Subject: US unilateral control of ICANN backfires in WSIS. Date: Sat, 01 Oct 2005 15:50:26 -0400 From: Milton Mueller <Mueller(a)syr.edu> The results of WSIS Prepcom 3 demonstrate the failure of US unilateralism. The US is well on its way toward being isolated, having lost the support of the European Union in its attempt to keep ICANN and Internet governance under its own control. Now its rigid, defensive policy has put the Internet itself at risk. The politics in Geneva were driven by an alliance between the European Union, states critical of ICANN such as Brazil, and authoritarian states such as China, Iran and Pakistan. All agreed to create an "Inter-Governmental Council for global public policy and oversight of Internet governance." Unlike ICANN, this Council would exclude civil society and the private sector from participating in policy making. It would set up a top-down, regulatory relationship between a governmental Council and the people who actually produce and use the Internet. As we have learned from the past two years, most governments have little interest in solving the real problems of the Internet. They prefer to play political games: asserting "national sovereignty" over a global communication medium, censoring inconvenient sources of information, thinking of ways to protect national telecom monopolies from internet-driven competition, grabbing control of country names in the domain name space, excluding Taiwan, and so on. The US government and ICANN have resisted inter-governmental oversight, contending that intergovernmental supervision can be politically unstable and dangerous to the Internet's autonomy. But the US still seems not to understand how its own insistence on unilateral oversight creates the same instability. When the US criticizes governmental control, the obvious retort is that there is already one government with extensive oversight powers over ICANN and the core technical functions of the Internet: the USA itself. The US is completely at a loss to explain why it should have that control, to the exclusion of all other governments. Its "but we are different" argument might find a receptive audience among US business interests, but it doesn't fly anywhere else. It's not enough for the US to say, "we are not an authoritarian state like China." For one thing, the US seems an increasingly authoritarian state to many in Europe, what with the Patriot Act and other recent measures forcing everyone entering the country to undergo biometric surveillance. But even if that is not an entirely fair perception, the US cannot claim that it will not use its unilateral power over ICANN * for it already has. In August, the Bush administration responded to political pressure from conservative religious groups by asking ICANN to reconsider the creation of a top level domain for adult content. It was inevitable and entirely predictable that other governments, including erstwhile allies such as the European Union, would want their own piece of that power. The US could have, and should have, privatized and internationalized its oversight authority when it had a chance. It could have, and should have, insisted on robust, democratic accountability mechanisms for ICANN that would have pre-empted demands for centralized, old-style inter-governmental oversight. It could have, and should have, insisted on negotiating binding international agreements protecting the Internet from arbitrary governmental interference and regulation. But it didn't. And now the debate has devolved to a choice between "US control" versus "UN control." If that is the choice, it is only a matter of time before collective international control wins. What seems to have been lost in the shuffle is the idea of distributed, cooperative control that involves individuals, technical and academic groups, Internet businesses and limited, lawful interactions with governments. The idea that nation-states should not have the ability to arbitrarily intervene in the Internet's operation whenever they feel like it, but should be bound by clear, negotiated constitutional principles, has been crowded out of the debate. As the WSIS debate spills into the US media, do not permit the US government to wrap itself up in the flag of Internet freedom. It is reaping what it sowed. Its own special, extra-legal authority over ICANN and the Internet has been the lightning rod for politicization. Its insistence on retaining control, and the spillover from its unilateralism in other areas such as the war in Iraq, has done tremendous damage to its credibility. Now the Internet is paying the price. The website, Yezzi.org, is a collection of photos of Tunisians holding up signs in various languages, each with a message directed to Tunisian President Ben Ali. Though the phrase they use, "Yezzi, Fock!," may appear to be a misguided attempt to curse out a certain swear word in the English language, it roughly translates to "General Ben Ali, enough is enough!" in Tunisian Arabic. In the words of the protest's organizers: "This expression in Tunisian dialect intends to transmit a clear message to the dictator in order to give up power, because we consider it is enough. For us Tunisians, who are always banned from freely reaching independent information and who are violently forbidden from any peaceful demonstration; this kind of demonstration is a new form of peaceful protest." The site, launched yesterday, contains dozens of photos of Tunisians venting their frustration at President Ben Ali. They note that free expression is technically protected under Tunisian law, though not in practice, so they're using the website to exercise that right: "[T]here's no Tunisian legislative provision prohibiting the right to express our opinions. Absolutely not, this demonstration is covered by the fundamental guarantees provided as well by the Tunisian Constitution as by the International Conventions ratified by Tunisia. All the demonstrators on Yezzi.org make use of their right to express an opinion in saying to the General Ben Ali 'It is enough!'" The Tunisian authorities, not surprisingly, see the matter differently. They've already started blocking the site, so only those of us outside of Tunisia can see it. One can only imagine what might happen to these cyber dissidents if they were caught by the Tunisian police. Hi Walubengo, Lizette & others, As indicated in Alices email, the meeting was principally meant to discuss several issues that related to the civil society sector within KICTANet (see report for details). The issue of migration of KIPlist members into the KICTANet list was also part of the agenda. Florence Etta was therefore invited to the meeting but did not make it to the meeting. I believe she had other commitments at the time. The multistakeholder KICTANet meeting will be held as earlier scheduled and any clarification on issues may best be discussed at that meeting. Overall, the objective was to have a face-to-face meeting to reduce the misrepresentations that may occur/have occurred online and allow members to discuss contentious issues in a diplomatic manner; with the benefit of immediate feedback/clarification. KICTANet Civil Society Caucus Meeting Monday, October 3, 2005 Held at Jacaranda Hotel, 11.00 - 14.30hrs, Nairobi, Kenya I) WORKING DEFINITION KICTANet (Kenya ICT Action Network) is a network of stakeholders moving the Kenya ICT Policy into Action. It comprises Trade Associations, Civil Society, Private Sector, Professionals, Media, and other interested individuals working on ICT issues in Kenya. II) DRAFTING CONSORTIUM The KICTANet Civil Society Caucus that proposes the following ten resolutions and action items is comprised of: Dorcas Muthoni (LinuxChix Kenya) Wainaina Mungai (OneWorld International) Alex Gakuru (KICTANET) Bill Kagai (FOSSFA) Alice Wanjira (APC/CATIA) III) FORCING FACTORS Acknowledging; . That Civil Society voices and issues have not been adequately represented not only within the network but throughout the general ICT policy development process at the national level as well as the global WSIS process that is currently underway . That the Kenya ICT Action Network (KICTANet) is an important multi stakeholder forum, which has provided space for different stakeholders interested in ICT issues to come together and by focussing on the collective goal of sharing skills, resources to stimulate and catalyse ICT related activities in Kenya. . That Civil Society Organisations particularly NGO's working in communication/ICT sector have not been involved in a unified and organised manner. . That Civil Society Organisations will require strengthening and capacity building to empower them to participate actively not only within the multi stakeholder network, but also contribute to our government's efforts to harness ICTs for national development. We the KICTANet Civil Society Caucus thus resolve; . The Kenya ICT Action Network Civil Society Caucus has been formed. The caucus focal point is One World. The caucus will strive to represent Civil Society voices within the multi stakeholder network KICTANet. . The KICTANet Civil Society Caucus is aware that diversity is a reality and will work with all the other stakeholders represented within the network, including government, private sector entities, trade associations, media and others, to strength the effectiveness of the joint collaboration, to improve impact, while articulating civil society perspectives on the ICT policy development and implementation process for our beloved country Kenya. IV) STATUS CONSTANTS KICTANet Civil Society Caucus therefore makes the following ten resolutions: 1. KIP mailing list should be moved to KICTANet list. a. The list should be localized in line with developing local content. b. Creation of sub mailing list groups along thematic as well as sector specific lists. These lists already exit; they were previously used to contribute to the ICT policy development process. We should continue using them for the various groups, which include KICTANet civil society, KICTANet Media, KICTANet private sector, KICTANet gender, KICTANet academia, KICTANet Youth. CATIA should continue to serve as the host and convenor for the KICTANet and should continue supporting and fundraising for network activities until such a time that another organisation/firm/corporation assumes leadership. 7. The KICTANet Civil Society Caucus has been formed and will take over the former Kenya WSIS Civil Society Caucus 8. The KICTANet Civil Society Caucus focal point One World will represent civil society organizations within national WSIS task force and will officially communicate the same to all stakeholders, including government ICT institutions development partners, private sector groups and others. 9. Information Africa’s Common Position on Internet Governance - The Dakar Resolution <http://africa.rights.apc.org/?apc=he_1&x=1500640> 09/20/2005 (WSIS) -- We, the African Information and Communication Technologies (ICT) Ministers, gathered to consider “Africa’s Common Position on Internet Governance”, in Dakar from 5 to 6 September 2005, thank His Excellency Abdoulaye Wade, President of the Republic of Senegal, for taking the initiative to organise this conference which has given us the opportunity to debate on building a fairer new world to improve people’s lives and eradicate poverty through the creation of opportunities to generate, use and share knowledge, Considering: - The Declaration of Principles and Plan of Action of the World Summit on the Information Society (WSIS), - The Accra Declaration for the Tunis phase of WSIS, 2005 - The African Regional Plan of Action for Economy and Knowledge (ARAPKE), initiated by the Bamako Bureau and the United Nations Economic Commission for Africa (ECA), - The Arab Plan of Action for the Information Society, 2005 - The African Partnership framework for Infrastructure Development - The Arab and African Joint Communiqué adopted in Cairo in May 2005, - The Recommendations of the Bamako Conference on «Multilingualism for cultural diversity and the involvement of all in cyberspace», - The Working Group on Internet Governance (WGIG) report, Considering that the Information Society would accelerate progress towards the Millennium Development Goals (MDGs), in particular for the developing countries. Considering that Internet Governance should be accountable, democratic and participatory; Given the general principles that should guarantee - A stable and secure functioning of the Internet; and - The open and decentralized nature of its architecture; Noting with satisfaction that the conclusions of WGIG reflect the concerns Africa expressed during the Accra Regional Conference (security, cultural and linguistic diversity, access, etc.); Recognising the need to reinforce the participation and association of developing countries effectively in the process of Internet governance; Convinced that, to arrive at practical solutions for the respective problems raised by Internet Governance, Africa should stand as one bloc at PrepCom3 and the second session of WSIS in Tunis 2005 and speak with one voice based on our interests; Convinced that the achievement of our priorities is an ongoing process requiring broad-based consensus among the international community on Internet Governance mechanisms associating States, civil society, the Private Sector, and international agencies; Considering that the creation of a World Internet Council (WIC), which reflects the recommendations of Chapter 48 of the Geneva Plan of Action and constitutes the final step that needs to be attained, can not be achieved immediately and necessitate the establishment of several different mechanisms; The Conference adopts, as follows: 1. The establishment of a global consultation framework to review in depth the general policies on Internet Governance. Such a framework should authorise equal participation for all stakeholders (Government, the private sector, civil society, and international organisations). 2. The expansion and reinforcement of the existing institutions for Internet Governance to enable all stakeholders to participate and ensure Internet Governance is efficient, accountable, and democratic, and that Internet services and resources are distributed in an equitable manner among all actors and all continents. The Conference also recommends: 1. Reinforcement of the role of the Government Advisory Committee (GAC) of Internet Corporation for Assigned Names and Numbers (ICANN) in all Internet Public policy development issues; 2. Internationalisation of root sever management; 3. African Member States should set up root server instances to facilitate access; 4. Setting up of a regional high speed Internet backbone allowing the creation of national, sub regional and regional Internet exchange points 5. Participation of specialized African institutions in technical Internet Governance bodies; 6. Reinforcement of the Internet Resource Management Institution, African Network Information Centre (AFRINIC), to guarantee the region’s independence in Internet resources; 7. Establishment in Africa of a reference framework for building a multi-stakeholder partnership at the national, regional and continental level, based on the basic principles of digital solidarity and in conformity with the spirit and provisions of New Partnership for Africa’s Development (NEPAD); 8. Contribution of African countries to the Digital Solidarity Fund (DSF) and utilisation of the Fund for building capacity, in particular for women and young people, and financing Internet-related projects in Africa; 9. Implementation of programmes that guarantee the presence of African languages on the Internet and use of free and open source software in order to fight against the linguistic digital divide and ensure the participation of all in the emerging new society; 10. The creation, in each African Member State, of a national structure responsible for the promotion and development of the Information Society, of knowledge sharing and the coordination of these structures at continental level; 11. The creation of Centres of Excellence around Africa for capacity development.
