Wow Andrew, It seems that is everyone's journey here until "recently" when Computer Science became a course in our universities. I am a "quack" as much as you are. I loved the story and all the best. So, Listers, this is my take. The problem is that the government has allowed tenderpreneurs to flourish in every sector, and the experts in the government, who ought to supervise, are compromised for various reasons. We are just feeling the heat now because we are in the way of the rent seekers. Look at our mechanical engineering sector and see the chaos caused by "regulation". Hmmm, There is no contention on the need for hard working, innovative "ICT practitioners" passionate about their craft. What is in contention is whether this is the right time to bring in regulation to the industry, not regulation of the practice. What we don't have, because the ingredients forming the industry are still changing rapidly is an ICT profession. Will there ever be an all-round ICT "professional"? Looking at human medicine, the human body is not changing, so one can standardise the medical profession, with known practices and various specialisations once the basic learning is done. It that it? We need to accept that ICT is in everything now. And it is entering mission-critical, life dependant places. And for a doctor who wants to carry out a remote surgical operation, the ICT professional helping him set up the equipment on local and remote site better be qualified in something beyond passion and innovation. Those don’t cut it at that point. The Wright brothers had no flying license. The pilots today do. I liken it to weaving a rope. At some points all the strands have to come together and form the rope. Are we looking at the quality of the strand or the strength of the rope? If it is both, then there are two different mechanisms at play. We need to separate those. If one is seeking a job we have enough international standards and certifications that guide ICT. I can own a medical institution and I'm an ICT graduate. Should KMPDB lock me out from their industry because I'm not a medical practitioner? It will not work trust me folks. It will not work. Dorcas You miss the point. Infact we are super concerned especially because these machinations are specifically targeting tenders. Why are you not answering the pertinent issues we have asked? 1. Who is an ICT Practitioner? 2. Who decides and what criteria is going to be used to ask and answer the above question? We are all for self-regulation. The majority of the malpractices are actually perpetrated by government functionaries who collude with TenderPreneurs. How then would you zero in on the so-called 'quacks'. Regards/Wangari Day 1 of 3: 2016 ICT Year in Review Feedback -Policy, Legal & Regulatory Issues Listers,(apologies for cross-posting) Thanksagain for those who spared time to provide feedback - so that the rest of uscan read and interrogate the same :-) Over thenext 3 days I shall share the feedback and basically hope to get furtherreactions from the floor. I attach the feedback document but withsummaries below: 1. Policy& Legal Feedback a) 52% of the respondents felt that the UniversalService Fund(USF) had not met its objective. 40% felt that it had to a moderateextent while 8% felt it had a very large extent. - CSOs tappinginto the fund; for advocacy, lobbying- Innovators - for groundbreaking research and solutions that others may ride on as enterprises a) 61% of therespondents felt that ICT Policies and initiative had not impacted thecounties. 23% of the respondents felt that these had moderately impacted thecounties, while 10% felt they had an impact to a very large extent.- CountyGovernments must take initiative to inbuilt in their services. c) 41% of the respondents felt that the multi-stakeholder approachbetween ICT stakeholders and government was moderately achieved. 31% feltit was not achieved while 25% felt it was, to a very large extent.We have seen public calls to ICT stakeholders by Government agencies- The Tech community contribution can do much better- CSOs are not at the forefront lobbying - perhaps may not have the capacity d) Policy/Legal Issues not yet addressed include: Cyber Crime /CyberSecurity Bill and its position in Senate and National Assembly, Data ProtectionBill, ICT Practitioners Bill, Privacy Issue Linkages between National &County Governments on ICT matters, Quality of Internet, Infrastructure SharingRegulatory FeedbackThe feedback loop can be improved2. Regulatory Feedbacka) 48% of the respondents felt that the question of affordable communications/internetpricing had not been well addressed. 30% felt that the question of affordablepricing has been moderately addressed while 20% felt it has been addressed to avery large extent.- CSOs who are best placed to lobbyfor this seem not to consider ICT as a frontier to venture into. They are stillfocused on the poverty areas where donors pump money of food, health, education- Donor support linked to the ICTs isnew frontier that entities like ISOC Chapter may champion forb) 68% of the respondents felt that the issue of dominance in the sectorwas affecting pricing of communication services to a very large extent. 16%felt it moderately affected pricing while 13% felt it was really not an issue.- Monopoly, oligopoly with a lukewarm regulator hand to players is notgood for the consumer. It is very good for the investor- The fact that the ICT sector is predominantly foreign-owned should be acontributor – with repatriation of profits and foreign versus local interestsc) 48% of the respondents felt that the urban-rural digital divide hadnot been adequately addressed while 34% felt that it had been moderatelyaddressed while only 7% felt it had been addressed to a very large extent. Urban-urban divide requires to get into the conversation. Consumers trust that the produceris in the market and certified because they offer a good product – which includesprotection from all harm- Might this be a factor in increase in cost ofsome services - Consumer education should be reinforced. Sorry for the cross-post but figured it will may make life easier for those compiling. Here are some thoughts on information infrastructure: *a) 86% of the respondents felt that government digitization (Huduma Centers, eCitizen portal, etc) program has been useful to a very large extent. 12% felt it was moderately useful with a very small minority1.5 thinking it has not been useful.* Comment: Digitizing operation has been a great idea. But is it widespread and consistently applied? E.g. getting an abstract at a police station means paying a certain fee for the photocopy usually available at the station’s kiosk. Yet if I go to Huduma Centre, I should get it at no fee and it’s a downloadable form. If I need to get the abstract over the weekend, I’ll pay for the photocopy at the station, yet I could have gotten it for free at a Huduma Centre. Government should therefore also invest in awareness programs that inform citizens about the digitizing of services, how to get them, what to expect etc. This can be done to grassroots level, and should include creative people like the Nakuru chief who tweets to residents in his location. Stability of the digitized systems should be guaranteed. ID replacement services recently had been shut down for several weeks at Huduma Centres because the system was down. At my university for example, I have many students bubbling with ideas for online content such as shows, blogs, information hubs, etc. But they’re afraid their ideas will be stolen if they ask for advice, they wonder what resources – financial or other – they will need, and sometimes they don’t know where to start. Content also is often the target of existing and proposed law, and even when it is encouraged (such as the CAK’s call for more local content on TV), it often seems to be most vulnerable to overzealous and sensitive authorities. The proposed Film Bill and pressures on bloggers come to mind. I think support should come from a variety of sources: government can provide a regulatory and policy environment that not only supports, but encourages the development of local content; government can partner with industry, academia and communities to raise awareness about local content, create opportunities for it, and enable creators to protect their intellectual work while getting paid for it. *d) 70% of the respondents felt that the issue of information security has not been adequately addressed. 25% thought it had been moderately addressed while only 4% felt it had been addressed to a very large extent.* Comment: I agree that information security is a weak point. I have questions about whether any of the digital information on our systems is well protected, whether it is sold to the highest bidder, who is watching what, etc. I have no solutions, but regulatory authorities and whoever else is concerned should consider that this is not just a technical issue, but one about trust. People may choose to do certain things on digital platforms, or to keep off, based on how much they trust the systems. d) The following were mentioned as key info-infrastructure interventions that have not been addressed/misaddressed: *Misguided/aggressive e-Content regulation maybe counter-productive to local content industry. Security surveillance without Data Protection Act is counter-productive. The Government Shared Service concept still not effective, particularly at County levels. Expand eGov Services to be accessible thro USSD, Improve the user-interface on most Government websites, enhance cyber security and offer public awareness programs on the same. * Comment: Let more digitization services start from the grassroots up, not from the top down. The tweeting chief in Nakuru offers an example of how a digital tool (Twitter) can be used to reach a large number of people (in his case, via sms) to address local challenges and provide information about local matters. Listers, (apologies for cross-posting) Thanks again for those who spared time to provide feedback - so that the rest of us can read and interrogate the same :-) Over the next 3 days I shall share the feedback and basically hope to get further reactions from the floor. I attach the feedback document but with summaries below: 1. Policy & Legal Feedback a) 52% of the respondentsfelt that the Universal Service Fund(USF) had not met its objective. 40% feltthat it had to a moderate extent while 8% felt it had a very large extent. b) 61% of the respondents felt that ICT Policies and initiativehad not impacted the counties. 23% of the respondents felt that these hadmoderately impacted the counties, while 10% felt they had an impact to a verylarge extent. c) 41% of the respondents felt that the multi-stakeholder approachbetween ICT stakeholders and government was moderately achieved. 31% feltit was not achieved while 25% felt it was, to a very large extent. d) Policy/Legal Issues not yet addressed include: Cyber Crime/Cyber Security Bill and its position in Senate and National Assembly, DataProtection Bill, ICT Practitioners Bill, Privacy Issue Linkages betweenNational & County Governments on ICT matters, Quality of Internet,Infrastructure Sharing Regulatory Feedback2. Regulatory Feedback a) 48% of the respondents felt that the question of affordablecommunications/internet pricing had not been well addressed. 30% felt that thequestion of affordable pricing has been moderately addressed while 20% felt ithas been addressed to a very large extent. b) 68% of the respondents felt that the issue of dominance inthe sector was affecting pricing of communication services to a very largeextent. 16% felt it moderately affected pricing while 13% felt it was reallynot an issue. c) 48% of the respondents felt that the urban-rural digitaldivide had not been adequately addressed while 34% felt that it had beenmoderately addressed while only 7% felt it had been addressed to a very largeextent. d) 65% of the respondents felt that the regulator had notaddressed the issue of inclusivity with regard to persons with disabilities(PWD). 27% felt this had been moderately addressed while only 5% felt it hasbeen addressed to a large extent. e) Areas needing RegulatoryInterventions: Operator Dominance Issues, Internet Pricing & Affordabilityissues, White Spaces, Operationalization of Universal Service Fund &Access, Failed Number Portability, Data protection for Subscriber Data,Conflict between regulatory bodies, Last mile connectivity and Way-leaves,Net-Neutrality, Support for ICT-startups, Support for Digital evidence incourts, Inclusion & Support for Persons With Irrespective of whether you participated in the questionnaire or not, you are invited to comment, support, oppose and/or seek clarifications on the views of stakeholders.Tommorrow we shall post the feedback on Human Capital & Infrastructure.

#GivingTuesday

Dear fellow listers, I hope that this email finds you well! Did you know that today is #GivingTuesday? This is a follow up to #BlackFriday which was started to get people into the Christmas spirit of supporting the less fortunate in our communities. Why do I bring this up? I am a lister that is particularly passionate about leveraging ICT for Development (ICT4D). In relation to this I'm a member of the Rotary Club of Muthaiga and we are currently running a campaign to collect 20 tonnes of food estimated at Kes. 3.5M by 12th December to take to Turkana. We have been running a water and community livelihoods programme in Turkana for the last 4 years with great success. Unfortunately due to delayed minimal rainfall people living in Liwan and Lobur especially are the most affected and are facing death by starvation. We have therefore started a mitigation campaign to collect and transport food to the people of Turkana on/ thereabout 12th December 2016. I am therefore appealing to all of us/ our companies to please help us get to our target by either donating food or cash; tweeting/ using our social media platforms to generate awareness or linking us to any individuals or companies interested in partnering with us. For food donations, dry food stuffs are preferred eg unga; rice; lentils etc. Transport to collect the food can be organised for free at your convenience. If possible you please drop it at Mayfair hotel/ Southern Sun westlands on Mondays at 6-7:30 pm which is when we meet and you'll get to meet us and hear more about the campaign. >From the findings, my few comments on c) 40% of the respondents felt that tertiary institutions were,to a moderate extent providing the requisite skill set for the ICT industry.34% felt they were to a large extent providing these skills while 24% felt they were not. Comment: Tech and specifically the ICT world is an ever evolving realm, and while therre are basics that remain constant, the institutions have the responsibility to introduce these basics and as a plus, engage the industry directly so that there is synergy and so that somehow the students come out of the labs co-established and supported by the industry such as the specialty labs with coding/startup ecosystems with skills hat can be arbsored directly. Does the millennial factor play a lot in this agile system, i think yes and is it time to consider the millennial factor? e) Provide general ICT literacy programmes to the public, Codingas a skill to all students ? irrespective of discipline, Continuity ingovernment offices (rather than sabotage of previous holder initiatives),Improve Academia- Government-Industry linkages, Cryptography training, Identifyand support Technology Universities, Promote Incubation Center, Have mechanismsto weed out ICT quacks, Provide ICT scholarships, Standardize ICT Trainings,Digitization of key services - police occurrence books, land registries shouldbe availed to the youth. Comment: Digitization of all these legacy systems is a goo start, utilizing the digitized systems should be improved so that efficiency is achieved. Incubation centers are great to the extent that actual output can be measured. Dear All, My apologies for cross posting. I am looking for someone who can give independent analysis of the recently launched Ajira Digital Program, which was rolled out by the ICT ministry yesterday, and which aims to introduce Kenyans to online work, and provide the tools, training and mentorship needed to work and earn an income. This would be a quick live television interview today at about 2.10pm about five minutes from I and M building in the city centre? It would dwell around what this means for youth and just how this will jell across teh entire country with the proposed digital hubs.
