The trio-patitioners don't get license, Court of Appeal gets more work and PPOA oversight role gets sharp scrutiny. You are pointedly and selectively unfair to Dr. Ndemo by asking him to critisize official decisions he initiated or happened under his watch as PS Ministry of Information. Broadcasting signal infrastructure is among critical resources, and so are telecommunications, Internet, servers, data centres, IXPs, superhighways, rail and civil aviation (including aircrafts)...etc.. @Wambua jst seen the CS breathing fire on K24 on this matter. It looks like this fight is moving from the courts into the public space. It sounds like its going to be looong and bloody. Ave heard from the Govt side, I wonder what the Media house side is...they are all here on KICTAnet and I wish they would freely share their view -outside the constraints of a court case. Even if a third license was to be issued there is no guarantee that they would get it. If Safaricom and Airtel were to bid and win, they would get it not media houses. * In March 2007 the Government established a taskforce to advice on a roadmap for Digital Migration. * In March 2008 the taskforce recommendations were adopted by the Government and the setting up of the Digital Television Committee to oversee the implementation of Digital Migration * 2009 KBC receives Government Authorization as the first Broadcast Signal Distributor. * 9th December 2009 H.E. President Mwai Kibaki launches the pilot phase on DVB-T signal. * In December 2010 the government adopted the Digital transmission technology DVB-T2 for further infrastructure rollout. * In August 2011 forums with Broadcasters, vendors and other partners were held. * In October 2011 a second signal distributor, Pan Africa Network Group (Kenya) Co. Ltd, is licensed. * February 2012 the DVB-T2 signal went on air in Nairobi and its environs. * In June 2012 Treasury approves the waiver of import duty on set top boxes by for the Financial Year 2012/2013. * Also in June 2012 the second digital platform went on air in Nairobi in. * On 8th June 2012 a large scale Consumer Awareness Campaign is launched. * 31st August 2012 the DVB-T signal transmission Ceased. Let media houses concentrate on content provision, infrastructure is not their forte. Otherwise Signet, just like Multichoice Kenya, is a partnership of KBC and multichoice and I think DsTV works fine just as Signet will. KTN, NTV and CTV should invest in and distribute as many set top boxes not aligned to either signal distributor as possible. That will ensure their viewers move with them. Plus KBC insists tht Signet is actually an independent subsidiary with its own independent human resource n management n with a different mandate from that of KBC thus as such will actually perform much better than everyone is forecasting. On free markets, its not true to keep saying tht it only applies in Africa, Ofcom usually holds public auctions of licences where the bottom line is cash, the one with the deepest pocket wins. NTV Kenya‪#‎DigitalMigration‬: The Big Switch-offIn the High Court sitting in Nairobi Monday, Justice David Majanja dismissed a petition by three media houses - the Standard Group, Nation Media Group and Royal Media- to have the digital migration postponed until certain critical issues spelt out in the petition are resolved. He dismissed the case and as a consequence digital migration takes effect immediately.In compliance with that judgement, we (the Media Owners' Association) are left with no option but to go off-air. We have instructed our lawyers to appeal against the High Court decision in the Court of Appeal. This course may also be of interest to: - Journalists, staff of international and non-governmental organisations, translators, business people and others who interact with diplomats and wish to improve their understanding of diplomacy-related topics. - Postgraduate students or practitioners in other fields seeking an entry point into the world of diplomacy. - Postgraduate students of diplomacy or international relations wishing to study topics not offered through their university programmes or diplomatic academies and to gain deeper insight through interaction with practising diplomats. - Practising diplomats, civil servants, and others working in international relations who want to refresh or expand their knowledge on the subject, under the guidance of experienced practitioners and academics. *Methodology:* This course is conducted online over a period of ten weeks, including one week of classroom orientation, eight weeks of dynamic class content and activities, and one week for the final assignment. Reading materials and tools for online interaction are provided through an online classroom. Each week, participants read the provided lecture texts, adding comments, references, and questions in the form of hypertext entries. The tutor and other participants read and respond to these entries, creating interaction based on the lecture text. During the week, participants complete additional online activities (e.g. further discussion via blogs or forums or quizzes). At the end of the week, participants and tutors meet online in a chat room to discuss the week’s topic. Courses are based on a collaborative approach to learning, involving a high level of interaction. This course requires a minimum of eight to ten hours of study time per week. The course materials, the e-learning platform, and the working language of the course is English. Applicants should consider whether their reading and writing skills in English are sufficient to follow postgraduate level materials and discussion. As usual for DCA, it has been a year of intense activity to ensure that our promise to Africa stands - that "we shall deliver .africa registry to the continent, sooner than expected". DCA Trust has a long-standing tradition of informing its African and global constituency on matters affecting the global Internet Governance, ICANN and related African affairs. Our regular Newsletters and Social media Campaigns sites provide us the conduit to keep all informed and more importantly, get feedbak on our initiatives. Before reviewing the major highlights of what DCA Trust accomplished during the year, I would like to make an extended commentary on the most important global issue of 2013. * *From Wikileaks of 2012 to Edward Snowden's NSA Leaks of 2013: * *Implications for Global Internet Governance* *2012 will always be remembered as the Year of Wikileaks. Similarly, 2013 shall also be remembered as the year that Edward Snowden, a computer security specialist and former CIA employee and National Security Agency contractor, leaked classified information regarding the NSA global surveillance programs.* *Whilst Wikileaks was about US diplomatic cables, the Edward Snowden disclosure of classified NSA information to private media organizations such as the UK Guardian newspaper has had graver implications for global Internet privacy. Unfortunately, the NSA leak presented the United States of America as a country that practically spies on everybody in a most indiscriminate manner, including its own allies. It was revealed that the President of Brazil, Ms. Dilma Rouseff had been spied upon by the USA; a dangerous revelation that compelled her to cancel a planned official visit to the United States of America. The German Chancellor, Dr. Angela Merkel also complained that her mobile phone had been hacked into, and the 'usual suspect' had been listening into all her conversations. The German Government was indignant and complained directly to the US Government. The EU also sought clarifications from the United States. Most foreign leaders demanded that US spying must stop after it was revealed by the Guardian that 35 world leaders had been spied upon after their telephone communications were tapped. * *Brazil had to take the matter to the United Nations General Assembly and collaborated with Germany in October to draft a resolution on the US spying allegations that would guarantee the privacy of electronic communications. The consensus resolution on *"The right to privacy in the digital age" *was adapted on 19th December 2013. It calls on UN Member States to **"review their procedures, practices and legislation on the surveillance of communications, their interception and collection of personal data, including mass surveillance, with a view to upholding the right to privacy by ensuring the full and effective implementation of all relevant obligations under international human rights law".* This seems to be the only coordinated reaction by the international community to the US global spying and surveillance activities. *But the revelation is that the US Federal Government has expanded its global electronic surveillance program and is said to have been collecting diverse types of information including email, chat, video-conferencing, file transfers, etc. supplied by Internet companies such as Google, Facebook, Apple, Yahoo, Microsoft, AOL, YouTube, etc, although all of them denying it, unless under a court order. These companies are often forced to comply since it is lawful under US laws for them to cooperate with National Intelligence Agencies. The US-based Internet and Telecoms companies (Verizon, AT&T, Sprint, T-Mobile, etc.) ordinarily cannot refuse to provide data upon the request of US national security agencies against the backdrop that increased surveillance activities by US National Security operatives are justified by heightened global counter-terrorism efforts that are aimed at discovering and disrupting terrorist threats.* *Thus, anything that is happening on the Internet, especially on the Social Media space is no longer private. These recent revelations have clearly shown that Internet user privacy has been significantly undermined and public confidence and trust on the Internet as a communications platform has been considerably eroded.* *It is expected that these issues would remain topical throughout 2014 and beyond, as the future of Global Internet Governance is debated. *The voices of those calling for a paradigm shift in the architecture of Global Internet Governance towards one that de-emphasizes the centrality of U.S.-based institutions will no doubt become more strident. The NSA leaks and the allegations of widespread international spying activities by the United States of America, including access to millions of data records obtained from Internet and telephone companies, have seriously undercut US moral authority as the custodian of Internet privacy, civil liberties and human rights. The countries that have been clamoring for a new internet Governance model that is led by the UN would try to buttress their case by citing US global Internet surveillance program and global spying activities. *The independent panel that was setup by the US Administration to review the surveillance programs recommended that some restrictions should be placed on NSA spying activities. During 2014, the global community will be closely monitoring the commencement of implementation of policy reforms regarding the US surveillance programs by the NSA.* *DCA's Year in Review* * DCA Trust had another year of continuous activity and engagement with matters and event concerning the new gTLD program and the DNS industry generally * *In March 2013, DCA Registry Services and its UK Technical Partner CentralNic participated in the African Multi-stakeholder Internet Governance meeting held at the UNECA Conference center in Addis Ababa, Ethioipia from 6-8 Mrach 2013*. DCA Trust participated at the event along* other African organizations like **African IGF, AfriNIC, AFTLD, ISOC Africa, and the ATU and ITU*. The delegation noted the urgent need for the improvement of services to make the market viable and profitable and these findings strengthen its promise to work with the ccTLD's. * DotConnectAfrica then attended and contributed to the "Innovation Africa Digital Summit", with the theme: "National Broadband Strategies and Agendas: Acceleration and Alignment", which was also held in Addis Ababa, the capital city of Ethiopia. DCA got the opportunity to clarify the .africa bid to the audience, stating that DotAfrica as an Internet new gTLD resource rightly belongs to ICANN, and that the entire new gTLD program is governed by ICANN under a globally approved process, and the AUC has no authorization to delegate DotAfrica to a registry operator outside the ICANN's process. DCA explained that Uniforum in its application submitted to ICANN has already given away the legal rights to the .africa registry databases and all intellectual property to the AU, which explains why Uniforum was calling it an AU initiative, the same view that was held by the NEPAD representative who was also a panelist at the forum. DCA Trust has always maintained that all the rights to the new DotAfrica gTLD including the registry databases, rightfully belongs to ICANN according to the stipulations of the new gTLD Program and the associated new gTLD Registry Services Agreement, and that the African Union and UniForum cannot act outside these specifications that have been legally codified and approve. * *Also in March, The Republic of Kenya saw the peaceful election of** His Excellency, Mr. Uhuru Kenyatta and His Deputy, H.E. Mr. William Ruto.** DotConnectAfrica Trust (DCA Trust), and its affiliate DCA Registry Services (Kenya) Ltd**. was pleased to extend very warm congratulations to the president and country of Kenya.* *The following months, in a candid discourse, **The Reporter Daily **a highly influential an**d respected source of reliable news to Ethiopians**, Africans and globally through its online readership **laid out the struggle of DotConnectAfrica and its six year efforts in initiating the .africa gTLD, the first African run gTLD registry business for Africa*. *In April, the ICANN-46 International gathering that took place in Beijing, China, DCA participated and learned its .africa application received an objection advice from ICANN's Government Advisory Committee (GAC), in the Beijing GAC Advice, to which DotConnectAfrica Trust responded. The GAC Objection Advice against DCA's .Africa application was later accepted by the ICANN Board New gTLD Program Committee (NGPC); a decision that DCA Trust refused to accept because the NGPC failed to perform all required procedures when considering GAC Advice related to Objections such as consultations with independent experts as stipulated in Section 3.1 of the Applicants Guidebook. DCA Trust has therefore challenged the ICANN NGPC decision to accept the GAC Objection Advice, and hopes that this will be resolved during 2014.* *To improve our skills in the ever changing ICT spectrum DCA not only train but also participate in training. Our dedicated delegates were among more than 1,700 people from around the world that attended the just concludes ICANN-48 International Meeting that took place in Buenos Aires Argentina from November 17, 2013 to November 21, 2013. The ISOC Board conducted a very thorough search over 10 months to find the best candidate to lead the Internet Society. Through our search process, we identified and met with talented people from around the globe representing leaders from our broad Internet community and across a large number of industries. The Internet is facing many new challenges ranging from the NSA pervasive surveillance, how the governance of the Internet should be structured, and if the current open Internet model is sustainable. The Board looked for a person who can lead the Internet Society to meet these challenges and decided that Kathy Brown is the person to do that. She is a proven leader with in-depth knowledge of global Internet governance policy; well acquainted with the community, commercial, technical, government, and non-government organizations that are stakeholders in the debate around the future of the Internet; and a strong manager. She has all of the qualities we were looking for in the next CEO of the Internet Society. Kathy joins the Internet Society from global strategy firm Albright Stonebridge Group, where she was a senior advisor. For more than a decade prior, Kathy was Senior Vice President for Policy Development and Corporate Responsibility at Verizon. In that role, she helped Verizon identify and navigate emerging digital issues and led its global corporate responsibility initiatives, overseeing an investment of more than $60 million a year in programs and grants that helped support Internet development. In 2010 she partnered with ISOC to launch a highly successful forum on the Internet and higher education in East Africa. In addition, she served on Verizon's corporate councils for the development of the company's online privacy and content policies and promoted Verizon's Human Rights Statement and Supplier Code of Conduct. In her policy role at Verizon, she led the company's international public policy engagement through a period of dynamic change. She represented the company in the successful adoption by the OECD of principles for Internet policy making and was a member of the U.S. delegation to the ITU World Conference on International Telecommunications treaty negotiations. Kathy joined Verizon from Washington D.C. law firm Wilmer, Cutler & Pickering, where she was a partner specializing in legal and regulatory communications policy. Earlier in her career, Kathy served in U.S. President Clinton’s Administration where she was deeply involved in policy development that was instrumental to the deployment and adoption of the global Internet. She served as Head of the Office of Policy and Development at the National Telecommunications Information Administration and then as Chief of Staff to Federal Communications Commission Chairman William E. Kennard. At the FCC, she managed the staff supporting Chairman Kennard's historic decision to keep the Internet unregulated, to fund the E-rate, and to increase radio spectrum availability to fuel wireless technology innovation. In a landmark ruling a Federal District Court judge ruled on Monday that the National Security Agency program that is systematically keeping records of all Americans’ (and non Americans) phone calls most likely violates the Constitution, and he ordered the government to stop collecting data on two plaintiffs’ personal calls and destroy the records of their calling history. Despite the system being broken, is the American influence on Internet Governance the best we have right now? I can't imagine such a ruling in China or Russia, let alone India, Brazil or South Africa - the so called BRICS countries championing a new dispensation on Internet Governance.. Listers, The Commission yesterday revised the digital Broadcast signal distribution fees with a view to facilitating a smooth transition to digital TV broadcasting in Kenya. Below is the press release issued yesterday on the same for your information: [P R E S S R E L E A S E][cid:image007.jpg@01CEFB0D.36919420] 16th December 2013 CCK reviews digital broadcast signal distribution charges downwards The Communications Commission of Kenya has reviewed downwards tariffs for digital signal distribution in a move geared towards facilitating a smooth migration from analogue to digital television broadcasting in the country. According to Determination No. 1 of 2013 on Cost-Based Terrestrial Digital Broadcast Signal Distribution Tariff dated 16th December 2013, Digital Signal Distributors shall charge broadcasters (also known as Content Service Providers) at KES. 125,990 per Megabit for Nairobi and KES.93,202.75 per Megabit for other sites in Kenya. The new tariffs take effect from today. Before the review, the Pan-Africa Network Group (PANG) had proposed to charge broadcasters a monthly signal distribution fee of KES 1,135,312.50 per channel in Nairobi. Kenya Broadcasting Corporation-owned SIGNET on the other hand had proposed to charge KES 248,141 per mega bit (Mbit) for signal distribution services within Nairobi. For other sites in Kenya, SIGNET had proposed to charge a uniform signal distribution fee of KES248,141.45 per mega bit, while PANG had proposed to charge a flat monthly fee of KES.378,437.50 for signal distribution services in Mombasa, Kisumu, Nyeri, Eldoret, Kakamega, Kisii and Meru. For Malindi, Webuye, Garissa, Narok, Kericho, Isiolo, Kitale, Bungoma, Embu, Voi and other regions, PANG had proposed to charge broadcasters a flat monthly fee of KES.126,145.83. In the determination, CCK further requires the two Digital Signal Distributors - Pan African Network Group (PANG) and Signet, to publish a Reference Offer three months from today in order to ensure that there is access, transparency and non-discrimination on the terrestrial signal distribution platform. According to the determination, digital signal distributors are also expected to prepare separate accounts for each commercial subsidiary including the appropriate allocation of central overheads within six months from today. In arriving at the afore-cited tariffs, CCK adopted a consultative approach where the signal distributors were involved. Jorge By system being broken I mean the Governance Structures. It is a no brainer that the current Internet Governance structures where one nation has an oversized influence is no longer tenable. If sane and right minded governments and other institutions do not move fast to correct this then I'm afraid the move towards a Balkanized Internet is just a matter of time.. Listers The Snowden revelations have blurred a crucial boundary between the U.S. private sector and its government, dealing a heavy blow to one of the fundamental precincts of Internet Governance. There remains a fundamental question to which we however have no clear answer: if the U.S. gives up its leadership of governing and operating key parts of the Internet, what would take its place? Is there an equivalent to some macro governance by multilateral agencies akin to the Security Council/the G-20/the United Nations combined with each country managing the micro governance through its own “visa” rules for crossing its borders? As netizens we must all contribute to ensuring a new paradigm for Internet Governance because Balkanization is not the answer. @Kioko, good observation...that in general high income can improve ur affordability rating since affordabilty is a ratio of unit price for broadband internet against average incomes. however this is not always the case. Just supposing the delay was effected until midnight June 17, 2015.... Recalling 29 November, 2013 post to this list, "....post 2015, [neighbouring countries] digital broadcasts are protected from analogue broadcast interferences from a distance of 200 km from the borders..." Which means that only a small area in central Kenya would be allowed to receive analogue signals while all areas within 200 km off Kenyan borders would be signal blank, suggesting, Kisumu, Malaba, Mombasa, even Nairobi(or parts thereoff) would be affected.
