Dear Colleagues, The Kenya ICT Action Network (KICTANet) invites you to a breakfast meeting on Friday 5 May 2006 from 7:30 to 10:00am to discuss the broadcasting and media sections on the Information Communication Bill 2006 at the Jacaranda Hotel, Gazebo Banda. The Permanent Secretary of Ministry of Information and Communication, Dr Bitange Ndemo will be chairing the meeting. The Ministry of Information and Communications finalized the ICT Policy early this year and Cabinet approved it. Subsequently, KICTANet has established a team to facilitate a comprehensive review of the draft ICT bill to make substantial recommendations for those who will finalize it. The key issues to be addressed include context, construction and implementation of the bill. Media groups are critical to this process and KICTANet would like to ensure that they contribute to this review process. Interim Report: Review and analysis of the Kenya Information Communication Bill 2006

Dear KICTANET Members Below and attached is the interim report for the review and analysis of our IC bill. Thank you and best regards alice --------------------------------------------------------- 1.0 Introduction Following the publication of Kenya Information and Communications Bill 2006 by the Ministry of Information and Communications in Feb 2006, KICTAnet decided to establish an infrastructure to review the bill in a systematic manner. The purpose was to take on board comments emerging from stakeholders in an efficient, constructive and nationally engaging process. Consequently KICTAnet established a team to undertake the review. This an interim report of the work of the I&C Review Team 2.0 Team composition The Team was formally constituted in the beginning of May and comprise of the following facilitators and their theme of responsibility in the Bill review exercise as set out in Table 1. Table 1: team membership and area of focus 1. Telecommunications: Muruiki Mureithi 2. Legal/Regulatory: J. N. Kihanya 3. Social Dimensions, including gender, youth etc: Dorcas Muthoni 4. Broadcasting/Media: Grace Githaiga 5. Acadamia: Victor Kyalo 6. Internet and information technology: John Walubengo 7. Economics: Ndungu Kimani 8. Outreach: Alari Alare The team Chair is Mr Muriuki Mureithi 3.0 Activities At its first meeting held on April 10th the team - approved an innovative model to review the bill . The model developed by Summit Strategies Ltd breaks down the review process into three dimensions, namely carriage system(s), content and finally services provision environment over three time phases. A detailed description of the model is attached - reviewed and allocated responsibilities for each team member as indicated in Table 1 above - Agreed to finalise and present phase 1 – contextualisation by Tue April 25 - Requested the Chair to brief and seek collaboration from PS Ministry of Information and Communications - Decided to publicise the bill review process to get constructive engagement with broad participation by all stakeholders - Decided to engage an expert to help engage the media on the review process These activities were carried out and reported in the 2nd meeting held on April 19th .This second meeting took note of the following;- - Briefing on the meeting with PS on April 13th who committed to support the process as reported below Dear Colleagues Further to our concurrence to work with the Ministry of Infocom, I met the PS on Thursday April 13th at 1700hrs and briefed him - on the framework and strategy we are using to review the bill - that the motivation of the process was to create synergy among all stake holders and enhance efficiency in the review process - that it was an open process we seek to bring all stakeholder interest on board - the team is giving time as a national contribution to development of ICT in the country - being a phased approach we shall have a peer review meeting on May 12th and a national workshop towards end of May or early June to be determined by the publishing of the bill by the AG The PS expressed appreciation to the work we are doing and committed to support us in this noble activity. He indicated that he will send his staff on the meeting of May 12th and that the ministry will takeover ownership of the national workshop to ensure high level participation. His office is open for any consultations we may need or support to undertake research that we may need. The Asst minister also came in briefly in our meeting Email to team members dated April 18th , 2006 , by Muriuki Mureithi chair - very concise reports by all members on their respective themes - the process leading to publishing of the bill by the Attorney General explained below ‘My very rudimentary understanding of the Bills process will be that on finalisation by the AG, the Bill will be published and forwarded to the House Business Committee, which will in turn forward it to the relevant committee of the House. The Bill will then be presented for its first reading by the Minister for communications. This involves a paragraph by paragraph reading of the all clauses in the Bill..or highlight of the PARTS of the Bill...It will then go to the second stage where the house will convert itself into a committee and raise queries on the Bill and then refer the Bill to the appropriate committee for any amendments proposed. It will then come back to the House for a final third reading and if passed, will await presidential assent to become law. I hope this gives a guide of some sort ON THE TIME FRAME.I could make a detailed report after enquiries. I am not aware of the internal workings at the AGs but would assume that the relevant officers will make the relevant changes to accord the Bill a final parliamentary style and when passed by the AG, the process above would kick in..’ Submission to the team by J N Kihanya Legal/ regulatory on Parliamentary process April 18th - Low response from the KICTANET list members. The team tasked a specialist Mr Alari to develop a strategy to engage all stakeholders in the bill review process - Commenced phase 2 – analysis of the bill with a view to make substantive proposals on the bill. A guideline has been developed by the legal expert on how to make proposals to the text as below Section 58(1)(ICBill) “The Minister may, by notification in the Kenya gazette, declare that any computer system or computer network is s a protected system.” Comment Delete entire section. The data protection regime needs a more robust treatment and we should seek views in other jurisdictions on how they have achieved this. Mr J N Kihanya Legal expert - to hold a media owners/ senior editors workshop in the first week of May to brief the media on the process - others key stakeholders to be engaged and briefed include TESPOK, Telkom Kenya, Safaricom, Celtel , E-government Secretariat, Postal Corporation of Kenya, CCK, Civil Society of Organisation - to meet on May 10th to present output of Phase 2 - to present our findings to a ½ morning workshop for peer review on may 12th - 4.0 Status PS Ministry of I&C has confirmed to attend the breakfast media briefing workshop on May 5th. We are now finalising the logistics to organise the meeting and bring in Media owners and senior editors Team members have almost finalised the final reports of Phase 1 whose cut off was Tue April 25th 5.0 Future programme The team has planned the following near term activities a.. Brief the Minister on the review once the report is complete b.. To organise a one day workshop for ICT reporters once review is complete to educate them on the contents of the Bill and our proposals Once the Bill is published by the AG a.. Jointly with the Minister organise a one day national workshop b.. Jointly with IEA , ATPS hold a two day workshop for Members of Parliament Committee responsible for ICTs 6.0 Resources The team is literally donating time and expertise for these national activities. The team needs funding for the better honoraria to cover direct costs and funding to organise the National workshop as well as the two day workshop with Members of Parliament Committee responsible for ICTs. +++

If you do, why not apply to be designated "At-Large Structure" and participate in the Internet Cooperation for Assigned Names and Numbers (ICANN) decisions critical to the Internet's end users? ICANN's Interim At-Large Advisory Committee (ALAC) is now accepting applications from existing or new groups that involve (or want to involve) individuals in Internet issues. Go to <http://alac.icann.org/> for more information. A new mechanism for individual Internet users participation in ICANN (the Internet Corporation for Assigned Names and Numbers) has been launched for people who want to be involved in issues that affect individuals use of the Internet's domain name system. ICANN is involved in shaping the Internet and is dealing with issues such as privacy protections for your personal domain registration information (called the WHOIS database), the implementation of internationalized domain names (use of non-ASCII characters), trade mark and domain name disputes and related matters, and how new top-level domains (i.e. .info, .name, .museum, etc.) are introduced. These are but a few ICANN issues on which the end-users voice needs to be heard. Groups throughout the world that deal with individual Internet users' interests are encouraged to register and participate in ICANN by submitting a simple application form. Groups that meet the minimum requirements will be designated as "At-Large Structures." The ALAC is an Advisory Committee to ICANN's Board charged with providing advice on activities of ICANN that relate to the interests of individual Internet users, and helping to organize At-Large groups throughout the world for structured involvement and informed participation of the individual Internet user community. Why become an At-Large Structure? By being designated an At-Large Structure, your group gets: a.. A recognized role in forming the policies that affect how individuals' use the Internet (ICANN is listening. Make sure your voice is heard!); b.. Quick and easy access to first-hand information on what's happening in ICANN and why it matters to end-users; c.. Opportunities to provide your members education on ICANN's work and Internet developments; d.. Participation in building your region's At-Large organization (RALO), and opportunities to network with other groups in your country and region as At-Large grows; e.. Representation in ICANN at the regional and international level, plus your group's members will be eligible to serve on important regional and international decision-making bodies in ICANN; f.. Uganda: Country Soon to Jump Onto the Outsourcing Bandwagon East African Business Week (Kampala) April 24, 2006 http://allafrica.com/stories/200604240920.html Edwin Nshuti--Kampala Since independence, Uganda has been actively engaged in the outsourcing industry, offshoring the refining and value-addition processes of most of her raw materials to Europe and America - to her disadvantage. This sad spectacle is, however, set to change and the country is set to realise its first positive benefits out of outsourcing. InterGlobal Services (IGS), a U.S. call centre operator in conjunction with the Busoga Kingdom are in the final stages of setting up a 150-seater world-class call centre in Jinja, 80 kilometres east of Kampala. "We are about one month behind schedule," the prime minister of Busoga Kingdom, Mr. Martin Musumba revealed to Business Week, "but it should be up and running by the end of May." The call centre will employ 450 operators, working 3 shifts everyday, and 7 days a week earning an estimated salary of about US$1,000 every month. However, the groundwork for equipping the population to work in the intricate offshoring industry had started earlier. The government through the ministry of education entered into an agreement with Global Management Consortium-Trade Information Network (GMC-TIN) and Serebra Learning Corporation (Canada) to provide low cost and affordable education in ICT, professional development courses including call technologies and call centre management through a programme known as EasyLearning. This programme will, according to Mr. Godfrey Seruwagi, the EasyLearning national project coordinator, go a long way in "bridging the digital divide through access to ICT education and provide Ugandan's with outsourcing job opportunities." Serebra, which owns the courseware has over 3,000 courses in its library but only 400 of those have been negotiated into EasyLearning and are accessible at a cost of Ush12,000 (US$6) per course. Ms. Rossette Serwanga, the EasyLearning programme manager says that since its launch on January 17, 2006, over 600 people have sat and passed the online courses. Busoga Kingdom set up an e-Learning centre in Jinja called IT Synergies, where they have been training the future call centre operators and managers and are now set to run the first outsourcing centre in the country. Outsourcing is the process through which one company hands over part of its work to another company, making it responsible for the design and implementation of the business process under strict guidelines regarding requirements and specifications from the outsourcing company. In this age of globalisation, in a world where Information Technology (IT) has become the backbone of business, very many huge companies like IBM, General Electric, Microsoft, etc are beginning to move some of their vital but peripheral operations like low-end software development and help-desk services to low cost labour countries. This phenomenon has mainly emerged due to stringent labour laws in developed countries and the need to cut costs to remain competitive. Over the last decade, India has been the leading offshore destination for global IT and Business Process Offshoring (BPO) industries because of its huge pool of highly educated, English speaking workers who are willing to work for just a fraction of what their counterparts in Europe are paid. These industries have played a major role in transforming India from a slow-growth economy with recurring balance of payments problems to a fast-growth economy generating ample foreign exchange surpluses. India's offshoring industry earns foreign exchange revenue of about US$6billion and employs about 350,000 people. However, India could soon lose its leading position as the world's 'back office.' According to a study conducted by McKinsey & Company, a U.S. consultancy firm and the India IT body Nasscom, India's outsourcing industry will face a short fall of 500,000 workers in the next few years. With Indian universities churning out 3.6million graduates every year, how can it be short of workers? The problem in India, according to experts, has always been the quality of its workforce, not quantity. US companies that operate call centres in India have continually complained the call centre agents' English accent being heavily influenced by their mother tongues. This has been India's biggest setback. Econet licence stays cancelled, court rules By RICHARD MUNGUTI THE High Court yesterday stood the decision taken by the Government to cancel a licence allowing Econet Wireless Kenya Limited to provide mobile services. Justice Mohammed Ibrahim said the court lacks jurisdiction to restrain the Government from cancelling the licence issued to Econet by the Communications Commission of Kenya (CCK). Justice Ibrahim in declining to reverse the decision by former Minister for Information and Communication, Raphael Tuju, to cancel the licence, said Econet was not clear over the kind of relief it was seeking. He said the order for prohibition was granted improperly and in breach of the principles of natural justice. "No allegations of illegality, impropriety or irrationality were made against CCK, yet it was restrained and injuncted in respect of some alleged deadline of payment of US$12 million which was not an issue from the statement issued by the minister revoking the licence and directing the commencement of the exercise anew," the judge said. He noted that Econet was seeking an injunction but instead applied for an order of prohibition by way of a judicial review. "In this application the prayer for injunction was 'hidden' in a different clothing and innocuously tucked away as a consequential order and made to appear as an integral and necessary part of the leave and stay," Justice Ibrahim noted. He added that "courts many times such applications are treated with a little more sacredness and solemnity that it would otherwise deserve." Justice Ibrahim had in November 2004 granted Econet leave to commence a suit against the minister and CCK challenging the orders. He had allowed the leave to operate as a stay of the minister's order to cancel the licence issued to Econet as the third Global System for Mobile Communications Operator (GSM) in the country. Econet was to join Safaricom and Celtel as mobile phone providers. Econet urged the court to restrain CCK from cancelling or suspending the licence issued to it even after the expiry of a deadline to pay a balance of US$12 million.
