Judge George Odunga trashed the prosecution of National Police Commission member Ronald Leposo Musengi, Machakos Senator Johnson Muthama and former Information Permanent Secretary Bitange Ndemo. The others were the former directors of the Malili Ranch Company Limited, who have been accused of stealing over Sh179 million from Malili Ranch Shareholders. Judge Odunga prohibited Director of Public Prosecutions Keriako Tobiko from trying the individuals. Mr Musengi, Mr Muthama, Dr Ndemo and six others had been charged with theft of the millions from the shareholders of the private company which sold the land to the government at Sh1 billion. In his judgement, the judge said the trial of the Malili Techno City land deal suspects was an abuse of the criminal justice process

Kenya to help local investors raise funds to settle at Konza

Speaking at the Konza investor briefing, ICT Cabinet Secretary Fred Matiang’i said interested local investors who face financial shortfalls would get government support. “Together with the National Treasury, I am working on a Public Private Partnership framework that will see government source for funds to support local investors,” said Dr Matiang’i. The Konza Technopolis Development Authority (KoTDA) will rely on Kenya Private Sector Alliance (KEPSA) to attract investors who will construct commercial, residential, educational and public amenities within the demarcated land. *DEVELOPMENT REQUIREMENTS* Land will be leased out to investors for a period of 99 years. Interested companies are expected to have strong financial muscle, a well-defined construction plan with timelines to start development by April 2016 and complete it by end of the year.

After industry partners agreed in September 2014 on a new set of standards governing person-to-person payments across multiple networks, it's now evident that interoperability is here to stay. In general, mobile money interoperability has seen great strides in a very short time, with five markets - Tanzania, Pakistan, Indonesia, Bangladesh and Sri Lanka - now offering this as an option for customers and agents. Nigeria also mandated interoperability in 2012<http://www.cenbank.org/out/2012/ccd/timeline%20for%20interoperability%20&%2…>, but this hasn't come to fruition just yet. All of these markets have followed different approaches. Indonesia's and Tanzania's initiatives were primarily industry-led, whereas Nigeria has followed a regulatory model. In Pakistan, ATM switches 1LINK and MNET, the technical infrastructure that facilitates transaction processing, were involved from the beginning. In Tanzania and Indonesia, providers have connected bilaterally through custom APIs. It is still too early to determine the success of these interventions and only time will tell if new models and standards will emerge. How did Tanzania do it? As a key entrant to the "Mobile Money Interoperability Club" it is worth discussing the Tanzania experience, as it offers some insights for markets and operators wishing to embark on similar initiatives. 1. An industry-led process The process towards interoperability in Tanzania started several years ago and has benefitted from the involvement of many partners. The latest round of negotiations that produced the payment-to-payment operating rules was facilitated by IFC and funded by the Bill & Melina Gates Foundation and FSDT. The Bank of Tanzania provided a supportive regulatory environment for engagement. Importantly however, the bulk of the content came directly from the industry. A very clear process was defined at the beginning and based on this a project plan and a team of experts from the payments and mobile industries was assembled. Through frequent meetings, debate, negotiation and eventually consensus, the industry has successfully put together a set of standards that will govern how person-to-person payments will be handled across networks. 2. Common business standards It is often thought that interoperability is a technology challenge and that a "switch" is the solution. However, a switch would merely be a technical solution that facilitates transactions based on a set of pre-agreed rules or standards. Without these rules and standards, in the card industry often referred to as a 'scheme', no transactions can be made through the technical switch. Therefore in Tanzania, the industry opted to develop the common operating standards first. Establishing these standards involved regular meetings to define and record membership and participation criteria, clearing and settlement principles, handling of disputes, principles for intra-party compensation (or interchange) and interparty risk. Now that the standards are in place, what next? There are currently no regulatory mandates in place in Tanzania forcing anyone in the market to implement the new standards. Each company can choose to opt-in to the new standards according to whether it makes business sense for them to do so. So far, four mobile money operators have opted in - Tigo, Airtel, Zantel, Vodacom - through bilateral API connections. Encouragingly, Tigo presented at the GSMA MMU meetings and believes from initial indications that it has been the right decision for its business. This is good news. Card schemes have proved that once the first players start, then the rest will follow. We believe the same holds for mobile money. Ultimately, interoperability offers great benefits to mobile money operators, regulators and customers alike, and should serve to advance financial inclusion. I'm curious. Airtel’s Sh2.1bn licence renewal fee splits CA board

Telecommunications firm Airtel’s quest to get its frequency licence renewed without paying the required Sh2.1 billion fee has split the Communication Authority Kenya (CA) board, adding a new dimension to the seven months battle to get Kenya’s second-largest operator on a firm footing in the market. Francis Wangusi, the CA director-general, sparked the controversy with a letter he wrote to the authority’s board advising withdrawal of a demand notice the authority had sent to Airtel asking for payment of the Sh2.1 billion fee. The advisory marked an about-turn by Mr Wangusi, who had previously insisted that Airtel pays Sh2.1 billion for a 10-year frequency spectrum licence following the expiry in February of the one it was awarded in 2000. Airtel paid a $55 million (Sh4.7 billion) fee for its initial 15-year licence. Matters came to a head during the CA’s board meetings held on Monday and Tuesday last week after the Treasury and a number of non-executive board members insisted that Airtel must pay the Sh2.1 billion fee for the licence. Mr Wangusi’s position is supported by CA chairman Ben Gituku and Joseph Tiampati, the principal secretary in the Ministry of Information and Communication. Mr Wangusi reckons that the authority’s pursuit of the frequency spectrum fee from Airtel may expose the agency to court battles it stands a high chance of losing. This, he says, is because the authority did not include the settling of initial frequency spectrum licence fees in the conditions it set for Airtel when the telecoms operator was acquiring Essar Telecom’s properties. “Management is of the view that considering the events that have taken place thus so far based on the legal analysis, it would be more prudent to withdraw the demand for $20,025,000 from Airtel,” Mr Wangusi said in his note to the board. If adopted, Mr Wangusi’s advisory would deny the Treasury the Sh2.1 billion it was expecting from the deal at a time when the government is in dire need of cash to meet the ever rising expenditure demands. Safaricom moves to court to compel Airtel to remove M-Pesa branding from its agents shops. http://www.businessdailyafrica.com/Corporate-News/Airtel-removes-M-Pesa-bra… I'm curious. 1. Does Airtel own these agent shops? Or are they exclusive Airtel shops? If they are independent shops why sue Airtel? 2. Is Safaricom acting anti-competitively? Compelling mobile money agents who deal with competitor products to stop dealing with them? In other words is exclusivity something that passes muster in our commercial laws? 3. Whilst I have absolutely no problem with Safaricom protecting its brands I'm curious how this helps them in the long term except to continue perpetuating their 'Green Monster' badge in the face of the public. Us Kenyans have a love-hate relationship with Safaricom. We love Safaricom and hate it at the same time. This is an interesting conundrum for any brand. How to harness the negative and positive energies from customers to grow their brand equity. I hope someone at Safaricom is listening. On a related matter on the issue of dominance and abuse of market position:- Why do we need a consultant to tell us what is already obvious in the Telco sector? I think the regulator is throwing too much bureaucracy at an issue which can be resolved over a cup of tea with the various protagonists in the industry. Just saying.. Kenya to rival Nigeria in local content production

Bwana Walubengo has written a good piece on local content and it's regulation in his popular Op-ed pasted below. For avoidance of doubt Walu, I've included here the definition of Local content as laid out in statute. Its very clear from the regulator's perspective on WHAT local content is. Another issue you raise is the quality of local content. Well, my answer would be, let us try and try and try until we get it right. Nollywood grew from not giving up. KENYA INFORMATION AND COMMUNICATIONS (BROADCASTING) REGULATIONS, 2009 “local content” means the total of all television or radio programmes which fulfil any five of the following conditions— (a) the production is made in either Kenya’s native languages or official languages of Kenya; (b) production was done in Kenya; (c) the content deals with issues that are unique and relevant to Kenyan audiences; (d) at least twenty per centum of the share of the production company are owned by Kenyans; (e) a majority of the artistes are Kenyans; (f) the location of shooting, in case of audiovisual programmes or performance was in Kenya; (g) the author thereof must be a Kenyan national and in case of co-authorship or multi-authorship fifty per centum or more of the authors must be Kenyan; (h) the production is made under Kenyan creative and technical control, but does not include news and commentaries; 35. Local content (1) The Commission may require a licensee to commit the minimum amount of time, as maybe specified in the licence, to broadcast of local content or as may be prescribed from time to time by the Commission by notice in the Gazette: Provided that where a broadcaster is, unable to comply with the foregoing, the Commission shall require such broadcaster to pay such an amount of money, as may be prescribed by the Commission into the Fund. (2) The Commission shall from time to time prescribe a minimum local content quota for foreign broadcasting stations that broadcast in Kenya. Kenya Information and Communications Act, 1998 “Kenyan programme” means sounds or vision or a combination of both whose content comply with the classification of local content as may be required by the Commission from time to time. 46K. Regulations on broadcasting The Minister may, in consultation with the Commission, make regulations generally with respect to all broadcasting services and without prejudice to the generality of the foregoing, with respect to— (a) the facilitation, promotion and maintenance of diversity and plurality of views for a competitive marketplace of ideas; (b) financing and broadcast of local content; (c) mandating the carriage of content, in keeping with public interest obligations, across licensed broadcasting services; (d) prescribing anything that may be prescribed under this Part. http://www.nation.co.ke/oped/blogs/dot9/walubengo/-/2274560/2890270/-/y4ede… Recently the Communications Authority of Kenya (CA) announced that broadcasters would be required to allocate 40 per cent <http://www.businessdailyafrica.com/Corporate-News/CA-demands-60pc-local-TV-…> of their programming to local content. This is just the beginning. Within four years, the broadcasters are expected to scale this up to 60 per cent. What this means, essentially, is that local radio and television stations must find local content to fill up the space, currently dominated by Mexican soap operas on TV and foreign music on radio, across their 24-hour programming. There are two views regarding whether this is a good or bad idea. >From a government perspective, the push for regulation is meant to force media owners to invest in local production, rather than opt for the easier, cheaper option of buying third-rate soap operas from Mexico. In order to meet the 40 per cent local content quota, there must be significant production of local movies, documentaries, music and interviews among others, yet the ecosystem to support local production is not as cheap as most people would imagine. *HEAVY INVESTMENTS* For example, producing a movie requires heavy investments in both equipment and technical expertise, ranging from scriptwriters, actors and stage designers to editors, producers and distributors, among others. Furthermore, a 30-minute production may actually take three weeks to put together. Now think about producing such a series, once per week, four times per month and forty-eight times per year, and you will realise why most local stations may avoid sustaining local productions. It’s obviously cheaper to buy Mexican soap operas and fill up our airwaves rather than invest in local production. What the government is saying here is that cheap is eventually expensive, in terms of lost opportunities to fruitfully engage the youth within the creative industry. The alternative view to the local content policy is that current productions are of such poor quality that they would not merit any airtime. Furthermore, forcing stations to broadcast 60 per cent local content contravenes the liberal nature of our broadcast industry. Broadcasters want the liberty to choose what content to serve their consumers. *WHAT'S LOCAL CONTENT?* If consumers prefer Mexican soaps, so be it — after all it's their taste, their choice. No one should therefore purport to dictate what is good for the consumer by subjecting them to the so-called local content quotas. Besides, what exactly is local content? Would a film such as *The Lion King*, with its African theme, or *Out of Africa,* with its Kenyan theme constitute local content? What of the movie *12 Years A Slave*, in which our very own Lupita Nyong’o played a leading role? What about those documentaries on Kenyan wildlife that dominate NatGeo Wild on satellite TV? Do all these films qualify as local content despite their overwhelmingly foreign production? How are we going to determine what is local content, in other words? Will the decision be based on the theme, the script, the cast, the location, the production crew or mixture of all of the above? *MORE QUESTIONS THAN ANSWERS* Whatever the case, how will we stop Kenyans from simply switching channels — away from the local broadcasters whose content maybe deemed too local — and subsequently continuing to watch their preferred foreign content on other channels? This might effectively mean local stations will lose "eyeballs" and the associated advertisement revenue to the foreign competition, which in turn may mean we are losing rather than creating local jobs within the creative industry. Clearly, there are more questions than answers in the local content debate. However, one must remember that you can come up with local content without necessarily creating local jobs. The government and regulators must therefore think through the local content policy in order to ensure the job creation intended is actually achieved rather than frustrated. *Mr Walubengo is a lecturer at the Multimedia University of Kenya's Faculty of Computing and IT.
