Listers, I hope everybody read the Thursday Star article on e-waste. The article quoted a study conducted locally and found out that we import thousands of tons in e-waste from developed countries. Environmental agencies are concerned. For every one used computer that ends up being used, there are ten to be juncked or to be used for canibalizing. Do we really need this in the country? In my view we should support the Government's proposal to ban the imports. My brief research shows those supporting this effort are themselves in the used electronics industry. In all honest the benefits do not justify our continued use of other people's waste. PS Ndemo said we can lower the cost of new computers to equal that of the used computer. Why can we not pursue this? Victor.

GOALS & ACTION ITEMS HIGHLIGHTS Goal No. 1: At least 100 million U.S. homes should have affordable access to actual download speeds of at least 100 megabits per second and actual upload speeds of at least 50 megabits per second. In order to be a world leader in access to broadband by 2020, the plan has recommendations to foster competition, drive demand for increased network performance and lower the cost of deploying infrastructure. These will help inform consumers about broadband performance, expand services and infrastructure, and reform access to rights-of-way to lower barriers to entry for firms. Goal No. 2: The United States should lead the world in mobile innovation, with the fastest and most extensive wireless networks of any nation. Without enough spectrum, the wonderful potential that wireless and mobile broadband promise will remain unrealized. The Plan recommends making 500 megahertz of spectrum available by 2020, including 300 megahertz within the next five years, for both licensed and unlicensed use. In addition, the Commission recommends initiatives to ensure greater transparency and access in allocating spectrum for various uses. Goal No. 3: Every American should have affordable access to robust broadband service, and the means and skills to subscribe if they so choose. Not only is our world increasingly accessible online, but Americans have more opportunity for civic engagement than ever. But for these exciting online tools to be useful, every American must: have access to a network; be able to afford that access; and have the opportunity to develop digital skills. The Plan proposes reprioritization of resources and strategic targeting of efforts in order to achieve the goal of a 90% broadband adoption rate by 2020. Goal No. 4: Every community should have affordable access to at least 1 gigabit per second broadband service to anchor institutions such as schools, hospitals, and government buildings. The plan makes recommendations to upgrade the E-rate and improve the Rural Health Care support programs. Reforming incentive structures, licensing, and data interoperability, ensure that public priorities take advantage of the benefits broadband networks offer. And once community anchors are connected to gigabit speeds, it will become less expensive and more practical to get the same speeds to homes. Goal No. 5: To ensure the safety of American communities, every first responder should have access to a nationwide, wireless, interoperable broadband public safety network. Often, first responders from different jurisdictions cannot communicate effectively with each other at the scene of an emergency. A nationwide broadband safety network should be robust enough to maintain performance in the aftermath of a disaster, and should allow every first responder to communicate with each other and share real-time data over high-speed connections. Goal No. 6: To ensure that America leads in the clean energy economy, every American should be able to use broadband to track and manage their real-time energy consumption. The United States must lead by encouraging renewable power, grid storage, and vehicle electrification. Real-time data can also inform automated thermostats and appliances, allowing consumers to save energy and money while reducing the need for expensive new power plants. Consumers should be able to access real-time usage information from smart meters and historical billing information over the Internet. Harry FCC: Cost a major barrier to broadband adoption By Marguerite Reardon February 23, 2010 11:19 a.m. EST Affordability is one of the main reasons why nearly one-third of Americans do not have broadband at home, a recent Federal Communications Commission survey found. FCC Chairman Julius Genachowski plans to discuss the findings during a speech at the Brookings Institute on Tuesday. About 93 million Americans do not have broadband Internet access at home. In an effort to get these Americans connected to the Net, Congress has called on the FCC to develop a national broadband plan that will detail a strategy for getting them connected to affordable, high-speed broadband. The FCC will deliver its plan to Congress on March 17. In order to understand what is keeping many Americans from subscribing to broadband, the FCC conducted a consumer survey of over 5,000 American adults in late 2009. The survey identified three main barriers to adoption: affordability, digital literacy, and relevance. About 36 percent of the 28 million adults who said they don't subscribe to broadband at home said that the monthly fee for broadband was is too expensive, they can't afford a computer, or the installation fee is too high. About 22 percent, or 17 million adults, indicated that they do not subscribe to broadband at home because they lack the digital skills or are afraid of the potential hazards of being online. And 19 percent, or 15 million people, said they don't have broadband Internet at home because they simply don't see a need for it. The FCC's task force developing the broadband plan suspected a few months ago before results of the survey had been completed that cost and lack of digital skills were crucial factors in broadband adoption. The recent findings bolster those earlier assumptions. The cost of broadband service is likely to be a major barrier for low-income families. And it is likely to explain why a disproportionate number of people in lower income families have access to broadband at home. According to the survey, 40 percent of people who live in households where income is $20,000 per year or less have broadband at home, while 91 percent of people living in households where the income is more than $75,000 per year have broadband at home. Chairman Genachowski said that getting these individuals connected to the Net is crucial to the future of the country. "We need to tackle the challenge of connecting 93 million Americans to our broadband future," he said in a statement. "In the 21st century, a digital divide is an opportunity divide. To bolster American competitiveness abroad and create the jobs of the future here at home, we need to make sure that all Americans have the skills and means to fully participate in the digital economy." But getting people connected won't be easy even once the barriers have been identified. In terms of cost, it's not clear how low prices would have to go to spur significant adoption. On average, Americans pay about $40 a month for broadband service. In some areas of the country, the cost is higher and in some places it is lower. Price also varies depending on the speed of the connection and whether that connection is bundled with other services. The FCC said many people who cited price as a barrier were reluctant to answer follow-up questions about how much they were willing to pay for service. Of the people who did answer, the survey found that responses varied from $10 to $20 to $25 a month for service. But when experts analyzed the data about how many people would actually likely sign up for service if prices were dropped to $10 or $20 a month, adoption rates only picked up slightly. If prices dropped to $20, experts said that would likely only change adoption by 6 percentage points. And a $10 price tag would only change it by about 8 percentage points. What this means is that cutting prices alone will probably not have a major effect on broadband adoption. But lowering prices on service, coupled with adding programs that teach people the digital skills they need to access the Net while also educating them on how the Internet can enhance their lives, could have a substantial effect.

South Africans choose dot ZA ahead of dot com, market survey reveals

Please read below: South Africans choose dot ZA ahead of dot com, market survey reveals (also follow via this link http://mybroadband.co.za/news/internet/11791.html) The recently completed “dot ZA market survey” of the dot ZA Domain Name Authority (ZADNA) shows that South African businesses and people prefer to use co.za to dot com. This is the result of an intensive market survey which began in November 2009 and involved thousands of online and telephone interviews with .za domain name holders (registrants), business people and non-profit entities. It was concluded in late February this year. ZADNA intended to use the survey to better understand the dot ZA market and in particular to ascertain what improvements were needed to make dot ZA more attractive and so better serve the interests of South African organisations. According to Vika Mpisane, the GM of ZADNA, “the research results are very important as they provide answers to most of the questions we and our stakeholders had about improving the .za space. These answers clarify what interventions ZADNA or its stakeholders need to make to improve ZADNA.” What was very noticeable from the results is that 83% of South African businesses choose to use co.za for their online presence. This effectively means only around 15% of local businesses confirmed having dot Com website names. When asked if they considered having both co.za and dot Com names was necessary, 58% of businesses interviewed answered “yes”. “This must be put into a correct perspective: the perceived need for registering your product and brand names across multiple domains results from the ever-increasing instances of trademark abuse online. To counter the potential for such abuse, a growing number of local and international businesses now register in as many domains as possible.” The survey also shows that dot Com still ranks better than the rest of other dot ZA domains, such as org.za and gov.za. This is understandable because the rest of dot ZA domains are more focused on a smaller communities and sectors. Providing an example, Mpisane said: “The growth of gov.za will always be limited as government and its organisations cannot be expected to grow as radically as business organisations, plus some government entities, such as parastatals and municipalities, register their website names in co.za and dot Com, instead of gov.za.” What the survey results also show is that most South Africans are patriotic and loyal to South Africa when they choose their online presence. Fifty percent of the interviewees chose this as the main factor influencing their choice, while affordability of dot ZA domain names came second. Pitting co.za against dot Com, 83% of the interviewees chose co.za ahead of dot Com as giving them superiority locally. Co.za also outscored dot Com by a great margin when it comes to affordability of registration – 93% chose co.za here – and 75% percent felt that co.za gives their business most online credibility. Probably as expected, dot Com outscored co.za when it comes to global appeal. Most Internet service providers (ISPs) and registrants felt that the process of registering dot ZA domain names should be made easier by automation. “The need for more automation can never be over-emphasised, and ZADNA will answer this through the licensing of dot ZA domain registries (i.e. operators of domain name databases) and registrars (i.e. ISPs registering domain names), and the introduction of a central registry that can standardise such automation across most .za domains.” The survey also tested South Africans’ awareness of the new generic (i.e. non-country specific) domain names that ICANN, the entity managing the global Internet domain name and IP numbering systems, is planning to introduce in due course. Most South Africans are not aware of such plans, but ISPs showed substantial awareness (at 44%), as expected because they are the entities that sell domain name registration services. Interviewees were asked about introduction of new 2nd level domains such as city or region-specific domains. When tested on this, respondents felt that city-specific domains were not as attractive as they could because of the potential for changing city and region names in South Africa. There was also very little enthusiasm shown for registering names directly under dot ZA (i.e. yourname.za instead of yourname.org.za) and for introducing biz.za to compete with co.za. “The feeling is that allowing registrations of names directly under dot ZA will lead to a potential for abuse of trademarks and brands. Dramatically increasing Internet speeds to 25 times the current average is one of the myriad goals to be unveiled in the National Broadband Plan by the the Federal Communications Commission on Tuesday. The highly anticipated plan will make a series of recommendations to Congress and is aimed at spurring the ever-changing communications industry to bring more and faster online services to Americans as they increasingly turn to the Internet to communicate, pay monthly bills, make travel plans and be entertained by movies and music. "This is a fairly unique event," said Paul Gallant, an analyst with Concept Capital. "The FCC really has never been asked to design a broad regulatory shift like this. Broadband is important and difficult because it threatens every established communications sector." Some details of the plan have trickled out in the last few weeks including how to find spectrum to meet an anticipated explosion of handset devices capable of playing movies and music in addition to handling emails and voice calls. But some carriers like AT&T Inc and Qwest Communications International Inc were irked last month when the agency's chief, Julius Genachowski, announced that the FCC would propose in the plan a goal of 100 Mbps speeds to be in place at 100 million American homes in 10 years. The current average is less than 4 Mbps. In a sign of tension between the FCC and carriers, Qwest called it "a dream" and AT&T reacted by saying the FCC should resist calls for "extreme forms of regulation." Since the FCC announcement, Cisco Systems Inc announced it would introduce a router that can handle Internet traffic up to 12 times faster than rival products. Google Inc has also gotten in on the hype, saying it plans to build a super-fast Internet network to show that it can be done. The FCC has praised both announcements. The plans could also touch off tensions with television broadcasters, who will be asked to give up spectrum to wireless carriers who desperately need it for their mobile devices, such as the iPhone and Blackberry. The FCC plans to let them share in the profits of auctions structured to redistribute the spectrum. "We've developed a plan that is a real win-win for everyone involved and we have every expectation that it will work," Genachowski said in an interview with Reuters. "We've certainly heard from a number of broadcasters who told us they think this is a promising direction and are getting ready to roll up their sleeves with us," he said. The FCC also wants to make sure that anchor institutions -- government buildings, schools, libraries and healthcare facilities -- get speeds of about 1 gigabit per second by 2020. The full broadband plan is expected to be released at a Tuesday meeting among the FCC's five members who are expected to discuss the results and recommendations of the roadmap, which was mandated by Congress. Congress may have to pass legislation to enact some portions of the plan. FCC officials have said some of the goals are aspirational and should be viewed as a "living, breathing" document for the next decade in hopes of helping 93 million Americans without broadband get connected. ACHIEVABLE "It is both aspiration and achievable," Genachowski said. The Obama administration has touted the plan as a way to create jobs and make energy use more efficient. "It will be a call to action," said Blair Levin, who heads the FCC's broadband task force which has collected data and comments from the industry, academics and the public as well as from three dozen public workshops. The FCC has placed most of its attention on broadband policy which Darrell West, director of governance studies at the Brookings Institution, called "the signature issue" since Genachowski took over the helm in late June. "It means that broadband is going to drive other types of policy decisions and it really sets the parameters for telecommunications and new applications," West said. FCC officials have said that the plan will not take sides on technology or applications, but they want to lay the groundwork to spur innovation and job creation. Officials have said the plan will ask Congress to fund up to $16 billion to build an emergency public safety system. It would also tell lawmakers that a one-time injection of $9 billion could accelerate broadband reach to the 4 percent of Americans who do have access. Otherwise they could let the FCC carry out a 10-year plan to realign an $8 billion U.S. subsidy program for universal broadband access instead of universal phone access. Experts call the plan ambitious but question if the FCC, which plans to spin off a series of rule-making proposals linked to the plan, can realistically make good on its recommendations. "There's so little progress on this stuff in Washington," said Rob Atkinson, who heads the Information Technology and Innovation Foundation. "I think Chairman Genachowski has a real opportunity to bring different warring interests under 50-75 percent of the plan." New CCK Site

I was pleasantly surprised to note that the CCK appears to have revamped their site. It certainly looks a bit cleaner (although it has clearly not been tested for all browsers). However I am very disappointed to note that they snatched defeat from the jaws of victory by failing to properly implement a credible complaints form. This one -> http://www.cck.go.ke/consumers/complaints.html requires a bit more work If just two improvements are made the usefulness would improve in leaps and bounds PROBLEM: A system to report complaints without offering a means to track the same is just an avenue to frustrate users. SOLUTION: The system needs to assign a ticket to me immediately after I complain and allow me to key that in to track the status of my complaint so that I can know whether or not my complaint is being addressed and how far it has reached. PROBLEM: Why should i be asked the email address, town, & phone of the service providers? Why would I be expected to know any of this? SOLUTION: Given that all the providers register through CCK, they already have a comprehensive database of all providers and offered services. These can be presented as a drop down list for selection I am willing to volunteer my time to help the CCK improve this.

Hi, I had another horrible experience trying to work from home again this weekend after Safaricoms the 3G services was was unavailable in the South C and the edge service is literally the edge of the service I could not even refresh a yahoo mail page. Just out of curiosity was don't the mobile companies outsource their network optimization business to the level of having providers invest in the equipment in exchange for a share of revenue from the traffic that they pass through. As consumers we are charged based on utilisation so the mobile companies don't need to change their tariff structures to accommodate the booster and repeater providers. Hopefully after they have tested this model in the urban areas they can use the same model to better cover the rural areas. On the other front is the excessive advertising spend my Telkom on the issue of wired services, when are they likely to make this available outside the CBD as their are no copper cables in the residential areas or does Orange think that all our Nyumbas are in the CBD? Hi Listers After an attempt that aborted in 2008, ICANN came full throttle into Nairobi and after 6 action packed days it was time to park the bags and leave- they did and they are gone heading for Brussels! Will Nairobi be remembered or put it differently will Nairobi remember ICANN. What's the impact both ways? My take is that the impact was both ways - Nairobi provided a fertile ground for Board action and ICANN event affirmed the local ICT sector and raised high to a pedestal for the world to see. Nairobi was a watershed for gTLDs . Being held in a developing country, it provided a fertile groundswell for consideration that resulted in at least two resolutions. EOI was thrown out by the Board for good reason - the criteria would have worked against the developing countries and small entities. This however is a short term reprieve and should only be a breather. Nairobi also provided a fertile moral ground to persuade the Board to pass a resolution supporting the formation of a working group to develop a sustainable approach to providing support to applicants requiring assistance in applying for and operating new gTLDs. These provide a lifeline for developing countries to participate meaningfully in the new space to be unleashed by the new gTLDs. It is a challenge thrown to us. ICANN more than affirmed the maturity of the ICT sector , the challenge is to build on this . A large number of ICANNers did not come to Nairobi courtesy of the mishandled security issues. This was a blessing in disguise for the ICT sector. The scribes did their work, transcribing live from California, some board members, presenters , and other participants participated fully - no latency . ICANN confirmed beyond doubt that our ICT infrastructure is world class and beyond reproach. In the main conference hall, I estimated over 200 devices all online and most streaming and the wireless internet speeds were incredible, the cellular networks were incredible and according to one staffer of ICANN, bandwidth capacity and quality was no different from any developed world country!! He thought the best thing should have been to stream the Carnivore Gala live to those who didn't come. Our ICT system has come of age and fully confirmed by ICANN. If scribes can sit in California and do their thing , the converse is true, we can offer first class scribing to world. This is an item we should shout loudly when marketing the BPO sector . Secondly, ICANN did official business on audio and video conferencing , is there any reason where we should not aggressively use audio and video conferencing in government , private sector and even social engagements? Finally, ICANN provided a stepping stone and great credentials to bring IGF to kenya next year . Media was caught unawares and never could catch up with the biggest event on internet that ever landed in Kenya . coverage of the opening day was a whimper and subsequent coverage tacked away in obscure pages. My limited experience (as Mc Tim will shortly remind me) indicates that after the general orientation one has to have some objectives for engagement. Long term ICANNers appear to have an agenda: sealing business deals, pushing for policy changes to do more business, protecting and promoting national and public interests, knowledge gathering and research etc. In terms of getting the lay of the land, ICANN has a great website with all sorts of tools to engage. The site also breaks down all those acronyms (without a quick acronym check, attending a meeting will be a waste of time). However, I think beyond attending a meeting, reading up and having an agenda, actors may still need some help on where the opportunities are. To somewhat illustrate, I met a registrar yesterday from Europe who got domain name accreditation in 1994 while he was still a college student. He has never missed an ICANN meeting although he rans one of the leading European registers. This is the kind of headstart Kenyans would be up against in various ICANN 'sectors'. On a light note, I must now change my line and say Kenyans are true ICANNers. The party at the Carnivore was filled with Kenyan merriment, butt wriggling and shouting. The Kenyan energy infected most of the visitors who danced wildly for hours sweating away in masaai blankets with no sense of modesty whatsoever. I must say that it does help to encourage more industry players to participate through creation of visibility and demystifying the whole Internet Governance/ ICANN setups. I don’t think we in Kenya lack the drive or even the tricks to lobby, I just think the whole ICANN/Internet Governance are generally shrouded in lots of secrecy, you would almost think there are limited opportunities to go around. My challenge to which I direct to myself first is that the broader ICT community and Internet community more specifically MUST seek to get the information out. More like the OFC kind of awareness that was created. The internet community need not make this area such a technical and secretly run group that the majority of stakeholders should be kept out but rather make it a deliberate intention to inform the wider public about them through media. The challenge goes to ICT Journalists as well, write more articles to do with the subject. This way more and more members will gain awareness and next time such chances come up it would be like CISA, CCNA Academies etc (Just examples of how interest aroused creates even greater impact). It is laudable and other service providers should consider this worth emulating, and from all of them, we expect more. With reseach ( an earlier post from Alice Best), showing that usage is increasing, and especially the fact that there is a huge potential for growth in this market, should motivate service providers to re-look at their overall strategy in reaching out to the "untapped" mass market and increase their sales volumes. Power Instability

I am staying in a so-called "5-star hotel" in Mombasa but there are unpedictable power outages that keep plunging the tourists in darkness before the back-up generators come on. I understand this is a common, alas daily, occurence. Why can't this power issue be addressed once and for all and how do industries like BPO and ITES cope? Note also that this was the meeting where the ICANN board was trying once more to conclude the EOI issue on generic TLDs - businesses from developed countries can barely wait for this decision to be made. Actually, I think the weak Kenyan engagement is genuine and not one that we should necessarily be defensive about. Am new to ICANN and if I had not made the decision to attend the meeting a little while ago, I would never have understood its agenda and whats at stake. Hi Victor and all Indeed I happened to sit close by and noted with dismay the various omissions that went beyond acknowledging the Ministry of Information and Communication's financial contribution and support but also to the role other stakeholders (company's, institution's, and individuals) have played in not only organising this meeting but contributing to broader ICTs for economic social, cultural and political development, as well as placing Kenya on the Internet map. When it looked like the Minister was getting late, he took up the Minister's speech and started to prepare to read. When Hon. Eng. Hi, When there is no water in Ngumo do we tell those who live there that NWSC are over stretched or that they are lucky they do not have to go to the river to fetch the commodity? Yes we do, but this is not right water, electricity, 3G and sunshine are utilities and if you have been licensed to provide it you need to do it right. I do not buy the story of BTS power the same way I do buy the story of undersized pipes or low water dams. SafariCom is a monopoly, when they indicated that 3G is available through out Nairobi I took this to mean South C, Dandora and even Runda if not then this qualifies as misinformation and CCK needs to take action. I suppose the problem here is not that 3G doesn’t work, rather its that Safaricom are a victim of their own success. South C seems to be a hot issue here similar to the experience those in Gitanga road/ James Gichuru areas used to experience a while back and I may be wrong but these are isolated cases. One of the challenges I understand they have had is getting a suitable location for their BTSs in some of these locations i.e area behind the Junction. I am sure they could do better though by deploying stronger radios from the nearest BTSs in these problem spots. Maybe boosters would help too but then again the owners of buildings in these areas must cooperate with Safaricom. I can say am one happy user and I am sure we aren’t few. The daily queues outside Sheria House are a sign that it is time to speed-up digitization of the birth registration process. To solve the problem, I believe the Kenya ICT Board should lobby for immediate and longterm action within government: *Immediate steps* *1. Application forms: All aplication forms must be availed on http://www.births.go.ke/ and the website made public asap.* 2.* Tracking*: Parents should be able to track applications via SMS and via http://www.births.go.ke/ and via SMS. Models of this exist in government and it's simply a matter of replicating the approach. - National ID card application status - http://www.identity.go.ke/search.html - Passport application status - http://www.immigration.go.ke/index.php?id=25 3. No identity cards (or even primary school admissions) should be issued without the birth certificate. This will encourage registration of births. *Longterm actions* * Every maternity hospital must submit birth information on a daily basis (electronically) and parents issued with a serial number for use in tracking and collecting the birth certificates. Burundi carriers form Africa’s first national infrastructure consortium to develop fibre backbone

One of Africa’s smallest countries is pioneering the use of a carriers’ consortium to develop its national fibre backbone and international links with help from the World Bank. Burundi Backbone Systems will oversee the development of a 1,200 kms backbone and several new international fibre links connecting the country to its neighbours in the next 18 months. The consortium brings together as shareholders the four main fixed and mobile operators (incumbent Onatel; Leo, formerly U-Com, part of Telecel Globe; Africell, owned by V-Tel and Palestinian Paltel; and Econet) and an ISP (CBI Net). The two main mobile players are Onamob, the incumbent’s mobile subsidiary, with an estimated 600,000 subscribers and Leo with 400,000 subscribers. The D-Gs and CEOs of the shareholders make up the Board of the Consortium and will appoint the senior management team. David Easum, formerly of Telecel Globe, has been appointed as Interim CEO. The World Bank contibution to the capital project means that it will provide coverage throughout the country, laid alongside road routes, with 26 different nodes. It will be 18 months before the network is materially complete. However, before that date, the important international fibre link to the Rwandan border post will be completed. This has been the primary reason that the operators have got involved in the project. Currently all international traffic goes via satellite, with a small element via microwave to Rwanda. Currently operators paying between US$2,500-3,000 per mbps per month. The Consortium will not actually sell bandwidth as this will be done by the participating shareholders. The headline international price is likely to be between US$1,000-1,500 but some of the partners may get capacity at nearer to US$500. Two of the shareholders – Onatel and Leo – have shares in EASSy (through WIOCC) and also have shares in its inland vehicle, the East African Backbone System. These shareholdings will form part of the two companies’ equity in the consortium. National fibre prices will not be distance-based. There are potentially five international border crossing links. There will be two connections with Rwanda in the North and in the North West of the country one or two connections to DRC. Finally in the North-East, close to one of the Rwanda connections, is another connection to a fibre ring in Tanzania. Meanwhile on the other side of the continent, Maroc Telecom is filling in a crucial cross-border fibre link between Morocco and Mauritania. This move forms part of a broader two-stage project with the aim of linking Maroc Telecom's African operations together (Mauritania, Mali, Burkina Faso and Gabon) and to provide them with onwards international capacity (via the Mediterranean fibre cables). The first stage of the project (being rolled out) is to connect Mauritania to Morocco via a terrestrial fibre link. Maroc Telecom is currently rolling out a link from Laayoune in the south of Morocco to Nouakchott the capital of Mauritania. This link is 60% completed and will be ready for use by the end of this year. The length of this link is about 3,000km (over 2,000 km in Morocco and about 700 km in Mauritania). The second stage of the project is to extend this link to Burkina Faso via Mali. This is still at the feasibility study stage. This may all form part of Maroc Telecom’s broader strategy of making further acquisitions in Africa and will almost certainly give them cheaper capacity than is currently available via SAT3 in either Dakar or Abidjan. On Education and Technology

Friends, I am glad to hear that KIE has plans of taking advantage of technology to deliver education to Kenya kids. I am pleased. Question: do we really believe that we would have better education results because of technology? My view is that any improvements (all things constant) with use of technology would be incremental. There are too many things wrong with the Kenyan education system; things that can be fixed with a clear sober assessment of why we are where we are. Education needs to be grounded in what ought to be "Kenyan national values and objectives"; it needs to focus on national priorities and help create a better, productive citizen than just passing examinations. It needs to appreciated the role of women in society, complete with values of equity, especially with respect to access. Indeed, we need to appreciate the key role that gender plays in the national well-being. Kenya's education promises kids jobs at the end of their schooling; but we know that the economy doesn't have the capacity to absorb even the "few" that make it through the system, passing through the examination filters; let alone the many that don't make it through grade 8, 12 and even university. We should instead be entrenching a business culture and risk-taking, and create an environment that nurtures such risk taking and in the process realize goods and services, and hence employment. The Kenyan environment (wrought by greed and corruption) isn't supportive of entrenchment of good national values. For example, what values do we pass to our kids when they watch big men steal money meant for kids' education? What of the fact that teachers, rather than do their jobs, would rather be at the shambas, dukas, matatus, etc. at the expense of doing their work. Contrast today's teacher and those of yesteryear, men and women that would be found in class at 6:00 AM helping kids; and even stay in evening preps to offer extra coaching for those that needed it. Today, .... I don't want to put a damper on the matter of technology and benefits thereof to delivery of education. We just need to place it in perspective. Technology is just one mode of delivery. If the environment, content, values, etc are not right, technology cannot right it. Some of my these views are reflected in this article. A law ordering data on calls and e-mail exchanges be retained for six months for possible use by criminal authorities violated Germans' constitutional right to private correspondence and must be revised, the Federal Constitutional Court ruled. In its ruling, the court said the law failed to sufficiently balance the need for personal privacy against that for providing security, although it did not rule out data retention in principle. "The disputed instructions neither provided a sufficient level of data security, nor sufficiently limited the possible uses of the data," the court said. Nearly 35,000 Germans had appealed to the court to overturn the law, which stems from a 2006 European Union anti-terrorism directive requiring telecommunications companies to retain phone data and Internet logs for a minimum of six months in case they are needed for criminal investigations. The court upheld the EU directive, saying the problem lay instead with how the German parliament chose to interpret it. Under the German law, which went into effect Jan. 2008, information about all calls from mobile or landline phones was retained for six months, including who called whom, from where and for how long. The following year, that law was expanded to include the data surrounding all contact via e-mail. Although the laws forbid authorities from retaining the contents of either form of communication, they met with fierce opposition from civil rights groups. "Massive amounts of data about German citizens who pose no threat and are not suspects is being retained," Germany's commissioner for data security issues, Peter Schaar, told ARD's morning show. Hi, I believe my cooling out session is over for instigating for Dr. Ndemo to give is a presentation and my failing to attend Being an astute planner I had taken into account the possibility of not being able to attend the session which is why I proposed that this historic presentation for recorded for posterity and to use against Dr. Ndemo if he ever decided to run for higher office. My suggestion that we contribute a token amount, 500/-, towards the hosting was short down and a free model was adopted all because of our entitlement mentality and over reliance on donors. This resulted in those who did not make it to the session miss the opportunity to listen to what was articulated as the "free" recording seems to have come to naught. There is a saying that goes "there is nothing like a free lunch", I hope the next time we shall avoid the free model. It's not that I haven't had a gas of a good time on the Internet. I've met great people and even caught a hacker or two. But today, I'm uneasy about this most trendy and oversold community. Visionaries see a future of telecommuting workers, interactive libraries and multimedia classrooms. They speak of electronic town meetings and virtual communities. Commerce and business will shift from offices and malls to networks and modems. And the freedom of digital networks will make government more democratic. Baloney. Do our computer pundits lack all common sense? The truth in no online database will replace your daily newspaper, no CD-ROM can take the place of a competent teacher and no computer network will change the way government works. Consider today's online world. The Usenet, a worldwide bulletin board, allows anyone to post messages across the nation. Your word gets out, leapfrogging editors and publishers. Every voice can be heard cheaply and instantly. The result? Every voice is heard. The cacophany more closely resembles citizens band radio, complete with handles, harrasment, and anonymous threats. When most everyone shouts, few listen. How about electronic publishing? Try reading a book on disc. At best, it's an unpleasant chore: the myopic glow of a clunky computer replaces the friendly pages of a book. And you can't tote that laptop to the beach. Yet Nicholas Negroponte, director of the MIT Media Lab, predicts that we'll soon buy books and newspapers straight over the Intenet. Uh, sure. What the Internet hucksters won't tell you is tht the Internet is one big ocean of unedited data, without any pretense of completeness. Lacking editors, reviewers or critics, the Internet has become a wasteland of unfiltered data. You don't know what to ignore and what's worth reading. Logged onto the World Wide Web, I hunt for the date of the Battle of Trafalgar. Hundreds of files show up, and it takes 15 minutes to unravel them--one's a biography written by an eighth grader, the second is a computer game that doesn't work and the third is an image of a London monument. None answers my question, and my search is periodically interrupted by messages like, "Too many connectios, try again later." Won't the Internet be useful in governing? Internet addicts clamor for government reports. But when Andy Spano ran for county executive in Westchester County, N.Y., he put every press release and position paper onto a bulletin board. In that affluent county, with plenty of computer companies, how many voters logged in? Fewer than 30. Not a good omen. Point and click: Then there are those pushing computers into schools. We're told that multimedia will make schoolwork easy and fun. Students will happily learn from animated characters while taught by expertly tailored software.Who needs teachers when you've got computer-aided education? Bah. These expensive toys are difficult to use in classrooms and require extensive teacher training. Sure, kids love videogames--but think of your own experience: can you recall even one educational filmstrip of decades past? I'll bet you remember the two or three great teachers who made a difference in your life. Then there's cyberbusiness. We're promised instant catalog shopping--just point and click for great deals. We'll order airline tickets over the network, make restaurant reservations and negotiate sales contracts. Stores will become obselete. So how come my local mall does more business in an afternoon than the entire Internet handles in a month? Even if there were a trustworthy way to send money over the Internet--which there isn't--the network is missing a most essential ingredient of capitalism: salespeople. What's missing from this electronic wonderland? Human contact. Discount the fawning techno-burble about virtual communities. Computers and networks isolate us from one another. A network chat line is a limp substitute for meeting friends over coffee. No interactive multimedia display comes close to the excitement of a live concert. And who'd prefer cybersex to the real thing? While the Internet beckons brightly, seductively flashing an icon of knowledge-as-power, this nonplace lures us to surrender our time on earth. A poor substitute it is, this virtual reality where frustration is legion and where--in the holy names of Education and Progress--important aspects of human interactions are relentlessly devalued. The EASSy has landed! Landing partner Telkom's ring around Africa

Landing partner Telkom's ring around Africa The East African Submarine Cable System (EASSy) - one of the nine undersea telecommunications cables that will connect various parts of Sub-Saharan Africa to the rest of the world by 2011 - will land at Mtunzini, on the northern KwaZulu-Natal coastline, tomorrow. Telkom is the South African landing partner for EASSy. In all, there are nine EASSy landing stations in Sudan, Djibouti, Somalia, Kenya, Tanzania, Comoros, Madagascar, Mozambique and South Africa, with shore-end landings already having occurred in Mozambique and Sudan. "EASSy is one of the elements of Telkom's cable investment strategy and is a key step towards the process of establishing a Telkom fibre ring capability around Africa," said Alphonzo Samuels, Telkom's Managing Executive for Wholesale Services. He added: "EASSy further increases the robustness of Telkom's international bandwidth offerings and portfolio. Together with other undersea cables and/or land based fibre routes, EASSy creates redundant fibre access prospects into East Africa." EASSy is a 10 000 km undersea cable system currently being constructed along the east African coastline. Its 1.4 Tbps system design capacity, coupled with its two fibre-pair configuration, equips EASSy with the highest capacity of all undersea cable systems along the east coast of Africa. Interconnection with various other undersea international cable systems will enable traffic on EASSy to seamlessly connect to Europe, North and South America, the Middle East and Asia, thereby enhancing the east coast of Africa's connectivity into the global telecommunications network. "EASSy is routed from South Africa to Sudan, linking the coastal countries of East Africa. An extensive backhaul system linking landlocked countries to the coastal countries has been developed and is at various stages of completion," stated Samuels, adding that EASSy is scheduled to be ready for commercial service from August this year. Samuels explained that submarine cables held many benefits such as superior transmission quality, considerably lesser delays compared to satellite, high transmission capacity, access to the global optical fibre network, lower unit costs (compared to satellite), no electromagnetic interference and higher resistance against adverse weather conditions. "However, activities such as fishing and anchoring, ocean drilling, fish bites and earthquakes constituted some of the commonly known submarine cable hazards," cautioned Samuels. Various initiatives were nevertheless undertaken to protect submarine cables. These included conducting ocean bed surveys to select the safest undersea routes; burying cable in sand where possible, especially at the shallow end; avoiding heavy shipping lanes when approaching landing points; selecting safe beaches, bearing in mind that later beach erosion could expose cables; designing the shortest land cable route for maximum security; and, manufacturing cables to exceed the 25 year design life of the cable system. "Redundancy, protection and - where necessary - restoration are also key considerations," said Samuels. He explained: "Redundancy means that we have duplicated equipment at the cable stations, duplicated power converters, generators, etc. Therefore, if a single piece of equipment should fail, we have another piece of equipment standing by to take its place." Protection ensures that a fully duplicated amount of capacity is available to re-route traffic on the same cable in the event of an internal failure impacting only one path or fibre. Protection therefore implies that for everything that is duplicated, automated switching takes place. Samuels added that restoration required traffic to be routed onto other cable systems via completely different traffic paths and even different routes. "This usually happens when a complete failure of a cable system occurs, usually via an external influence such as a ship's anchor breaking a cable, to the extent that 'in-system' protection on the same system is not possible." He also explained that customers have a choice between the regular international private lease circuits that includes restoration for their bandwidth or a product that excludes restoration, which would be termed non-restorable bandwidth or traffic. "It must be emphasised, though, that in the event of submarine cable service interruptions, every attempt is always made to expedite customer services," emphasised Samuels. Although EASSy will not be commercially active by the time this year's 2010 FIFA World Cup(tm) kicks off in June, Samuels stated that "Telkom's undersea capacity has been significantly upgraded". "For example, by end-October last year, SAT-3 and SAFE were upgraded to at least three times their former capacity." He added that SAT3 provided the shortest route to Europe while SAFE was the shortest link to Asia. From an undersea capacity perspective, therefore, "it's all systems go for the World Cup," emphasised Samuels. As it's investment in EASSy highlighted, Samuels said that Telkom had a robust strategy with regard to undersea cable investments. The Company's cable investments included COLUMBUS3, SEA-ME-WE3 (South East Asia-Middle East-Western Europe), SAT3/WASC/SAFE (South Atlantic Telecommunications / West Africa Submarine Cable /South Africa Far East), EASSy, EIG (Europe India Gateway) and WACS (West Africa Cable System). "Our investments are geared by the participation of other operators and we firmly believe that investment sharing translates to better unit costs and improved customer prices," he added. "Ultimately, we believe that EASSy will also go a long way towards increasing Africa's bandwidth capacity, affordability and create increased diversity and fibre redundancy between SA and Europe as well as within East Africa" concluded Samuels. The Nairobi meeting is scheduled to run from 7-12 March. The biggest issue on the table is a crucial stage in the addition of new top level domains; the vote by the Board on how to handle expressions of interest. But in the last 24 hours, ICANN’s COO, Doug Brent, has published a security warning <http://nbo.icann.org/meetings/security-information-11feb10-en.htm> that may result in the meeting being cancelled. If this happens, it will be a real blow for the Kenyan Internet community. A previously planned meeting in Nairobi was cancelled because of security concerns prompted by election violence a couple of years ago. I thought this was the wrong call at the time, as election violence tends to die down and our meeting wasn’t till several months later. But I didn’t question and don’t envy the people who have to make that decision. An ICANN meeting brings about 1200 people from around the world to a country chosen from host applications about a year in advance. It’s a mix between a trade show and a party conference, with endless parallel sessions, soap-boxing, hallway deal-making and late night drinking. Probably two thirds One third (thanks, Kieren <http://public.icann.org/meeting-participation-data>) of the participants are regulars, and there’s always a ‘back to school’ feeling on the first day as you greet people you’ve not seen in months with an enthusiasm that wears off in about a nanosecond. The dominance of the regulars causes ongoing criticism that the whole travelling circus doesn’t work to get more and different people to take part, and should halt its global peregrinations and stay put in L.A., Frankfurt or Singapore. It’s expensive to take part in person, but however much resources are put into it, the number of remote participants is always disappointing. The in-person meetings have an uneasy mix of lobbyists, volunteers (many of whom are self-styled volunteers and in fact make their living from ICANN activities), beleagured staff members, G-men, NGO types, ccTLD reps, techies, salesmen, and confused-looking locals. Like it or loathe it, the travelling ICANN meeting is a big deal for the local hosts and the Internet community of the country and region it’s in. It’s their moment to come together as a group and strut their stuff on the global stage. The latest security warning about Nairobi concerns a known threat, the possibility of a terrorist attack by Al-Shabaab, a Somalia based Islamist insurgency group. The group has said it will attack if Kenya supports the Somali Transitional Federal Government. The UK Foreign & Commonwealth Office put out a warning <http://www.fco.gov.uk/en/travel-and-living-abroad/travel-advice-by-country/…> in December 2009 that terrorist attacks throughout Kenya remain a high risk, but that only non-essential travel to near the Somali border is to be avoided. Like London, New York or Washington DC, Nairobi functions admirably despite a constant threat of terrorism. However, the US State Department has just issued a specific warning about possible suicide attacks on the Kenyatta Conference Centre where the meeting will be held. It says the individuals planning on carrying out attacks have been living in Somali communities within Kenya since early February. Although the Board just voted a couple of weeks ago to go ahead with the Nairobi meeting despite the more general security concerns, the latest warning has re-opened this tough question. Ultimately, ICANN’s CEO and Chairman must weigh up the risk of bringing over a thousand people to a potential terrorist target. Their decision isn’t simple as that sounds. Chances are, no attacks will happen and the meeting will be a success. But I suspect the maxim ‘if we cancel it, the terrorists have already won’ has a lot more rhetorical than practical weight if you’re the person on whose conscience the safety of hundreds of people will sit. The Nairobi meeting is hugely important to the people directly involved, in a way I’m finding hard to articulate. As well as the official programme, endless meetings and interactions will take place that are very important to the African and indeed the global Internet community. The solidarity and awareness of what it takes to keep the Internet going in different parts of the world grows from talking and sitting side by side for hours in endless technical workshops and council meetings. It can’t be got any other way. Or put it another way, if the meeting gets moved to ICANN’s home base in Los Angeles, lots of people who would have come won’t be able to. Not least because of visa problems. If ICANN Nairobi has to be cancelled, the loss in the Internet community’s regional momentum and global amity will be great. Over the years, I’ve heard a lot of carping – from mostly American community members, I have to admit – about ICANN going to high-crime places like Sao Paolo, Delhi or Mexico City. In my experience, the non-Americans in the Internet community are markedly sanguine about visiting visiting poor and potentially dangerous places. When we cancelled Nairobi last time round, the Kenyans had to more or less button their anger and disappointment to stay in the game. But it’s infuriating to be told by people you work with that they can’t possibly risk themselves in a city you live in year round. However, there is a qualitative difference between visiting a city with a lot of crime against property and one where you may be a live target. As a nonprofit with a public interest mission and a healthy contingency fund, relocating the meeting will hurt ICANN, but not mortally. I’m sure as I write that the meetings team is triggering its contingency plans to hold the meeting elsewhere if needed. It can be done. I just hope it doesn’t have to be, and that more information about the security threat means fore-warned is fore-armed. Already, a couple of companies have pulled their people regardless. That’s their choice. This time it has more bite than the usual xenophobia: the COO has published <http://nbo.icann.org/meetings/security-information-11feb10-en.htm> a US Department of State report that lists the conference centre itself as a specific threat from a Somalian insurgency group, Al-Shabaab <http://en.wikipedia.org/wiki/Harakat_al-Shabaab_Mujahideen>. In response, a number of Internet companies have already announced they are pulling their people. The Kenya conference was cancelled last year following election violence, and the meeting this year has been under a constant review – with the Board finally deciding the bite the bullet at a meeting <http://www.icann.org/en/minutes/minutes-22jan10-en.htm> on 22 January (my heart, incidentally, goes out to my former colleagues in the meetings team who have a near-impossible job of preparing for over 1,000 attendees at short notice). Now there is fresh discussion about whether to go ahead with the meeting – due to start on 7 March. Maria Farrell has written an interesting post <http://crookedtimber.org/2010/02/12/14645/> giving some background (although, I feel the need to point out that the attendees at ICANN meetings are: one third regulars; one third occasional; one third entirely new – my analysis online here <http://public.icann.org/meeting-participation-data>). So I thought I’d write a post pointing out how this bad news can be turned around to be positive for the organization. *If the meeting goes ahead…* It is a terrific opportunity for ICANN to really work on remote participation since large numbers of ICANNers will not be physically attending. This fact has not been missed (thank god) by the Board’s Public Participation Committee <http://www.icann.org/en/committees/participation/>, which has been pushing for participation guides at its past <http://www.icann.org/en/minutes/minutes-ppc-27jan10-en.htm> two <http://www.icann.org/en/minutes/minutes-ppc-13jan10-en.htm> meetings. I am delighted to see this approach, especially since it was a main recommendation <http://kierenmccarthy.com/2009/12/01/public-participation-my-icann-leaving-…> of mine in my leaving report <http://kierenmccarthy.com/2009/12/01/public-participation-my-icann-leaving-…> as general manager of public participation. Most of the tools for effective remote participation are already in place. What is missing are the cultural and procedural guidelines to make the most of them. With lots of people unlikely to attend, this is an ideal opportunity for ICANN to step up a notch and start making remote participation a functional reality. *If the meeting is cancelled…* Then I sincerely hope that the Board decides to simply cancel the event and reinvest the $2 million it costs to run an ICANN meeting (or as much as it can recoup) into events that focus people’s attention on the issues that need to be tackled. There are only really two things of importance that the Nairobi meeting is going to cover: the Expressions of Interest model for new Internet extensions (whether people have to pre-apply for their gTLD); and the registry/registrar separation issue (the rules surrounding the split between those who sell domains and those who run the Internet registry itself). The Board is going to make the decision regarding the Expressions of Interest. And it has lots of comment <http://forum.icann.org/lists/draft-eoi-model/> from the community following a very active public comment period. I’d like to see the Board meet physically somewhere else (Los Angeles?) for a week and really tackle the issue and do what it needs to do – make a decision. The community has had its say, having another meeting on the issue is only chewing up valuable time. And wrt registry/registrar separation – well, it seems that there is work being done on that by the Board, as made clear in the latest Board minutes (item k) <http://www.icann.org/en/minutes/minutes-04feb10-en.htm#k>. So why not have the staff focus on producing the work the Board has asked for, and then have the Board spend a week discussing and reviewing the issue, coming out with firm recommendations for review – rather than engage in another largely pointless and time-consuming community discussion that is scheduled for Nairobi. The other HUGE advantage to cancelling the whole meeting would be to overcome the status-quo fears of some in the community about moving from three to two international public meetings a year. Over the past four years, first Susan Crawford (ex-Board member and former advisor to President Obama), then Paul Levins (ex-VP of Corporate Affairs and the man who negotiated an end to the Joint Project Agreement), and then the Board Public Participation Committee as well as the Head of Meetings have all argued that ICANN should reduce the number of large international meetings the organization runs each year. Having studied this issue closely myself, I have absolutely no doubt that reducing the number of international public meetings would benefit both ICANN and the community. All it requires is the community to get over its fear of change. And cancelling the whole meeting will cause minds to focus, and provide some funds to think about what meetings do need to happen to move the organization’s work forward. So, possibly, hopefully, this Nairobi problem will end up a blessing in disguise.

I can think of four reasons why cable vandalism would occur: 1. Malicious – cable theft: The thief benefits primarily from reselling the metal (is fibre ever resold/). 2. Malicious – corporate sabotage: The thief’s organization will benefit from the service woes of a competitor. 3. Benign – construction work: Someone digging a foundation, trench or similar inadvertently severs a cable. 4. Benign – accident: An unforeseeable event occurs that damages the cable. I don’t have data about the breakdown of the incidences into these four categories. I believe we need to collect real data first before prescribing a solution. However here are my thoughts about how we should address each of these if the incidence warrants it. 1. Cable theft: This is petty thievery; we already have enough statutes in our books to address the perpetrators. The recent ban on the export of scrap metal may have helped – the decline in copper prices may have helped more but prices have been recovering. 2. Corporate sabotage: We need a level competitive playing field and if there is corporate sanctioned sabotage against competitors then the perpetrating company should have some real sanctions including imprisonment for guilty executives and possibly even the loss of their licenses. Telkom in recent press reports seems to be strongly alluding that this is what is going on. 3. Construction work: In Connecticut, (and many other parts of the US), it is the law to call a hotline 48-hours before digging. A joint effort by all the utilities & municipalities in the state (water, electricity, telecoms, sewerage, gas etc) is responsible for coming out to your site and marking where the underground utilities are buried. (There is a call centre to field the calls!) Failure to do so has real consequences on the contractor if there is damage to utilities. 4. Accidents: Nothing we can do here. I am shaking my head in disbelief at the suggestion that any of these (that does not result in death or injury) may even be construed to be a capital crime. *Erasing our innovation deficit* By Eric Schmidt Tuesday, February 9, 2010; 10:14 AM We can see it reflected in our search trends at Google: Too many people are out of work, and the fear of unemployment is changing the behavior of millions more. In the fall, searches related to back-to-school shopping and holiday travel bookings peaked weeks later than usual, as families put off spending as long as possible. At the same time, queries for payday loans have gone up a third in the past two years. To spur job creation and alleviate the fear of unemployment, the United States will need to tackle what Commerce Secretary Gary Locke has called our "innovation deficit<http://www.commerce.gov/NewsRoom/SecretarySpeeches/PROD01_008778>." We have been world leaders in innovation for generations. It has driven our economy, employment growth and our rising prosperity. But much of the cutting-edge research and development in key areas such as renewable energy now takes place outside the United States. There's a real chance that the "green Silicon Valley" will take root in Germany or China. We can't afford to let that happen. Addressing the innovation deficit requires rethinking our innovation model. We can no longer rely on the top-down approach of the 20th century, when big investments in the military and NASA spun off to the wider economy. Now that the Internet has put abundant information and powerful tools in everyone's hands, innovation is often driven from the bottom up. The ideas that power our next generation of growth are just as likely to originate in a coffee shop as in the laboratory of a big corporation. More than ever, innovation is disruptive and messy. It can't be controlled or predicted. The only way to ensure it can flourish is to create the best possible environment -- and then get out of the way. It's a question of learning to live with a mess. First, start-ups and smaller businesses must be able to compete on equal terms with their larger rivals. They don't need favors, just a level playing field. Congress should ensure that every bill it passes promotes competition over protecting the interests of incumbents. Second, encouraging risk-taking means tolerating failure -- provided we learn from it. If we want to be a leader in new industries such as green energy, we have to accept that some of our investments won't pan out. Show me a program with a 100 percent success rate, and I'll show you one with 0 percent innovation. Third, we need to invest more in our knowledge base. The decision by Congress to double science funding last year was a big step in the right direction. Now we need to extend the R&D tax credit so businesses can confidently invest in their future. Fourth, information must become even more open and accessible. Government-funded research should be made public through "a Wikipedia of ideas," so entrepreneurs can harness ideas commercially. High-speed Internet access must be much more widely available. Broadband is a major driver of new jobs and businesses, yet we rank only 15th in the world for access. More government support for broadband remains critical. Finally, we need to hang on to talented people. The best and brightest from around the world come to study at U.S. universities. After graduation, they are forced to leave because they can't get visas. It's ridiculous to export such talent to our competition. We have everything else we need to climb out of the current morass. Right now, somewhere in the United States, someone is working at a kitchen table, in a dorm room or a garage, developing an idea that could not only create a new industry but could also just possibly change the world. It might have asserted full U.S. governmental control, or it might have turned over the functions to an international body such as the International Telecommunications Union. Instead, it created a "private-public partnership", incorporated as a California "nonprofit public benefit corporation", with a charter giving the company a dual mission of quasi-governmental functions combined with responsibility for operational stability of the Internet. In all its deliberations, the ICANN Board must maintain a balance in its mission of lessening the burdens of government and promoting the global public interest in the operational stability of the Internet. ICANN has the responsibility to draw the fine line dividing two contrasting areas, one where it should not go, and the other where it risks not doing enough. On the one hand, ICANN cannot become involved in areas such as content control and rule making in areas unrelated to operational stability. On the other hand, ICANN's self image as technical coordinator has at times constrained it from taking action necessary to discharge its public interest obligations, such as, for example, requiring registrars to comply with their contractual obligations. ICANN's recent attempts to find a way to insert new top level domains in the root zone file illustrate the difficulties of achieving this balance. From a purely technical point of view, there is room for many additional new gTLDs in ASCII and in IDN.IDN versions. There are concerns about stress on the root zone, but it appears that this is a manageable risk, and ICANN is taking responsible steps to deal with it. On the other hand, the whole question of how new generic top level domains would serve the public interest has never been openly considered by ICANN. The current proposal for an Expression of Interest proceeding illustrates this. Instead of being a straightforward determination of who might want to apply, the proceeding risks becoming an avenue for well-financed commercial applicants who treat the domain name system as a species of investment opportunity comparable to real estate. This is a far cry from the public interest in making names available to people who want to use them. The proposals for selection of new top level domains present even more serious problems. There will very likely be multiple applicants for some popular strings, and ICANN has the job of selecting from among the competitors. There will also likely be applicants for strings that are obscenities or phrases intended to inflame social or religious conflict. >From the standpoint of ICANN's obligation to serve the "global public interest in the operational stability of the Internet", ICANN cannot allow these into the root. In addition, there is the continuing problem of minimizing trademark infringement opportunities. For better or worse, the United States government demanded in 1998 that ICANN become the enforcer of a global system of trademark rights. This quasi-governmental function, in the form of the UDRP, became part of the otherwise more technical duties assigned to ICANN. The extension of this involvement with trademarks is possibly the most serious test of ICANN's abilities to promote the public interest. ICANN's Draft Application Guidebook (the "DAG") for new gTLDs attempts to find the appropriate mechanisms for taking into account the sometimes conflicting responsibilities described above. The first and second drafts, issued in October 2008 and February 2009, respectively, were not successful in many respects. These drafts demonstrate, all too clearly, ICANN's reluctance to face its public interest responsibilities. ICANN proposes to create a system of independent decision makers to decide such questions as likelihood of confusion between different proposed strings for new gTLDs, alleged infringement of legal rights by a proposed string, and objections based on morality, public order and community objections. Of these, the first and second are probably amenable to objective determinations based on internationally recognized principles of trademark law, although there are serious questions as to how far ICANN should go in creating what amounts to international law. As to the questions of morality, public order and community objections to applications for new gTLDs, these can only be tested against conceptions of the public interest. ICANN apparently believes that getting a third party to do this work relieves ICANN of its responsibilities. There are two problems with this approach. First, there is nothing to indicate that any third party has either the expertise or authority to make these judgments better than ICANN, and second, ICANN's mission to serve the public interest does not allow it to delegate its responsibilities to outsiders. Further, ICANN apparently hopes that its self-serving requirement that all gTLD applicants waive all legal claims against ICANN will insulate it from litigation. ICANN is certainly justified in its fear of litigation. As a creature of California law and subject to US federal law, this risk is always present. However, attempts to pass off to third parties ICANN's obligations to make judgments about the public interest will not lessen this risk, and may in fact increase it. The waiver of legal claims applies only to applicants for new TLDs, not to third parties that may be adversely affected by the process. As another example of ICANN's failure to face up to its responsibilities, ICANN proposes to create independent evaluation panels to choose from among conflicting applicants for the same new gTLD string. The call for expressions of interest states that evaluators must be capable of exercising subjective judgment. ICANN may have a legitimate need to consult with outside experts, but they cannot be allowed to make the final decisions. There are no grounds for a belief that a third party's subjective judgment would give better results than decisions made by ICANN's Board. The Board clearly must face up to its responsibility to make judgments in the public interest, based on the experience and expertise of the Board members. To ICANN's credit, it finally realized that there is a connection between the creation of large numbers of new gTLDs and the public interest in preventing a vast increase in cybersquatting and the spread of fraudulent practices. The first two drafts of the DAG neglected to deal this issue in any serious way, but since then ICANN has taken steps "to develop and propose solutions to the over-arching issue of trademark protection..." It is still an open question whether or not ICANN's current proposals will be adequate to serve the public interest in protection of the legitimate rights of trademark owners. ICANN has not been so successful in dealing with other overarching issues. In October, 2006, ICANN's Board asked that a comprehensive economic study be completed before the introduction of new gTLDs, but it was never made. Instead, ICANN produced economic studies that purport to justify its proposals for a radical change in the policy of separation of registry and registrar functions. Whether or not this change will serve the public interest will apparently be judged by the results of the experiment, and not by a considered weighing of relevant evidence. Even when ICANN grasps the concept of its public interest responsibility, it does not always come up with a reasonable approach to a particular problem. For example, the current proposed base agreement for new registries includes a provision allowing ICANN to amend the agreement unilaterally. While there may be a need from time to time to take account of changing circumstances, this brute force approach can hardly be justified as serving the public interest in a stable relationship between ICANN and the new registries. Despite the concerns outlined here, ICANN has done most of the right things it was created to do and it continues to deserve our support. It is very unlikely that a single government or international organization could better fulfill the obligations undertaken by ICANN. However, a lot of work remains to be done, and ICANN must pay a great deal more attention to its global public interest responsibilities.

Unfortunately, all the efforts to understand the vice focus on the cyber crime against property and against governments. The only other notable effort against the person is against the child. While cyberspace have provided secure tools and spaces where women can enjoy their freedom of expression, information and privacy of communication, the same benefits of anonymity and privacy also extend to those who employ ICTs for criminal activities and use the internet to commit violence against women. The use of mobile phones and internet to stalk, abuse, traffic, intimidate and humiliate women is palpable in developing countries including Kenya. The lack of specific cybercrime/cyber security legislation makes it even more difficult to punish those who use ICTs tools to conduct violence against women. Kenya Communications (Amendment) Act 2009 focused on the cybercrime against property and not the person. Kenya is not alone but that is not a consolation. With increased use of internet in Kenya with the onset of broadband, it is necessary to create the necessary policy / regulatory and the operational framework to reign in the vice. KICTANET and IDRC has launched a study on the vice whose research questions are: 1. What is the prevalence of cybercrime against women in terms of degree, level, quantity, and distribution? 2. How does cyber crime affect women differently? (Demonstrate spiral effect and determine if women are already intimidated by cyber space e.g. mailing lists, how active do women participate in debates? Is the design of the cyber already woman unfriendly?) 3. What are the current measures and gaps (technological, legal, social, and psychological) to address cyber crime against women (local, regional, and global)? Map the efforts (lessons of best practice). 4. What mechanisms are appropriate for addressing cyber crime against women? Kictanet, with support from the IDRC will mount a validation workshop to review literature as well as the research strategy on Feb 16th, 2010 as detailed below We have limited spaces (free) for you or your colleague at the workshop.
