that barcode to 7-Eleven, get it scanned and pay the cashier your rent in cash. You’re done. “The transaction runs at the speed of buying a Slurpee,” Shader says. A veteran tech entrepreneur who has sold companies to Amazon and Motorola, Shader started working on PayNearMe just under four years ago. Until now, PayNearMe has worked directly with larger businesses, including Greyhound and Amazon. (In California, you can also apparently use PayNearMe to fund your account with Xpressbet, a site that lets you wager on horse-racing online.) Starting today, small and medium-sized businesses can set up an account directly through the PayNearMe website to start taking remote cash payments themselves. The account costs $199, and consumers pay $3.99 per payment. PayNearMe’s backers clearly see the cash economy as a moneymaking opportunity. The company just booked $10 million in its latest round of financing, led by August Capital. Shader pitches the service as a boon to the unbanked and underbanked, a major chunk of the U.S. population on the financial margins. But he also says the ability to take cash without the headaches of physically handling it has advantages for those on the receiving end: “Cash,” Shader says, “doesn’t bounce.”

The CCK was established as the regulator for telecommunication, radio and later broadcasting and ICT services. The CCK had issued Royal Medial Services, a Kenyan broadcasting company, with licences to provide radio and television broadcasting services in various parts of Kenya. In August 2010, a new constitution came into force, section 34 of which provided as follows: *34.(1): Freedom and independence of electronic, print and all other types of media is guaranteed, but does not extend to [forms of expression prohibited under Article 33(2)-* *(2) The state shall not –* *a. exercise control over or interfere with any person engaged in broadcasting, the production or circulation of any publication or the dissemination of information by any medium; or (b) penalize any person for any opinion or view or the content of any broadcast, publication or dissemination.* *(3) Broadcasting and other electronic media have freedom of establishment, subject only to licensing procedures that – * *(a) are necessary to regulate the airwaves and others forms of signal distribution; and* *(b) are independent of control by government, political interests or commercial interest….* *(5) Parliament shall enact legislation that provides for the establishment of a body, which shall-* *a. be independent of control by government, political interests or commercial interests;* *b. reflect the interests of all sections of the society; and* *c. set media standards and regulate and monitor compliance with those standards.* In May 2012, the CCK issued a press notice that certain radio frequencies in some towns in Kenya were being operated without a licence and required the operators to surrender the frequencies within 30 days. The majority of the frequencies which were the subject of this notice were for television and radio services operated by Royal Media Services (RMS). RMS filed a constitutional petition in the High Court in which it argued that the notice was contrary to the Constitution because the CCK was not the licensing body sought to be established by section 34(5). It argued that the effect of the new Constitution was to re-organise the state entities concerned with media regulation in order to protect the newly established constitutional freedom, and to suspend all the licensing provisions and functions of the CCK under the Kenya Information and Communications Act until the body envisaged under Article 34 of the Constitution was established. RMS further argued that the notice violated its freedom as a media organization, its right to the property in the frequencies and its right to fair administrative action. Held: - The Constitution of Kenya 2010 was superimposed on an existing legal framework. The framers of the Constitution intended that over time, this framework would be transformed by legislative Acts to accord with the Constitution. It was for this reason that Article 261(1) and the Fifth Schedule to the Constitution required parliament to enact the legislation contemplated under Article 34 within three years from the date of the promulgation of the Constitution. - Under section 7(1) of the Sixth Schedule to the Constitution, all law in force immediately before the date of the promulgation of the Constitution of Kenya, 2010 continued in force and shall be construed with the adaptations necessary to bring it into conformity with the Constitution. - Moreover, Article 259(1) of the Constitution was to be interpreted in a manner that promoted its purposes, values and principles; advanced the rule of law, human rights and fundamental freedoms; permitted the development of the law and contributed to good governance. For the Court to permit a situation where a legally constituted body is extinguished leaving the airwaves unregulated would undermine the constitutional objectives of good governance. - It followed that the Kenya Information and Communications Act, 1998 and all the regulations made under it remained in force subject to the Constitution and the transitional provisions. - The Communications Commission of Kenya was established by legislation which was currently in force and was empowered to licence and regulate postal, information and communication services as contemplated under Article 34 of the Constitution until the body contemplated under Article 34(5) was established. - The action of the Commission against Royal Media Services was in the nature of a notice to show cause why regulatory action should not be taken against it and it did not amount to a contravention of any of the petitioner’s rights under Articles 34, 40 and 47 of the Constitution. *Petition dismissed.* *Download the Full Judicial Opinion*<http://www.kenyalaw.org/Downloads_FreeCases/91338.pdf>

It fosters the next generation of active scholars and in-situ experts capable of contributing to good ICT-related policy and regulation in the region. The emphasis is on research for evidence-based ICT policy and regulation, and on the use of research for policy influence. The conference will be hosted at the Infosys Campus Mysore India. The state-of-the-art campus has been set up and is managed by the Indian global technology services company, Infosys, for the purpose of training its staff and recruits. The Infosys Bangalore and Mysore campuses inspired Thomas Friedman to write the international bestseller The world is flat. *Content* The conference will accommodate 30 paper presenters from Africa and the Asia-Pacific over the course of three days (Asia-Pacific papers will make up around 60 percent of total). "We estimate it would require an additional $1.1B for about a quarter of the original scope to continue and fielding would not be until 2020. The Air Force has concluded the ECSS program is no longer a viable option for meeting the FY17 Financial Improvement and Audit Readiness (FIAR) statutory requirement. Therefore, we are cancelling the program and moving forward with other options in order to meet both requirements." The Air Force will instead need to use its "existing and modified logistics systems for 2017 audit compliance," the statement adds. Air Force officials restructured the program three times within the past three years, and ultimately determined the military division "will be better served by developing an entirely new strategy versus revamping the ECSS system of record again," it states. The system dates back to 2005, when Oracle won an $88.5 million software contract, securing the deal over rival SAP and other vendors. It was supposed to replace more than 200 legacy systems. InfoSec: Red October cyber-espionage attack list includes 5 African countries

In alarming news, Kaspersky's revelation of their discovery of the Red October (Rocra) cyber-espionage operation lists at least 5 African countries (South Africa, Uganda, Congo, Tanzania and Kenya) that have been victims/targets of the spy network's activities. The spy network, which largely focuses on international diplomatic service agencies, also targets governments and scientific research organizations. Red October allegedly rivals the sophistication of last year's Flame malware but is described a "more devious" as attacks can be handcrafted for specific targets. Our lines are still out of service. Simple maths, if each of the lines was making Telkom KES. 10,000 a month, we can easily claim that Telkom has lost more than KES 240 million in revenue (240,000,000), where only they can compete from this small group of customers in 2012. The Telkom officer who was responding to my complaint last year thought i was being skeptical. I wonder where Telkom will be in 10 year with this France Telecom? Muthoni

No one seems to understand that we are behind schedule already. It took Britain and US eight years to fully migrate. Indeed the minimum time you need to fully migrate is five years. Safaricom has partnered with KopoKopo to turn MPesa into a point of sale payment platform but what is more important with this development is that the transaction fee can be reduced to a fixed cost in this case 1.5% and also the sharing of the revenue between Safaricom & Kopo Kopo an issue that was previously a no go zone at Safaricom. This new product is the second death kneel on the mpesa agent business model after the one of the banks, as an mpesa agent we are preparing for the inevitable death proactively. Like with the newly reduced voice interconnection charges we need a similar model for integrators like PesaPal so that the consumer is not overcharged when using such services as the integrators are forced to charge a fee over and above those already being charged by the mobile money provider which means that they PesaPal has proven they are not going away and what they need to take off into the stratosphere is a little local support, I am sure that Liko will soon be responsive to a buy out. I see PesaPal becoming the debit card of the mwanainchi where funding can be done from multiple sources. Farewell to Aaron Swartz, an extraordinary hacker and activist

Aaron Swartz, an Internet savant who at a young age shaped the online era by co-developing RSS and Reddit and later became a digital activist, has passed on. Aaron did more than almost anyone to make the Internet a thriving ecosystem for open knowledge, and to keep it that way. His contributions were numerous, and some of them were indispensable. When we asked him in late 2010 for help in stopping COICA<https://en.wikipedia.org/wiki/Combating_Online_Infringement_and_Counterfeit…>, the predecessor to the SOPA and PIPA Internet blacklist bills<https://www.eff.org/issues/coica-internet-censorship-and-copyright-bill>, he founded an organization called Demand Progress<http://demandprogress.org/>, which mobilized over a million online activists and proved to be an invaluable ally in winning that campaign. Thoughts on Kenya's National Broadband Strategy

I had shared these thoughts in ISOC-KE and someone asked if I would mind sharing them with KICTANET. Well, here goes: ------------ Is it right to explicitly name a particular technology within the context of such a high level strategy? Pg 6 ¬† the immediate plan to further deploy broadband through a nationwide LTE system The language in principle 2 (pg 8) and principle 7 (pg 9) seem to be contradictory. While principle 2 emphasizes technology neutrality (a good thing), principle 7 in elaborating competitive use of technologies explicitly names fiber optic and wireless broadband. It is proposed that the language here be changed to distinguish between fixed and non-fixed media as alternatives for infrastructure Pg 21 - the relationship between a pacemaker (for heart conditions) and content & applications is not immediately obvious - could this be the wrong kind of example to use in this section? Pg 22 (Table 4) on the problem of an unstructured innovation chain; wouldn't it be better to aim at developing a National Innovation System - rather than simply seeking to "institutionalize the innovation value chain"? The current recommendations fall far short of *really* tackling the underlying issues and proposing sufficient interventions to address the problem in the medium to long term. Pg 23 the figures related to mobile penetration should be updated with latest market estimates and not figures from 2011. Current estimates are at 100% mobile penetration. Also the percentage of *youth* is questionable as it is based on a 2005 study. Should statistics that are 8 years old be used in such an important document? pg 26-32 Section 3.4 Policy, Legal & Regulatory Environment While CCK has over the past 13 years of it's existence facilitated massive transformation with the information and communication technology sector in the country and the region as a whole. It could be argued that the Commission's mandate has become bloated over the years, leading to a "too many eggs in one basket" problem. It could be recommended that specialized agencies be established to deal with essential issue that do not strictly fall under the regulatory mandate of CCK and may, in some cases create opportunity for conflict of interest. These include but are not limited to: Operation and Administration of the Universal Service Fund, Operation and Administration of cyber-security related units, consumer protection etc... While it is evident and obvious that CCK has served and may continue to serve as an ideal "incubator" for these types of services/agencies. It is true that they encompass a potentially vast amount of work, especially within a national context and could be better served by specialized agencies that can focus time and resources and deal with issues in a focused and timely manner. pg 33 Section 3.5.2 by specifically referring to a particular technology (in this case LTE) as a means to accomplishing the objectives of this strategy - it might appear that the strategy is biased towards particular vendors or operators and may not necessarily be taking the best interests of the marketplace and the greatest stakeholder - the citizen - into consideration. It is recommended that the language in this section be reworked to eliminate the mention of specific technologies. The section on Financing and Investment should include recommendations on various incentives to promote activity in the area. Tax breaks, concessions, PPP proposals, allocations from various existing (and new) funds etc... Section 4 Implementation once again, specific reference to LTE may not be in the best interests of leaving the strategy open enought to allow for competing and maybe more affordable technologies that can achieve stated objectives.

Update on the switch off of unregistered SIM cards

Listers, More than 2.4 million unregistered SIM cards switched off The four local mobile operators have to date switched off more than 2.4 million unregistered SIM cards. According to statistics gathered from mobile operators, a total of 2,408,266 unregistered mobile lines had, by January 8, been switched off, barely a week after the expiry of the December 31 deadline. Safaricom has disconnected a total of 1.2 million unregistered SIM cards. Orange and Airtel have disconnected 520,000 and 365,266 unregistered lines, respectively. YuMobile on the other hand has switched off 323,000 SIM cards. Subscribers whose lines have been switched off have up to 90 days to register their SIM cards, failing which their mobile numbers will be withdrawn permanently and subsequently reassigned to new users. The action plan derived from the Africa strategy, will help implement a series of seven (7) priority projects , including ICANN's further engagement with I*, particularly the African Internet related Organizations and businesses, an all Africa workshop on the DNS industry, a DNSSEC roadshow, the ICANN academy, the ambassador programme , the incubator programme for DNS industry and business development. The latter will be launched in July 2013 (FY14), together with another series of projects. Internet Society Seeks Nominees to Join Other Historic Figures in Internet Hall of Fame Nominations Submission Deadline February 18 [Washington, D.C. and Geneva, Switzerland – 10 January 2013] – The Internet Society today announced that nominations for the second annual Internet Hall of Fame will be accepted January 11 through February 18, 2013. The nomination form will be available on the Internet Hall of Fame website, http://www.internethalloffame.org/nominations. Individuals who have played a significant role in the conceptualization, building, and development of the Internet in any region or country are considered for induction each year into one of the three categories of the Internet Hall of Fame: * Pioneers: recognizing individuals instrumental in the early design and development of the Internet. * Innovators: recognizing individuals who made outstanding technological, commercial, regulatory, or policy advances and helped to expand the Internet’s reach. * Global Connectors: recognizing individuals who have made major contributions to the growth, connectivity, and use of the Internet, either on a global scale or within a specific region or community. Sorry @Paul K, @Ndemo and @Kate Gitau to pick on you early in the year, but it looks like I cannot reach most of the government site (www.xxx.go.ke) I quick ping to the following fails: http://www.ict.go.ke/ (ICT Board site down) or http://www.information.go.ke/ (Ministry of Info and communication site down). Rumour has it that it has something to do with the TEAMs cable undergoing scheduled maintenance. Pliz ?!!??...
