People, Some of you might have struggled with ethical concerns around receiving corporate gifts or bluntly bribes from suppliers or other people courting you in a corporate sense. From a corporate governance sense such gifts can pause challenges. Forgive me for the long post that I am just about to make! I would like to chip in with my comments to the on-going discussion about IEBC and Technology. The IEBC shortfalls were not about technology. It was about people and process and the risk mitigations put around the whole effort! Some of you are aware that we were mentioned several times as a player around the technology failures. This is not to placate our position. We had no position to defend as our systems were fully and properly delivered and performed 100% to expectation. We are very proud of our work at IEBC. Yes, it was a massive IS (Information Systems) effort where literary tonnes of cash (yes, I say this with some form of sarcasm as we did not need to spend in the manner we did) was availed. The fiasco surrounding the BVR voter registration procurement (Biometric & AFIS - to avoid double registration/dead voters) has been well documented and written about. Our previous elections (2007) were marred by a resultant election violence catalysed by a claimed election fraud/theft that is said to have been caused by claims that the then manual voter registration system was porous and may have been manipulated allowing double registration in some areas and even ballot box stuffing in many others. So all this spending was in an attempt to avoid a repeat of this. On 9th November 2012 in an email conversation with some colleagues who I know are also active on this list I said and I quote ".......I must say that IEBC now remains the single largest threat to the security and safety of Kenya in the way they are managing this very sensitive matter. This is my personal opinion; it is not the opinion of LANTech (my employer) which is currently engaged in a business transaction with IEBC. I would say very frankly that their level of preparedness is appalling!" Still earlier on, on 30th October I had expressed the very same similar sentiments where I said, ".....I wonder whether IEBC will not use this as an excuse to scuttle any hope for the Kenyan Diaspora to vote. I must say that the level/state of preparedness by IEBC is shocking to say the least. It is a classic case of how not to! Some of us who are doing some work there are just shocked at how things have been left to the very last minute and with this you can be sure that a lot of stuff will fall through their fingers. We pray for Mother Kenya!". As it happens both my predictions have come to pass. There numerous goofs were mostly self-inflicted, few others quite external and even others very expected on a project of this nature in which you will expect that they will anticipate and take corrective action or plan for risk mitigation. Let us say that the main and biggest self-inflicted risk was procuring the systems very late into the calendar of the already known election date (I will not also go into the details of vested interests which was well reported about). For example the BVR Kit should have been procured and delivered by May 2012 to allow for 90days voter registration period. In the end the voter registration was only conducted in 30days deep into the election calendar and other milestones on the calendar were equally reduced. Even then Kenyans were very eager and more than 14.5m of us registered to vote! And we must do away with this practise of registration for elections when they are nigh. Voter registrations should be a continuous exercise (as our new constitution states) and even then anybody with an ID, having registered by the Registrar of Persons (as an adult Kenyan) should by default have a right to vote. The registration of persons should not be any business of IEBC as you will see in my other discussion that I will start asking for the Ministry of Immigration to stop the current tender for the AFIS/Civil Registration systems and instead take over the systems just newly procured by IEBC. The IEBC enjoyed massive goodwill both locally and multi-lateral partners who ensured that it had all the resources (fiscal) and otherwise to run the elections. This is probably where the expectations were not matched evenly with the delivery (call it reality). It may seem that the IEBC was lacking in that other resource that may not have been anticipated or planned i.e. its human resource capacity to deliver on the expectations. The 2013 Elections were the most complicated ever with 6 different seats being voted/vied for at the same time. This was akin to running six different elections in parallel. This is a huge logistical exercise by any measure! Thus the decision and rightly so to use technology as an enabler to deliver the election. If we analyse the Technology dimension, the ICT infrastructure at IEBC was discredited and archaic having been largely inherited from the old ECK. No clean voter database existed. It had to be recreated afresh with a fresh voter registration exercise, the reason for procuring the BVR voter registration system (worth close to Kshs. 9b as reported in some circles - US$105m). Then the EVID system (Electronic Voter Identification System/poll-books) and other technology that went largely un-reported. Even though the EVID system was supposed to be leading-edge, in reality it isn't. This was supposed to identify you at the polling station and then immediately update the database that you have indeed accessed your polling station where you registered/are supposed to vote and that you have cast your ballot. This was the "closest" we would come to electronic voting (as envisaged by the Kriegler commission) which was not possible because of the reality of the communication infrastructure challenge and the general level of literacy of the voting population which may not be at a high enough level to allow for a seamless electronic election voting. As we are all aware, these poll-books failed massively, sinking close to $40m down the drain! I would say that the risk mitigation applied was in the form of manual forms 34 & 36 that we are now familiar with. Talking about the process dimension of the election, IEBC would have had to apply a mix of in-house and external persons to conduct the elections including taking the route of sub-contracting and outsourcing to conduct most of its core mandate i.e. conducting elections. Internally it needed to have the requisite skilled people to manage the out-source/sub-contract operations while ensuring contracted services are delivered. This would be risk transference at work. An election is a massive exercise in its very nature. IEBC knew that at the election period itself, it would require close to 400,000 people working for the few days to the run-up to the elections and few days after (say a week). This is a huge logistical process and part of the discussion would have been to allow the BVR and EVID equipment suppliers to also recruit and train the head count that will be used for this period as part of the ways of managing this process. This would have probably ensured that these gadgets worked and not the excuses that the batteries failed or password were forgotten. >From the above, we see that the mitigation actions that should have been taken would not only be qualitative but also quantitative. A mix of technical and social actions should have been deployed. The human factor "failed" this election and one would say that the technology integration to the whole election exercise failed except the case of the BVR Voter registration which mercifully went well/successfully and only due to the Kenyans own desire to register and not necessarily that the IEBC did anything spectacular about it (as we have seen the voter registration systems were delivered very late in the day!). So then we see the need for a hybridisation of not only the management practise but also the actions taken to mitigate the risks. The human element in the whole exercise failed to adequately weld together all the various elements to deliver a flawless election. We are now discussing that technology failed when it is actually that the people tasked with ensuring the integration of all the systems together largely did not make this happen. What I am now concerned about is what we do with this huge investment in information technology (close to US$ 150m in value). This is huge spend. We must find a way in which this investment must be deployed in other departments e.g. the Civil Registration Bureau for a complete new and clean civilian database and hence issuance of a new 3rd generation ID card that should ideally serve as your voter's card at any time that an election may be called. I hope that this has not been a boring post. Ours is a manual voting system, and in 2013 some processes (voter registration and identification, results transmission and tallying) were enhanced (not replaced) by deploying technology. Detailed Supreme Court judgement may shed light on this. @ Muraya - the high voter turn out in 2013 can be attributed to several factors, chief among them that it was a fresh register compiled only 3 months to the election. Chances are the people who registered intended to vote and even if one accounts for natural attrition, chances of well over 90% turnout should not raise any eyebrows. An Open Letter on the ICT Sector to President Uhuru and Deputy President Ruto

Dear Mr.President and Deputy President As you embark on your journey to transform Kenya into a Digital Country here are a few suggestions, humby submitted:- 1. The idea of giving every child a laptop is a good one but it must be followed by real efforts to encourage and incubate local content otherwise we will loose control of what our children read. 2. We have made great efforts in improving ICT infrastructure but alot still needs to be done. Some great initiatives have already been started. They need your personal attention:- a. KENET - Kenya Education Network (KENET) is a National Research and Education Network that promotes the use of ICT in Teaching, Learning and Research in Higher Education Institutions in Kenya. KENET is already rolling out high speed internet in Universities. This needs to be expanded to all institutions of learning. It is a shame for example that schools in informal settlements do not have either computers or internet access in Nairobi. I shudder to think what happens when we move beyond Nairobi. b. The Universal Access Fund - The Kenya Communications (Amendment) Act, 2009, provides for the establishment of a Universal Service Fund (USF), administered and managed by CCK. The purpose of the Fund is to support widespread access to ICT services, promote capacity building and innovations in ICT services in the country. Sources of Funds come from Licensees, appropriations form Government as well as grants and donations. The USF act of 2009 has been just that....an Act until recently when the Board was constituted. I humbly ask that this be in your To Do List for the forseeable future. c. Husband the formation of the new Independent Communications Commission of Kenya (ICCK) which will replace the current CCK. This is in line with the new constitution and will go a long way in adding much needed gravitas in the regulation of this important sector (Which I daresay your campaign ably borrowed from during the electioneering period with the word 'Digital'). This new look ICCK will have seven commissioners selected through competitive interview process by the Public Service Commission and the names forwarded to the President for final approval. Each of the Commissioners will have specific roles like compliance, spectrum among other roles. d. Enhance the Ministry of Information and ensure that the Technocrats leading it are steeped in the industry, have a track record and able to navigate and steer the country to truly be the Silicon Savannah of Africa. 3. Without a strong educational infrastructure and a culture of learning all the above will be for nought. I humby request that we relook closely the current practice of turning all Polytechnics into Universities. There is a place for all in the educational space. We need academics, enterpreneurs, professional managers and artisans for us to move this great nation of ours towards Vision 2030. We must ensure that the whole educational ecosystem serves all these different needs. 4. We must inculcate and encourage a research oriented Higher Education (Universities) system deeply entrenched in social needs, business, health etc. Universities should not be set up as profit centres but centres of excellence where we go to draw from to feed our various needs. Businesses should be encouraged to partner with Universities to bring out the best talent and ideas for our country. There is a lot of emotions, bigotry, outright tribalism and jingoism being bandied around the country in many channels - Online responses to media stories, FM Station talk shows, social media, work places, bars etc. Whilst I abore the very nature of some of the discussions we have fought too hard for freedom of expression and association to blanketly condemn everything whole sale. I have just read a story in today's nation titled *'14 Bloggers linked to hate messages'*. http://www.nation.co.ke/News/14-bloggers-linked-to-hate-messages/-/1056/173… The gist of the story is that the bloggers are using the anonymity of the internet to spread hate, tribalism etc.and they are being 'hunted down' like rabid dogs. What I found interesting is this particular paragraph:- *Mr Robert Alai, a well-known blogger was on Tuesday charged with posting “annoying” statements on social media sites, Twitter and Facebook.* For those of us who follow Robert on Social Media you may be forgiven if you think he is the 'Village Mad Man'. However he is a Kenyan and has a right to free speech. I do not excuse some of the stuff being posted online but I sincerely do hope that when one is being charged at our law courts the charge sheet does not say that he or she is charged in court for posting 'Annoying Statements'!! A few months ago Eric Hershman (whiteafrican.com) posted a blog defending Robert's right to his unique brand of 'journalism' and I am one of those who commented on the blog saying that one needs to take responsibility for his actions. http://whiteafrican.com/2012/08/22/kenyas-slippery-censorship-slope/ Now I see where Eric was going... Oh the power of Retrospection. Bwana Ndemo, As I reflected on your unenviable job as a "cyber cop" (watching you on The Trend last Friday) and stumbled on this article by Gaitho entitled "The demented postings on social media must stop before blood flows" http://www.nation.co.ke/blogs/-/446672/1723754/-/ee6vonz/-/index.html it occurred to me that we probably need something deeper, while we must address the madness online. You're on record here advocating for policy/decision-making based on empirical/research evidence. I recall your spirited campaign about the Cancer Bill that MPs excitedly passed without the benefit of scientific evidence as to "the actual cause of cancers in Kenya". You argued that you wished they did not get excited about addressing the symptoms of the problem, but the root cause. As you crack down on cyber haters (to address the symptoms of the problem), could we also ask ourselves a couple of questions (listers, feel free to add more questions) to get to the ROOT CAUSE of this ANGER: *why are people so angry? *is this anger only in cyberspace? *If not, to what extent is it a reflection of simmering (unexpressed) anger on the ground? *what are the implications of unexpressed anger? *why are people comfortable to express such deep anger online and not offline? What are they afraid of? *How can long-lasting co-existence be achieved, once and for all? * etc etc etc Someone has work to do as we try to address the short-term symptoms - is it the academic community? or pollsters can have a post-election job to do? March 20, 2013 Kenya’s PKI Destined for Failure? Today I had the opportunity to attend a seminar organized by the Ministry of Information & Communications and Samsung SDS as part of the implementation of Kenya’s National Public Key Infrastructure (NPKI). The project is undertaken within the framework of the Kenya Transparency & Communications Infrastructure Project (KTCIP), a World Bank funded initiative that will help Kenya achieve a number of the goals under the ICT pillar of Vision 2030. The presentations from the team from Korea consisted of representatives of Samsung SDS (who won the International tender for Kenya’s NPKI implementation) as well as representatives from some of the key actors in Korea’s own NPKI. The Korean presentations were interesting, informative and very well prepared. Over the period of a few hours they were able to take the relatively complex subject of National Public Kenya Infrastructure and unpack it in a way that was both easy to understand as well as clear and straightforward. They left no shadow of doubt as to whether Samsung SDS can successfully implement this project. They also shared the organizational structure for the project, which is as follows: [image: CAM00454]<http://140friday.com/wp-content/uploads/2013/03/CAM00454.jpg> During the course of their presentations the team from Korea shared the high level plan for the implementation of Kenya’s SDS. They made it clear that they had spent a good deal of time working closely with Government officials responsible from the Kenyan side. In describing the structure and hierarchy that has proven successful in Korea for the implementation and operation of their NPKI, the team shared the following diagram. [image: CAM00455]<http://140friday.com/wp-content/uploads/2013/03/CAM00455.jpg> At the very top, there is the Ministry responsible for the NPKI, they provide the legal and regulatory framework, national authentication plan and other high level functions. Below them is the “Root Certification Authority” an organization known as the Korea Internet Security Agency (KISA), which provides operation of the National Authentication system, licensing/accreditation of certificate authorities (CA) to provide service to the public as well as development of technical standards. Below them are the accredited CAs of which Korea has 5 who provide certificate issuance and management services to the public. In a presentation which came later, the Korean team shared the proposed structure for the Kenyan implementation which had been arrived at after consultations with Government. The diagram is as follows. [image: CAM00457]<http://140friday.com/wp-content/uploads/2013/03/CAM00457.jpg> In this structure, Government who will be responsible for legal and regulatory framework, national authentication plan, other high level functions as well as licensing and auditing are to be represented by the Communications Commission of Kenya (CCK). Below them and responsible for operation of the Root Certification Authority is CCK. Below that are a proposed “Government CA” which will issue certificates for Government agencies and employees and a proposed “Private Sector CA” which will issue certificates to the rest of the country. I have a big problem with this structure. First and foremost because CCK is being proposed as BOTH the licensing authority as well as the licensed operator of the Root Certification Authority. The potential for conflict of interest is immediately evident, not to mention the fact that the end-to-end integrity of a structure that ensures top-down accountability is rendered completely void. Even worse was the mumbled suggestions by some of the government participants at the seminar that CCK might also act as the Government CA. In addition that is the fact that a project as crucial as this has not gone through a proper stakeholder consultative process and is seemingly being shoved down our throats. In his closing remarks a director a the E-Government directorate asked the ICT Board to engage stakeholders further and receive input before moving too far. I raised this point as a question during the Q & A session at the end of the seminar and would like to emphasise that it would be *very wrong* for CCK to be the Root Certification Authority for a number of reasons: 1. *Conflict of Interest:* As per the proposed structure the representative of Government, CCK needs to serve as the top level entity that handles the legal and regulatory framework and the national authentication plan. Adding a subsidiary role would not only compromise their integrity but would also expose them to all manner of challenges with regards to operation of an infrastructure that is supposed to be based on trust. 2. *Procurement Issues:* In sharing to a certain level of detail the complexity of the Root Authority setup, it became evident that there would be a continuous need for procurement of various goods and services. As a government agency, CCK is subject to public procurement regulations, this means that even very basic, small and simple items could take months if not years to procure. The problems with our public procurement are well known. Subjecting the Root Authority to this kind of environment is in itself a major risk for successful implementation and operation. 3. *Human Resource Issues:* Several times in their presentations the Koreans complained that they had observed a critical lack of human resources. They emphasized that they were not referring to *skilled*human resources but simply to *enough people* for the project requirements. Shock of shocks! With the incredible numbers of well educated Kenyans who are unemployed or underemployed? They could obviously have only been referring to what they had seen as far as the people available for the project from the Ministry and CCK. It is no secret that CCK has extremely limited human resources in their ICT division and those few are oveworked, stretched beyond measure and juggling multipe roles. Isn’t adding additional responsibilities into this mix a formula for disaster? 4. *Inertia*: CCK has proven to be very poor at the timely execution of functions that fall outside their core mandate of licensing, regulation and resource management. A perfect example is the implementation of the Universal Service Fund, which CCK insisted on handling as an inhouse function instead of facilitating the setup of a dedicated entity to handle the task. It has been over 6 years since regulation and legislation regarding the USF came into place and there is still nothing to speak of. I will reserve this as a subject for another day (it is a long and detailed one!) *Recommendations* The Government should immediately consider adopting a *Public Private Partnership* approach for the implementation of Kenya’s NPKI. This is especially timely because we now have a fully ratified Public Private Partnership Policy that provides a variety of models for project implementation. This will not only ensure involvement from crucial stakeholders but also free the Root Authority from the problems highlighted above (and probably many others) while at the same time ensuring that enough private sector energy and enthusiasm is infused into the project so that it moves with speed and determination. Success stories such as KENIC and TEAMS show that it is not only possible but that it can be done with ease.

Hi, It is always good to watch what the competition is doing to avoid planning in a vacuum, I came across an article and report on the approach Tanzania is taking in developing outsourcing and knowledge centre. The model is interesting and takes into consideration the fact that a large pool of highly educated personnel is important to achieve their objective therefore they have opted to take the Stanford model. Warigia, In my view, the assessment of CCK's performance in respect to Universal Access Fund is not fair. I say this because the legal framework for the Universal Service Fund (USF) is barely three years old (i.e. the Kenya Information and Communications Act of 2009 and the Kenya Information and Communications Universal Access and Service Regulations of 2010). It is these pieces of legislation that charge CCK with the responsibility of managing and administering the Fund. From the date USF's legal instruments were put in place, the issue of doing nothing in the last six years does not arise. You will also recall that the Universal Service Access Committee (USAC), which is mandated to advise the CCK Board on the management of the Fund, was appointed in December 2012 by the Minister for Information and Communications. As it awaited the legal framework to be in place, CCK undertook a number of preparatory activities for the implementation of USF. These include: * Establishing a Statistical function within the Commission in view of the need for up to date information on access and usage of ICT to inform universal access planning. This is the Unit that prepares the Quarterly Sector Statistics. * Carrying out a number of studies to guide the implementation of the Fund, including the National ICT Survey (2010/2011) and the ICT Access Gaps Study (2011). The Survey was undertaken in conjunction with the Kenya National Bureau of Statistics to provide baseline information on the level of access and usage of ICTs at the household level in Kenya. The Survey provides benchmark indicators against which to measure the penetration of ICT services particularly through the USF. It provided a key input into the ICTs Access Gap study of 2011 undertaken by APOYO Consultoria. The ICT Access Gap Study identified areas that lacked access to voice, postal and data services and provide cost estimates for closing the gaps. It has provided the basis for identifying the areas requiring USF interventions and prioritizing allocation of funds. These reports are available on the CCK website. * Implementing a number of UA pilot projects whose experience will be key in implementing national UA projects. The pilot projects include: 16 ICT Centers in Secondary Schools (2 in each province), 4 Community Centers, 8 ICT Centers schools for PWDs (covering all secondary schools for PwDs in Kenya), 10 e-Resource Centers within the Kenya National Library Service outlets, E-health Project (in collaboration with the Ministry of Health and Qualcomm Inc), Content Development that include the Digitization of the Kenya Certificate of Secondary School (KCSE) Form I and II curriculum by KIE and a Web Portal for Persons With Disabilities (in partnership with the National Council for Persons with Disabilities and United Disabled Persons of Kenya). These projects have been funded largely by the Commission. * From 2012 to date, the Commission has been developing USF program concepts, projects prioritization criteria and USF Strategy with technical support from USAID's Global Broadband Innovation (GBI) programme. Again with support from the USAID, the Commission in conjunction with the Ministry of Information and Communications, Kenya ICT Board, E-Government Directorate, Vision 2030 Secretariat and National Communications Secretariat and other stakeholders are developing a National Broadband Strategy (NBS). This strategy is important in the realization of universal access to broadband services in Kenya. Starting from July 2013, the Fund shall be brought into operation. In this regard, all licensees shall be expected to begin remitting their statutory contribution to the Fund. On its part, the Commission has set aside Kshs1,000,000,000 as seed money for the USF. But we can be forceful, and find ways to train people who will administer the NPKI system. We currently have thousands of security experts in the country, and we are willing to learn more. Good points from Brian and Evans. I think the elephant in the room is CCK to be the Root Certification Authority. PPP as Brian puts it might be the best way to go, although it has its own challenges, as we saw last year when KENIC was facing leadership challenges, and discord within the board. Other channels might be to tender for local companies to bid to be the RCA. This has worked very well in developed countries. The issue of HR can be sorted if we are willing to empower our youth, by say Knowledge Transfer. Unfortunately, these Asians are not very keen in transferring such knowledge to the client side of the business since they want to be indispensable. But we can be forceful, and find ways to train people who will administer the NPKI system. We currently have thousands of security experts in the country, and we are willing to learn more.
