Law enforcement agencies, the judiciary and the prosecutor should ordinarily not be allowed to initiate laws. They are likely to trample on the citizen's rights by making laws that make their job easier. How come that government agencies have a legal mandate to develop policy and its implementing instruments (legislation and regulations) are silent on this matter? On this subject, it is curious that Safaricom's partner in the project is Chinese Telcom giant Huawei. Americans have reservations, apprehensive/suspicious Huwawei technology wrt spying. Here is an excerpt "U.S. House Intelligence Committee chairman Mike Rogers somewhat famously said last year that Huawei's products "cannot be trusted to be free of foreign state influence and thus pose a security threat to the United States and to our systems." It will specifically examine how Kenya’s newly developed Cybersecurity strategy would address mobile Internet security threats that undermine the overall efforts of national security. The results of this study will form part of my dissertation project for the award of a Master’s degree. The study has been reviewed by Ms Karen Renaud, a senior lecturer in the School of Computing Science whose main research interest is usable security. We really have a GOOD opportunity to develop capacity locally if there is a determined effort. Back in the 1980s (??) Moi challenged universities to produce the Nyayo Car. This was done, despite the poor quality of the product. But it demonstrated that our people can do it given the challenge, the chance and resources. Had we proceeded on that path, we could be producing a Kenyan car, however rudimentary. Indeed, we could even be producing substantial ranges of spares even for foreign models (just imagine the engineering knowledge, project management, quality assurance, etc capabilities we would have acquired by now.) What's more, results from such investments don't end up confined where they were initially targeted. A lot of US aerospace and military research realizes many applications/products for civilian use (example = microwave tech!). Talking of Booze Allen, I thought they also did our Cybersecurity Master Plan? Or not so? Ali: what's our "national interest" and how many, even in government, understand it, act in concert with it and remain patriotic enough to live to the promise! This is in an environment where a large segment of Kenyans can even sell their mothers for "30 pieces of silver". You can "hear" utter: damn the national interest, if one existed and understood thus. Security Situation in Kenya

Listers, In case you might not have heard, there has been a very serious security breach that has occurred in Mpeketoni, Lamu that has so far claimed close to 50 persons. The details on this are here http://www.nation.co.ke/news/mpeketoni-Lamu-gunfire-al-shabaab-terrorism/-/… To put this into context, Mpeketoni is the largest town, bar Lamu, between the Somali Border and Malindi and the center of commercial activity in the region. So, as much as a lot of us might not know it, the fact that Al-Shabbab could drive trucks full of fighters into such a town and commit these crimes and then leave should send all the security-bells that we have ringing. This is exactly how Boko Haram started in Nigeria and we are seeing it played out here right infront of us. I think its time that we spoke as the local ICT Community and came up with a stand on what in our opinion needs to be done in ICT Terms to secure this nation. As an example, it would actually be very irresponsible of us to let a few gentlemen to come together and tell us the solution to our current security problems, from an ICT perspective, is a police network deal that largely puts CCTV Cameras in Nairobi & Mombasa, when maybe nothing is being spent to secure our porous borders as well as actual on-the-ground intelligence collection. We could send this as a proposal to the powers that be as well as the parliamentary ICT Committee and hope, nay, push, until something gets done. The way I see this working is, we draft a document, brief and simple with what our recommendations are, then Listers can comment on it. If largely agreeable, we send it to the powers that be. TAKING STOCK OF WHERE WE ARE AS AN INDUSTRY

Listers Once in a while we must take stock of where we are at as a country beyond ICT because it is the environment we live in that ensures we succeed or fail. There is no doubt that this country has come a long way since 'independence' and the bad old days of the KANU Regime. What have we achieved since Multi-Partism? 1. Freedom of speech and association, a more competitive political landscape and the De-Godization (my own words!) :) of the Presidency. 2. A somewhat level playing field in the pursuit of happiness (read economic activities) 3. A more tolerant (not sure) society? 4. The 'discovery' of mineral resources (the wags have it that certain people high in government knew about the potential of our extractive natural resources long time ago and for whatever reason didn't move ahead to start exploiting them) and the potential economic empowerment for the country. 5. And for our industry a robust playing field filled with hope and enthusiasm for the future. 6. The right regulatory environment for most sectors (especially ICT) is emerging and although a work in progress a step in the right direction. 7. Almost universal access to financial services through the use of mobile technologies. Where have we retrogressed? 1 Moi warmed us about the ills of Multi-partyism and that it will breed tribalism in its most virile form. Are we seeing his self-fulling prophesies come to light? 2. The more things change the more they remain the same? What has really changed in the political playing field? 3. The recurrence of corruption networks. 4. Religious extremism never seen before and the almost ineffectual response by our disciplined forces. 5. A retrogressive regulatory environment? Or is it that there is less engagement with the industry then we have been used to in the last decade? I'm writing this because we MUST TAKE STOCK as an industry and ensure that we understand the environment we live in and how we can come together to change it. To give you an analogy I borrowed from Tom Friedman's famous book ' The World is Flat' - if the Operating System is flawed then it doesn't matter how good your desktop productivity tools are since you won't even be able to access them! What role can we play as an industry beyond penning opinions in lists like these, blogs and social media engagement? The case started in December of last year, when a magistrate judge in New York signed a search warrant seeking records and emails from a Microsoft account in connection with a criminal investigation. However, Microsoft determined that the emails the government sought were on a Microsoft server in Dublin, Ireland. Because a U.S. judge has no authority to issue warrants to search and seize property or data abroad, Microsoft refused to turn over the emails and asked the magistrate to quash the warrant. But the magistrate denied Microsoft's request, ruling there was no foreign search because the data would be reviewed by law enforcement agents in the U.S. Microsoft appealed the decision. In an amicus brief in support of Microsoft, EFF argues the magistrate's rationale ignores the fact that copying the emails is a "seizure" that takes place in Ireland. "The Fourth Amendment protects from unreasonable search and seizure. You can't ignore the 'seizure' part just because the property is digital and not physical," said EFF Staff Attorney Hanni Fakhoury. "Ignoring this basic point has dangerous implications - it could open the door to unfounded law enforcement access to and collection of data stored around the world." The government has argued that allowing a U.S. judge to order the collection of data stored abroad is necessary, because international storage would make it easy for U.S. Internet companies to avoid complying with search warrants. But Microsoft asserts that the government's legal theory could hurt U.S. technology companies that are trying to do business internationally. Additionally, EFF argues in its amicus brief that the government's approach hurts Internet users globally, as it would allow the U.S. to obtain electronic records stored abroad without complying with mutual assistance treaty obligations or other nations' own laws. Internet Companies fighting back to retain control of customer data (and competitiveness)

Listers Internet Giants are fighting back their governments' request for data and access to their networks in the wake of Snowdenia. http://www.nytimes.com/2014/06/07/technology/internet-giants-erect-barriers… This is a natural reaction to the fact that most of these companies have seen a significant decline in customer confidence regarding their ability to maintain integrity of their data. Cisco for example has seen it lose market share in Asia and Europe because of perceived NSA installed back doors to their routers. This is an interesting lesson on how government action can detrimentally affect private sector competitiveness.
