ZACR and AfTLD MOU signing– a momentous occasion Note from the editor The Internet Corporation for Assigned Names and Numbers (ICANN) held its 24th meeting in Beijing, Republic of China. This ICANN meeting was the most well attended meeting in the history of ICANN meetings, with the numbers totalling 2600-registered participants. With that said, it was indeed a scramble to get one’s hands on the most sought after commodity at ICANN… the Gala dinner tickets. The dotAfrica team did not attend, alas. The spectacular event was held at the Great Hall of the People, Beijing. This 24th meeting was of great interest to the dotAfrica team, particularly with regard to the much-anticipated GAC Advice, issued for the new gTLDs, and the requirements for the Trademark Clearinghouse (TMCH). Full reports on these two topics are included below. Overall, the meeting was a success for the dotAfrica team, with many people engaging us on the progress of our application, the dates for the delegation of the .africa gTLD, and so on. The spirited and very exciting debate still continues for .africa and we eagerly anticipate the completion of the initial evaluations. GAC Communiqué - GAC Advice (Alice Munyua) GAC advice on new gTLDs contained in the GAC Beijing communiqué GAC advice represents a consensus position among member states that a particular new gTLD application potentially raises sensitivities, thereby creating strong presumptions that the ICANN Board of Directors should not approve the application. The Beijing meeting Governmental Advisory Committee (GAC) communiqué issued on 11 April 2013 was an important one, as ICANN was expecting GAC Advice on new gTLDs, as defined in the Applicant Guidebook. The GAC communiqué serves as the official notification to applicants of GAC Advice and triggers a 21-day response period as per the Applicant Guidebook (Module 3.1). The guidebook states: "If the Board receives GAC Advice on new gTLDs stating that it is the consensus of the GAC that a particular application should not proceed, this will create a strong presumption for the ICANN Board that the application should not be approved. If the Board does not act in accordance with this type of advice, it must provide its rationale for not doing so." Read More 3. Trademark Clearinghouse (TMCH) - an update (Ed Pascoe) Here are some of the highlights of the meetings and discussions around the TMCH at ICANN Beijing. The pricing for the trademark holders and the ability to pay for the trademarks have been finalised. Everything else is still under development or in discussion. All the TMCH meetings were very well attended and fairly vocal. They have received lots of feedback and objections to some of the proposals so expect some of them to change. In particular IBM are still implementing email notifications of status changes. The SMD has yet to be implemented. The full strawman process is yet to be implemented. The text for rights holders’ notice of domain name registration has yet to be discussed. The TMCH will verify trademarks automatically where they have direct access to a trademark database. Otherwise the rights holder will have to submit trademark documentation. TLD is required to give 30 days’ advance notice of sunrise. It is expected that the first TLD to use the TMCH for sunrise will be .jobs. .jobs was delegated in 2005 but has recently changed its charter and has never had a sunrise period. TMCH are predicting a very short testing phase before it goes live. Some of the changes that have happened to the TMCH in the past few weeks include the following: - The claims notice period has changed from 60 days to 90 days. - The TMCH will provide brand holders with 30 days’ notice prior to the start of any sunrise period. This means that no TLD can start its sunrise without giving prior notice to the TMCH. If the TMCH does not have the resources/bandwidth to process the sunrise period, the TLD will have to delay sunrise until capacity is available. - Brandholders will be able to register up to 50 variants of their marks in the TMCH as long as those variants have been the subject of successful litigation or UDP arbitration in the past. ZACR and AfTLD MoU signing - a momentous occasion AFRICAN INTERNET COLLABORATION RECEIVES BOOST WITH "BEIJING AGREEMENT" A landmark Memorandum of Understanding (MoU) has been signed between the ZA Central Registry (ZACR) and the African Top Level Domains Organisation (AfTLD) at ICANN's 46th Public Meeting in Beijing, People's Republic of China. Dubbed the "Beijing Agreement", the MoU is the foundation of the relationship between AfTLD - the representative of African country code Top Level Domain (ccTLD) managers - and ZACR - the registry that is set to be awarded the right to operate the new dotAfrica (.africa) registry by ICANN. The agreement is a culmination of collaboration in existence since 2011 when AfTLD and its members endorsed the ZACR dotAfrica application. The agreement was signed by AfTLD President Dr Paulos Nyirenda, ZACR CEO Neil Dundas and the dotAfrica Steering Committee Chair Mohammed El Bashir. The key deliverable from the MOU is the allocation of a portion of dotAfrica’s surplus revenue for programmes aimed at enhancing African ccTLD capacity as administered by AfTLD. The AfTLD capacity building programme includes technical, policy and regulatory training, workshops and conferences. The investment in AfTLD’s ccTLD programme is not the only key deliverable for the ZACR dotAfrica project. Africa's tech scene is a soaring firebird and all the techies on the continent will tell you something game-changing is coming and Africans will build it. In case you haven't heard, apparently the next Facebook, Google or Microsoft will come from Africa. That's what the young mavericks are working towards. *In Africa, we worship at the altar of innovation* Innovation is the fountain from which most African entrepreneurs drink -- their raison d'etre. This is hardly surprising on a continent that leapfrogged the tech scene, producing insanely useful mobile solutions. It seems it is only logical that the continent will build the next big thing. Why Barr the Media from PS Interviews?

Listers, Can someone explain the logic of the Chair of PSC barring the media from interviews of Principal Secretaries? Aren't they public servants who are supposed to be vetted publicly even with citizens giving their submissions? Judges, commissioners of various commissions were vetted publicly infront of "live" media cameras, why not PS' ? What are they shielding? The argument that interview questions will be known by others does not fly, the same argument would also have applied to judges, commissioners etc, but it did not. If you're good you're good and we'll see it (otherwise, you appear too "rehearsed" when you cram interview responses") Where's citizen participation which is enshrined in the constitution? I think these are the kind of issues that COFEK needs to take up, Mutoro? Edith

Our press release following the meeting with Pasha Centre owners yesterday and the subsequent announcement of our bandwidth subsidy program. FOR IMMEDIATE RELEASE Government to offer bandwidth support to Digital Villages Nairobi, 29th April 2013: The Government through the Kenya ICT Board will from May this year offer a 90 per cent subsidy on internet purchase to all Digital villages (Pasha Centres). The bandwidth support will be provided under the Transparency Communication Infrastructure Project (TCIP), which is funded by World Bank. The objective of the Bandwidth Capacity Support is to enable the 63 Digital villages to purchase high quality and affordable connectivity for their centres to enable information sharing and offer affordable access in rural areas. Speaking during a workshop in Nairobi with Pasha Managers, The Kenya ICT Board CEO, Mr Paul Kukubo said, “We have recognized that the major challenges surrounding internet access for Pashas centres are connectivity and affordability. As a solution we have decided to subsidise the internet costs.” The government will pay 90 per cent of the internet access costs while Pasha Managers will pay the remaining 10 per cent. The Initial support will last 18 months and will cover internet connection costs but exclude the purchase of connectivity equipment. To qualify for the internet access subsidy both pasha managers will first identify the Internet Service Providers (ISP’s) that they will work with and submit prescribed documents in order to take advantage of the support. ISPs will have to be registered by CCK as a provider of the services. “Pasha centres are strategically placed to bring ICT services to their communities. To succeed they need to take advantage of devolution opportunities and respond to the government agenda of delivering digital education in remote areas,” challenged Mr Kukubo. The workshop brought together heads of digital villages and leading ISP companies to agree on the modalities that will be applicable on the subsidy. I heard that he lamented about the lack of a human resource index and I chuckled, as even I, am not on LinkedIn, at least not yet which is sad for a man having in my docket. Will it disadvantage African trademarks? Most African business/trademark holders etc have not been paying much attention to what has been going on at ICANN with the new gTLD processes and this discussion has not taken place in our region, yet it is an important one. A proposed African Mark Validation System (MVS) will be established for "holders of various proprietary-‐naming rights, in particular trade mark rights" and can soon start submitting their marks to the MVS with supporting documentation. The Kenya ICT Board wishes to correct this position. The Kenya ICT Board has committed funding for 65 Pasha centres to date across the country. For a factual update, we urge listers to visit. http://www.ict.go.ke/index.php/digitalinclusion. We will update this even further with an announcement we are making on Monday to further develop these centres. The Kenya ICT Board will write to COFEK formally providing further information in the public interest on the basis of COFEK's stated goal as stated on their website "advocacy is based on authentic information as backed by continuous research." We have finalised our 6 year report on the Kenya ICT Board which is currently being printed. we shall upload a digital copy onto our website, in the next week or so. This will make an exciting read on the sector. My view as the outgoing Kenya ICT Board CEO is that Dr Ndemo provided the vision, compeled us to seek a world class approach, set the tone of energetic execution, helped us cement partnerships in order to improve capacity, and focus on enterprise development, innovation and the ordinary citizen. He cautioned against getting too carried away in ICT dogma, but asked that we rather just get the job done. This was augmented with spirit of learning to pick up quickly from mistakes, (and many were made). There will be much debate, and indeed many things are left for the next team to do. As a team, we gave this our very best effort and Dr Ndemo gave us a style of leadership that even in the best private sector environments, you will struggle to find. (I will write more extensively on this later.) We reaped a leadership dividend in the sector, with support from the highest level of government. On this score there can be no debate. The country is much better for it We pray this carries on. County Governors and the Need to Embrace ICTs

Listers, Today, Governor of Nairobi County, Kidero (or is he H.E....how do you address them?) posted on his twitter account a note inviting Kenyans to the first public participation meeting to plan for the County. As most of us are at work during the day (or tarmacking) , how are we expected to meaningful participate? I dare suggest that County Governors embrace ICTs and have "live" online coverage of the event in a way that those unable to attend can still directly contribute via whatever means possible - radio, sms, social media, digital hangout etc etc? Any thoughts on how this can be done to embrace EVERYONE based on technologies and tools available in people's hands (not forgetting the digitally excluded). Ideas? Edith

Posta is in dire need of re-inventing itself ala Deutsche Post which reverse took-over DHL and benefited from its logistics and savvy managerial skills. Is the semi-privatization of Posta Kenya imminent? Is it the only thing that can save it? Should the Government/Posta seriously look at this option? I dare say we must move poste haste (pun intended) or be confined to the fate of the US Postal Service which seems incapable of getting out of its morose state. To actually strengthen the polytechnics and colleges to become world class reminiscent of the Indian Institutes of Technology? Listers, P R E S S R E L E A S E E [cid:image003.jpg@01CE3C49.88BCD940] 18th April 2013 Growth rate of internet/data surpasses voice The number of internet users in Kenya increased to 16.2 million in the period between October 1 and December 31 last year, representing a growth of 11.6 %. According to the CCK Sector Quarterly Statistical Report (2nd Quarter of 2012/13 FY) released today, the number of Internet subscribers in the country rose from 8.5million in the 1st quarter of this financial year to 9.4 million by the end of December 2012, posting an increase of 11.5%. The number of Internet subscribers increased by 75.1% compared to same period in the previous year. Mobile data/internet continued to dominate the Internet market contributing 99% of the total internet/data subscriptions in the country. Internet penetration went up by 4.3% to reach 41.1% up from 36.8% recorded during the previous period. However, the number of broadband subscribers declined to 1,002,701 from 1,006,071 posted during the previous period mainly due to a reduction in the number of fixed terrestrial broadband subscribers. The report attributes the growth in the Internet/data market segment to international internet connectivity (used) bandwidth that has continued to spiral upwards. During the quarter under review the international internet used bandwidth rose to 328,641 Mbps from 278,329 Mbps posted during the previous period, representing an increase of 18.1 percent. Meanwhile, the total number of mobile subscribers in Kenya rose to 30.7 million, representing a marginal growth of 1.0 percent from the previous quarter. As observed during the previous period, the rate of growth has slowed down as the market appears saturated and tending towards maturity. Pre-paid subscribers continued to dominate the mobile sub-sector contributing 99% of the total number of subscribers. Mobile penetration on the other hand increased to 78% during the same period up from 77.2% recorded during the first quarter. All mobile operators recorded positive growth in service subscription beside Telkom (Orange) which lost a total of 609,321 customers, representing a decline of 19.7% during the quarter under review. The number of letters sent locally declined by 2.0 percent to reach 17.3 million down from 17.7 million letters sent during the previous period. Compared to the same period of the previous year, a decline of 11.8 percent was recorded. The number of international incoming letters grew by 20.9 percent during the period to reach 191,672 letters from 158,549 received during the previous period. Similarly international outgoing letters reached 1.9 million from 1.6 million during the previous period, representing 18.1 percent increase. The full report is attached. Some are suggesting the protest take the form of a “blackout” – going offline for 24 hours, displaying censorship bars over content or posting statements of opposition to Internet censorship — similar to last year’s opposition to the Stop Online Piracy Act (SOPA) and the Protect IP Act (PIPA). Last week, the Internet Corporation for Assigned Names and Numbers (ICANN) held its meeting in Beijing. These meetings are held in every region, and discuss emerging technical and policy issues relating to the internet. ICANN has several bodies but one of the key one and probably the most controversial is the Government Advisory Committee. Controversial because private sector, internet manager types feel that governments have nothing to do with internet management while governments feel they should be at the center of it because of public policy concerns. For a long time, ICANN has worked hard to show that its international and that there are many other governments involved in decision making and it is not only the US. WHO NEEDS THE ITU WHEN WE HAVE THE GAC (Governmental Advisory Committee at ICANN) & KENYA'S SHENANIGANS AT ICANN 46

Listers For those who followed the goings on at ICANN 46 in Beijing there seems to be a concerted effort from Governments worldwide to endanger the freedoms we have enjoyed on the internet. See GAC communique attached. While I applaud the GAC for having reached consensus to object to two applications, one of them dot Connect Africa, my personal opinion is that the same (in my opinion) retrogressive elements who derailed WCIT12 are at play again with some GAC members trying to introduce/recommend to ICANN a complete redesign of the underlying policies for approving new top level domains. To quote from the article below (see link) *'The GAC has interpreted the task of providing advice on public policy as a mandate to start from scratch and revisit every policy issue related to the use of domain names that has been debated since 1999. Six years of work by the Generic Names Supporting Organization, which is supposed to develop policy, has been ignored.' * http://www.internetgovernance.org/2013/04/11/who-needs-the-itu-when-you-hav… I understand though that various ICANN constituents requested that the GAC advice on safeguards be put under public comment and I think this will be a good thing in protecting the multistakeholder model of policy making at ICANN. But all the same, what should we make of this? Is the Multi-Stakeholder model under attack? As it was in Kenya during deliberations towards WCIT12 in Dubai? And what is Kenya's position on the safeguards? Can the new Kenya GAC Rep please enlighten us? Talking of the Kenya GAC Rep, we understand there have been some very embarrassing situations where he contradicted the Kenya Government Stand on the African Union Commission (AUC) .Africa gTLD application. He is purported to have supported a competing application from DotConnectAfrica (DCA) against the AUC application which is supported by African countries including Kenya. See attached letter from our former Minister of Information, Mr. S. Poghisio. By the way, how is the Kenya GAC Rep appointed? We had Alice Munyua and Michael Katundu and then now it seems there is Sammy Buruchara who was recently appointed to apparently replace Alice Munyua, whose term was ending after the Beijing meeting having been the vice chair of the GAC. This is a terrible mess that points us as amateurs without an inkling of where our heads are at.. The link below paints a sorry picture of a country at odds with itself. The Minister had following these summits sent a clear message to ICANN regarding Kenya's support for the AUC application for .Africa (see letter attached) and there is also our former President who attended the African Union Heads of State summit that yet again mandated the African Union Commission to pursue and implement an Africa TLD. Listers, I invite you to make your own conclusions based on the evidence and documentation attached and linked to this posting. Lastly listers this also begs a question that has been burning me for a while:- Who is responsible for Policy Formulation in the ICT Space? Is the CCK or the Wider Government through the Ministry of Infocom? It is important that we interrogate this issue since we are seeing a slow creep of CCK Apparatchik in policy processes and engagement as opposed to regulation, enforcement and enablement. If this is the case then it needs to be very clearly mandated through new law. Or am I missing something? I stand corrected though if I am wrong in my assumptions. We are leader in Africa in this space and we must act the part. We shouldn't be seen to stumble and look like fumbling teenagers when it comes to our engagement in international fora. The Kenyan Private Sector, Non-Profits and Government must be seen to move in tandem like a well-oiled machine.
