@Kevin I like your response. The interplay between independence and interdependence. :-) I fully agree with you. I have one issue though and this is one of *Corporate Governance*. The monies we are talking about are not small change in the scheme of things. A million here and 25 million there..This adds up. No organization worth its salt should be run 'Kiholela' like that. With all due respect to the Mandarins at the MOICT. They should know better. The right way to do things is to sit with the CA and have a discussion at the end of every year as to which activities they would like CA to fund. These then should be consolidated and ExComm (Executive Committee of the Senior Management Team at CA) presents this to the Board of Directors for ratification and it becomes a budget item and above board. The CA is a critical institution and the goings on there smack of machinations to control the billions that CA has in its budget. It's wrong for MOICT to treat the CA budget as its personal piggy bank/slush fund. The MOICT has a vote. Let it live within its means like we all do. And in case they are unable to the paragraph before this should be a guideline on how to go about it so that no one is exposed. Lastly, I also think what the Director General did, if the reporting has any truth to it is wrong. He simply should not have the power to approve extra-judicial budget items. This leaves him vulnerable later to manipulation. Let there be clear procedures on how these things are done. At the Boards that I sit in that in itself is a firing offence. Let us not expose our heads of government agencies to such manipulation. It is akin to abuse of power by MOICT. It simply is not acceptable. there is need to identify ote there is a gap between legal practitioners, police investigators, jury as far as cyber crime ins concerned. this far evidenced in crime jurisdiction, chain of custody, crime scene management and current laws.. how can one prove beyond reasonable doubt where a crime have been done when data is encrypted,can non forensics person extract data especially with limited knowledge on crypt o analysis and stenography, what about if the crime was done through social engineering or the attacks was done using zero day attacks.some crime are done in deep net or deep web . there is need to recognize digital forensics who can help in bridging the gap.

@Kevin Indeed. A point of clarification. There is no letter of the law that gives powers to a ministry to request monies from their agencies without due process. Otherwise we might as well not have a board that provides guidance and policy to management. In a nutshell: - Kenya undertook a big experiment on delivery of public services through mobile Internet. - Notably, the country did not have an Internet shutdown unlike many other African countries that have had election related disruptions in the last three years - There was massive mis and disinformation that kept many online to counter, discount and discuss social problems in the country. - While online rights are guaranteed, trends towards information controls for example election results are a cause for concern, hence the title of the report,* Moving forward while looking back* Going forward, there is need for discussion on Kenya's strategy in the data economy including aspects such whether perceive data as a national asset, our preparedness for the data economy, equitable sharing of benefits from data such as election data and of course protection of personal data. Most privacy policies and terms of services for web and mobile applications are in English and therefore it is only 10% of us who can actually read them before we provide our consent. Even if we can read them, we may not have the necessary legal training to understand them. According to a tweet thread by Pat Walshe (@privacymatters), the Tetris app, a popular video game, has a privacy policy that details the third-party advertising companies that they share data with. These third-parties include "123 Ad Networks; 13 Online Analytics companies; 62 Mobile Advertising Networks; 14 Mobile Analytics companies. The linked privacy policies for Tetris run to 407,000 words, compared to 450,000 words for the entire Lord of the Rings trilogy." The child aged four and above that plays the game and her parents need an intermediary to deal with the corporations hiding behind Tetris. Unlike the European Union, which has more than 37 years of history when it comes to data protection law, India is starting with a near blank slate after the Supreme Court confirmed that privacy is a constitutionally-guaranteed fundamental right in the Puttaswamy case judgement. While we would want to maintain adequacy and compatibility with the EU General Data Protection Regulation (GDPR) because it has become the global standard, we must realise that there is an opportunity for leapfrogging. This article attempts to introduce the reader to three different visions for intermediaries that have emerged within the Indian data protection debate around the accountability principle. I will also provide a brief sketch of an idea that we are developing at the Centre for Internet and Society. This is an incomplete list as there must be more proposals for regulatory innovation around the accountability principle that I am currently unaware of. n Account Aggregators: The India Stack ecosystem that has been built around the Aadhaar programme first proposed intermediaries called Account Aggregators. Account Aggregators manage consent artifacts. India Stack has traditionally been described as having four layers -- presenceless, paperless, cashless and consent. The consent layer is supposed to feature Account Aggregators. If, for example, a data subject wanting an insurance policy visits an insurance portal, the portal would collect personal information and a consent artifact from her and pass it on to multiple insurance companies. These insurance companies would send personalised bids to the portal, which would be displayed on a comparative grid to enable empowered selection. The data structure consent artifact has been provided in the Master Direction from RBI titled "Non-Banking Financial Company Account Aggregator Directions," published in September 2016. How does this work? The fields includes (i) identity and optional contact information; (ii) nature of the financial information requested; (iii) purpose; (iv) the identity of the recipients, if any; (v) URL/address for notifications when the consent artifact is used; (vi) consent artifact creation date, expiry date, identity and signature/digital signature of the Account Aggregator; and (vii) any other attribute as may be prescribed by the RBI. While Account Aggregators make it frictionless for the grant of consent and also for the harvesting of consent by data controllers, it does not make it easy for you to manage and revoke your consent. n Data Trusts: Most recently, Na.Vijayashankar, a Bengaluru-based cybersecurity and cyberlaw expert, has proposed intermediaries called Data Trusts registered with the regulator and who (i) will work as escrow agents for the personal data (which would be classified by type for different degrees of protection); (ii) will make privacy notices accessible by translating them into accessible language and formats; (iii) disclose data minimally to different data controllers based on the purpose limitation; (iv) issue tokens or pseudonymous identifiers and monetise the data for the benefit of the data subject. To ensure that Data Trusts truly protect the interests of the data subject, Vijayashankar proposes three requirements: (a) public performance reviews (b) audits by the regulator and (c) "an arms-length relationship with the data collectors." In his proposal, Data Trusts are firms with "the ability to process a real-time request from the data subject to supply appropriate data to the data collector." n Learned Intermediaries: The Takshashila Institution published a paper titled Beyond Consent: A New Paradigm for Data Protection, authored by Rahul Matthan, partner at the law firm Trilegal. Learned Intermediaries would perform mandatory audits on all data controllers above a particular threshold. Like Vijayashankar, Matthan also requires these intermediaries to be certified by an appropriate authority. The main harm that he focuses on is, bias or discrimination. He proposes three stages of audit which are designed for the age of Big Data and Artificial Intelligence: "(i) Database Query Review; (ii) Black Box Audits; and (iii) Algorithm Review". Matthan also tentatively considers a rating system. Learned Intermediaries are a means to address information asymmetry in the market by making data subjects more aware. The impact of churn on their bottom-lines, it is hoped, will force data controllers to behave in an accountable manner, protecting rights and mitigating harms. n Consent Brokers: Finally, I have proposed the model of a Consent Broker by modifying the concept of the Account Aggregator. Like the Account Aggregator proposal, we would want a competitive set of consent brokers who will manage consent artifacts for data subjects. However, I believe there should be a 1:1 relationship between data subjects and consent brokers so that the latter compete for the business of data subjects. Like Vijayashankar, I believe that the consent broker must have an "arms-length distance" from data controllers and must be prohibited from making any money from them. Consent brokers could also be trusted to take proactive actions for the data subjects, such as access and correction. The need of the hour is the production of regulatory innovations and robust discussions around them for all the nine privacy principles in the Justice AP Shah committee report -- notice, choice and consent, collection limitation, purpose limitation, access and correction, disclosure of information, security, openness and accountability. Hey Elly, Just a correction, on a light note. It's Listers, as opposed to 'listeners'.. While we appreciate this communication, there are a few disturbing issues I take note of in the brief from Kenic, and a clarification would suffice:- 1. Why would a module upgrade be carried out on a live registry database, literally throwing the entire country .KE space into a spin, for almost two days..? Was an offline upgrade test run conducted..? 2. Why did it take two days for this communique to be released, albeit much late in the day as chaos reigned..? 3. Any disaster recovery strategies in place, to mitigate such..? Any timelines..? Were laid protocols followed in this strategy..? Do we have a failover in place for the Registry..? 4. Any assessment of the impact of this outage,on the .KE space, technically and economically..? I believe most if not all stakeholders would shudder at &take great exception at such light handling of a major registry outage that's currently the backbone of the entire country's digital framework, considering the chaos that ensued in the aftermath. I honestly suggest all protocol be now put forward by Kenic to ensure the .KE space is urgently certified as a national security infrastructure.
