Happy Monday! I pray many have found their steps in the real world away from the social sphere even as this fiasco hits many of our families and institutions. Firstly, I wish to point out and assert that the BAKE Press Release might not be accurate. Even if attempting to prove that blogging/social media is a 'good guy' here, might be spreading an online falsehood which BAKE cites it is against by citing that no bloggers or social media users were beneficiaries. Unless the press release means that BAKE has already followed the food chain for the proceeds, has 100% verified that the cited direct beneficiaries are not/have not been bloggers in their own spheres and do not hold any social media presence - has verified with the individuals or the host companies. A tall order I suspect this would be! I would understand attempting to say social media as a tool did not go into the bank and cash out or make the leaders act as they might have or that the entity wasn't a direct participant. Secondly, the social media boasted and was largely credited for the Arab uprisings. The uprisings had many effects, many negative including loss of lives, economic turmoil, most of which is still felt today. Even in the midst of this, what was the social media given credits for? - Bringing democracy, 'giving the citizens a voice (platform)'. This means that groups of people may choose the side of the coin to glorify or cling to based on their interests. Thirdly, I would imagine that when the first cheque leaf was invented, some ingenious (yes, innovative) people deviced their own in the backstreets. Due to this, the real inventors had to go back and extra innovate measures to build confidence for verification of cheques. Social media is sitting in this space now and this cannot go on for too long. Where is the real, veri-checked, authentic information to be found? Even as you and I become sources of information in 'public journalism'. How to ascertain that the WApp press release or video message circulating as from CBK, from Chase Bank, from IG is for real or the real one. Please do not even refer to the official website...some may already have duplicates, diversions etc. This not addressed, the online space will continue to be viral yes, msema kweli to some, yet mostly viewed as venom ground, active users with many followers cited to be paid, thus shrouded with suspicion and this kills the confidence it should be breeding as a tool that is actually a sector. Yes, it gives Government agencies whose work is to govern and hold public interests a battle ground which CSOs will keep calling 'muzzling of freedoms'. Finally, it would be exciting to have a study done on the influence of social media on the financial services sector and most recent happenings. It would be great for the Central Bank of Kenya to run this from the government point. And since a meeting of minds on findings with CSOs may not happen at the onset, CSOs from the industry insider Kenya Bankers Association to internet champions ISOC KE, KICTANET, BAKE to consumer bodies COFEK may proactively run their own. As 'mattress banks' and 'maize granary banks' mushroom, definitely there has been an impact. Some lessons that may be leveraged upon, while others avoided or managed early. I think people should embrace social media rather than complain about it. Social media is part of us and nobody has control regrading what it will spew out there the next minute. I can only compare it to a natural phenomena like earthquake. Why ISACA is cracking the whip on individual auditors

Dear Listers, On November 13, 2015 I wrote to the CBK governor Dr. Njoroge expressing concerns over the conduct of audit firms in Kenya. Top of my agenda was to instill discipline to the auditors in Kenya and restore confidence to shareholders over reported state of their business. This was as a result of the collapse of Imperial bank with blames pointing to weak audit practices and some sort of collusion. As you may know, I am the current President of ISACA Kenya the body that certifies and regulates IT/System Auditors(CISA). ISACA has a code of conduct for all it's professionals working in the cybersecurity, assurance, audit and risk management functions. All certified members know that they are required to adhere to strict ethical standards. That's why in the wake of the mounting blames on poor audits and in particular IT audits, as an association we are going to investigate individual auditors and recommend that they are struck off their title should they be found culpable. Further we are going to work with CBK to enforce that all IT/System auditors must be fully certified and also be in good standing with professional bodies ICPAK, ISACA & others. By holding individuals accountable will help eliminate instances of collusion and professional negligence in performance of IT/System Audits and give shareholders and the regulator a true reflection of their financial institutions. Dear listers, Today we begin our online discussions on digital privacy. By electing a government, we give it a responsibility to protect our security and in the course of that, they make policies by which our data is collected and used. Nanjira had shared a CIGI-IPSOS research (here <http://ipsos-na.com/news-polls/pressrelease.aspx?id=7159>) on digital security and trust done early this year which found out that: - 75% of Kenyans law enforcement agencies should have a right to access the content of their citizens’ online communications for valid national security reasons - 66% agreed that tech companies should not build technologies that prevent the law enforcement agencies from accessing the content of their communication. 1. Are ‘National security’ and ‘terrorism’ being used as a means to justify government breaches of security? 2. Is data collection proportionate and justified? And how secure are our government's’ information systems from other parties 3. How can the tech industry work with the government on security while ensuring people's right to privacy are not infringed? 4. What are your concerns on government collection of data and surveillance? 1 Billion People will Encrypt by default, thanks to WhatsApp & Open Whispers

Hello listers, As some may have learnt, WhatsApp has taken privacy to a whole new level today for over a billion people by integrating Open Whispers’s Signal end-to-end protocol to their platform. It will be a default for all WhatsApp users (upon updating to the latest version) across all clients. This includes chats, group chats, attachments, voice notes, and voice calls across Android, iPhone, Windows Phone, Nokia S40, Nokia S60, Blackberry, and BB10. Secure end-to-end encryption has been a preserve of a very small ‘cult’ of techies an early early adopters of privacy apps. Their usability has been a major hurdle on mass adoption. What this WhatsApp e2e integration does is to package privacy, usability and mass adoption in one update. As of Feb 1, WhatsApp had 1 Billion users <https://blog.whatsapp.com/616/One-billion>. It surely will draw questions from law enforcement agencies that will most likely claim their capacity to pursue criminals or terrorists in a fully encrypted mass communication channel. What we often forget though in most of these discussions is that privacy is the older brother of security. When fundamentally people are assured of their privacy, they can fully be who they truly are. e-Commerce is powered by strong encryption standards and this affords trust to an individual using his credit card online to buy from a stranger online. Security and trust are founded on privacy, and law enforcements should be on the frontline to fight for it. Be that as it may, this is a big moment for privacy on the Internet. Ethiopia and the Technical Control of OTTs

Jambo! Ethiopia’s only telco, Ethiotel, has announced it will be charging for VOIP services considering they are loosing revenue to the Vibers and WhatsApps of these world. They floated a Request for Information on the supply of Policy and Charging Control (PCC) and Deep Packet Inspection (DPI) mid last year: http://www.ethionet.et/sites/default/files/bid/RFQ-3209012.pdf <http://www.ethionet.et/sites/default/files/bid/RFQ-3209012.pdf> It seems the set up is complete and they will go ahead with implementation (http://www.addisinsight.com/ethio-telecom-charge-services-like-viber-whatsa… <http://www.addisinsight.com/ethio-telecom-charge-services-like-viber-whatsa…>). There have been network disruptions since last week on VOIP apps and some basic probes I did pointed to IP address blocking but whatever it is they are doing notwithstanding, this raises some issues here. The fight back from telcos against OTTs in the name of revenue/tax/infrastructure costs seems to have moved beyond policy. Technical capacity implies that debate is closed on their end. Ethiotel is a special case considering it is fully owned by the government and it is the only telco in Africa’s second most populous country (around 95Million people). It is easier for them to make decisions. For countries with more liberalised markets, and where government is a regulator not a service provider, could it be that the only impediment to adopting such technical capacities is government regulation and oversight? Could it be that Kenyans, for example, are charged to use WhatsApp but at a very negligible fee that no one notices? This moves beyond the market - it is a human rights issue. Consumers should not be punished for adopting innovations. Dear Colleagues, One of our international colleagues with whom we have been collaborating, attending ICT and Internet Governance forums, Mr. Nizar Zakka disapperaed in Iran about 6 months ago. Nizar is a director in WITSA and Regional Vice Chairman for MENA. On September 11, 2015, he received an official invitation from the Vice President of the Islamic Republic of Iran to attend a conference on Role of “Women in Sustainable Development - Entrepreneurship and Employment” in Tehran, where he was invited as a speaker, being an expert in ICT for Development. After the conference, as he was departing for the airport, on September 18th, to return back to Lebanon, he was held by Iranian security agents. Since then, he has been detained in Evin prison and to our knowledge, without due process, legal representation, or visitation from the Lebanese embassy in Iran, which are considered basic human rights and preserved under the Vienna Convention, of which Iran is a signatory. Apparently, Mr Zakka was also not allowed to be seen by his lawyer. More than six months have passed and we have indications that his health is faltering. Mr. Zakka started a hunger strike on March 13, 2016. I wanted to let you know about an important iPetition to free Mr. Nizar Zakka that has been brought to my attention by Mr. Salam Al Waeli, Director of Programs at the Arab ICT Organization (iJMA3).
