Kenyanization and its affect on startups

All, I was recently reading this form for a work permit for non-Kenyans: http://www.immigration.go.ke/images/downloads/form22.pdf I think this single form sums up why Kenyan companies thus far haven't been able to be pan-African, let alone global powerhouses. Aside from the glaring omission of anybody being non-European, non-African and non-Asian (i.e. everybody from North and South America), I noticed that the underlying thrust of the document is to make sure all companies located in Kenya are geared towards becoming more Kenyan (except of course, all the international non-governmental and diplomatic organizations which bypass this whole process). It seems like GoK (or most of it anyway) doesn't understand that every country has to choose indiginezation of its domestic industrial sector OR allowing its industrial base to compete at a global level. Indiginization can work in countries like Saudi Arabia where the focus is purely on resource extraction and not on building global companies - but it doesn't seem like Kenya is on that path. Kenya seems to me to be a place of commerce where it can really take advantage of trade with other countries much like Singapore, Hong Kong, Thailand, etc... have done in South East Asia. You'll notice that the largest Kenyan bank is KCB as the 59th largest bank in Africa. Who knows how small KCB is when compared to the global field. http://www.theafricareport.com/Top-200-Banks/top-200-banks-2013.html There is no natural reason for Kenyan banks to be so low on the list. Kenya is one of the major economies on the continent, it has an educated work force, it has a large domestic market with which to nurture companies - yet there is no way for a Kenyan company to scale because of the insularity of the immigration regime. Is there any impetus within the government to address this problem? I'm concerned about what my plan B is as a startup trying to be pan-African with a headquarters in Nairobi. When I first moved to Nairobi, I thought this was a global city like New York where I had worked with Indians, Swedes, Burmese, Brazilians, Americans. Here I'm friends with people from all over the world but they all work for the UN and their employers bypass the GoK which otherwise fights so hard to keep foreigners from working and building businesses here. Is there a solution or is it just going to get worse? People I've spoken to say 'come to Rwanda' or 'come to Mauritius' or even 'come to Ghana' .... can a company have a headquarters in Kenya and run a tech company with pan-African and global ambitions? Launch of the Dot Africa Government Reserved Names List (RNL) Policy

Dear KICTANet, Re: Launch of the Dot Africa Government Reserved Names List (RNL) Policy The Dot Africa project has now reached a stage where African Governments are being offered an opportunity to reserve domain names that are of National significance before the dot Africa Top Level Domain is opened to general domain name registrations. Respective Governments will be required to redeem the reserved names within the timelines set in the RNL policy using the prescribed systems and tools that have been developed to facilitate efficient submission and redemption of reserved names. The African Union (AU) through the Uniform SA (ZA Central Registry) which is the appointed registry for dot Africa has developed several policy documents, among them the Reserve Name List (RNL) policy that will be used to govern the process of reserving government names. Dear All, The Consumers Federation of Kenya (COFEK is Kenya's independent, self-funded, multi-sectoral, non-political and apex non-profit Federation committed to consumer protection, education, research, consultancy, litigation, anti-counterfeits campaign and business rating on consumerism and customer-care issues. Cofek works towards a fair, just and safe marketplace for all Kenyan and regional consumers. Cofek is a member of the Government-run Kenya Consumer Protection Advisory Committee (Kecopac). Matiang’i rules out Safaricom reprieve from licence terms

ICT secretary Fred Matiang’i has vowed to tie the renewal of Safaricom’s licence to the voice quality checks that show the mobile phone operator is non-compliant. Dr Matiang’i said the government and the Communications Commission of Kenya (CCK) will not negotiate on the voice quality standards. .... “I don’t understand why an operator would like to negotiate a licence condition. There are only two options here, either comply or step out of the business,” Dr Matiang’i told the Business Daily on the sidelines of the launch of the electronic filling of returns by insurers to the Insurance Regulatory Authority. The numbers on some alternative payment channels are; Safaricom on its Lipa na Mpesa service takes 1% of each transaction value, Equity Bank with their transport centric service BebaPay which is in partnership with Google take 5%, while PesaPal a payment services aggregator levies a 3.5% transaction fee on e-commerce, bill payments and invoicing and 5% on ticketing. For service based businesses, these transaction fees could be considered okay, but for those moving product, a deeper analysis will reveal why adoption may be stifled. Dear Listers Please find attached the Report of the Online Debate conducted in November 2013 on the African Union Convention on Cybersecurity (AUCC), which has now been submitted to the Africa Union Commission. A meeting with the drafters took place in December where it was agreed that the Commission would look into our input, and provide an explanation/justification on areas of disagreement. Most important is that the convention will not be signed in January as earlier expected, and the earliest this can happen would be in June 2014. This means that we now have an opportunity to engage further and shape the Convention. We therefore look forward to a Stakeholders Consultation meeting as promised by the CS to hopefully inform the official Kenya Position. Wishing you Peace, good health and prosperity. RgdsGrace

Hi All, Very interesting discussion on new policy, in fact the government should consider the implementation of a single standard for payments like ITSO in the UK to provide interoperability between different modes of transport. e.g. If I use the train, matatu to get to work I should be able to buy or load a ticket on to a card, mobile phone or any other, which could be easily accepted by the different modes of transport operators. This will also enable some amount of regulation and discipline within the modal transport operators who could be measured on quality of service. This could also include behaviour on the road. Simple matrix could be developed, to provide the quality of transport that is available in many cities around the world. This also is away to ensure that the government is able to assure safety, in return be able to collect taxes to improve facilities for the commuters that could include footpaths and proper rest areas etc. Furthermore, not too sure of the fleet management aspect of the policy as this is something that individual companies can choose to implement, is open to manipulation, this will not guarantee that the different companies are meeting their stated KPI's, and there is no way you can penalise the PSV it could be too late, additionally, all PSV drivers need to retest and get issued with proper driving licences that are not subject to fraud as a part of the regulation of the sector. There are many points that could be discussed, the important point is there is action being taken and if there is help required in thinking through the various policies and if it is going to make the daily commute easy we are here to help and advice. Couple of thoughts on the subject of technology, its utility, & impact on behaviour. - some have rightly pointed out the place of technology: a tool that enhances efficiency + effectiveness of task accomplishment. Unfortunately, a large segment of the population make see technology as an end in itself! Neil Postman, I believe, coined the term: the medium is the message, in reference to proliferation of (especially) TV broadcasting and how this was impacting the population. - if a person posts "mbwa kali" at the gate, a potential intruder is likely to think twice before attempting an intrusion. Indeed, the sign could thwart a lot of potential intrusions. Ditto for gadgets in cars that suggest (rightly or wrongly) that a vehicle has an alarm. In my corporate experience doing information security we noticed that a lot of prohibited technology use dropped substantially when we announced that there was monitoring. We can expect similar behaviour when (say) PSV drivers understand that vehicle back boxes are installed. That said, a policy that captures and appropriately punishes violation is essential to assure deterrence! - on technology and corruption: In india (I forget the exact reference) it was found that technology did have an impact on corruption, especially by shifting the beneficiaries, who were largely tech-literate. Overall measures of corruption (say cumulative amounts that change hands) remained pretty close prior and after implementation of technology, and because fewer people were involved, they took home bigger slices of the corruption pie. May be there are more recent studies on the same but I haven't come across these. A new law to regulate the public transport has been put in place and will take effect by June 2014 where 1. All PSVs must implement cashless paymeny system for bus fare 2. All PSVs to be fit with fleet management systems where overspeeding will be checked from system logs, not on speed cameras 3. All PSVs to have surveillance cameras to reduce carjackings, petty crimes, and terrorism 4. Install digital speed governors This will see Beba Pay and Mpesa fight for supremacy. I'm keen to see what card Safaricom has on it's deck. This is a great opportunity for payment system innovators to comeup with exciting products, and also for fleet management system companies to have regular work. The commuters on the other hand will dig dipper in their pockets to pay for the services. Cofek to sue CCK for defaulting on television deal

“Customers who fail to pay subscription fees on time will continue to access the must-carry free-to-air services (FTA) for a period of at least two weeks,” read a letter from CCK director-general Francis Wangusi (pictured, below left) to pay-TV providers. Through the letter, CCK is reneging on an earlier agreement with Cofek that made it compulsory for pay-TV companies to give subscribers access to all free-to-air channels, even without a paid-up subscription. Telcos fail CCK compliance test

The country's four mobile network operators failed the CCK quality service test for year 2012/2013. The research focused on completed call rate, call setup success rate, dropped calls, speech quality, handover success rate, call setup time, and signal strength. The report revealed that non of the operators complied with the set rules over a period of three years. Telkom Kenya had the highest compliance level (62%), and Safaricom had the worst completed calls rate. The penalty for non-compliance is Ksh500,000 but CCK did not indicate if it will take any action. Members Let me start by wishing you all a happy new year (and apologize for cross posting) 2013 saw a number Internet Governance events good, bad and worrying in no particular order. Towards the end of 2013 The leaders of organizations responsible for coordination of the Internet technical infrastructure globally also known as I* met in Montevideo, Uruguay, to consider issues affecting the future of the Internet. The outcome of that meeting was a document now Known as the Montevideo statement http://1net.org/posts/3. As part of the multistakeholder approach, /1net http://1net.org is hosting an open, global online discussion about Internet governance. Please contribute to the conversation by joining the mailing list of the movement. I’m sending this email in my Capacity as Chair of AfriNIC as I have not seen many discussions from the African region. As a community it is now imperative that we pro-actively take our position on the global table of internet governance. After all we are a community of over 1 billion people. I urge the community to take time read the archives if you have not been on the list and then contribute from your perspective. We should also take 2014 as the year that we start a very active but balanced dialogue with our governments on how we integrate the internet into our society as an enabling tool not the threat that some of our governments have been lead to believe. Finally we need to review the thin line between the Internet Technical community and the civil society. My personal view is as longer as we believe their is a line between these two we will not get to a synergized outcome. Let me end by Wishing you all a Prosperous new year and look forward to deep win-win based discussions over the year that will enable us all leave a legacy for the next generation as we pass on this thing called the internet in whatever form it will be then. I say “whatever form” because we all have to accept that the internet is and will continue to change at a pace we need to keep up with. One (perhaps last) post from me on this. There is nothing in practice that prevents governments from stipulation of equity buyback from foreign-owned entities over time, where national interest is paramount. For example, if we realize that we have gone down an unfavourable path, we can put in place regulation/laws laws that require gradual divestiture of foreign equity to local ownership; or increase of local ownership/control via new shares whose structure would largely favour local interests. There has been discussions on capacity (skills, finance, etc) on this matter with little mention on how this can be realized over time, be it with respect to change of business culture (essentially cooperation-competition=coopetion?), managerial training/mentorship, etc. all of which could be achieved with clear strategy of cooperation between government and education/research/etc institutions. For example, if we wanted experienced people (say 5 years down the road) that can do mergers/acquisition, raise capital (locally + internationally), manage complex projects (from conception, design, financing, etc.) ... we could be working more with our universities and colleges in this respect. Indeed, that would make them more relevant than in the present state where they are largely businesses churning out individuals with certificates (regardless of how they are acquired), some of who have little relevance to the job market! When I was growing up, there used to be the Directorate of Personnel Management whose role was to look at skills gaps and propose/implement options that would address such gaps. Western world countries have perfected this via investment in strategies that address such gaps and hence the number of scholarship and immigration opportunities for those that can address the gaps thus identified. If, as a country, we had such plans in place, for instance, we wouldn't be importing CEOs to run such a critical sector as telecoms. One last point: NOT all critical national interest matters are classified! And, at the expense of repeating myself, once we define what constitutes national interest and criteria thereof, it would be easy to identify what fits the bill. @Kioko, its true the local media houses have not sufficiently invested/supported local content production...but that does not mean they lack local content. Like safcom with MPESA, these media houses have a killer application. Its called Prime Time News. That is where their audience and advertisement revenue is. Signet and PANG and even DSTV are all dead in the Kenyan market without KTN/NTV/Citizen 7pm and 9pm news. That is why the media house by their own volition opted to go off air to leverage their arguments in court. Bw Kivuva Couple of more points 1. Transition need not be as messy as has been the case, even in the face of "creative destruction". I am not sure that in this case, for instance, issues of employment impact, redeployment/reuse of existing infrastructure, etc have featured at all. The focus has been on failed bids. Period. Note that our current constitution has specified a number of rights and I bet a worker, were s/he to have the wherewithal to challenge the process in the courts for loss of income/livelihood, and were the courts were to be true to the spirit of the constitution, would win BIG money from either government or some other culpable party that may have bungled the process. Just pray that Kenya has not become as litigious a nation as the western world whose characteristics we are fast emulating. 2. On the capacity to bid & win: again, drawing from my experience in Canada, government can suspend the tendering process until such conditions as fits the "national interest" are met. Indeed, government itself may inject money, hire needed expertise, change policy, etc to ensure that the strategic national interest is met. But again, we haven't defined what that national interest is in our country. Our resources can be exploited in whichever way by whoever, authorized by whoever has the power on the material time! Watching this debate is extremely distressing, like happens on major discourses in the public sphere! Our ability to negotiate, arbitrate, mediate, etc is extremely limited, a process that leads to expensive, emotionally draining litigation process. I can bet that a mediator/arbitrator, had the process been in place, would have found an amicable solution, less costly (financially, time-wise, emotionally, etc.) than has been the case. Finally, the tone of some suggests an unspoken message: soak it to them! Damn the consequences! Yet the issues raised mean loss: employment, financial, ... Ngigi, You emphatically accuse everything and everyone else, except yourself of corruption. We take it that you, your firm and partners are clean and have never been in any way whatsoever done anything another soul here would consider as touching on the corruption devil you describe? Just so that we all clear... Secondly, local participation and patriotisim has been fronted by persons in India and South Africa (deliberately skipping Kenya) to secure prieveleged access to government procurement and in the process entrenching local corruption hidden from international scrutiny. Friends Happy Holidays. This is an interesting debate, but one which I feel should be beyond digital migration and to that of how we deal with national resources. In Canada, for instance, there are industries (banking & finance, telecoms, energy, etc.) that have been designated to be of strategic national interest; and which need to have majority control exercised by Canadians. The regulators also impose conditions on any sales, mergers, acquisitions, etc. of the same, especially where foreign interests come in to assure adherence to the national interest. And that isn't about a controlled economy! It is a balancing of factors that would maximize gain for what is naturally the nation's for the benefit of its citizens. I think the challenge for us Kenyans is that "national interest" appears non-existent in our vocabulary; and worsened by the mindset/practice/tradition of "you eat where you work", damn the consequences for the nation and its future. Someone pointed to the Tanzanian case study as per link below. Case study of digital TV switchover in Tanzania So what did Tanzania do differently? On a different note, the issue of capacity (technical, financial, managerial, etc.) will continue to bedevil local companies for a long while, unless of course there are deliberate measures to ensure that capacity. And this, in my view, can be done through various policy options and strict enforcement of the same. What if we required that all major contracts of a given nature (strategic importance, value, etc.) require x% local participation, where x, in my view, should be 40 and above. Messy as that may be, the results down the road, would show. It will be the local partners today that become the key players tomorrow! Take infrastructure (roads, telecommunications, buildings, etc.) and the regional (EAC, Comesa, etc.) that such players could take advantage of. But they aren't going to be of age without nurture! And it isn't far-fetched for government to step in to offer preferential assistance to local firms that need a hand to strengthen their capacity. But do you believe the Court of Appeal would (a) entangle itself with day-to-day spectrum allocations (b) a legal mandate of telecommunications and media regulator, (c) never mind its highly technical nature, (d) Regional and International commitments involved and (e) akin to the court usurping role of signal distribution functions. And here looking at the court as a mere disputes arbitrator? There is a reason and logic why even warring countries/parties surrender-why fight a losing battle? Count your losses and move on. In my view, the old analogue broadcasting kings could use the 45 days breathing space to congregate, reminisce tossing glasses their now gone analogue empire. Enjoy the break and happy New Year.
