Dear colleagues The Association for Progressive Communications (APC) is developing an action research network focused on ICTs & Environmental Sustainability. The initiative builds on work in this area undertaken by APC and its member organizations in the last few years. An important part of building the Action research network is to build stronger relationships with others who are active in the field, to exchange information and build collective knowledge and work towards common actions. To this end, we would be interested to learn about work your organisation is doing in this area. We are particularly interested in initiatives in the following areas, in the context of ICTs & Environmental Sustainability: - policy advocacy - environmentally-sustainable computing practices - use of ICTs for awareness raising and education about ICTS and environmental sustainability - use of ICTs in climate change (CCH) mitigation - e-waste disposal and CCH The outcomes of our research and activities will be made available to all who are interested. If your initiatives cover other areas where ICTs play an important role in environmental sustainability and climate change (or dealing with it), do let us know as well. On the creation of awareness on the fibre infrastructure, isn't it time some slotted this into the science education syllabus so that right from primary the children know what fibre optic is just as we did copper wires. This will achieve two things, bring up an informed generation next. Another wasted bumper harvest

Hi, Yet again we suffer from a lack of information, farmers are pouring milk because the dairies cannot handle the increased volume and on another front maize is rotting in the shambas because NCPB do not have money to buy the maize due to an unexpected bumper harvest. I could understand the increased milk production as it could have been sudden but how is it that we did not realise, in good time, that there will be a bumper maize harvest. Well, application developers can we get out an application that can help the government and millers be better prepared for a good or bad harvest or are we waiting for 3G connectivity or a 3rd fibre optic cable to land before we can role out such a product. Even Joseph had a prediction system that saved Egypt from extinction yet he did not have a high speed Internet link nor a 3G mobile phone and definitely not an IPAD. Lets apply ourselves to solving this basic issues instead of lamenting about a lack of 3G infrastructure, this is a challenge to the strathmore, IFC and other incubeter initiatives as well. I believe that self- criticism is symptomatic of defeatism, however that which is done in moderation is healthy. In due regard I would urge my colleagues to make do with that which is available to the maximum. Optimal resource utilization would go a long way in rooting out existent problems e.g. improved revenue collection by the city council of Nairobi. More over I would reiterate by borrowing a leaf from a former US statesman who ranted , “do not ask what your country can do for you rather ,what you can do for it” end quote. The Tigers(Malaysia etc) made progress by developing customized local solutions adaptable to their contexts. Thus this case studies serve as a motivation that not all is impossible. Last but not least not all is lost as Obama deftly put it , “YES YOU CAN.”These produce could be sold in the wider COMESA market , all you need to do is provide effective structures and let the laws of demand and supply manifest. In the Kenyan debate specifically, I would find it counterproductive if senior government officials openly call for patent right infringements (and again, Dr Ndemo did qualify his statement). Apart from the fact that I'd rather like to see innovation encouraged, it does nothing for Kenya's image towards international ICT and tech investors or people looking to outsource processes. Copy right and patent infringement and intellectual property right theft was and is a big concern in China, and Kenya has none of the advantages that China offers to offset these: very low-cost manufacturing environment and a huge domestic market. It's a bit of a contradiction to call for e.g. certifications etc to build international credibility, and then offset it with a signal like this. On the IPad specificially: I doubt that Kenyan companies, even if they managed to copy the IPad, would be able to build it at a lower cost, and the way the education sector is run now, they'd be stolen just as quickly as any book - probably faster. I went to the Intel Classmate launch a couple of years ago and they made a useful point that just handing out kiddie laptops is not the solution: You need the whole ecosystem to make them productive. Electricity, connectivity, a place to lock them up, and importantly a teaching plan that they are integrated into. Listers, Can someone please let me know why with all the ICT brains in Kenya, Government Receipts are still issued in longhand using carbon paper! Without for a moment suggesting impropriety on the part of anyone currently using long hand, one suspects that, if the process is automated, revenue will rise significantly. After all, how does one know that the seven (7) in the customer copy of the handwritten receipt is not accounted for as a one (1) in the duplicate copy. Add zeros to the figures and see what effect it can have (7,000 = 1000; 70,000 = 10,000 etc). Imagine the resultant reduction in taxes. Do the government accounting officers not want to have a dashboard on their computers where they can see revenues coming in in real-time. My solutions to this quagmire. Complaining does not solve anything. It only makes things worse as people would be emotionally stressed to make any meaningful debate. As someone has put it, those who use Thika Road, will have to wait until 2011 to enjoy the benefits of the Super highway under construction. So that means patience. Secondly, only use your vehicle if it is necessary. If you choose to drive and your neighbour does the same, traffic will be unnecesary. The same applies to coming to Nairobi. Do you travel there as a matter of choice, convenience or reason? If in self-employment, ask yourself whether it is necessary to come to Nairobi - assuming you do not stay in the city. You see my friends, there is a need to know why a problem exist so as to find the solution. The last master plan of Nairobi was done when Dr. Gitu was the PS or Director at the Local Govt. Ministry and, it never saw the light of day, unfortunately. Solutions are within and the govt. acts as a medium to reaching the solutions. I rest my case! India's Outsourcing Exports at US$50 Billion

All is not lost, and against all critics.we can still get a share of the pie (http://www.pcworld.com/article/188514/indias_outsourcing_exports_at_us50_bi llion.html) India's revenue from exports of IT and BPO (business process outsourcing) services is likely to grow 5.5 percent to US$49.7 billion in the Indian fiscal year to March 31, 2010, according to estimates released Thursday by the country's National Association of Software and Service Companies (Nasscom). The revenue figure includes exports by Indian outsourcers as well as by Indian services and software development subsidiaries of multinational companies including Microsoft, Dell, and Oracle. Nasscom has forecast higher revenue growth in the range of 13 to 15 percent from IT and BPO exports in the next fiscal year to March 31, 2011. India has emerged as a key supplier of IT and BPO services to customers in the U.S., U.K., and other markets. Its business was however hit in the fiscal year to March 31, 2010 by the recession in some of these economies. The growth rate of 5.5 percent estimated by Nasscom for the year ending March 31, 2010 is far lower than the 16 percent estimated by Nasscom for the previous year. The 2009 figure is still an estimate as the results of Satyam Computer Services, a large Indian outsourcer, are still being re-stated, after a financial scandal at the company. Top Indian outsourcing companies like Tata Consultancy Services (TCS), Infosys Technologies, and Wipro said in January that they were seeing an improvement in demand for their services from customers in key markets, including the U.S. Indian outsourcing companies have also started hiring in large numbers again. Wipro's IT services business added 4,855 staff in the quarter ended Dec. 31. The company had cut staff by 630 in its IT services business in the previous quarter. TCS said in January that it is adding about 11,000 staff in the current quarter, including 8,000 trainees. The company added 7,692 staff in the quarter to Dec. 31. Direct employment by the country's IT industry is expected to be 2.3 million by March 31, 2010, with over 90,000 jobs added during the current fiscal year, Nasscom said. A number of new large IT services deals are expected to be signed by the second quarter of this year, Sudin Apte, principal analyst at Forrester Research, said in January. Indian companies are however not likely to achieve soon the revenue growth levels they had before the recession, he added. A lot of the expenditure by customers still falls under the category of necessary expenditure, with discretionary expenditure on IT services likely to start by the middle of this year, according to Diptarup Chakraborti, principal research analyst at Gartner. Besides a pick up in exports revenue for the year ended March 31, 2010, Nasscom is also expecting a growth in the domestic services business. Domestic revenue is expected to grow by 12 percent to Indian rupees 662 billion ($14 billion). Local Content: Cost of Local Hosting

Bandwidth costs seem to be coming down and that's welcome news. However an important area seems to be largely ignored and that's the cost of hosting locally. A Dedicated server in the U.S/Europe (8 Core Processor, 6GB RAM, 3,000GB Bandwidth, 500GB disk space, ...) costs about $500/month. I believe in Kenya that would cost about 8-10 times more and that's without the 3,000GB bandwidth. With bandwidth becoming cheaper and better quality, it's far cheaper to host the local content internationally, and end-users might not feel a big difference in speed and quality. Factors leading to high hosting cost might be cost of physical space and electricity (highly priced and unstable). If these are the major reasons why hosting costs are high, then we cannot expect the cost to come down any sooner no matter how many fibres are coming to Kenya. Local companies (e.g. BPOs dealing with large volumes of data) and local branches of international companies looking for secure off-site back up might also do it from internationally located servers, where the companies running those servers not only offer lower cost but also more experience which leads to better service. As one of such companies puts it ,"98% of replies within 30 mintues, 99.9% Network Uptime Guarantee, ...". Therefore we are looking at a situation where local content might be hosted internationally. 8~!

Yeah you're right, KDN's virtual server costs are close to overseas costs. (Open question) In Kenya, what would be the monthly price range for the following dedicated (not virtual/shared) server (no setup costs, no service charge, no bandwidth, no taxes, etc) If the price is at least 3 times compared to what I listed below, what factors lead to the price (high energy costs, ...)?: 8 Core Processor, 6GB RAM, 500GB disk space. Zuku does @ KShs 4,500 (VAT Inclusive). Was surprised to experience up to 800 kbs on Zuku this week. It is shared bandwith so that was a treat that should be more consistent. Zuku also seems to have a problem (possibly due to their server side configurations) which register only one MAC (pc hardware) address to connect to to their side. Could be wrong but this locks out other PC's on a LAN. It does not seem intentional as they are willing to rectify the problem when it is brought to their attention. Is KDN's KShs 4,000 offer VAT inclusive? Customer service is very poor in all our ISP's so individuals would be wise to expect worse than Corporates experience. KDN never responded with a (Site Survey) to mail, phone calls and a visit to their offices so Zuku is better for individuals and SME's that have 2 or 3 weeks to wait for them to set you up. This is better than no response at all. Zuku have the best offers in the market and are flooded with more installations than they can handle. This means getting support can be a 2 to 3 week issue but their connection (connectivity) is not too bad where they have good signals. Orange EVDO (Internet Everywhere 3+) is stable if one is not too far from their BTS. Zuku is a much better deal for unlimited downloads but gets slower or faster than EVDO depending on Network conditions. Orange ADSL has been messed up (limited) by the Orange 'Fair Use Policy'. Their Livebox modem leaves a lot to be desired and needs to be continually reset as it keeps dropping signals. It also often does not pick up signals which are restored after fiber & copper cuts. Suprisingly Orange is improving their Customer Service to follow up on their degrading ADSL Internet Service. Limiting Kenyans to 2GB (256kbs @ 3K), 4GB (512kbs @5K) and 8GB (1 Mbs @3K). Looks like the GoK sold our infrastructure to foreigners who limit their bandwidth usage in other nations (including their UK neighbours) except in France. Orange is least stingy in France. For data avoid Safaricom if you can. Certification should not be the only drive. We should encourage people to take up software development as a career up to and including in high schools. The fundamental blocks here are the access to the developer tools and training manuals / e-learning material. Certification can happen later for most, but key is to be able to write software, and this will get them a leg in a software company after which they can pursue certification. *Certification Process Development**:* Paul’s discussion touches on working with leading IT companies and academic institutions and this is the best way for creating that critical mass of skills. For established local software companies that want to showcase their maturity in the full Application Life Cycle Management, there are also international certification programs available. A well adopted one is the Capability Maturity Model Integrated (CMMI). In fact there are studies showing that this is the reason that India has been quite successful (see article http://archives.infotech.indiatimes.com/articleshow/836340.cms) even though they are no longer a cheap destination. This certification acts like a guarantee for quality, which is critical in this industry. I see the ICT Board’s value here as making CMMI or similar level certification available locally at a much reduced cost (It is expensive currently as the consultants to evaluate are not based here and could involve several trials and getting to CMM level 5 could cost upwards of USD 50K currently). So I support the boards drive to have a local center in the same line as Joburg Centre for Software Engineering to help with this. The number of companies with this certification will increase with the right support and that can be used to start branding Kenya as a software outsourcing destination that has software quality in mind. No need to create anything local; just to make what is internationally available is cost friendly and accessible. Finally, I think one other thing the ICT Board could try to do is to support with connections to venture capital. I feel it may be a challenge for most software entrepreneurs to access capital (and most times not much capital is needed as this is people business) to grow and expand or even start operations, and even though we may have the youth fund locally, The fund is not IT Specific and software entrepreneurs compete with many other business, probably putting them at a disadvantage. IT Specific funds can help especially if they can be disbursed with the advice of the ICT board. This is to enable us to adopt a globally certified software development methodology and certification for generic software development. This is Most software developers in this country would benefit from the establishment of a higher standard of code development. Most software firms would benefit from access to international certification in process and methodology which is otherwise very expensive. Good example is the project in South Africa at the University of Wits with the Joburg Centre for Software Engineering. http://www.jcse.org.za/. We had spoken to them about partnering as well, but opted for this option. The suggestion you make is not an alternative, but another important strategy for achieving a more enhanced IT services sector and it is actually one that we have given much thought too. We are seeking the funding to do as well. Just this morning I have had a meeting with Symantec who are beefing up their presence in Kenya. Some of the discussions we have had go along the same them as I have had with many other multinationals who visit us often. 1. Many Kenyan business owners in IT services are afraid to make the investment in top talent certification despite the obvious returns because the certified employees often flee and are 'unbondable'. As an example it costs close to 10,000 USD to certified a top Cisco engineer who can then earn that in a month with some experience in any market in the world. 2. To develop Kenya's ICT credentials we will need to develop more certified engineers and experience consultants across the board, and across various technology platforms. We need technical implementation people, but we also need systems architects and experienced solution designers who can interpret business problems and convert them into an IT specification. Those who have been the industry for a while will attest to the fact that although we have a growing Kenyan pool, still many large IT systems in banks, major multinationals and other large organizations have substantial input from consultants from outside Kenya. This is for various reasons and is not unique to Kenya. At the very top level of talent in IT, there is a global shortage. 3. To build Kenya IT properly, the investments in all the right places need to be made. As we spend more on IT as a country, the demands becomes even more sophisticated. For example, with the current connectivity transformation, there is need for security, network, data center engineers and consultants. Without any research, one can attest to the frustrations experienced by some on their networks even currently. This is an opportunity for entrepreneurs. 4. When we sell the country as an outsourcing destination, all these things matter, the whole ecosystem including marketing, training, depth of experience, breadth of experience, industry culture, government policy, legislation, peer recommendations by companies based here, and indeed the nightlife. The reason why we think it important to provide the software sector with greater tools is because this sector is often made up of young brilliant entrepreneurial individuals who leave college sub-optimally equipped for commercial application of their craft. They then have to fend foe themselves and then some of them will develop into good engineers while many other others will pick up bad habits in who they write software. These bad habits become the industry norm and then define our sector. Standards are critical. I have received many direct emails and I thought I might want to respond to one publicly and BCC the gentleman who raised the issues. Thank you for your email. My answers are in red. 1. Scope of the project-Is it meant to cover software alone or how does it integrate other pertinent aspects of ITES & BPO A. yes. for now certification covers software development both for individuals and for organizations developing software. without pre-empting the procurement process, this standards may take the form of certification for process methodology. This basically means that once you have certified the method by which the firm or individual writes his code, you can vouch for the standards of the underlying code. One of the challenges many projects have locally (an indeed internationally), is that the software designers dont document what they are doing and you are left at their mercy once they have finished, another challenge is most projects dont allow for testing the code or the software that is written. Others because the same person who wrote the code has the responsibility to provide final test results for it. Indeed software development, document and testing is often outsourced and provides an interesting outsourcing opportunity. There is another project on the establishment of a BPO centre of excellence centre which is under way. 2. Character of the project- Does the board intend to entirely transfer the certification mandate to a private enterprise. Why not remain at the centre to guide and oversee progress with intermitent consultancy support? B. The thinking is still open on this. Candidates for this consultancy may well be educational institutions who can collaborate with local institutions for a long term capacity transfer. In the case of South Africa, this is housed at the University of Witwatersrand in a semi-autonomous arrangement known as the Joburg Centre for Software Engineering. http://www.jcse.org.za/. This particular one is a 3 way partnership between academia, business and government and has a much more enriched mandate than we are envisioning initially. 3. Duration- 2 years are grossly insufficient for all the tasks envisioned. Certification can only work successfully along a continous time plan. Some assumptions cited within the terms list are meant for fun. eg the testing targets for 200/500 developers. Supposing no one turns out for those tests where will liability rest? Or are we assuming that people are extremely looking forward to those tests? This is true. The project just gets us started with the funding available. We forsee developing a more long term project as indicated in 2. These have to be multi-year commitments. 4. Degree of stakeholder participation- Certifications are life and death issues because they determine whether you qualify for the pay roll or not. Such matters can not be left to private investors. As indicated in 2 above, a partnership model would take care of this. I certainly share the view, However well regulated private investors can mitigate these risks were we to take a private sector only route. 5. Integration of existing efforts- This project may not necessarily have to start from scratch. There are multiple instances of related efforts which just require some little fine tuning. I am happy to convene a stakeholder discussion on this issue, (and all the wider issues generally). We shall seek your assistance. The consultants terms of reference will however include establishing the state of play in the market. We can augment this with other inputs. 6. Span of resources and their source. How much worth of Kenyan currency is at disposal for this activity. What other options can be considered using the same towards the goal in question I will confirm this here later. Other options include setting up a specialized unit at the universities, adding this to university curricular. Any other suggestions. Actually all these are also things must be eventually done. 7. Outcome- Is the final product meant for the local market or the foreign one. There seems to be an unfounded assumption that once we embrace foreign standards international business will come looking for us. Is the emphasis on the soon to be papers or on the skill quality they will trigger? Excellent question. We do need better standards in everything. (An example here is the quality of Masonry, or Carpentry. Is the issue that we don't enforce standards or that at a basic level, we have lost the reference to standards in the first place?, or is it that Masons and Carpenters with half backed skills have been allowed to proliferate the industry? or even perhaps all the above!). Because we all committed to developing a world class ICT sector, the attitude towards the basics must be that everything matters. This is a sustainable approach. ICT is a human capacity sector. 8. Given the critical nature of standards and certification, wouldnt be more prudent for the Board to invest in a full fledged department that will handle the pertinent matters in that dimension. Waiting for KASNEB, KBS to set the pace for ICT certification and standardization can be deemed as inertia on the Board's part. As far as ICT standards are concerned the Ministry is already working on various dimensions as you may be aware. The Board's role here is very project specific in order to meet the BPO /IT enabled services sector growth as outlined in the Vision 2030. Honourable Members, I was just having a chat with a good friend who is a web developer over the issue of online payments. I realised paypal is common but the procedure and processes involved seem to be too complicated despite the fact that it is an important medium for online transactions globally. Does anyone has an idea of how we can encouarage local banks to interface with such systems to facilitate online transactions instead of the difficult route being undertaken currently, better still can mpesa be a viable option. Listers, Can someone please let me know why with all the ICT brains in Kenya, Government Receipts are still issued in longhand using carbon paper! Without for a moment suggesting impropriety on the part of anyone currently using long hand, one suspects that, if the process is automated, revenue will rise significantly. After all, how does one know that the seven (7) in the customer copy of the handwritten receipt is not accounted for as a one (1) in the duplicate copy. Add zeros to the figures and see what effect it can have (7,000 = 1000; 70,000 = 10,000 etc). Imagine the resultant reduction in taxes. Do the government accounting officers not want to have a dashboard on their computers where they can see revenues coming in in real-time. Michael, Would it be possible to have a safaricom dedit card with visa or Mastercard via Mpesa? Kenyans are slowly accepting plastic as a means of payment. With mobile banking, we have to go through the bank to transfer funds or receive funds, however if consumers were able send money directly to a safaricom debit card, we could eliminate the extra cost and time of routing money through a bank. Additionally for the Mpesa users who may want to pay for a dinner at a restaurant or in the middle of the night or even buy a plane ticket can simply swipe their safaricom debit card for easy payment. Thank you for your questions. many have written to me directly to seek clarification. I have received a flurry of questions on the status report and I will respond to those that are of a recurring nature directly on this list while pointing listers to the website www.ict.go.ke for more information and updates on aspect of the projects. * * *Objective of the assignment* The objective of this assignment is to recruit a leading international academic institution or standards body to develop and implement an internationally recognized and sustainable software developer certification program (Certification Program) for Kenya. The Certification Program will have multiple components, including content and processes for local software developers to prepare, register and be certified; an Internet enabled credentialing program; and an initial pilot testing, evaluation and fine tuning of the Certification Program. The program should be underpinned by a sustainable business model.** * Scope of services* i. *Inception Report and Business Plan:* Provide an Inception Report that contains a description of start-up activities, the detailed work plan, methodologies, and an estimate of the time allocation for involved personnel from both the Government of Kenya and the organization’s team. In addition, to provide a business plan that spells out the resources to be deployed and the results proposed to be achieved. The business plan should also propose long term, sustainable business model options for the Certification Program. ii. *Content Development:* Develop appropriate content for certification in close collaboration with relevant partners; including leading international and local IT companies, academic institutions, governments, international standards bodies and industry/trade associations. The developed content should have their explicit support in terms of relevance and quality, be based on the latest technologies and extensible to address the major languages (C, C++, Java), operating systems, language combinations, and software development tools and environments. iii. *Certification Process Development: *Develop an internationally recognized, authentic, secure and valid process for software developer certification. This process should be developed in consultation with leading IT companies and academic institutions as well as have the buy-in of at least two industry associations of established countries in the area of BPO, and two countries aspiring to establish themselves in this domain. Countries should be chosen to be representative of at least three regions out of the following: Latin America and the Caribbean, Europe and Central Asia, Middle East and North Africa, South Asia, East Asia and other parts of Sub Saharan Africa. In addition, the processes should be based on proven experiences in similar certification programs. The testing process should be representative of real-life, professional software development. The examinations should also be refreshed annually; and extendable to address the full software development life cycle (including post-deployment maintenance) and modern issues (including the development of secure software systems). The examination must be developed using recognized techniques for validation and verification of quality. Linkages may be established with one or more organizations with leading testing and certification mechanisms to ensure that the certification will be conducted in a secure and proctored setting. iv. *Provision of Internet-Enabled Credentialing Program:*Provide a web-enabled credentialing program, including functions for online registration, preparation and certification. v. *Piloting:* To pilot the Certification Program with an initial batch of at least 50 enrollees, comprising of local software developers who should be benchmarked against a control group. vi. *Evaluation Reports:* Conduct an evaluation of the pilot to prepare a detailed report to recommend strategies and action plans for improving the Certification Program. An evaluation should also be conducted on gaps and weaknesses in software development skills, so as to recommend changes in curriculum and pedagogy required as part of broader education reforms in Kenya. vii. *Program Refinement and Local Capacity Building:* Refine the Certification Program based on the agreed recommendations of the Evaluation Report, and develop capacity within the country to conduct the assessments for certification. viii. *‘Live’ Rollout:* Commence ‘live’ rollout of the Certification Program with assessment of certification by local institutions, with the target of testing at least 200 local software developers. In addition, to obtain the commitment of leading companies operating globally and locally to use the results as a necessary pre-requisite for their hiring decisions. ix. *Mass Rollout and Marketing, and Business Model Implementation: *Implement mass rollout and marketing campaign for the Certification Program across Kenya, with a target to test at least 500 local software developers. In addition, to implement a business model for the Certification Program that is internationally recognized, financially self-sustaining and affordable for local software developers by the end of this consultancy service (24 months after contract signature). A final report is to be prepared to highlight the next steps to be taken by Kenya for the Certification Program, including future steps on training content development, certification process and local capacity building. Thanks Mwende, Your views capture the intent of the society. Our membership is quite varied, there are those players that indeed are focused on getting business - "onshore" (Kenya); "nearshore" (east and the larger African continent) or "offshore" (EU and North America) or a combination of the above. The society's strategy then has to incorporate all these aspirations. The onshore market challenge is that of lack of sensitization, most local companies do not see clearly the benefits of outsourcing their non-core functions. Most BPO/ITES startups lack the capital to effectively do this(and there are many reasons to this), which is where the KBPO Society and the government come in. Capacity building to address the above models must be there and it need not only focus on local business but international as well. For example, the EU (in particular; Netherlands and Denmark) have expressed strong interest in partnering in ITO, we cannot afford to ignore these. Key partners in the US and UK have expressed the same. We are not focusing on stealing the market share from India, but from the global outsourcing market; local outsourcing marketing being a part of it. Mwende, KTDA and the society (members) can work together in developing this local market. Hi, It was sad to read about the KQ pilot who was robbed on Uhuru Highway and later died from injuries inflicted by the thieves. This is an opportunity to kill many birds with one stone. I want to make a proposal to all parties out there that we turn the entire mombasa rd, Uhuru Highway and Waiyaki way into a digital super highway. How you ask? We have fiber optic cable laid along the length of the road from Athi River interchange to the Limuru Interchange. Then install solar powered wifi equipment and web-cams atop the street lights and also on any building with a fibre node along the stretch. The WiFi will turn the whole of the road into a hotspot which will enable tourists to use their WiFi enabled phones as they drive from & to the airport as well as business traveler and Yawe. Through the link we can feed country specific information such as weather, animal sightings, culture etc. In addition the links should enable the mounting of multimedia display boards along the road that can have content streamed to them remotely. This two areas will provide the revenue for maintaining the infrastructure. Traffic information can also be provided through the display boards to enable drivers decide if they want to remain in the jams especially when the president has been allowed out of statehouse. With the webcams the police will have a better view of what is happening on the road and can fine errant drivers such as the matatus that obstruct at the Shell near DHL. We can also connect the traffic light controllers to the police allowing the lights to be controlled remotely therefore leaving the extra traffic policemen to be redeployed. I have provided this information with no non-disclosures anyone out there who can pick it and run with it is welcome to do so. Hi, I notice the 3G discussion has come to an abrupt end, as usually, but I feel I need to share my frustration with all the GSM providers. I live in South C but frustratingly I can only use my phone (Safaricom, Orange GSM & Orange CDMA) from a particular corner of the house, if this is the service available in Nairobi how much worse is the condition outside the City. Many of you raised concerns about the 3G license issue and I said this should not be the issue, CCK needs to enforce service delivery levels for the GSM providers. I am forced to carry 4 modems with me if I am to get any miningful work done when I am at home as the providers services are erratic. As I write this the Orange Internet Nowhere service is offline. My Safaricom bambanet working but only working at edge speed, it normally would not work at all but I found a solution by purchasing an external high gain antennae. The other providers modems unfortunately do not have a facility for plugging in an external arial. CCK can you please do your work of monitoring the network operators performance, if you cannot monitor this in Nairobi how will you be able to do it nationally. Maybe we should devolve CCK. Analysts say last week's launch of the country's first electronic payments system may not have an immediate effect on the budding e-commerce industry citing the pricing structure that I&M Bank and Visa will offer the retailers. That pricing will determine profit margins for online sales - a key ingredient for e-commerce. For many Kenyan e-commerce retailers, card use translates to higher transaction charges and reduced profit margins. But for smaller firms that generate lower sales margins, hefty payments to Visa may force them to hike prices in order to make profits. "This is an unnecessary expense for us. Our margins are small enough that this has a significant effect on our bottom line. It will also involves a much higher level of security and protection to safely use credit cards for online transactions and that administrative cost is too high for us," said Mr Faulkner. In Kenya, alternative payment systems have been gaining popularity as consumer demand for different payment avenues, other than credit cards, intensifies. Online retailers say Kenyan consumers have been shying away from credit cards in favour of cash on delivery or mobile money transfers.And as security concerns surrounding e-payments increase, some online retailers are turning to outsourced payment processing companies such as Pesapal to manage their e-payments. A poll of e-commerce outfits reveals that the most used payment system in Kenya is cash on delivery, which accounts for 70 per cent of on-line purchases. A growing number of payments (around 20 per cent are made using M-Pesa or Zap, a segment that many industry insiders believe will grow as more consumers get online using their mobile phones or computers. With eight million users already on the system, M-Pesa is gaining ground as the cashless currency of choice because they offer instant payments at rates lower than those charged by banks or credit card vendors. Only five per cent of online purchases are paid for using credit or debit cards which two million Kenyans have access to. (from Balancing Act) National survey shows Kenyan Internet market heading towards “critical mass” The latest national survey from market research company Synovate shows Kenya’s Internet market is growing fast and on the basis of this growth will soon reach “critical mass”. The growth in users is coming from both urban and rural areas and is predominantly amongst the young and well educated. Russell Southwood pored over the results. The total sample for this random survey was 1,500 people, with 500 of those in a boost sample from across the major districts of Kenya. Therefore the coverage is nationally representative of adults 15 and above and has a sampling margin of error of + or – 3%. It makes comparisons with a similar survey it carried out in 2007. On the basis of this sample, Synovate estimates that there are now 3.5 million Internet users in Kenya. However, daily Internet use has grown from 2% of the respondents in 2007 to 5% in 2009 and weekly use from 5% to 12% over the same period. The daily use figure is the crucial one as it shows users who are finding that that they cannot do without Internet services. If the weekly Internet use is broken down on an urban vs rural basis, urban use grew from 22% of respondents in 2007 to 30% in 2009. Rural use grew from 4% to 9% over the same period. These results confirm a lot of anecdotal evidence that has been reaching us about young people using the Government’s new Internet centres and cyber cafes in rural areas. The lower income groups recorded a much more fast paced growth in internet access. However Internet penetration within middle class and below is still very low, making it the group with the highest growth potential. And following the expected drop in Internet costs LSM 4-10s should provide the highest growth in usage. At least half the non-users across all social categories said they would be interested in using the Internet if they had access. In terms of age, 50% of the respondents using Internet were aged 15-34 with 21% in the 18-24 age bracket. The upcoming generation of Kenyans will be regular users of the Internet and it will form as much part of their lives as mobile phones. Over 56% of the Internet using respondents were college or University educated. Therefore those countries with better education levels in Africa will show markedly higher Internet penetration levels. On average, the Internet users in the sample spent approximately 70 minutes on the Internet per visit. This level of media user is close to the average time spent on television on daily basis but does not challenge radio use which is much higher. This will inevitably impact on the media usage of key socio-demographic groups. Although the survey results did not include newspapers, it is likely to be them that suffer as younger generation make less use of the printed word in getting information. The big shift in where sample respondents accessed the Internet between 2007 and 2009 has been a significant fall in the number of those using Internet cafes and a commensurate rise in the number using mobile phones. Strikingly, this trend – of using mobile phones for access – is more pronounced amongst the rural part of the sample. This is bad news for cyber-cafes for despite rising numbers of users they are not coming their way. But this is good news for mobile operators if they can get their mobile Internet offers cheap and pre-paid. The five top uses of the Internet range between 40-50% of the sample users and were in descending order: entertainment; games and music; social networking and instant messaging; e-mails; general surfing; and job search. The pattern is very close to existing mobile usage (with the exception of job search) if you take SMS as the equivalent of e-mails. Users are starting with what they know but will inevitably become more adventurous as more content and services are put on offer. Not surprisingly it is the young who are disproportionately more likely to be members of social networking sites but membership is more likely to be male than female. Facebook was by far the most popular site although You Tube (which features in the Top 10 sites used in Kenya according to Alexa.com) does not feature. BBC, CNN and The Nation are the most used news sites. The significance of these findings is that Kenya is both one of Africa’s largest mid-scale markets and is a bell-weather in terms of technology adoption. Crudely, what happens in Kenya will start to happen elsewhere. And as the uptake of M-Money services shows, this is not simply an urban, well-educated, middle class phenomenon. Critical mass kicks in when the number of users starts to create networking effects. In other words, existing users start to draw in new users who don’t want to be left out. In Kenya, this is clearly already beginning starting to happen. And although the number of daily Internet users is smaller than the overall estimated total of 3.5 million, it is beginning to grow significant and will continue to do so as access prices fall and local content offers become more varied. dear listers i have no doubt how our beloved country (kenya) has invested poorly in the educational tourism. try compairing the number of foreign students in our universities with those who fly out of the country to SA , USA ,UK China etc. first i think the country's education system is slow in adopting the new learning technologies. its about time the kenyan students and the government put some empasise/effort in this issue. a good example is in our own public university like egerton, the ratio of students to lecturer is way out of range yet the same lecturers will stand in the lecturer hall trying teach 300 students with a piece of chalk and a small blackboard(how does a student in the back of the class get anything out of this lecture): what am trying to say is that the administration should adopt technologies like projectors in order to serve even the student standing at the back of the class, otherwise people will preffer having better education in the foreign countries rather than their own country.

DNSSEC Deployment in Root Zone of DNS Begins at ICANN 27 January 2010 The collaboration between ICANN, the Commerce Department's National Telecommunications and Information Administration (NTIA) and VeriSign, Inc. to deploy DNSSEC in the root zone of the Domain Name System (DNS) passed an important milestone today. DNSSEC information is now being served by L-Root, one of the Internet's 13 root servers, operated by ICANN. The DNS is vitally important to the proper operation of almost all services on the Internet, and the deployment of DNSSEC in the root zone is the biggest structural improvement to the DNS to happen in twenty years. The deployment of DNSSEC is proceeding with widespread involvement of the Internet's technical community, and is being carefully staged so that any unintended consequences of the deployment can be identified and mitigated promptly. ICANN engineers executed a maintenance procedure to introduce DNSSEC data into L-Root between 1800-2000 UTC on 27 January 2010. The maintenance was completed as planned. The reaction of the root server system as a whole to the change is being closely monitored, with root server operators performing extensive data collection to be analysed centrally. The data collection and analysis is being coordinated by DNS-OARC, the Domain Name System Operations Analysis and Research Center. Other root server operators will execute similar maintenance procedures in the coming months. Deployment of DNSSEC is proposed to be completed in July 2010. Hi, I now know why shell\BP are exiting Kenya, with a CEO like Mr Obath (now Chairman of Federation of Kenya Employee), says that implementation of the government directive on NSSF contributions for domestic staff is not feasible because of the resources required for registration and remittance you understand why. Can Mr. Obath please go and register for mpesa, ZAP or any other mobile money transfer system and then tell us how long it took. He also needs to know that the ID information is now digitised therefore allowing for mobile registration. With executives like this and techies raising issues about 3G no wonder we are unable to move forward. CNN has highlighted the fact that Haitians are being buried in mass graves without any records being made? The asian Tsumani victims had photos taken and matched to their 'mass grave' so the relatives will get some sort of closure. Is there an existing ICT initiative that is helping to keep records of the dead and match them to their 'mass grave'? ...or an effort to help relatives not look for someone forever? Many are looking forward to Nairobi, some expressed concerns, particularly in light of the events in downtown Nairobi on January 15. Accordingly, ICANN staff and board have reexamined the security situation During our re-examination we first explored moving the event out of the downtown Nairobi area to a suburb, but determined that no suitable venue was available. Second, we reached out to the Kenyan government as well as other nations with operations in Kenya for their risk assessments of the situation. The consistent feedback was that the overall risk assessment of Nairobi had not changed. Accordingly, based on the ICANN CEO’s recommendation, the ICANN Board has approved moving ahead with the ICANN Nairobi meeting. At the same time, we recognize that many developing country cities have higher ambient levels of street crime and much of the world (the U.S. And Europe included) faces international terrorist threats and attacks. Both are simply facts of life. Also, as with all ICANN events, we will continue to monitor the security situation in case there are any material future changes. For any ICANN community members who do not travel to the event, remote participation will be available for many of the meetings. Given that ICANN is committed to “One world. One Internet. Everyone connected.” we have engaged and will continue to engage with the whole world. We greatly appreciate the assistance of Kenya, the host country, and their commitment to address ICANN security concerns. In addition, the ICANN board has approved further security investments by the CEO as necessary for the event, and the CEO will become personally involved in reviewing the security plans. It will feature 40 artists--including Alicia Keys, Bono, Sting, and Justin Timberlake--and is a benefit for a number of charities. Home About Contact ICANN meeting and security concerns 20 01 2010 By rebecca wanjiku Comments: 0 Available in: English In March 2008, Nairobi was supposed to host Internet Corporation for Assigned Names and Numbers (ICANN) meeting. This is a huge meeting, ICANN uses about $ 2 million for these meetings, am sure you know what it means for the economy. But the events that followed the 2007 elections meant that the meeting was cancelled, it was such a shame but that was understandable; after all, you do not want the people who control internet resources to fall into the traps of rival tribal gangs or to be caught in the cross fire. After another round of presentations last year, the Kenya delegation led by Kenic and the Communications Commission of Kenya was able to convince the ICANN community that Kenya is safe enough, and they agreed to host the meeting this March. We have been busy sweeping the roads and upgrading the hotels just to make sure that the most important ICANN community is happy, but they have never been, and I do not think they will ever be, if you ask me. I have been talking to sources within the organizing committee and ICANN has always had one niggling problem after another. Last Friday's fracas with the muslims seems to have tipped the balance; ICANN now is contemplating moving the meeting to another safer city. But if you ask me or any other ordinary Kenyan, I think ICANN does not understand the country and how it operates. Since 1998, Kenya has never been secure, according to US and UK embassies, yet its their installations that make us targets. For whatever reasons, the country has always been rated poorly security wise, but which city is safe? New York? J' Burg? Cairo? Cassablanca? Am sure this is open to debate. I think ICANN has its double standards; if they were truly concerned about the security, the meeting in Seoul would not have taken place; South Korea is always under alert because of North Korea nuclear intentions. The meeting in Mexico city would not have gone on, after all every one there is said to carry a gun and the senior executives within ICANN membership were at risk of kidnappings. But the meetings took place. So, why all the security farce about Nairobi? I would love to point out a similar incident during the 2005 or around there Cricket world cup, where New Zealand forfeited their match with Kenya in Nairobi because of security situation. Sri Lanka agreed to play their match in Nairobi provided they were given top notch security, the government obliged. By the time the plane carrying the Sri Lanka cricket team entered the Kenyan air space, they were escorted by helicopter gunships and all the other stuff you see in the movies. But Sri Lanka soon realized that no one was bothered with them; we whipped them and by the time they were going back to the airport, they took taxis and realized that no one cares. In short, ICANN should know that they will come, they will hold their meeting, they will go away, and no one will probably remember they were here. How many people know about ICANN and what it does? How many people know that the people present are online millionaires? ICANN has made demands that the meeting be moved to the UNEP Complex in Gigiri, and that the government should pay for all the charges bla bla... I think this is a move to alienate themselves from the ordinary kenyans. Getting to Gigiri is hectic let alone getting through the mean UN security staff. Trust me, I have had my share of security incidences in Nairobi, but I do not think its worth canceling a meeting. From my sources, I am told the government is paying for the gala dinner and all that, in other countries, ICANN has paid for that. So I think this is just a way for ICANN to make their demands and demonstrate their authority. I am not saying that security measures should be ignored, but just know that poor security rating means more hardship allowance for the UN and embassy staff, so its in their interest to show Kenya on fire all the time. One thing you should know that Kenya is a highly political company, all year round, stupid politics and we the media love it and exalt it, so deal with that. When you come and when you go, we will remain the same, and it does not mean ICANN will change anything, so get over it. By the way, most people who will come will be holed up in lavish 5-star hotels where the thugs will not reach. The insecurity problem is for people like us who will have to walk home and deal with the neighborhood thugs. The upshot of it is that ICANN should come, hold their meeting, give us the revenue, visit Maasai Mara and all the other areas, and go home. I am sure there will be enough cops guarding everywhere. So, insecure or not, I think the meeting should go on. If you guys are not convinced, then you can move the meeting to wherever you want! I think the media wants the public to believe that the government is issuing regulations unilaterally. However, as Dr Ndemo pointed out, the media have previously snubbed meetings to discuss the regulations before they become law. Makali confirmed this by the following statement: it has also been pointed out that there is an element of bad faith in the manner the ministry always proceeds, despite protestation. our meetings, submissions and petitions never seem to curry favour with the ministry, hence a sense of deja vu. the apparent reluctance of the media to engage sometimes with the ministry is borne out of the sense, rightly or not, that you have taken this as a personal cause/agenda to prosecute, and the public is only improvised as a pawn in the drive to hem and castrate the media. In an opinion piece in today's Nation (http://www.nation.co.ke/oped/Opinion/-/440808/846842/-/5qd4jt/-/index.html) a media consultant points out that the Kenya Communications (Amendment) Act which empowers the Minister for Information and Communication to make regulations does not require him to seek the approval of the industry; he only needs to consult CCK. If this is true, it shows the government went out of its way, I believe in good faith, to seek the views of the media industry but the media, for the reasons stated by Makali above, refused the offer. They cannot, should not, cry foul now. I would advice the media to repent their bad faith in government and adhere to the regulations, especially those concerning content by keeping 'adult content' off family times, if not off altogether. This will win back some public sympathy and probably get enough support to deal with the legitimate concerns they have with other sections of the regulations and the government. Jotham K. Daktari; i thank you for your response. i beg to reply. while no sane person can object to the need for the regulations, there are some fundamental principles of media independence which the published regulations offend - especially with regard to adjudication of disputes or determination of right and wrong. our insistence, which we have to admit has failed to persuade you, is on an independent arbitration mechanism so that the media is not subject to a potentially repressive regulatory regime. it has also been pointed out that there is an element of bad faith in the manner the ministry always proceeds, despite protestation. our meetings, submissions and petitions never seem to curry favour with the ministry, hence a sense of deja vu. the apparent reluctance of the media to engage sometimes with the ministry is borne out of the sense, rightly or not, that you have taken this as a personal cause/agenda to prosecute, and the public is only improvised as a pawn in the drive to hem and castrate the media. it took that meeting we had at the pm's office and the ag for example, to moderate your hard stance on some of the problematic clauses in the communications act. in your recent interviews (eg the one you had with louis on K24 and the statements in the current issue of Kenya Today), you whipped out the bogey of pornographic/adult content and stated straight-faced what the public has "decide" it does not want. well, i cannot contest your facts because i have none, but it left me wondering when the survey was conducted and by whom, and the percentages it generated against this and that? i suspect you are right; i too am loathe to any adult content aired or discussions of some topics during neutral radio space like morning or early evening hours. but the point is that no one is opposed to that aspect of regulation and you know you are whipping it out basically to box the media and coax the public to endorse other extreme measures within the body of the regulations published. fact is that no one in the media is opposing the watershed period for adult content or the provisions against "glorification" of violence, incitement, hate speech, or offensive vulgar speech and many other great provisions in those regulations. the frustration in the media with the ministry is historical. it is the result of the many meetings that took place on the path to the passage of the kcomm act, 2009, and the protracted engagements thereafter which yielded the deletion of sect 88, which you and minister poghisio had defended to the hilt, quite surprisingly. this is our country and all of us want laws that are in the interest of everyone, the public, and not who may happen to be in authority. i disagree that the media has declined to attend any meeting. you know that you/the ministry have selectively been inviting and engaging the media owners association, whose interest is predominantly in the frequencies they control and the investments thereof. you have deliberately avoided engaging the editors and media practitioners, who are opposed to govt control, NOT regulation. that's cheeky, sir. i am not going to defend anyone who has hoarded frequencies, and from our discussions and other comments i have made, i believe it is against public policy for anyone to be allowed even one more day with frequencies they obtained through influence peddling or political patronage. they are not any different from the mau forest mbuta; no compensation or sympathy is due to them. why are we applying different standards - people who grabbed road reserves are having their structures demolished and the mau squatters evicted, but bigger land grabbers are to be compensated and the frequency hoarders given a grace period of five years to surrender? everyone should be evicted in the same style whether patched in the sky or squatting on some land. dr Ndemo's assertion that when the thuggish MP attacked journalists they turned not to the media council but to the govt is twisted logic. the mp committed a criminal offence (assault) not a professional (ethical) or civil misdemeanor which the media council is charged with arbitrating. and that is why the media is opposed to professional omissions or commissions being arbitrated by the CCK, whose tribunal is not imbued with specific professional competence or such juridical disposition. ok, let me briefly turn to some contentious issues with the new regulations: 1. overstepping mandate although the Kenya Information and Communication Act, 2009 [sect 46(s)1], clearly states that content regulation is the function of the Broadcasting Content Advisory Council, the ministry has already gone ahead to gazette regulations covering exactly that. why can't the ministry just appoint the council and wait for it to draw up these content regulations as is its duty call? I find this overbearing on the part of the ministry and a betrayal of its suspect eagerness to intervene. it is a moot question why the ministry is so apprehensive of the capability of the council to do so when media representation on it is dismal or non-existent, it being dominated by the government, including you, as PS? reading through the regulations there is nowhere the content advisory board is mentioned in terms of the regulation functions. everything reads "the commission shall..." including the drawing up of the Programme Code. is it to be presumed that the commission stands for the content council in the regulations? i suspect not. 2. excessive regulation PART II: LICENSING (6) stipulates that anyone licenced to broadcast shall set up infrastructure and commence within 12 months or the licence shall be revoked. THIS PERIOD NEEDS TO BE LEFT TO THE CCK TO DECIDE depending on circumstances. there is no need for the ministry to tie the hands of the regulator. 6(b) the commission shall ensure that broadcasting services are delivered using the most efficient and effective available technologies. HOW SHALL IT DO SO WITHOUT INTERFERING WITH THE LICENCEES UNDULY? ISNT THIS THE PREROGATIVE OF THE INVESTOR (TO REMAIN RELEVANT) or CCK? 4. legitimising and maintaining an unfair status quo there is quite a bit that is wrong with the current broadcasting regime that the regulations make a feeble attempt at redressing. many frequencies have changed hands and the current skewed landscape disadvantages new entrants.and some provisions are coming after the horse has bolted, for example: PART III: BROADCASTING SERVICES (2) "the public broadcaster shall not lease or transfer the broadcast frequencies of channels assigned to it for use in public broadcasting". WHAT OF THOSE THAT HAVE ALREADY BEEN ASSIGNED UNPROCEDURALLY, AS WE ALL KNOW? SHALL THEY BE REVOKED OR REGULARISED? (5) "the Commission shall allow community broadcasting licencess to advertise, on their station, adverts that are relevant and specific to that community with the broadcast area". EXACTLY WHY SHOULD THEY BE BARRED FROM AIRING ANY KIND OF ADVERTISEMENT? THIS IS TANTAMOUNT TO MICRO-MANAGING AND INTERFERING WITH THE OPERATIONS AND CONTENT OF THE COMMUNITY. BROADCASTERS. 5. politicising the media (25) During a polling period, a licencee shall: (a) "provide equitable coverage and opportunities to registered political parties participating in an election and in particular to presidential candidates" THIS IS UNDUE. MEDIA SHOULD BE FREE TO DECLARE THEIR SUPPORT TO ANY POLITICAL PARTY, OPINION OR IDEAS WITHOUT PREJUDICING THE OTHERS. THE MERE FACT THAT A PARTY IS REGISTERED OR A POLITICIAN HAS DECIDED TO RUN FOR PRESIDENCY SHOULD NOT AUTOMATICALLY ENTITLE HIM/HER TO ANY PARTICULAR AIRTIME/COVERAGE. POLITICS IS NOT A PUBLIC IMPERATIVE AND SHOULD INTERFERE AS LITTLE AS POSSIBLE WITH THE OPERATIONS OF COMMERCIAL/PRIVATE ENTERPRISE. POLITICAL TIME MUST BE DELINEATED FROM THE STATION'S GENERAL TIME AND LET EDITORIAL DISCRETION FLOURISH. 6. interfering with editorial decision making and content (26. 1) A licencee shall ensure that any person who is to be interviewed in any of the broadcasts is; a) advised or the subject of the interview, b) informed before the interview takes place, to determine whether the interview is to be recorded or broadcast live". WHY SHOULD THIS BE MADE LAW? ISNT THIS A PROCEDURAL AND PROFESSIONAL IMPERATIVE? WHAT IS THE MOTIVE BEHIND THIS CLAUSE? INDEED WHO ATTENDS AN INTERVIEW WITHOUT KNOWING WHAT IT IS ABOUT? WHO DETERMINES WHETHER IT SHOULD BE LIVE OR RECORDED, AND WHY DOES IT MATTER TO THE REGULATOR? WE SHOULD AVOID "CANNED" JOURNALISM (29.) "A licencee shall not broadcast any information acquired from a person without that person's consent, unless the information so acquired is essential to establish the credibility and authority of a source, or where the information is clearly in The public interest." THIS IS AMBIGUOUS. IT GAGS THE MEDIA AND INFRINGES ON THE ENTERPRISE OF INVESTIGATIVE JOURNALISM. (30.) a licencee - (a) shall not accept sponsorship of news broadcasts; HELL, WHY NOT? WHAT ABOUT ALL THE OTHERS - SPORTS, COMEDY, SOAPS? (31. 1) a licencee shall not broadcast an informercial - a) during prime-time, or... WHY? COMMERCIAL ENTERPRISES TOO NEED TO REACH AUDIENCES WITH THEIR SERVICES/MESSAGES.IT IS OK TO LIMIT THE CONTENT OF SUCH INFOMERCIALS IN LINE WITH THE "WATERSHED"PERIOD BUT TO BAN THEM IS NOT JUSTIFIABLE. 2.) a licencee shall ensure that all infomercials that are broadcast by its station are lawful, honest, decent and conform with the principles of fair competition. THIS IS UNTIDY. WILL BROADCASTERS HAVE TIME TO ESTABLISH ALL THE UNTRUTHS CONTAINED IN ALL ADVERTS? THAT RESPONSIBILITY LIES WITH THE AUTHOR/ADVERTISER, NOT THE CHANNEL THAT TRANSMITS. IT CANNOT BE TRANSFERRED. THE STATION NEEDS ONLY TO ADMINISTER THE JOURNALISM ETHICS TEST OF GOOD TASTE, NOT TAKE RESPONSIBILITY FOR THE TRUTH OR FALSITY OF INFOMERCIALS. (33. 1) a licencee shall ensure that it only broadcasts advertisements that are lawful, honest, decent and conform with the principles of fair competition. (33. 2) a licencee shall ensure that advertisements broadcast by its station do not - a) contain any descriptions, claims or other material which may, directly or by implication, mislead members of the public in relation to the product or service advertised, or about its suitability for the purposes recommended; or b) unfairly attack or discredit, directly or by implication, any other advertisers, products or advertisements. (33.3)a licensee thall, before broadcasting an advertisment, ensure that any descriptions of claims in the advertisement have been adequately substantiated by the aevertiser. WHILE THE MEDIA CAN ASSIST BY BEING JUDICIOUS (which they do), THIS REGULATION SHOULD BE DIRECTED AT THE ADVERTISING PRACTITIONERS ASSOCIATION (APA) AND THE MARKETING SOCIETY OF KENYA (MSK). WHEN IS THE MINISTRY PUBLISHING SUCH A BILL? WHAT IS THE YARDSTICK APPLICABLE HERE FOR WHAT IS DECENT, LAWFUL? BROADCASTERS ARE NOT COURTS, INVESTIGATORS OR INVOLVED IN TESTING THE CREDIBILITY OF CLAIMS IN COMMERCIAL ADVERTS. 7. loopholes for state interference in content PART V - PROGRAMME CODE THIS WHOLE SECTION COMPLETELY IGNORES THEE EXISTENCE OF THE BROADCAST CONTENT ADVISORY COUNCIL AND INVALIDATES THE AGREEMENT MEDIATED BY THE PM. THE REGULATIONS MANDATE THE COMMISSION TO PRESCRIBE THE PROGRAMME CODE AND COMPLIANCE. 8. others to avoid regurgitating the arguments i proffered last year when the regulations were first published, i am pasting herebelow the article published in ET as well as our website, eastafricapress.net, which Dr Ndemo does not seem to have had regard to, hence his challenge. it provides context. *** These regulations will not guarantee media pluralism By David Makali The Kenya government early September published the Kenya Communications (Broadcasting) Regulations to guide the application for licences, award and use of broadcasting frequencies. The rules are expected to give effect to the Kenya Communications Act, 2009, enacted in February amid much acrimony with the media. The regulations are bound to generate heat in as far as they propose radical changes in the largely discriminatory and partisan allocation of frequencies handed out in smoke-filled rooms devoid of transparent criteria. Beneficiaries of this crooked licencing regime are bound to resist any reform that will create a level field for new entrants and fair competition. It is not clear whether public interest is served by their continued enjoyment of those frequencies. Already, there is a suit in court challenging the attempt to perpetuate this injustice by automatically renewing the licences and frequencies of those who have, which is tantamount to legitimising the means by which they acquired them. Some companies are known to be hoarding hundreds of frequencies which they luxuriously pop on air and employ against their competitors. That has effectively stifled competition and turned off potential investors in a sector that is perhaps the fastest growing. That past regime must end, and how else to bring the shutter down except by declaring all frequencies held as interim, until justified on the basis of new criteria agreed by the public? It is in the public interest that media diversity replaces the current dangerous concentration propelled by political favouritism. To that extent, we salute the ministry/government for taking the first step, and introducing a transparent system of licencing. And yet not so. Some of the proposed requirements are suspect and an unnecessary encumbrance to potential investors. They are even skewed against the potential applicants who are, for example, required to demonstrate: [(Part II, 3 (b)] – evidence of technical capability in terms of personnel and equipment to carry out broadcasting services (Which one comes before the other – a licence or demonstration? How does an investor or applicant acquire technical equipment before they are licenced?) [Part II, 3 (c)] — evidence of relevant experience and expertise to carry out broadcasting services. (Again, is this a fair requirement for an investor? This presumes that investors in broadcasting business are technicians or professional journalists, which is not the case because it is not an investor’s job to run a station). [Part II, 3 d)] — evidence of the capability to offer broadcasting services for at least eight continuous hours. (What purpose is served by this condition and must a licencee broadcast for such length of time? Suppose an applicant wants to run a station that only targets school-going children between the time they return from school and when they go to bed?). The regulations also prohibit trade unions from being licenced yet other more partisan groups – such as some religious denominations, politicians or political parties – are not prohibited or already have frequencies. What is it about trade unions – including the Kenya Union of Journalists — that disqualifies them? Proceeding with the same regimental mode, broadcasters (3b) are required to “include news and information in their programming as well as discussions on matters of national importance as may be prescribed by the commission from time to time.” Now, pray, why should it concern the government whether a station is airing commentaries of news unless it wants to have a voice there? Isn’t that a matter best left to each broadcaster to find its competitive edge and niche? And must all the stations look alike by offering information and news? That’s boring. But there is some good news, for advocates of diversity and media pluralism, in the clause on ownership and control (6 I) which says that all licencees shall not be assigned more than “one broadcast frequency for radio or television broadcasting in the same coverage area.” Well, that would spell doom for companies like Nation Group (Easy FM, QFM), Radio Africa (Kiss, Classic, Radio Jambo, East FM, Xfm), and Royal Media Services (Citizen Radio and TV and 11 vernacular stations broadcasting in almost all parts of the country under one roof). There is continuing ambiguity about those holding licences and frequencies prior to the commencement of the regulations. In clause (a), they are required to apply for broadcast licence(s) as prescribed by the Commission and pay the requisite fees. But the same regulations again state that the licences will (c) “retain such radio frequency resources already assigned under the same terms and conditions of issuance, provided they comply with such new terms and conditions that may be imposed by the Commission”. There is no sign that the government is ready to undertake any radical changes in media ownership. By extending to five years the period during which those with multiple frequencies in one area are required to surrender them, the government has definitely chosen the partners to do business with. Furthermore, the government appears to have succumbed to the broadcasters regarding local content by merely providing that “a licencee may be required to commit a minimum amount of time to the broadcast of local content as may be prescribed in the licence, as may be prescribed from time to time by the commission in the gazette.” Stations that fail to comply will only be required to “pay such an amount of money as may be prescribed by the commission”. That sadly reduces the imperative of local programming to a monetary value when all along we thought the objective was to create jobs and support our culture, ideas and art. How that is exchangeable for money defeats logic. We can hear the artistes yawning. Yet, while it spares the local media the burden of investing in local productions it foists the rigid requirement on foreign broadcasting stations for whom minimum local content will be prescribed. The target is of course the usual suspects —BBC, RFI, VOA. Reading through the regulations, there is a discernible attempt by the government to avoid another fight with the media. But it invites the same unknowingly by duplicating the duties of the existing Media Council with regard to arbitrating content related complaints, an issue which was raised in the heated debate that preceded the legislation of the Communications Act earlier on last year. There is also bad news for owners who have acquired stations and frequencies issued to speculators. Now any change in the shareholding of any company licenced to broadcast will require the approval of the CCK. The commission will grant or refuse to allow such change of ownership upon considering several factors, among them the possible “impact of the transaction on competition in the sector and the promotion of pluralism and diversity in the sector. _______________ "If my doctor told me I had only six minutes to live, I wouldn't brood. NEW ICT REGULATIONS ON MEDIA

I would like to state categorically that as much as the media regulations are controversial as claimed there is need to treat the matter with sobriety. There are two sides of the coin and just a government system -there is need for checks and balances. As much as the media is the government's watchdog it should be true to its role of exposing unethical values in the society instead of resonating to the same string of decaying our society with an immoral programs that corrupt our young generations' minds. One thing I can never stoop low to, is to support the media on crying for censorship of programs that will bring them profit at the expense of upbringing a morally upright society. There can be other debatable issues in the draft including censorship of government's inappropriate actions, cross media ownership, subsidizing one business with another but till Christ comes back morals, values and culture are pillars for country that is heading to the right direction of success. Further as Mobile phones operator begin to register their subscribers what information will they gather and how will they protect it. -- ÐÏà¡±á
