Using this precedent, what would stop each of every the remainder of television broadcasters also demanding a license? On the grounds that every (corporate) person is equal before the law? A Poison Pill for Safaricom's QoS woes? Will Collymore blink?

The Kenyan Regulator has presented Safaricom with a catch22 situation:- Sort out your QoS issues or we will slap you with punitive fines..and by the way we just might not renew your license! Oh...Also note that for you to be able to sort out your QoS issues you need more frequency than you (or us) currently have. Wait a minute! There might just be a way out of this conundrum! Acquire yumobile assets (which include frequencies). However before we approve your acquisition of these assets which will improve your QoS issues you MUST open up the Safaricom Agent Network. Question: is it the business of the regulator to ask companies to open up their hard earned Agent Networks? Is this akin to the Central Bank asking a dominant bank to allow its branches to be operated jointly by other banks? Or should the regulator focus on interoperability of the technology network? Dear all; I have been following the robust debate here since the Court ruling and Cofek's response, and i'm impressed by the quality of arguements put forth. Let me declare my interest, I'm an editor at the NMG, but i speak here in my private capacity. Im also a consumer of television broadcasts. But so are you all kictanetters, you're both interested parties in this matter of digital migration, as well as consumers of TV broadcasts. Unfortunately, i find your take on this matter elitist, completely biased and humanly selfish. You forget that a court of law makes judgement after weighing all interests at stake, and is ultimately guided by the letter of law, and the public interest. The major media houses have not at all been against digital migration. They have only been against the hurried manner in which the process has been pushed through by the CCK, and the less than transparent award of licenses to third parties to the contemptous exemption of the major broadcasters and investors in the industry. Ladies and gentlemen, from you posh houses and offices in upmarket Nairobi estates you forget that KSh5,000 is a fortune for most Kenyan households, which cannot be spent on a set top box while there are other most pressing basic needs. This is a reality that even rich economies like the USA chose not to run away from, and they issued vouchers for digital boxes for those households that couldn't afford them. Their migration had to be postponed severally to ensure no household was left behind. What happened even to the proposal to scrap taxes on these boxes, which could have halved the cost? Have you, kictanetters, in your eagerness to make a quick buck from the new digital world, forgotten that more than half of kenyans live on less than Sh105 ($1.25) per day, yet they also crave for and have a right to watch TV? what the court of appeal found was a CCK bent on bulldozing a critical process, and ruled that on a balance, it would hurt public interest more to continue than to pause, be more consultative and carry everyone on board like the civilised and accomodative society that Kenya is supposed to be. As a major stakeholder, I think the courts did not balance. It looked more on the purported injustice of the major media houses and ignored the broader goal of digital migration. With regards to CCK all government institutions are moving towards complying to the constitution. And CCK will pass over the work and programs they have been implementing to the new body once it is formed in a smooth process that will not destroy the gains so far. What the courts have done is destroying all gains through this. I have a feeling that very many Kenyans and professionals/institutions have very little knowledge on Digital migration. By legitimizing the expectation of the media owners for a license and proceeding to grant it one uncompetitively. So, why did the const require vetting of judges who were in office by 2010? They had a legitimate expectation to continue working into pensionhood, having held their positions for years. The pt: the constitution erased all preferential expectations and set a new standard because of grievances over legitimacy and competence of the status quo. In the case of ICT/ broadcasting, similar questions lie over the evenness of the ground. The "competitive" standard in the award of any public resource or positions is to address such issues. 2. By simply voiding the rights of PANG which had been issued a license pursuant to a competitive process, however conducted by an "illegal" cck, and disregarding the injustice and financial consequences of such a decision. Why uphold the rights of one party and extinguish the rights of others? The court's Sympathy only seemed to lie on one side for which it poured out its heart generously, but totally ignored the rights of Pang and its subscribers. A middle ground position, recognizing the predicament of the current media investors and a suitable remedy to the injustice it found committed against them by cck would have sufficed to put the country on a forward footing. But this? The next Destination seems to be the Supreme Court, which am afraid is going to be choking soon with many unnecessary petitions, thanks to the court of appeal's contestable strokes of justice. Pang, a subscriber, another investors, or even "cofek's" unrecognized consumers have more than enough ground the way I see it. 3. By failing to admonish the govt for its confused policy (chaotic really) and confirming how dangerous it is to invest n this country, in ict particularly, because it has protected investors, and others are secondary regardless of the processes, which are now routinely reversed. Thats true Rad, there will always be an under-priveledged group in society, but can we (government) carry them along to some reasonable distance, make sure we have at least four-fifths of Kenyan households on board, before takeoff? Of what use/impact would digital migration be if we locked out 70% of Kenyans from watchin TV? Have even our policy makers become so elitist (and eager to cut deals with the Chinese) that they forget the importance of inclusion? Surely even making a strong case to the Treasury for scrapping of taxes would have been a reasonable step/effort.., or even mass importation of the most basic digital boxes by government for the very low-income, for sale at cost? Indeed the consumer movement is emboldened and we hope other sectors shall take their lesson. It vindicates our long held view that in its' current form, the CCK (and now CAK) is not the regulator envisaged under Article 34(3) of the Constitution. We are grateful that the Media Owners Association have pushed and won the fight we began in December 2012 to make the transition to digital broadcasting fair and independent to all stakeholders. We expect that the nullified Broadcast Signal Distribution license to PANG will have immediate consequences on Star Times and that the BSD to media owners will be fast-tracked. It will be futile for the Government to appeal the ruling at the Supreme Court. In light of such embarrassment to Government, it is only fair that the ICT Secretary resigns from office and that the regulator rescinds all major decisions it has made as the effect of the ruling has the potential to reverse all decisions made by the CCK since August 27, 2010 when the current Constitution was promulgated. Dear Listers On March 14, the GOK through the ICT Authority released a 13 page draft Cyber Security Strategy (http://www.scribd.com/doc/212456939/GOK-National-Cybersecurity-Strategy) We had considered conducting an online discussion on the draft as is usually the tradition, but this has not been possible. I therefore requested Victor Kapiyo to give us some initial thoughts that can we can build on, and which will form part of our submission. The deadline for submission is this coming Friday, March 28. We propose to send the comments by Thursday March 27, 2013. I wish to kindly request you to add/ subtract/amend by Thursday 1.00 pm (March 27, 2013). General Comments The strategy appears to be generic. It lacks specifics and glosses over several key issues: · It lacks a detailed discussion of the current context - current statistics of internet usage, threats to the internet, key bodies, resolutions, policies, directives, key public concerns, challenges facing the country, current legal and policy framework for ICT etc. · Lacks clear justification for the strategy. · Fails to identify the key players/stakeholders/institutions in governmet, private sector, civil society – and their roles and responsibilities in addressing CS issues, how they will be involved and their coordination mechanisms. · Does not provide reasons or demonstrate how and why the prioritized goals were arrived at/chosen. · The actions under the goals are few and not SMART. · It fails to discuss the current legal and policy framework to address CS on which it should be anchored. Proposals/ Recommendations The strategy should clearly articulate what the government intends to do, viz: · Enhance protection and promotion of fundamental rights and freedoms in the Bill of Rights in particular on expression, media, participation, personal data and privacy, · Promote the national values under article. 10 of the constitution – rule of law, democracy, participation, good governance etc. · Improve preparedness, rapid response and capabilities to respond - CERTs · Improve cooperation with, clarify obligations, and manage roles and responsibilities of operators of critical infrastructure and key providers of on-line services, such as e-commerce platforms, Internet payment gateways, social networks, search engines, cloud computing services, app stores. · Improve transparency and accountability in the management of the net and CS · Address public concerns over censorship / mass surveillance in a post-snowden era · Improve information sharing and cooperation - how should the info flow, which routes? · Improve the reporting and publicity of cyber-security incidents to the relevant authorities · Promote openness of the internet, GoK commitments under open government. · Regulate - who is currently covered/who is responsible? · Improve international cooperation and engagement with international instruments - EAC treaties, Budapest convention. · Set standards and common minimum requirements for government bodies and market, · Maintain the reliability and interoperability of the Internet, · Promote research, innovation and development in CS, · Improve governance of the internet, · Promote access to the internet, · Promote CS through strategic procurement, · Improve the policy and legal framework on CS, · Mainstream CS into national security agenda, · Improve coordination of CS initiatives, and · Facilitate training of law enforcement, judicial and technical personnel to address cyber threats.

FYI, Luigi represents European incumbent telcos as Chair of ETNO : European Telecommunications Network Operators. He was the proponent of the "sender pays" model during the run up to WCIT. In other words, the Internet should be like the telephone billing system. His "free lunch" idea disregards the fact that you already pay for Internet access AND the fact that Netflix already pays for their access. Acknowledging the fact that fiber needs to be deployed to consumer is perhaps the first step in reaching agreement. Fiber deployment would certainly be in the public interest and is necessary in building the information Society. Google (and now others) can make profits at gigabit speeds. Orange to exit, CS to yank the NOFBI contract from orange

It's now clear that Orange will be exiting the East African market by end of the year. In an apparent related development the CS has given Orange notice that the Government intends to cancel the NOFBI contract. This is as it should be. The Government is making the right move yanking this out of a partner who unfortunately through either ineptitude or inability to read the market or both has turned one of Kenya's Crown Jewels into so much confetti.. I'm curious though what next for NOFBI? Will it be collapsed into the new proposed PPP for infrastructure? China is the biggest smartphone market in the world, so getting approval there is clearly a priority for both Microsoft and Nokia. India is also proving problematic: That country hit Nokia with a $414 million tax bill and a $571 million guarantee that must be paid before the firm can transfer ownership of a factory in that country to Microsoft....

That’s how every other form of commerce works in our country. It’s simply not fair for Mr. Hastings to demand that ISPs provide him with zero delivery costs – at the high quality he demands – for free. Nor is it fair that other Internet users, who couldn’t care less about Netflix, be forced to subsidize the high costs and stresses its service places on all broadband networks. > > As we all know, there is no free lunch, and there’s also no cost-free delivery of streaming movies. New Rules on high speed Internet out

In today's Nation, page 39, there is a small story titled:- New rules on high speed Internet out I couldn't find a link to the story online but the gist of the story is that the government has issued new wireless broadband spectrum policy guidelines with hopes that it will accelerate internet connectivity to rural areas. The bottom line is that going forward if this story is to be believed is that:- 1. A PPP company will be set up to build, own and operate a nationwide mobile broadband telecom network and infrastructure. 2. It will not be permitted to offer services directly to customers but will offer whole capacity to existing and new service providers There has been debate about whether the infrastructure being rolled out by telcos was being done in the most efficient way and whether there was a better way. I would like to congratulate the CS for husbanding this process and would urge him to move with full speed to actualize this. I have always argued that the business of telcos is not for them to roll our individual networks but to collaborate and compete on service delivery with various VAS. Its good to see the government taking this seriously and moving with haste. One question that I'm sure has been thought out is how to deal with the already existing individual infrastructure. It has asked ICANN to facilitate, in consultation with the global multi-stakeholder community, the development of a proposal for the transition. Leaders of the I* Internet technical coordination organisations (including AFRINIC), met several times and, in line with the Montevideo Statement on the Future of Internet Cooperation (October 2013), we agreed on some common principles for an evolution such as the one announced by the US Government. Regular participants in those meetings, including their affiliated organisations, are noted here: http://www.nro.net/news/statement-from-the-i-leaders-coordination-meeting As an outcome of these discussions, a common position was developed on the following points: - The roles of all Internet registry policy bodies will stay unchanged. These bodies continue to hold policy authority for the protocol parameter, number, and name spaces, including responsibility to ensure the faithful registry implementation according to those policies. - The IETF, IAB, and RIRs are committed to the role of ICANN as the IANA protocol parameter and IP address registry operator. - ICANN reaffirms its commitment to implement all IANA registry functions in accordance with the respective policies. ICANN will also provide affirmations to all stakeholders (including governments) that all Internet registry policy bodies and ICANN itself will continue to use open and transparent processes. The full text, agreed upon by the I* leaders, is included at the end of this email. Separately, ICANN released a timeline that details its expectations of the multi-stakeholder consultation process. More information on these plans will undoubtedly come out of the upcoming ICANN Meeting in Singapore (23-27 March). ICANN's structures and accountability mechanisms continue to evolve and advance guided by the AoC community reviews, including ATRT. In addition, ICANN will continue to embrace its aggressive roadmap to truly globalize its structures. In order to operationalize the transition from USG, ICANN will engage with the Internet community in a bottom-up public consultation process to ensure appropriate accountability mechanisms. In addition, ICANN will work with the names, numbers, and protocol communities to formalize relationships, commitments, and mutual responsibilities. When community stakeholders have input about the policies emanating from the names, numbers, and protocol communities, they would be directed to pursue their interests through the relevant Internet communities (such as the gNSO, ccNSO, ccTLD ROs, ASO, IAB, IETF, or the RIRs) and their mechanisms for consideration and potential redress. The IETF, IAB, and RIRs are committed to open and transparent processes. They also are committed to the role of ICANN as the IANA protocol parameter and IP address registry operator. The accountability mechanisms for ICANN's administration of these core internet functions will provide escalation routes that assure the names, numbers, and protocol communities that if IANA's performance is lacking, those communities can pursue defined processes for improving performance, including pre-agreed independent 3rd party arbitration processes. ICANN reaffirms its commitment to implement all IANA registry functions in accordance with the respective policies.
