We do not believe that these provisions are consistent with basic principles of transparency, due process, accountability, proportionality and the rule of law. The leaked TPP Agreement is a complex set of rights and principles related to IPR and we believe that the current draft reflects a disproportionate balance of rights in favor of intellectual property owners. In addition to other issues, these provisions could also have important consequences for online privacy, a critical dimension in light of heightened awareness worldwide about the importance of protecting the privacy and security of end-users. In particular, with respect to intermediary liability, some of the articles appear to assign new levels of responsibility to private entities and create an environment where content will be subject to extensive filtering. Some draft provisions would impose an unparalleled set of conditions on intermediaries that would allow them to escape liability and could ultimately lead to content blocking and affect legitimate speech and online expression. Such measures are neither new nor original; they have appeared in similar forms in other national or international contexts. On the whole, these measures have proven to be inefficient or unworkable. They have failed to adequately address the stated problems or to provide sufficient answers to the existing challenges. The Internet Society has advocated for intellectual property discussions to adhere to minimum standards of process and substance. In June 2013, we released a paper in which we called on the international community to apply standards such as transparency, due process, accountability and compliance to the rule of law to all intellectual property discussions that relate to the Internet. Similarly, we have been vocal in advancing these principles in various fora, including the World Intellectual Property Organization (WIPO), the Internet Governance Forum (IGF) and the Organization for Economic Co-Operation and Development (OECD). We also joined other organizations (1) in a statement made in 2012, urging the negotiators of the TPP *“to make [the] process more transparent and inclusive, following the multistakeholder model, at least for those chapters of the agreement pertaining to the Internet.”* Throughout this process, the Internet Society has taken the position of not commenting on substantive issues based on leaked texts. At the time, we understood that the leaked texts provided only a snapshot of the issues while many provisions were omitted. The most recent leak, released by Wikileaks, appears to be the complete draft of the TPP’s Intellectual Property chapter and has made us reconsider our position. That we feel compelled to comment on leaked versions of the TPP demonstrates that these basic process standards have been ignored. In an era where the global economy depends on information and networks, we believe that discussions that affect the Internet and its users should reflect these basic principles of transparency and openness. Once again, the Internet Society calls upon the TPP negotiators to abide by standards of transparency as they complete this critical international agreement that will impact Internet users worldwide. We also urge the negotiating parties to reconsider the TPP’s intellectual property provisions and to ensure they don’t have a negative impact on innovation, creativity, prosperity and market participation. Photograph: Ian Waldie/Getty Images From databases to mobile phone apps and SMS systems, GPS tracking and humanitarian drones to biometric registration, new technologies are rapidly becoming central to the delivery of humanitarian and development aid. Refugees fleeing the Syrian conflict are having their irises scanned and their identity documents digitised. Nurses in Nigeria are using SMS systems to communicate HIV test results to health facilities. Cash is being delivered to those living in Kenya's slums through the M-Pesa mobile-phone banking system. The drive behind this technological and data evangelism is well intentioned. The usefulness of these tools has played out repeatedly on the humanitarian stage, be it through the use of Twitter analysis to map the spread of cholera in Haiti or the distribution of smart cards to flood-affected populations in Pakistan. New technologies have made delivering a id faster, easier and cheaper. Yet the technological revolution in foreign aid – like many other well-meaning innovations – is not without risk. A clear implication of adopting new technologies is the creation of previously unimagined amounts of data about the individuals who receive humanitarian and development assistance. Often, the collection and retention of data is an objective of the intervention – as with biometric identity registration systems in refugee camps, for example, or the establishment of a database of HIV-infected pregnant women to monitor transmission rates. But in many more cases, it is incidental to the use of technology. Mobile phones generate call and SMS records that not only contain troves of data, but produce dramatically larger stores of information about an individual's location, routines, contacts and network. When mobile phones are used in health-monitoring programmes, or for crisis mapping of human rights violations, they also facilitate the generation of particularly sensitive information. The collection, digitisation and dissemination of personal data raises serious issues about the ability of humanitarian organisations to protect such information. Organisations of this nature operate in complex environments with outdated information security practices and inconsistent access to electricity. Data protection standards are virtually non-existent and data is shared fluidly between organisations, agencies, donors, and NGOs. Most disconcertingly, data is also often shared with (or accessible by) two entities that do not necessarily operate under the same humanitarian ethics and with the same well-intentioned objectives – the private sector, and the state. There is a real danger that the aid community is laying the groundwork for pervasive – and potentially devastating – surveillance. By encouraging the sharing of incredibly sensitive information through insecure mobile networks, the establishment of national centralised databases of invasive biometric information, the analysis of location data derived from mobile phones, or the use of private-public partnerships to deliver mobile access to financial services, these organisations are providing the building blocks for surveillance states. If governments access this information – either because humanitarian partners provide it to them, or they demand access – they could build profiles based on data about location, ethnicity, religion, gender, land ownership, political affiliation, financial status or health. Victims who report human rights violations might be the subject of reprisals, people living with HIV could be exposed, members of particular ethnic groups monitored. Centralised identity databases have a tragic legacy of being used to facilitate mass human rights violations – look no further than the role of Rwanda's ID cards (pdf) in facilitating the 1994 genocide, or the way in which South Africa's 1950 Population Registration Act laid the foundations for apartheid. Imagine the implications of government access to the data collected by refugee agencies, peacekeeping forces, or NGOs monitoring violence against women. The use of these technologies for the collation of data is particularly worrying given the lack of any effective data protection framework in most developing countries. Of course, such programmes are only possible because of the absence of legal protections; it would be impossible for any European-based enterprise to collect location data on minorities, require SMS-reporting about drug adherence, or establish large databases of sensitive information without safeguards. This illustrates the curious double standard applied to the adoption of new technologies in developing countries and humanitarian emergencies. Whereas similar ID systems, biometric databases, and health registers have met serious resistance in the UK, Germany and Israel, and national condemnation of state surveillance reverberated around the US and Europe in the aftermath of the Snowden revelations, these same surveillance-facilitating technologies are being promoted by foreign aid donors hailing from western states. Funds have even been earmarked particularly for technology-based interventions by the US aid agency USAid, World Bank, the UK's Department for International Development (DfID) and EuropeAid. The very real danger of aid facilitating surveillance was highlighted by the revelation that EuropeAid, to which DfiD is a contributor, has been used to support the security forces of Belarus, Europe's last dictatorship, with the aim of enhancing border security. But the implications of aid are not always so obvious. Whether it might be helping to create a legacy of state surveillance in developing countries is a crucial question that needs to be asked of DfiD and other aid agencies. The road to surveillance may be paved with good intentions, but the warning signs are everywhere. The challenge now is to heed them. NAIROBI, KENYA: The Government has now cancelled the Laptop Project tender for schools over a budget deficit as bidders exceeded the budgetary projections. Education Cabinet Secretary Prof Jacob Kaimenyi announced that the tender process was canceled as lowest bidder quoted Ksh 32B against an anticipated budget of Ksh 20B. read more @ http://www.standardmedia.co.ke/?articleID=2000095732&story_title=jubilee-la… ~~~~ Not sure if it is true but I think Kenyans need to ask serious questions on this. We cannot spend our time and effort putting forward ideas on how to best implement a high-risk project and then suddenly we are told it is over...kapput.. finito..go home. just like that! For example If money is the problem why not modify the project to fit 20B the budget? I still think 20B would be sufficient if this project was tilted and tweaked towards the form1 student labs or even university students. The idea was noble and timely but execution and target audience for me (not Yawe :-) has always been doubtful. Right now we are told suppliers asked for 32B Ksh and but we had 20B so cancel the project, no questions asked and perhaps wait for 2-3yrs later to read from the Auditor General about how the 20B was (mis?)used. I think the CS for ICT should make a pitch to salvage the project in the modified form - assuming ofcourse the project was truly intended. walu.

Hello All, As described in the introductory email yesterday , we're glad to kick off discussions on this important topic, and look forward to feedback from the wealth of knowledge and experience here. We imagine there's a lot to say on the *Status of Internet Freedom in African Countries, *but let's start with the summary of Freedom House's 2013 *Freedom on the Net *report, which shows the status in some African countries - Nigeria, Angola, South Africa, Zimbabwe, Malawi, Uganda, Kenya, Ethiopia, Sudan, Egypt, Libya, Tunisia and Morocco. As seen in the attached image (below), Sudan and Ethiopia are *not free*; Kenya and South Africa are *free*; while the rest are *partly free*. You can also see an interactive map of African (and other countries) and details of the measurement at http://freedomhouse.org/report-types/freedom-net. With this background, we'd like to start Week 1 by asking for your views on issues of online freedom of expression. However, we'll also look at themes such as Internet Intermediary Liability; censorship and surveillance incidents; regulations, laws and policies governing freedom of expression online; and perspectives on the African Convention on Cyber Security. We invite you to look at the questions below, and please feel free to answer them directly or speak generally to the issues of the week. *We would like to here from you on:- * 1. Safaricom shuts down cash for Bonga Points platform

Safaricom has disabled a phone code that was being used to trade in Bonga Points by a Nairobi-based IT firm. Onfon Media developed the code, *981*400#, that it was using to buy the loyalty points from Safaricom subscribers at Sh0.20 each and selling them for Sh0.35, hence earning a return of 75 per cent. The increased availability of affordable marine fiber optic bandwidth, a rise in private sector investments, the popularity of social media and innovative applications, and increased use of the mobile phone to access the internet, are all enabling more people in Africa to get online. In turn, there are numerous purposes to which users in Africa are putting the internet‐from mobile banking, to connecting with fellow citizens and with leaders, tracking corruption and poor service delivery, innovating for social good, and just about everything else. The increasing usage of the internet, however, has in some countries attracted the attention of authorities, who are eager to provide caveats on the openness of the internet and the range of freedoms which citizens and citizens’ organisations enjoy online. The popularity of social media, the Wikileaks diplomatic cables saga and the Arab Spring uprisings have led many governments including those in Africa to recognise the power of online media. In a number of African countries, there are increasing legal and extra-legal curbs on internet rights, in what portends tougher times ahead for cyber security. *PIN and CIPESA work on Internet Freedom* The Collaboration on International ICT Policy in East and Southern Africa (CIPESA) and the Paradigm Initiative Nigeria (PIN) will co-host an online internet freedom forum during November and December 2013. The purpose of this forum will be to discuss key online safety matters in Africa. The forum aims to attract discussions from key ICT experts both within Africa and outside Africa. The outcomes of the discussions will feed into a report that will be presented at the first African Internet Freedom Forum to be held in 2014. Furthermore, it will inform the work of CIPESA, PIN and their partners that are working in the area of online freedoms. *Format of the discussions* Discussions will be hosted on selected online platforms in Uganda, Kenya, Nigeria and a mailing list comprising Africa Internet Governance experts. Identified platforms are: APC Africa IG mailing list; KICTANet (Kenya) mailing list; Information Network (Uganda) mailing list; Naija IT Professionals mailing list; West African IGF mailing list; and FOI Coalition (Nigeria) mailing list. The lists will be moderated by a representative from both CIPESA and PIN. Each week, a new topic with guiding questions will be introduced on the listserves and a summary provided at the end of each week. A draft report will be made available at the end of the fourth week. This too shall be posted back on the mailing lists to capture feedback from participants as well as seek clarification on any issues that might not have been captured well. A final report shall then be made that will feed into the face to face meeting as well as be shared on the targeted platforms and on partners’ websites. *Discussion Outline * *Week 1: November 11-15* *Status of Internet Freedom in African Countries*: Focus shall be on seeking participants’ views on issues of Freedom of Expression both online and offline; Internet Intermediary Liability; censorship and surveillance incidents; regulations, laws and policies governing freedom of expression online and perspectives on the African Convention on Cyber Security. *Questions to explore* 1. What are the major issues surrounding online freedom of expression in Africa? 2. What convergences and tensions exist between freedom of expression and privacy? 3. What are the implications of approaching the balance between freedom of expression and privacy from a freedom of expression–centric point of view? 4. What actions can governments, civil society, media and the private sector take to balance privacy with freedom of expression online? 5. What is the best way to empower users to stay safe online while protecting their freedom of expression? *Week 2: November 18-22* *Global Surveillance Revelations and Impact on Africa*: Focus will be given to global surveillance incidents like the NSA/Edward Snowden drawing lessons for Africa stakeholders i.e. governments, activists, CSOs and private sector; how to balance privacy while maintaining security for citizens. *Questions to explore* 1. What can African governments learn from the NSA surveillance and Snowden revelations? 2. What are the current technology trends and which cybersecurity threats raise the greatest concern? 3. How are evolving Internet services and technologies, such as mobile and cloud computing services, affecting these security threats? 4. Is there any country data, across the continent, on how surveillance has really helped to curb – or prevent – acts of terrorism? 5. Are African countries spying on each other? Are there countries that have shown a tendency to breach the rights of other sovereign nations on the continent? *Week 3: November 25-29* *Best Practices on Internet Policy in Africa*: Discussants will be called to share best practices on internet policies in Africa. *Questions to explore* 1. What policies are working in your country and what needs to be streamlined or strengthened? 2. Are there African countries that offer a model, or close enough to Best Practice scenarios that can be highlighted for other countries to learn from, or emulate 3. What are the signs to look out for in our various countries’ ICT policies, to be sure that the country plans to improve Internet Freedom? 4. What worked well for countries that have shown steady progress in the annual Freedom House ratings? 5. What can other countries learn from those that have, or are developing, crowd-sourced (and citizen-led) Internet Freedom Charters? *Week 4: December 2-6* *Recommendations for Africa*: Participants shall be called upon to suggest ways to improve internet security, data and privacy protection in Africa. *Questions to explore* 1. FYI Africa's Future is Clear: Youth, Technology & Broadband Technology is not an end unto itself. While it needs to reward shareholders and management, it has to address the improvement of human well-being. At its core it has to place the values of equity, justice and human dignity. Only then will it drive a revolution of ethics and morality that resolve the grand challenge of development in Africa and the world. The increasing disparities in wealth are causing rage worldwide, with global protests over corruption, bonuses, and tax evasion. Large numbers of unemployed youth fall outside formal markets and public services. People are demonstrating not only for democratic inclusion, but also to change the form of democratic inclusion - traditional multiparty politics is losing the ability to command younger populations, with party membership and voter participation going down worldwide. Still, there is a revolution going on in our world. The Internet and mobile phones were widely credited with the ‘death of distance’, and the rise of mobile broadband may be widely credited with the ‘death of geography’. Mass connectivity via mobile phones will exceed the global population of 7 billion in 2014. But where is Africa? I remember in the mid-90s as Minister of Communications in the Mandela Cabinet that there were 600,000 mobile phones in sub-Saharan Africa. Today it exceeds 750 million and is one of the fastest growing markets. No aid dollars drove this digital revolution. It was innovation; game changers like the prepaid card and demand for the right to communication from users. It was the appropriate policy and regulatory frameworks and freeing up of spectrum, that gave certainty and predictability to private investors. Most importantly it was getting our presidents out of the clutches of securocrats and to understand that communication as a right of citizens was our best protection of democracy. Today technology is changing our world - the way we live, work, educate ourselves, buy goods and services and transfer money. It determines the way in which our future societies will be organized. How do we ensure Africa rides the next wave of the digital revolution? What do we need to do to stop being left behind again in development? Half the population on our continent is under 25. It is our demographic dividend. While the populations of most continents are aging, ours grows younger. Are we hoping to be the factory or the farm of the future or the center of the global knowledge economy? What we do in this sector will decide our growth trajectory. Technology is driven by young people. They are the most connected generation in the history of humanity. So what are the key challenges we confront in Africa today and how can technology help us overcome them? Poverty confronts half our population who live on $1.25 a day. Education is one of the key pathways out of poverty. But half the children out of school live in Africa and the quality of public education is generally poor. Our infrastructure is weak and regional integration lags far behind the rest of the world. That reduces intra-African trade and the movement of goods and services. Although we are the richest continent we have not learnt to value our assets. We act as 54 separate countries and weaken our bargaining power with powerful economies and trading blocs. We have not benefitted from the commodities boom in the past decades. Now we can harness the digital broadband revolution to drive a entrepreneurial and livelihoods approach to our key assets; our land and agricultural potential to feed Africa and the world through a modern, technologically-savvy smallholder farmers model. Farmers, mainly women, have been incredibly empowered by being able to negotiate prices for their crops with middle men because they know market prices now. We can build on the incredible talent coming out of the technology hubs in Africa. In Nairobi, one of the cutting edges of new technology, public innovation, has produced some of the most successful applications. It is estimated that anywhere up to 20% of the Kenyan GDP is circulating on the back of mobile platforms like M-pesa, putting effective financial services into the hands of the previously unbanked. Over 17 million customers can deposit, withdraw and transfer money, pay bills, buy airtime from a network of agents that includes airtime resellers and retail outlets. Across Africa I see a multiplicity of such miracles are being born. We can use technology to drive education content and teaching and to deliver telemedicine. Public information on lifestyles, exercise, diets, breastfeeding and maternal and new-born care can be universally accessible and citizens empowered. We can begin to see our citizens as the greatest ally for good governance. Governments can improve outcomes on public expenditure by breaking down budgets and making it transparent for citizens to follow the money and demand accountability at a local level, in schools, clinics and local governments. Citizen engagement is essential for effective development, strengthening the quality of policymaking and the “science” of service delivery with improved social accountability. We live in the world of the ‘Internet of Things’, a universe of around 9 billion connected devices which could reach a trillion by 2025. Convergence of technology, a dream in my term in government, is now a reality. Mobile broadband is growing faster than any technology in human history averaging 30% per year. And it is driven by private sector investment. Five countries now have mobile broadband penetration in excess of 100 connections per capita (Singapore, Japan, Finland, Korea and Sweden). By the beginning of 2013, 32 economies had mobile-broadband subscription penetration in excess of one subscription for every two inhabitants, compared with just 13 countries at the beginning of 2012. There are more than 70 countries where more than half the population now has access to the Internet. While the impact of mobile over the past decade on our continent has been nothing short of a game-changer, there is a larger revolution for progress waiting. Just as we leapfrogged into the digital infrastructure of the mid-nineties we can today leapfrog the PC era into the marriage of mobile broadband and the Internet: we can be in the top league if we had the political will and build a smart partnership between government, the private sector, civil society and citizens. But we need to support an entrepreneurial approach to public innovation driven by public demand and needs. Today it is policy, regulatory and investment frameworks that will determine the future of Africa’s economic success: broadband licenses and spectrum are not cash cows for government in the short term. They are the foundations for long-term economic success. Otherwise broadband will remains out of reach in many countries in Africa. We need: Governments to lead through clear policies and regulations Each country needs a broadband rollout plan Clear policy and regulations that drive competition, attract private sector investment and drive down tariffs Introduce financial incentives that support entrepreneurs in public innovation Universal service obligations to subsidize education and rural internet access Local governments to drive connectivity and increase citizen access to public services and information Define incentives for operators and stakeholders in the broadband value chain While there is no single recipe that is likely to work for all countries - instead, countries need to relate the options they choose for universalising broadband to their market needs. None of this is rocket science. We need transparency in the way licenses are issued. We need predictability and certainty of policy and regulation. We need to drive digital literacy in our schools and communities. We need to eliminate any tariffs on the inputs into the broadband value chain. And Africa needs to use its bargaining power to ensure that we benefit in the manufacturing value chain from this broadband boom. 4G joint venture suffers setback as Safaricom pulls out

Listers Safaricom has announced its intention to pull out of the 4G Network consortium claiming that the Government is taking too long in concluding the details of the agreement. Maybe the ICT CS could enlighten us on what exactly the issue is? This multistakeholder approach to ICT infrastructure is what we have been advocating for all along and I believe forms a cornerstone of our Broadband Strategy? Marketing ICT in Kenya

Listers, I came across this ( http://www.nation.co.ke/business/marketing-Kenya-at-London-expo/-/996/20588… ) where Kenya tourism Board takes 50 firms in the Tourism & Hospitality industry to an international expo in London to showcase Kenya's Tourism opportunities. During some discussions we had at #140Friday sometime back, there was a good suggestion that the then Kenya ICT Board should sue at least 50% of their marketing budgets to actually marketing Kenya's firms, services & products in the ICT Sector. We know this currently doesn't happen as most of their (KICT Board) marketing budgets gets spent up in travelling per-diems to every other forum being held globally somewhere. Dear Listers, Allow me to refer you back to the just concluded Summit in Kigali - Transform Africa2013, I am sure most of you followed keenly, physically and remotely. One of the very many topics for panel discussions was coined as: "*Developing Smart infrastructure: Developing Ubiquitous, Secure and Sustainable ICT Infrastructure"* I must say the discussions were led by eminent panelists! But it is interesting to note that the critical resources of the Internet (Domains, IP - Addresses, AS numbers) continue to elude many people as part of the entire ICT infrastructure. Not many people gave this a thought, yet Africa is lagging behind in the uptake of some of these resources. It is widely assumed that Infrastructure is limited to Broadband Infrastructure! But, would we be better served by recognizing patents, especially software patents, or not?
