Listers, Article 4 clause (1) (e) of the proposed law states the Council of the proposed Institute shall consist of... "five persons of good professional standing nominated by the *Information Communication Technology Association of Kenya*" [emphasis added] which elevates ICTAK (a members' society) to the level of a statutory body! Clearly ICTAK is trying to entrench themselves into a legal body. Not good. With kind regards, Paul K. Listers, Has ICTAK failed to appeal to ICT practitioners’ interests as a society and resorted to legal regulation? I’ve seen similar innuendo coming from CSK (the Kenya Accreditation Agency Bill or something like that). They clearly don’t represent the entire ICT community. This is truly disturbing and not worthy the debate it has raised. Until this community of Techies starts speaking and acting OUT there, it is propagating injustice to the masses whose lives would be uplifted from their work. On the ground, we still have masses of people for whom ICTs in today's form is unreachable. Numerous applications of ICTs to our peoples way of life, still yet to be cracked and not the vice versa. The level of scaling of solutions designed is too slow and low. It doesn't have to be the case! We have the right people and skills, bring it on! Blessed Thursday! Greetings Sidney! I refer to your last para on existence of this community as the multistakeholder platform. I concur by saying it HAS GOT the potential, however it is not yet/not doing it; 1. Look at the contributions to the ICT Policy. If we consider this policy would be the gameplan and Kenya's gamechanger for the next couple of years - probably about 20pax, 40pax... lent their voice through this medium. Well perhaps others had other avenues Come the Practitioners Bill, and we have a good flood across all social media. Well this may be viewed to hit directly right at the bread and butter and the innovative future. 2. For the ICT Practitioners Bill circulated to have reached as far as it is now in its current state even if it were not from practitioners then "where was this community of practitioners"? This is a BIG question as this community has great Techies. Or it points to a disconnect with policy and policy making and as such something to work on. 3. Who is/are behind the Practitioners Bill? Every paper has a face of persons to it and the spirit behind it. That has not been raised here so as to interrogate/engage with them whether they are part of this community or not. I suspect we have barely had a scratch of the ICT potentials to jerk our country's development. I say again, yes the potential is there and this community would offer great service to the nation. I welcome the statement by CS Mucheru, clarifying the Ministry's, and the government's position that this private member's bill, introduced by Aden Duale, is at odds with ICT policy. What is not clear is whether the Ministry's intention is to kill this bill, or to subject it to modification. Let's be clear - this bill is an abhorrence to our hard-won freedoms, and should not go forward in any form. I would like to propose that KICTANET be formalised, with kictanet's original founders as the initial board, and be registered as a society with paying members. I'm sure others on this list, better qualified in such matters than I, can draw up an appropriate memorandum for such a society. If the membership fee is nominal - say, 500 or 1000 bob per annum - I think many 'ICT Practitioners' will join. Cheers, Tony -- Tony White

Hey Alex, Bwana Walu seems to have ducked "under" on this one, though my sentiment would be that, his oped at the time seemed to lean more on how to give the ICT fraternity a voice through representation at the national stage than what we seeing now with the proposed bill that seems to weigh in more on regulatory policing. Given the multifaceted nature of the ICT space, the worst the proponents can do is to sneak in such proposed regulatory frameworks without as much as subjecting the same to wide multistakeholder input. This could be counter productive, and in fact threatens to stifle the very space that opened up, got liberalized and has thrived for almost 14years and which, has been a catalyst and testament to some of the amazing innovative achievements and growth to date in this sector. So again, just like the wifi surveillance bill who initiated this..? Where was the consultative engagement..? Apple - Started by Steve Jobs who dropped out of college. 2. Microsoft - Started by Bill Gates who dropped out of Harvard. Paul Allen the co-founder was also a dropout 3. Facebook - Started by Mark Zuckerberg who dropped out of Havard 4. Dell - Started by Micheal Dell who dropped out of University of Texas. 5. Twitter, Square - The current CEO, Jack Dorsey who dropped out of NYU. Twitter co-founder Evan Williams also dropped out of college. 6. Oracle - Larry Elison dropped out of University of Chicago. 7. Plaxo, Napster, Airtime - Formed by Sean Parker who never attended college. He was also an early employee of Facebook 8. WhatsApp - Jan Koum, the founder is also a drop out of San Jose State University 9. This is sheer madness! We already have legislation (unconstitutional at that) requiring licensing of any kind of research (Science, Technology and Innovation Act of 2015, Article 12). Was this new dispensation aimed at regulating every liberty we have even those that are natural? Regulation always opens the door for bureaucratic abuse. This stinks of the same colonial attitude that prevented indigenous people from growing cash crops. Whoever came up with this bill was of the mindset 'if you can't innovate then ride in their coat tails'! Please can someone stop this madness?! As I said earlier, non-Techs will be there. Perhaps another classification within the broader "ICT Professional". *ICT Practitioners - sounds like a very broad term to attempt to compact and create shared guidelines/standards. On the said ICT Practitioners Bill - it seems that part of the issue is with regard to who is/are behind it. All in all, to have gotten a hearing, it means this is an organised group. Which is perhaps what this community might seek to engage with and build together before "shooting the innovator". Blessed day. Blessed day! I do not think the national ICT Policy and practitioners are related. Said "ICT Practitioners" would not be the "only" persons with interest or affected by the national policy direction. I am yet to read the Practitioners Bill shared. What I know is that professions have "practice " Marketers,and Lawyers, HR Practitioners, Electricians are registered against certain standards which include academic and professional development. At the same time, more often than not, the "expert" Electrician when cables fall of is normally streetwise and may not be registered - gets job done. On the ICT practitioners end, a shared definition on ICT Practitioner is required so as to have a coherent discussion. Otherwise kila mmoja anachangia mada yake, kwani hatushikilii maana moja. And if ICT Practitioner has no definition, perhaps the drivers of the bill may have been attempting to give it a face. Blessed day. What I know is that it is expensive for parents to perpetually pay fees before their (overgrown) children can finally get employment. It is also an additional cost to businesses as they have to foot the cost of compliance for the various professionals they employ or outsource. Finally, what are our legislative priorities in this sector? I would have thought the Data Protection framework is more urgent and maybe a Cyber Security one. While I did not intend to comment on the contents of the Bill, I can't help but notice that one ICT Association of Kenya will have the arduous task of appointing five (out of nine) people to the Council that will regulate professionals (Section 4). Pray tell, who is this association? To capitalise on the value of ICT, we may position as an enabler so that all sectors may be more efficient and in turn more productive to the national economy. "A prosperous Kenya"...leave to Vision 2030 which is already using this appropriately in its messaging. "A productive ICT-enabled Kenyan Society." Thus very clearly measures of the value of productiveness may come out of this. The "competitive"...perhaps seek the global positioning Kenya wants....versus use of the generic word. "A productive ICT-enabled Kenyan Society; making Kenya a (the) global innovator." Something in the league of hotbed of innovation. Since ICT is in continuous evolution. What I know is that it is expensive for parents to perpetually pay fees before their (overgrown) children can finally get employment. It is also an additional cost to businesses as they have to foot the cost of compliance for the various professionals they employ or outsource. Finally, what are our legislative priorities in this sector? I would have thought the Data Protection framework is more urgent and maybe a Cyber Security one. Kivuva +1, I think ICT in itself is a very disruptive phenomenon and also an environment that rapidly goes through incredible changes within a short period. I also think most people then can be regarded as ICT practitioners by virtue of daily use of computers, smart devices etc. As much as people go to school to learn it as a profession, most have earned skills through daily use of the technology and may not necessarily have a certificate to show. Therefore this bill therefore may not be well advised.
