With regard to Trademarks Clearing House “TCH” vs Mark Validation System “MVS”, Neil Dundas noted that these issues are being dealt with through the Geo TLD group. dotAFRICA FOUNDATION Issues such as location and the organizational governance model were raised and discussed. There are ongoing Steering Committee discussions about where the foundation will run its operations. TRADEMARK CLEARING HOUSE TMCH provides trademark verification to support trademark protection in the launch of the new gTLDs. It was explained that the verification process is a‘4-eyes’ process which consists of 2 verifications per TM record plus the proof of usage. Accuracy and completeness of information and compliance with the requirement would be verified. However, in the event that the TM or proof of use is incorrect, a process called‘re-correction’ would kick in. Certain reasons would permit the occurrence of the re-correction process. Common errors in the process were noted: for example, name of trademark, registration date, name of holder address, etc. TMCH now includes: weekly notifications, newsletters, monthly webinars, and a full blown API test environment. TMCH animations are now available in more than 10 languages. In the near future one can expect to find the ‘proof of use’ uploaded as a separate document, an SMD file, implementation of the 50 abused labels, transfer of TM records, and updates on the clearing house guidelines which will be soon found in different languages. UPDATES ON SUNRISE AND CLAIMS The Sunrise services allow trademark holders an opportunity to register domain names corresponding to their marks, either defensively or with a view to exploiting a valuable new Web address before new names are made available to the public. New gTLD registries are required to offer a Sunrise period of at least 30 days. The trademarks claims period follows Sunrise and runs for at least 90 days after the opening of general registration. During the trademark claims period, anyone attempting to register a domain name matching a mark that is recorded in the TMCH will receive a notification displaying the relevant mark information. If the notified party goes ahead and registers the domain name, the TMCH will send a notice to the one or more trademark holders with matching records in the clearinghouse, informing them that someone has registered the domain name. ICT ENTREPRENEURSHIP IN AFRICA The meeting discussion included issues such as the Internet challenges in Africa and how we can overcome them. Africa reaches the Web very differently from the rest of the world. For instance, credit cards are very scarce in Africa compared to other parts of the world. It is clear that Africa still needs infrastructural development and financial investments. Another interesting discussion was the existence of opportunity for the youth in Africa to register domain names. Our own Octavia Kumalo who was there representing us and the Foundation for Internet Development, answered this worrying issue, by affirming that opportunity and space for competition does exist since Africa has only 6 ICANN-accredited registrars. There need to be more DNS training programmes and financial education to make it easier for youth start-ups. Africa has about 40-60 tech hubs which give visibility to innovation in Africa. The hubs are a reaction to the lack of support from governments and other organisations. They are a way for Africans to help themselves. According to Andile of the discussion panel, at least 60% of Africa is made up of youth who possess the majority of mobile phones. Therefore products and services should be addressing the youth specifically. Closing remarks: An ICANN Youth Dialogue is suggested to address such issues whenever ICANN meetings are held. African governments need to engage with their youth in order to make it easier for them to start their businesses in ICT. IEBC ordered to surrender voting kits in laptop plan

The electoral commission has been ordered to surrender 45,000 laptops used in the March 4 election to the Ministry of Education.The gadgets are to be used to train teachers to implement the free laptops project whose implementation will begin in January. Jason Lakin makes some excellent (and very very common sensical) points on policies, budgets and data - concerns the laptop initiative as much as as host of other issues: 'What is the vaunted laptop policy, for example? It is a matter of constant discussion, yet we really do not know what it entails. This lack of clarity leads to sterile debate. (...) Policies are not made on television or on the radio. Serious policy must be written down, it must contain details, and it must include information about costs. (...) Another point that seems trivial but unfortunately needs repeating is that transparency about policy is not enough. The data that government puts out must also be accurate.' Listers This is an interesting article about the Chinese Telco Giant, Hauwei. Chinese telecommunications giant Huawei may have been all-but-barred from doing business in the U.S. over allegations that it's basically an intelligence agency masquerading as a tech business. In Africa, however, Huawei is thriving. From Cairo to Johannesburg, the Chinese telecom has offices in 18 countries and has invested billions of dollars in building African communications networks since the late 1990s. The company's cheap cellular phones today dominate many of Africa's most important markets - and that was before Huawei teamed up with Microsoft earlier this year to launch a low-cost smartphone on the continent. Just in the past few months, the firm closed a pair of telecommunications deals in Africa each worth more than $700 million, part of an African business that brings in more than $3.5 billion annually for the Chinese firm. According to Huawei's marketing materials, the projects are all part of a mission of "Enriching [African] Lives through Communication." But current and former U.S. officials - as well as outside security analysts - worry there could be another agenda behind Huawei's penetration into Africa. Hi All, +1 Agreed with Ali, both Safaricom and Equity are known to have tried to run hand in hand on the mobile money, peer to peer transfers etc. After a failed attempt by Equity with m-kesho, where they had the right opportunity to exploit the network Safaricom has build out now they are complaining. The financial sector needs to agree on payment standards which they could get M-Pesa to align to thus bring and even playing field, but our bankers are continuously chasing M-Pesa and other mobile money products. Today, if you consider what M-Pesa offers and it is very easy for the financial industry to replicate but requires the level of boldness and innovation that Safaricom under Michael J. displayed in an poorly regulated market or accept that Safaricom has the necessary banking licences to compete with them as stance of equal footing. Whilst CCK in return opens out an MVNO's licensing opportunity to other interested parties like financial institutions to increase competition. I foresee a financial institution or a supermarket (e.g. Tesco UK) could become one stop shop for providing various services provided by the a mobile network operator and a financial institution. This is leading to sophisticated bundling of services that provide the convenience a customer requires but leave the core competencies of running the MNO in the hands of specialist. The question here is of the customer footfall and how an organisation is able to services its customer requirements with the right value for money propositions. As many have pointed out, opening up Mpesa will benefit Safcom in the long run. As some have quoted the case of AT&T, if Safcom were to open up Mpesa, and may I suggest even setup Mpesa as a separate organization, the growth will enormous. I can foresee a scenario where the platform will penetrate the market segments that have eluded other electronic money transfer providers such as Visa/Mastercard- or even have collaborations with them. Imagine having someone deposit money into my Mpesa account in Nyamira- Kenya and be able to use my visa card at a shop in Helsinki! @Ali, Funny how Equity is thinking like me below...exactly my idea about "unbundling" MPESA. It should be "open-access" and I dont see how that would affect Safcom intellectual property rights to MPESA. It as about inter-operability - think "Mobile Phone Inter-connection" agreements where competing operators interconnect at a fee that is settled regularly. Listers, CCK to renew Safaricom's licence Kenya's largest mobile operator - Safaricom - will pay Kshs2.36billion (US$27million) for renewal of its operating licence for a further term of 10 years. CCK today announced that the renewal of Safaricom's licence would depend on the operator paying the renewal fee upfront and meeting the set minimum quality of service standards by June 2014. Safaricom's initial licence term of 15 years is set to expire on 30th June 2014 but has a provision for a possible renewal for a further term of 10 years. Addressing the media at the CCK offices, CCK Director General Mr. Francis Wangusi said the renewed Safaricom licence would come with a set of new licence terms and conditions negotiated between the regulator and the mobile operator. The licence renewal fee of US$27 million is based on the bid price offered for the third GSM mobile licence by the latest entrant to the mobile telecoms market in Kenya -Econet Wireless Kenya Ltd (now Essar Telecom Kenya Ltd). The Director General said that whereas Safaricom has significantly contributed to the economy, developed innovative products and services and met most its licence obligations, the mobile operator needs to up its game in regard to meeting the set quality of service standards. ''We have considered the fact that whereas Safaricom has met most of its licence obligations, its continued failure to meet the set Quality of Service standards remains a concern that needs to be addressed,'' said Mr. Wangusi. Mr. Wangusi further said the three other mobile operators would pay the same amount for renewal of their licences for a further term of 10 year to ensure parity and a level playing ground for all service providers in the sector. Think you have places to go now? Wait until you see what’s coming. Open Neighborhoods Some new top-level domains will invite anyone to register a domain for any purpose. Need a laugh or want to spread some laughter? Visit a *.lol* website, or set up your own. Interested in motherhood? *.mom* is there for you. And there will be hundreds more to choose from. Internationalized Neighborhoods Why let the Roman alphabet have all the fun? This new domain era will see the first top-level domains in numerous other languages and there will be a موقع. for .みんな in the .世界. The World Wide Web is about to start living up to its name. Geographic Neighborhoods We've discussed country code domains like *.ca* or *.de*. We’ll soon be able to get even more specific with domains related to a specific geography such as a city (visit*.boston*) or region (wine*.aquitaine*). Specialized Neighborhoods Some of the new top-level domains are intended for websites created by members of specific professions, communities, or interests. Looking for a lawyer? A website ending in *.esq* will signify a certified legal professional. Similarly, *.ngo* will be reserved for non-governmental organizations’ websites, and *.catholic* and *.shia* for sites representing those religious communities. Gated Neighborhoods Numerous companies have applied for closed top-level domains and will have complete control over what websites to make available on them. These are usually recognized brand names, like *.montblanc* or *.gucci*. When you visit a website on a closed top-level domain, you can be certain that it’s authorized and overseen by that brand. The new generation of top-level domains will start launching in the fall of 2013 and continue rolling out through 2015. Data Bundles and Expiry Dates

Listers Please see below. A few months ago I wrote on this list about Telcos and their expiry dates on data bundles. This is from Safaricom's customer portal. A nice nifty customer service portal. My question however is this:- Is it legal to put an expiry date in bundles that I have already bought? Even if it is written in the fine print of the legal document when you are buying the bundle? What happens when Nov 16 arrives and I haven't finished my bundles? It's like telling me that my fuel will expire on a certain date and my car will stall after that.. I have copied the chukua hatua CCK email so that we can possibly get a legal position on this. The struggling Postal Corporation of Kenya has found a saviour in newly appointed ICT secretary Fred Matiang’i.To rescue the institution, Mr Matiang’i believes that Postal Corporation’s new electronic payments system, Posta Pesa, should be guaranteed of all government e-payment services.This is the wrong approach to securing financial stability of any institution, not even the Postal Corporation.
