CA’s Position on Service Provider’s exclusive deals with MDU Owners.

Good evening Listers, Hope you are having a good weekend. => Ill be short and to the point: Say there is a large residential neighbourhood V.R. With a significantly large number of tenants: => Then a provider S, who wields considerable sway on the management of V.R. => Lets say there are clients , living in V.R who are interested in getting service from a different provider B. and B, on approaching V.R is told that they have signed an exclusive deal with S, to disallow anyone from accessing the market at V.R. It obviously can be argued either way considering there is a Willing Buyer, Willing Seller agreement there, But What exactly does CA have to say about this? I ask because some providers wield enough financial muscle to actually buy out my County and sign an exclusive deal with my Governor, preventing me from operating in my own backyard…. Listers, The KENIC saga was in the papers today >From the leaked letters, it appeared DRAKE was complaining to the Communications Authority (CA) that the KENIC board affairs are not being run above board, but more specifically, that the position of chairman has never gone to them. I could not trace the current constitution of KENIC to ascertain how the current chairman of the KENIC board is appointed but previously, KENIC has served as the best reference point for multi-stakeholder governance systems. Intermediary liability law in African countries (and the AU)

Greetings everyone, I am new to the channel, so apologies if I have missed any relevant discussion on this. I signed up to consult this group on recent developments on intermediary liability in Africa. As you might know, APC had a few papers in 2012 on intermediary liability in Nigeria, Kenya, South Africa and Uganda <https://www.apc.org/en/node/15623/>. I also wrote for them a report on best practices for intermediary liability in 2013 <https://www.apc.org/sites/default/files/APCInternetIntermediaryLiability_Be…>. Following from that, I have been recently contacted to write a chapter for an upcoming Oxford handbook on intermediary liability, which looks back into developments on the subject over the last few years in Africa (2012-2018). I want this to be as complete and accurate as possible, but the material I have been able to find online regarding new laws and court decisions is rather limited. I would therefore be very grateful to any of you who took the time to share, *in or off-list*, *notable developments in your country relating to liability of intermediaries* (in a broad sense: digital platforms, but also ISPs and other types of intermediaries, e.g. registrars and domain name operators, or payment companies). I would also be curious to hear of *any regulation or policy coordination relating to intermediaries in the context of the African Union*, which at the time I wrote the 2013 paper appeared to be a suitable forum to develop some common principles in this field. Has anything happened on that front? Thank you really very much in advance for anything you're able to contribute. Dear Listers, Here is an excerpt from the President’s Memorandum which is up for consideration before the National Assembly tomorrow. He proposes taxation of telephone and internet data services. Safaricom, Airtel, Telkom etc do you have a projection of what this could mean for your consumers? Now I am only but a simple lawyer, but I would think that this will enlarge the chasm between the haves and have nots in an already inequitable country. I wonder what this will mean for data costs, internet access and penetration levels, innovation, employment (esp for the youth) and generally keeping up with the new age. It was laughable when this was happening in Uganda, little did we know we were up next.
