This is despite a court application by the three media houses of Royal Media (Citizen), NMG (NTV) and Standard Group (KTN) to allow them to keep broadcasting in analogue until they have their infrastructure in place. But tough talking Ministry of Information and CAK officials said in a press conference that the switch off timetable as issued in a gazette notice by Cabinet Secretary Fred Matiang'i, remains in place. Despite obtaining orders from the Supreme Court Vice President Kalpana Rawal certifying their application as urgent and maintaining status quo until the hearing set for January 5, Lawyer Wambua Kilonzo acting for CAK and Mr. Mwangi from the Attorney General's office, said their interpretation of the court orders was that the digital migration process was not stopped. "I have advised CAK not to cancel the licenses of the media owners but this does not stop the digital migration process from going on," Kilonzo said. Kilonzo in a position supported by the AG's counsel, said the Supreme Court did not grant orders to prayer number 2 of the media houses for the digital migration process to be stopped in the meantime. According to CAK Consumer and Public Affairs director Mutua Muthusi, the channels set for switch off tonight include: Citizen (Channels 34, 39) KTN 59 KBC 23 K24 26 GBS 47 NTV 42 QTV 12 Family 9 ETV 62 KIss TV (Channel 55) Muthusi said Kenyans are ready to migrate and cited sales figures of set top boxes which have ballooned in the last month. The advert in the daily Nation on Friday 19th advertising the vacancies at the Communications Authority seem to indicate that the CA senior managers are required to apply for their jobs. The managers have since gone to court: http://www.businessdailyafrica.com/30-managers-sue-communication-regulator-… The information and communications Act Amendment of 2013, section 105; the transition provisions set out in schedule 6 shall have effect with respect to staff, assets, rights, liabilities, obligations, agreements and other arrangements at the commencement of this act. It says among others " staff shall transit from CCK to CA of Kenya at the same terms and benefits or better terms and their terms shall not be interfered with." Change is good in every society. It brings impetus in organisations, reduces complacency, and improves efficiency. But these change has to be within the law. By the board advertising these positions it clearly contravenes these provisions of the act. Hon. Jamleck Kamau, Hon. Eng. Rege, Hon Yinda and all honorable members of parliament on this mailing list help us understand how a group of people (the CA Board) would blatantly ignore the law with 'impunity'! A spot check with some of the employees indicates that their employment terms have not changed - meaning they are permanent and pensionable. You cannot just wake up and change this without terminating and compensating them. The due process should be followed and you do not declare a position (whether change of name) vacant when you have an incumbent. The timing of this process also seems ill intentioned considering that Parliament which amended the Act before passing it is in recess until February 2015. The advert requires all to apply before 14th January 2015. Listers, we have to worry about what happens to the Authority because above all disruption to the setup definitely affects many businesses. Dr. Matiangi - is this another ignorance of the law from your ministry? Walu I disagree with you on this. You seem to forget about Natural Justice. This sort of thing should not be allowed to continue. I'm with Mwendwa on this. Why create uncertainty and anxiety? When the CA was created the board was dissolved and a 'new' one was put in place. This new dispensation of government/Parastal jobs being advertised while incumbents are still in place is just plain wrong. Something must be done otherwise we will continue to see litigation being the only option for the wronged. Listers Happy Holidays. Interesting story in the Sunday Nation on the above. It's especially poignant for me as I sit in Lamu trying to send an email for the last two hours with no success. I have both Orange and Safaricom and both have failed me dismally. I'm left wondering:- What National Broadband Strategy if we can't get the key county headquarters connected even with decent reliable connectivity. Maybe it's because it's the season of Kaskazi which is interfering with connectivity. Anyway, back to the Telkom issue:- Clearly, the government is yet to think through a clear strategy on how to handle the impending exit of France Telecom from the shareholding of Telkom Kenya – even as the country’s third mobile operator in terms of subscribers sinks deeper into financial distress. The uncertainty around the fate of what was once one of the largest state corporations with a workforce of more than 23,000 employees is captured in a recent letter by Information and Communications Secretary, Dr Fred Matiang’i, to President Uhuru Kenyatta. Writing in October, Dr Matiang’i argued that the insolvency of Telkom Kenya was bound to affect negatively the government’s plans in the ICT sector. According to Dr Matiang’i, Telkom Kenya’s dwindling fortunes will put the success of the national broadband strategy, including the plans to roll out Huduma Centres at risk. I hope Dr. Matiang'i was misquoted because for the life of me I can't see how the collapse of one company can put the whole country's Broadband Strategy at risk. Can someone please explain this to me? I doubt this is the case. Was the management contract for NOFBi so skewed to favour Orange Telkom that we are now unable to extricate ourselves? 2. Are we serious about connecting the country? By now we should expect at least the same level of connectivity as Nairobi. We now know that the myth of our country's GDP coming majorly from Nairobi is just that. A myth. Again, when are we going to get the Universal Access Fund working? At this rate we might as well call it a Phantom. 3. Why are we wasting so much energy on Telkom Kenya? I do commensurate with the current Government because they really were saddled with this albatross. But now it's time to put it out of its misery. This may sound callous but Orange is going nowhere. Even the staff know it. If we want to save Kenyan jobs then let's step in and revert it back to being a parastatal because clearly the French have funked it. Listers, We have already started the process of bringing up what will be Mombasa's Technology Hub, The SwahiliBox <http://cio.co.ke/blog/swahilibox-the-next-major-technology-hub-in-africa>, to life, and we have prepped up a team of volunteers to work with us in the process - so we are working together with the tech community here to shape up their next new and major home. It is going to be interesting to eventually see how the Nairobi and Mombasa Technology Communities can come and work together as a result of this. What would be more interesting would be to see the activities we can bring down to the space and create a more "regional" technology landscape. We shall be sharing the stories as we move along the way. The Securities laws amendment bill 2014 and it's impact on ICT

Kenya is in the process of implementing a new bill the "Security Laws (Amendment) Act, 2014." which is being fast-tracked by the executive. This law among other thing seeks to put in place punitive measures to ensure terrorists and those who promote terrorism are punished accordingly. We will seek to review the clauses in the law that affect the ICT industry, and ask you to give feedback on how best the laws should be implemented. Attached with this email is the security laws. Here are some of the contents of the laws 1. The bill makes it an offence to broadcast information which undermines investigations relating to terrorism without police consent. (page 55) 2. The National Security Organs may intercept communication for the purposes of detecting, deterring and disrupting terrorism in accordance with procedures to be prescribed by the Cabinet Secretary. (Page 57) 3. A person who publishes or causes to be published or distributed obscene, gory or offensive material which is likely to cause fear and alarm to the general public or disturb public peace is guilty of a felony (page 4) 4. It's illegal to post anything in social media that praise, advocate or incite acts of terrorism 5. It's illegal to adopt ideologies based on violence and which advance political, religious or social change in terms of radicalisation 6. In any legal proceedings, electronic messages and digital material shall be admissible as evidence. (Page 29) 7. The Bill intends to make it an offence to publish or broadcast photographs of victims of terror attacks without the consent of the police or the victim. (page 55) The public consultation started and probably ended yesterday (why such a short notice), but your input can still go a long way in ensuring we pass laws that serve the Mwananchi fairly. Internet Society Kenya Chapter and Kictanet seeks to engage in a series of online discussions covering various trending issues which will culminate in a public consultative forum with industry and policymakers to share the feedback from the community and see how best we can influence and shape the Internet landscape in Kenya.
