New role for ICANN's GAC?

Should governments develop National regulations rather than lobbying within multistakeholder processes like ICANNs? Best Alice http://www.circleid.com/posts/20130514_icann_and_gac_a_new_role_needed/ Syracuse University professor Milton Mueller published a blog <http://www.internetgovernance.org/2013/05/13/will-the-gac-go-away-if-the-bo…> under the title "Will the GAC go away if the Board doesn't follow its advice?". Having been to a number of (very limited) ICANN meetings on behalf of law enforcement cooperation, I would like to share a few --- probably thought provoking --- observations. The GAC should not leave ICANN but it may be more efficient if it's role changed and it's efforts were aimed at a different form of output. *Governments and direct influence* I know that I should explain here what ICANN and the GAC is, but this article is only of interest if you already have some background. Over the past few years the role of the GAC, Government Advisory Board, within ICANN, Internet Corporation for Assigned Names and Numbers, seems to have changed. Having started as an advisory board, giving an advice to the ICANN board, which can be ignored or only taken to heed in parts, GAC operates more forceful. From advice to orders it seems. As ICANN is multi stakeholder all the way and, as most internet related organs work, bottom up and through consensus only. Perhaps the most stifling form of democracy, but democracy it is. Show up or participate remotely and your voice is heard. In this environment governments are seeking attention for their needs and concerns over the internet. Shouldn't they ask themselves: Is this the correct place to have direct influence? *Why are governments concerned?* The internet as we know it was created outside the view and influence of governments and by the time of the commercial boom, let's say, since 1998, most western countries had liberalised the telecommunication markets. If anything was regulated it was the old telephony and access fees, not the internet. With the rise of commercial opportunities also other opportunities arose for criminal actors, hacktivists, activists, free speech advocates, state actors, etc. The results of these opportunities concern governments (of all sorts, for different reasons) as all sorts of national interest from public safety to economic are at stake. By the time governments seriously started to look around for enforcement matters and regulations they faced a global challenge. Hence the drive to have more say on internet related policy discussions. Hence more interest in ICANN, ITU, IGF, etc., but mostly ICANN it seems. But again is ICANN the right places to have direct influence? *GAC and ICANN* What also surprises me, is that governments put all this effort into ICANN. In the end this organisation handles only one aspect of what makes the internet work. Is this because it is the best organised one? There are so much more topics and equally important ones, where there seems less involvement. The RIRs, technical internet bodies, CERT meetings, etc., are less government attended. So again is ICANN the right place to have influence? *National laws* If a government wants real influence it has to write law that is binding within its own country. It would be advisable that (several) governments coordinate on laws and regulations, e.g. the E.U., perhaps even beyond. The three times a year GAC meeting could be great for coordination. Why go national? The internet is only as stateless as the first cable coming on/into land somewhere. Everything behind that is within a nation state. This is where influence starts or could start should a government wish to have influence. Let's say that a government wants a ruling on: 1) a validation of (a domain name registration by) registrars and registries and resellers. It can lobby with ICANN and hope for self-regulation or it can write it in the national law; 2) abused IP addresses revocation. It can lobby with the RIRs (Regional Internet Registries) or write a regulation into national law; 3) revocation of abused domain names? Idem; 4) National organisations implementing best practices developed at the IETF, it can lobby there or oblige national organisations, e.g. ISPs, to respond and implement within six months through national law; 5) etc., etc., etc. A national regulation, whether directly enforced or through mandatory self-regulation, would be much more effective from a government's perspective than lobbying within multi-stakeholder groups and hope for the best. Does this mean governments have to leave these groups? *A new role* I'm not claiming that governments should leave ICANN. I'm not even propagating regulatory regimes here. To the contrary, but I do think the present effort could be bettered. Governments should use ICANN meetings, and all others around the internet, to understand which topics are important, what issues are at stake, inform themselves as good as possible from all sides by asking all the right questions and to have a true understand of it all. From this understanding they can build their policies, using all that acquired information. Policy that on the one hand aids the development of the internet and the economy while on the other assists in making it more secure. There is a fine line to walk here, but a line governments need to walk to be most effective on both sides. And, without the aid of industry it will never come about. *Conclusion* So, governments, lay down your ears and give your advice, but then go home and act on it in the best way possible. Preferably coordinated. * *

Our two constituencies and 400 individual and organizational members appreciate the opportunity to comment on the GAC’s “Safeguards applicable to broad categories of new TLDs” (the Safeguards). We address the specific recommendations of the Safeguards in the second half of our comments. We begin, however, by expressing broader concerns about the role of the GAC in ICANN, of which this Advice is symptomatic. The GAC and the multi-stakeholder process The ICANN bylaws authorize GAC to “provide advice on the activities of ICANN as they relate to concerns of governments, particularly matters where there may be an interaction between ICANN's policies and various laws and international agreements or where they may affect public policy issues.” This mandate assumes that ICANN’s carefully balanced representational processes (the GNSO, ALAC, etc.) develop policies and GAC comments on them in a timely manner. When offered in a timely manner, such advice might prompt the board to instruct the Supporting Organizations to reconsider or modify their policies before implementation. The Beijing Communique does not appear to be the kind of “policy advice” contemplated by the ICANN bylaws. The GAC did not advise or comment on the actual ICANN policy, but seems to have attempted to take over the process of defining and implementing new gTLD policy at an impossibly late stage of the process. It was either unaware of or disliked the results of an open, transparent, multi-stakeholder process, and now seeks to change it dramatically. The GAC concocted categories for new gTLDs that were not contained in the Applicant Guidebook and, for each category, came up with new, extensive and often contradictory or ambiguous regulations that it now insists be included in the contracts governing registries, registrars and domain name users. >From the standpoint of a multistakeholder policy making institution, this approach is deeply flawed, because a substantial transformation of the policy was not made with the participation of the GNSO or with the civil society organizations and businesses affected. There were no public hearings at which these governments’ citizens could make their views known. Moreover, since this advice would have the effect of an international regulation, it is notable that there was no review of this work by GAC members’ national legislatures. This is not “policy advice,” therefore, but an illegitimate form of international legislation. Worse, because it is couched as “advice” and not formal law, its recommendations, if implemented by the board, might be exempt from important constitutional checks and balances. In short, the GAC’s Beijing Communique is positioned not as advice, but as a substitute for the policy work of the broader ICANN community. As such, it constitutes a threat not only to the implementation of the new gTLD program, but to ICANN’s status as a multi-stakeholder policy development institution. Unless this “advice” is rebuffed by the board, ICANN undermines its Supporting Organizations, its policy development process, and the Applicant Guidebook under which hundreds of companies applied for new domains. At a time when authoritarian governments and intergovernmental institutions are challenging the legitimacy and validity of open, bottom-up, nongovernmental global governance, allowing a group of governments to over-ride and negate ICANN’s policy development processes in this way would send a terrible signal to the world. Specific elements of the GAC advice 1. The Preamble to the ‘Safeguards’ While most of the Annex would impose very specific requirements upon registries and their users, the GAC begins its Annex with a free-floating dictum that all of its commands “be implemented in a manner that is fully respectful of human rights and fundamental freedoms” and consistent with all existing international treaties and conventions. As the ICANN stakeholder group most concerned with human rights and fundamental freedoms, we appreciate the GAC’s recognition of human rights and the protections of international law. But we have a difficult time believing that they will serve as real protections in this context. In deciding what to do with this Advice, we ask both the GAC and the Board to consider the following questions: What does it mean to be “respectful” of the UN Universal Declaration of Human Rights, which includes the right to free expression, while at the same time requiring registries for strings such as .FAIL, .SUCKS, .WTF, and .GRIPE to “develop policies and processes” that would regulate content and expression under those domains? Is the GAC declaring that domains set aside for critical content be subject to special, new kinds of content regulation? Would such a governmentally-imposed requirement be consistent with Article 19, the U.S. First Amendment, the European Convention on Human Rights or other constitutional protections? What does it mean to order registries to “comply with all applicable laws…related to privacy” while at the same time ramping up the WHOIS enforcement mechanisms and data accuracy requirements without any regard for whether the registrant is a legal person or a natural person (i.e., an individual with a stronger privacy claim)? How is a concern for privacy consistent with the GAC’s clear intention to transform the WHOIS into a tool of systematic user identification and surveillance, and to use WHOIS accuracy as a pretext for immediate takedowns? What does it mean to demand respect for international law in one phrase and then demand that Amazon and Patagonia, both holders of trademarks recognized under international law, be denied the right to use their trademark in a TLD simply because some governments don’t want them to? On what law is the GAC’s request to deny these applications based? What does it mean for a global registry to “comply with all applicable laws” regarding dozens of “regulated industries” when there are nearly 200 jurisdictions and the regulations applicable to specific industries in each one may differ? More to the point, why does the GAC expect ICANN contracts to apply and enforce these laws rather than the governments themselves? In democratic jurisdictions compliance with law includes due process requirements for policing. What does it mean for a registry to comply with all applicable laws while at the same time being required by GAC to suspend domain name registrations based on a vaguely defined criterion which the GAC calls “security risks that pose an actual risk of harm”? What, exactly, is the definition of “risks that pose an actual risk of harm?” Is it the same as actual harm? What is the applicable legal standard here? How will it be adjudicated? This aspect of the GAC communique founders on its own contradictions. It cannot be implemented and any attempt to do so will fail. 2. Regulations applicable to all gTLDs In this section of the Annex, the GAC shows that it does not trust or respect current international or national laws governing privacy, identity and cybercrime. It seeks to impose upon registries, via ICANN contracts, detailed technical regulations regarding Whois testing and surveillance mechanisms. Yet many of the activities “required” are already undertaken or required in various venues; e.g., by ICANN (Whois accuracy checks at the registrar level), national law enforcement authorities, Internet service providers, registries, and independent security services companies. For example, all registries we are aware of already have abuse notification mechanisms. Phishing, botnets, and various forms of spam are already illegal under national and international laws. It is likely that ICANN contracts for registries are the wrong place to situate additional, specific regulations regarding monitoring of botnets, spam, etc. The GAC wants to impose additional regulatory burdens without any plausible case that there will be an improvement in the results. As advocates of Internet freedom and individual rights, the NCSG looks with concern upon increasing efforts by GAC to make WHOIS an internet identity card with a “real-name” registration policy similar to the failed attempt in South Korea. 3. Regulations regarding Consumer Protection, Sensitive Strings, and Regulated Markets In this section the GAC claims that “Strings that are linked to regulated or professional sectors” must be regulated in advance of any harmful action, because “these strings are likely to invoke a level of implied trust from consumers, and carry higher levels of risk associated with consumer harm.” This argument fails on two counts. First, the concept of “linkage” is too vague and open-ended to serve as a basis for systematic domain name regulations of the sort the GAC contemplates. Food, for example, is subject to health and safety regulation in all countries. Does that mean that any word related to food in the domain name system should be subject to special regulation? If so, we suspect that there is literally no word in the dictionary in any language that could not somehow be “linked” to some kind of sector or trade that has governmental rules and regulations attached to it. Reinforcing these concerns, the GAC includes the words .CARE, GAME, GREEN, PICTURES, DATA and dozens of other innocent generic terms in its Safeguard list, indicating just how limitless their approach can get. Such an approach would make ICANN (or the GAC) the world’s word police. Second, the GAC has fallen prey to the fallacy that any and every form of consumer harm that might occur on the Internet can be eliminated by imposing ex ante regulations on the words that are assigned in the domain name system. This is simply false. Many names and words that might theoretically be “linked” to specific services, industries or professional sectors can and will be used in productive and legitimate ways without any consumer harm. Conversely, many strings that are not clearly linked semantically to regulated or professional sectors could be used in a way that defrauds or harms users. The only rational way to react to these kinds of risks is to enforce the law ex post, not ex ante. In other words, actual, provable harm must occur first and regulatory action based on due process and clear standards of evidence and law should only occur afterwards. Any attempt to substitute ex ante regulation for ex post law law enforcement will harm many innocent users while failing to provide improved protection from a large array of unforeseen and unknown harms. We find it incredible that the GAC proposes to make registrars and registries authoritative licensing validation entities for 200 jurisdictions and an innumerable number of sectors and professions. This is not feasible. The principle of ex post law enforcement is a more feasible, and more freedom-respecting method of safeguarding concerns about fraud and consumer protection. If service providers or web sites are using names which fraudulently imply some kind of legal status, it is not that difficult for local or international law enforcement to stop them from doing so. But the legality or illegality of uses cannot be determined in advance. It is not a good idea to make the global name registry system responsible for policing the world’s professions and sector regulations on an ex ante basis. 4. Restricted Registration Policies We find this area of the GAC advice confusing. On the one hand, the GAC demands that registries carefully vet registrants ex ante and apply numerous regulations regarding who can register in nominally open generic TLDs; but it then goes on to insist that all registries be open and demands pre-approval and justification from any registry that proposes to restrict registrations as part of an attempt to establish a clear reputation and identity for a top-level domain. Business model innovation was an important rationale for the new gTLD program. Yet the GAC seems to want to make the traditional registry-registrar model that rewards mass registration a requirement, even though the economic incentives for mass registration are what often causes the security and consumer protection problems associated with domains. While the NCSG differs on the merits of closed generics and on the proper policy response, we agree that these policy issues should be resolved through the bottom-up, multistakeholder process and not unilaterally by the GAC.

As we resolved during the last Kenya Internet Governance Forum (KIGF), the Internet Society Kenya Chapter (ISOC KE) will be convening this year's KIGF. ISOC KE formed a working group to coordinate the planning and logistics of the same. The working group has slated the KIGF to be on the 26th July 2013 at the Strathmore University Business School. The working group sat for two meetings and identified Internet Governance issues pertinent to the Internet and ICT sector in Kenya. These issues are not exhaustive and we therefore invite input from the public to propose topics of interest to be discussed at the KIGF. The topics can be drawn from the main IGF themes or any issues that are of interest to Kenyans. The study shows that in many countries the development of Internet access is hampered by constraints on terrestrial connectivity between the submarine cables, the Internet Exchange Points (IXPs), last mile access infrastructures, and Internet Service Providers that deliver access to end-users in Africa. The report sets forth an Internet development approach focused on removing regulatory roadblocks and promoting Internet-specific investments, supported by a high-level policy environment to result in greater Internet availability and empowerment in Africa. "This study is significant as it identifies some of the last barriers for the development of Internet infrastructure in Africa,” noted Dawit Bekele, Regional Bureau Director for Africa, Internet Society. “It pinpoints the issues that all stakeholders and more particularly African governments and telecommunication regulators need to address to ensure that the massive infrastructural development that we have seen in Africa in the last few years results in bringing Internet to all Africans at an affordable price." Jane Coffin, Director for Development Strategy at the Internet Society, added, “We hope that this study will spark a national and regional debate in Africa that impacts future Internet development. There is so much that stakeholders can do to close infrastructure gaps by working together through creative public-private partnerships and by taking bold steps to allow change to happen by breaking down traditional barriers and allowing market entrants greater ease in network deployment.” “For us, the variation between regions in retail price of Internet traffic was revealing, with some ISPs offering access at USD 10 per gigabyte of traffic, and others charging up to ten times more than that. The RIA online resource is not a study rather a framework to provide comparative analysis of operators. Some days back, I visited the ICT Board to chat with Victor Kyalo about the digital villages project. I remember when I wrote about the launch in 2008, there was so much hype and I wanted to find if the hype was still there. I found that there has been challenges, from recipients buying cars, investing in other things to success. I also found out one nice thing; women recipients showed more commitment, which was good for women in ICT. I must admit that lending people Ksh 800,000 to 2 million is a great idea but if the business case isn't proven, you cant blame the people who felt it was better to buy a car for public image, or even to operate as a taxi. Why wouldn't such loans be given to thriving businesses that lack capital to finance projects? You can imagine Victor gave me a long winding answer that seemed to say that such a project is in the offing. I am writing a review of the board's performance in the various areas, according to my knowledge and experience. If you have views of how the board has performed, whether positive or negative, please share by giving me a blog post. I gave Paul Kukubo and his team a chance to write weeks ago but he declined or is yet to keep his promise or (insert your excuse here). Topics that come to mind: 1. BPO 2. Chipuka 3. Advertisements (as in newspapers, TV, etc.) provide the primary course of revenue for these businesses. Safaricom and other telcos need to demonstrate that they are offering services as below par prices and hence need to recoup/make a profit through ads. There is no justification for bombarding individuals with ads when they are not getting a cut in airtime rates. CCK should step in and advise accordingly. Regards. The government expects the majority of its 40,000 PCs to be migrated this year, the region's CIO Theodomir Cayetano announced on 18 April. Extremadura estimates that the move to open source will help save 30 million euro per year." Listers If you are like me you must by now be going out of your mind with useless SMS messages from the different players in the Telco sector. Is there some rule somewhere that CCK can dust off and ask them to stop sending these SMSs to 'abused' subscribers like myself. Or at the very least could you at least give us an option to Opt Out of this deluge of useless (in my opinion) SMSs? In my case I am specifically referring to Safaricom. I know that Safaricom has sophisticated Mass Customisation tools and if they use their Analytic Tools they would have known that for a Muslim (assuming in the majority of cases they would make deductions by name usage) a message that reads:- *'Watch Pastor Tim's Sunday Sermon...' * is particularly useless for a Muslim. The program seeks to identify members of the Internet community who either have not previously been able to participate in ICANN processes and constituent organizations, or those who require further exposure to the Internet community and its work but cannot travel and attend a meeting without financial support. This outreach program seeks participants from developing regions and countries of the world, in order to help create a broader base of knowledgeable constituents who will become the new voice of experience in their regions and beyond. Applications to become an ICANN Fellow are assessed for each meeting by an independent selection committee. Priority is given to applicants who: meet minimum program requirements; are current residents of developing and least developed nations; and are interested in participating in the ICANN multi-stakeholder process and its supporting organizations, advisory committees or stakeholder groups. An effort will be made to include participants from the African region as it is the site of this ICANN meeting. All confirmed fellowship participants must comply with the terms and conditions of the Fellowship program, as outlined at http://www.icann.org/en/about/participate/fellowships/terms-conditions. As stated within these terms and conditions, ICANN is a California non-profit public benefit corporation and must therefore comply with all the laws and regulations of California and the United States. Will the Trademark Clearinghouse Fulfill its Potential-Will Trademark Owners Even Use it?

By Thomas Barrett ICANN created the Trademark Clearinghouse (TMCH) as a way to streamline the repetitive process forced on trademark owners during the launch of new top-level-domains. With the expected tsunami of hundreds of new TLD's starting later this year, the TMCH should generate a clear benefit for trademark owners who elect to participate in Sunrise and Claims Periods. The side effect of introducing new TLDs is that the legacy TLDs will be making changes to make sure they are competitive against the new TLDs. This means they will be relaxing restrictions and opening up unused namespaces at the second and third-levels. Many of these will follow a Sunrise or Grandfathering process as a way to implement the changes. Already three existing TLDs (one sTLD and two ccTLDs) have announced such policy changes and decided they would like to utilize the TMCH Sunrise tokens for their Sunrise Period. This includes .Jobs, Radio.AM and Radio.FM. Donuts, the largest applicant with over 300 TLD applications, have also indicated they will use the Sunrise token from the TMCH for a universal blocking service called Domain Protected Marks List (DPML). All this is happening before the TMCH has even supported its first new TLD. While ICANN has welcomed the use of TMCH by .Jobs, it remains to be seen if ICANN will also welcome use of the TMCH by ccTLDs. The eventual benefits and viability of the TMCH will hinge on a few factors: • Will trademark owners even use it? • Will the main driver be participation in Sunrise or Claims? • Will other existing TLDs want to use it? Will Trademark Owners Even Use it? It is a given that trying to participate in every future Sunrise Period would overwhelm the budgets of nearly every trademark owner. Every sage legal advisor is counseling that the trademark owner must be ultra-selective about which Sunrise Periods they engage in. On the other hand, a review of the Trademark Agents published on the TMCH website show a good number of law firms have already advanced the TMCH the minimum $15000 required to be an Agent. If this trend continues, then it is a clear indicator that law firms will aggressively market the TMCH to their clients. (Disclosure: My firm, TM.Biz is offering a portal for these Trademark Agents). Will the Main Driver Be Participation in Sunrise or Claims? Trademark Claims provides some protection in every new TLD. But it is for exact matches only and only for the first 90 days. This forces trademark owners to also subscribe to a watching service that catch confusingly similar registrations not caught by the Claims service. I predict trademark owners will elect to do both Claims and watching to ensure they catch domains that might confuse their customers. Will other existing TLDs want to use it? There are actually two parts to the TMCH. The validation service is performed by Deloitte and CHIP. They are issuing Sunrise tokens called Signed-Mark-Data (SMD) files to trademark owners as proof that a trademark has satisfied the requirements for the typical Sunrise Period. The Database Administrator for the TMCH is IBM. They actually help Registries and Registrars operate the Sunrise and Trademark Claims Periods. The validation service initially launched on March 26. The database part is expected to launch in July. But there are applications for just the TMCH Sunrise tokens that do not require IBM to be used. This is because the SMD file is portable. For example, any country-code TLD who decides to change their policies and wanted to conduct a Sunrise Period first, could accept SMD files from trademark owners. Also, any TLD that wanted to accept SMD files for a new Rights Protection Mechanism, as Donuts is planning; also do not need IBM in the process. The .Jobs Sunrise Period The .Jobs TLD has decided to eliminate the current restriction that .Jobs domain names must match company names. This means that product and division names will be eligible for .Jobs. Before this change takes effect, .Jobs will first conduct the Sunrise Period that is designed for new TLDs. .Jobs will utilize both parts of the TMCH. Thus they need to wait for IBM, their Back-end Registry and Registrars all to be operational before they can conduct their Sunrise Period. The Radio Global Domains The .AM and .FM ccTLD's, have long been re-purposed for the Radio industry. They are now introducing new namespaces, called Radio Global Domains, which are designed to target new market segments within the Radio industry. These will be radio.am and radio.fm. Before these changes take place, they will also undergo a Sunrise Period starting May 28. Validation for the Radio Global Domains Sunrise Period will be performed on either trademark data or the Sunrise tokens called Signed-Mark-Data (SMD) files issued by the TMCH. All this is happening without the need for the involvement of IBM, or even for Registrars to support the new protocols required for the new TLD Sunrise Periods. (Disclosure: My firm, TM.Biz will be handling the trademark validation, SMD validation and direct submission of Sunrise registrations to the Registry). It is still an open issue whether the TMCH will be capable of issuing SMD files by May 28 for use by the Radio Global Domains. Or if the TMCH is capable of issuing SMD files by this date, whether ICANN will allow the TMCH to release the SMD files so that the ccTLDs can use them. There are no doubt other ccTLDs that are interested in changing their registration rules and restrictions that might consider holding a Sunrise Period first. I predict that these ccTLDs would be interested in using the SMD files as well, if allowed by ICANN. Additional Rights Protection Mechanisms The largest TLD applicant, Donuts, is also planning to accept SMD files for its universal blocking service called Domain Protected Marks List, or DPML. As applicant of over 300 TLD's, with half of those uncontested, a DPML represents a good value for trademark owners. There may be other applicants that decide to offer new Rights Protection Mechanisms that utilize the SMD file. Hopelessly Optimistic The Trademark Clearinghouse has enormous potential to support the domain name industry. The portability of the SMD files enables many uses that were not originally envisioned by its creators. Certainly, the days of a TLD manually checking trademark databases should be coming to an end with SMD files becoming the new de facto standard for trademark validation.
