Fiscal Budget FY 2013 - ICT Stake

Listers, When all is said and done the money / numbers will talk about the commitment to make ICT work in Kenya. Out of curiosity, is there a proposed request to the government by the industry on how much and for what will be needed to grow it further, create more jobs etc etc? As one lister said not to look as one who just points out but provides a solution. 1. Earlier discussions on this forum to have a representative industry body went mum - I hope it does not mean they are over. 2. If the wearer of the shoe seems comfortable I guess the government can go ahead and direct all the funds to the election 3. Lack of active objective engagement by providing a policy view to the government locks out any hope of funding (yet your / our companies pay tax) 4. Opportunities to grow, develop, create jobs etc continue to be lost and worse still taken up by other countries. 5. I believe the discussions and an open letter (Dr Ndemo, Paul Kukubo, Dr. ... can advice on the best protocol) My initial 1 cent on the approach but without solid numbers; 1. Structural interventions - financing. 2. Operational - tax breaks, etc 3. Capacity building i.e., centers of excellence, subsidized I.T training etc, training rebates for companies that retain workforce for a period of time etc 4. Research note my earlier mail on not having numbers and anaylsis of ICT sector even in the economic survey 5. VAT and WT harmonization to allow regional play. I've lost a number of deals on this account 6. Incentives to investors and clients 7. Market development Any better thoughts and hopefully an action that could see a proposal of inclusion in this years budget reading. Have a pleasant week. Regards, Patrick M. Karanja

Yes, I had a card. Are you saying that the process is easy? Were you able to get info online? You didn't have to produce physical receipts? If this is the case then I guess my beef is with Agakhan Hospital not NHIF.. Economic Survey 2012

Dear Listers, I just went through the highlights of the Economic Survey 2012 with a level of disappointment albeit expected. Once again, I see no profound indications or recognition that ICT is a key contributor to the economic growth. Which brings me to the point, is there any data on the the ICT sector? In more than one occasion, I've been had to look for data e.g., how many companies, number of employees, revenues (local and exported), types of services, tax contribution etc. If these numbers are not reflected yet we have this as one of the key pillars in the Vision 2030 how can we measure progress or plan for interventions? http://www.knbs.or.ke/Economic%20Surveys/Ministers%20Presentation%20ES%20FI… Regards, Patrick M. Kenya' Road Safety Status

Listers As you debate the very grave road safety situation in Kenya, we would wish to share this preliminary information from a study we are conducting on the accuracy of road safety data. Good data is critical for effective policy formulation, implementation and evaluation. Anecdotal evidence suggests a significant level of underreporting, compounded by errors in other complimentary data sets. However, on the basis of what is available, we aver that the major problem in respect of road safety in Kenya is a human problem. That is our weakest link. How to deal with it is key. Longonot Erruption

There have been reports in media about a looming eruption of Mt. Longonot, including localised earthquakes with the ground having huge cracks. Today morning, the Mai Mahiu - Naivasha road has been closed due to huge cracks on the road rendering it impassable. They've used discussion boards for brainstorming, and they've used SharePoint to share specifications. Fahrenkrug says one goal of SharePoint was to eliminate as much paper as possible to reduce printing and shipping costs and support the Van Andel Institute's environmental sustainability efforts. "We wanted to be as environmentally friendly as we could," he says. The collaborative workspace certainly helped: Culhane and Fahrenkrug have shaved as much as $250,000 off the cost of the project because they were able to reduce the amount of paper they had to print and ship around the country to the various architects and contractors by 50 to 60 percent, compared to typical past projects, says Fahrenkrug. Campbell also believes the construction process has been expedited because architects and engineers don't have to wait 24 hours or more for the documentation they need to do their jobs. "Turning documents around faster translates to building faster and that translates into cost savings on labor," says Campbell. "SharePoint has worked pretty well, adds Fahrenkrug. "It saved a ton of time and a lot of money and trees, but it hasn't been flawless." Specifically, SharePoint took some getting used to, and its workflow didn't support the project's requirements out of the box, he says. Provisioning proper access for users was also tricky using SharePoint TeamServices. But the consultants and the Van Andel IT staffer who developed the site worked around those difficulties and crafted a solution that has largely met everyone's needs. Here's a inside look at their solution and what it accomplished for Van Andel's building expansion. Building a SharePoint Site Kim Jeffries, an application analyst at the Van Andel Institute, began developing the SharePoint site in February, 2006. She first met with Culhane and Fahrenkrug's administrative assistant, who explained which stakeholders were involved in the design phase of the construction process and the associated workflows. The admin told Jeffries that the project was going to have different teams focused on areas such as brainstorming, parking, construction and sustainability, and that these teams would need different levels of access on the site. She gave Jeffries a spreadsheet listing all of the people involved in the design process and the levels of access they'd need. Culhane and Fahrenkrug also wanted an area of the site that only they could use. "We drew it all out and we ended up with a home page that everybody hits, with about five sub-sites off the home page, a couple of document libraries, main contacts, discussions and at least one private site for our owner rep team [Culhane and Fahrenkrug]," says Jeffries. Because the Van Andel Institute was already using SharePoint Team Services internally at the time, Jeffries had to build accounts for each participant locally on the existing SharePoint server. Then she had to bring in each participant page by page, library by library, and meeting workspace by meeting workspace. She says provisioning access for users in Team Services was "tedious" and "the most difficult part" of building the site. It took about 40 hours over the course of a month to get the site up and running, Jeffries says. When it was complete in March, she turned the design and the content administration over to Fahrenkrug and Culhane's administrative assistant. Jeffries continued to create accounts for new teams and individuals as they came on board, because that process was complicated and it needed to be done on Van Andel's local SharePoint server. Fahrenkrug says it generally took users two to three weeks to get accustomed to SharePoint. Jeffries hired a local training center to teach the owner representatives and a handful of employees from the architecture firm and construction offices to use Sharepoint. But, Fahrenkrug says, most users learned the system on the fly. Though the SharePoint site took some getting used to, Fahrenkrug says, the user interface is more intuitive than an FTP site, which looks more like a computer file than a web page and never offers enough storage, in his experience. As such, SharePoint makes storage and retrieval of documents easier, he says. Users can access the site whenever they want; and they don't have to wait for Federal Express<http://www.cio.com/article/397263/subject/Federal+Express+Corporation> deliveries. Jeffries adds that users receive alerts via e-mail whenever a new document is added to the site. When users need to find a spec, they can simply type the name of it into the search engine on the home page, which takes them right to it, as opposed to drilling through folders to find it, he notes. Troubleshooting problems is also easier on SharePoint than on an FTP site, says Fahrenkrug. "If people couldn't get into an FTP site, it was pretty hard to figure out why," he says. "With SharePoint, my admin can go in, figure out why they can't get access, and if there is a glitch on our end, we can easily fix it." Tips for Getting the Most From SharePoint *1. Train users.* "If you can't get people to use SharePoint, putting a site together is not worth the effort," says Kim Jeffries, an application analyst with the Van Andel Institute. *2. Give novice users targeted tips.* "When I created an account for a new SharePoint users, I sent them an e-mail with their user name and password and some quick tips on how to access the account, what level of security they had, and what that meant in terms of what they could and couldn't do, how to use the calendar, and how to use a document library," says Jeffries. *3. Follow the three-click rule.* Within the SharePoint site, says Jeffries, keep content as close to the surface as possible. "You should be able to get done what you need to get done in three clicks," she says. *4. Make sure you have enough storage.* By the end of the Van Andel Institute's building expansion, the SharePoint sites might take up one terabyte of storage, says Bryon Campbell, CIO of the Institute. *5. Understand SharePoint's capabilities and limitations.* "SharePoint is not the end all be all of software, but it works if you understand what it can and can't do," says Matt Fahrenkrug, owner of Culhane & Fahrenkrug Consulting. "By understanding that, you can manipulate the software and get to the result that you want." *--M. Levinson* Upgrading to Microsoft Office SharePoint Server<http://www.cio.com/article/397263/subject/Microsoft+Office+SharePoint+Server> (MOSS) When the Van Andel Institute migrated to Microsoft Office SharePoint Server (MOSS) in January, 2007, Jeffries had to update external users' security levels because they could no longer access their specific site with the local accounts she had originally set up for the previous version of SharePoint, Team Services. (Security is set up differently in Microsoft Office SharePoint Server than it is in Team Services.) Drawing on research she had done about the best way to set up user access on MOSS, she worked with the Van Andel Institute's server administrator, Russell VanderMey, to create Active Directory accounts which she could then bring into SharePoint. VanderMey created an external Active Directory domain that's not on the Van Andel Institute's network, yet provides Jeffries with a domain that she can use to create and maintain security for SharePoint users who are not Van Andel employees. "With MOSS, the maintenance is so much easier because I created security groups for every level necessary on each page and sub-site and I created security groups within SharePoint," says Jeffries. "Now, when someone new joins, I go out to the external active directory site, I get their name and plug them into whatever site they need to belong to." Jeffries adds that it now takes less than five minutes to provision access for users, because she doesn't have to drill through 30 sub-sites to maintain security. SharePoint Key to New Submittals Process In June, 2007, Fahrenkrug came to Jeffries with a new request. A new phase of the project had started—the submittal phase—and he needed technology to support it. During the submittal phase, architects and engineers create drawings which they release to subcontractors, who bid on the projects and create new, more detailed drawings. These documents then get sent back to the architects and engineers for review and approval. "I thought this was a huge undertaking," says Jeffries of the submittal phase. "If we could get a solution for them using SharePoint, it would be huge." Her first effort to use Microsoft Office SharePoint Server to automate the submittal process ran into complications. SharePoint's workflow didn't support the architects' and engineers' needs. They wanted to use a certain naming convention for .PDF files, and they didn't want users re-naming files. The problem, says Jeffries: SharePoint wants users to rename .PDF files after they've checked them out of a library and are ready to return them. To fix this problem, re-coding SharePoint would take too much work and would complicate software updates and patches. So Jeffries wound up creating three separate sites—one called submittals out, where all specifications are uploaded for review; a coordination site, where the architects can review the contractors' changes and suggestions; and a third called submittals in, where the architects submit specs to the owner reps. She says creating three separate sites was much easier than customizing the software. The beauty of SharePoint is that it makes creating these sites a cinch, she says. Setting up three separate sites also ensured that all of the versioning that needed to take place during each phase of the submittal process happened in the right site, and ensured that versioning was complete at each phase of the submittal process, says Jeffries. The sites went live on July 13. Today, the Van Andel Institute has four SharePoint sites supporting the construction project, with 18 document libraries for each of the three submittal sites and 25 document libraries on the original SharePoint site used for the design phase of the project, says Jeffries. Each folder within each of the document libraries on the submittal sites can contain 100 or more documents. "The paperwork alone being maintained here is amazing," she adds. The sites support 108 users and 200 or more gigabytes of storage according to Fahrenkrug. Fahrenkrug estimates that the new building, which is expected to be complete late next year, is about 40 to 45 percent complete today. "It's right on schedule. It's on budget," he says. When things are not done well, we must be honest enough to acknowledge where things went wrong and to come up with some proposals on what will be done to improve the works and address the high road carnage. Rather than resort to the usual defensive position - that does not help anyone Minister Bett. I would have expected you to have an open forum to discuss the concerns of Kenyans rather than be so dismissive! Despite being assured that the issue had been brought to the attention of Eng Kidenda, there is no response to date! Grace, I wonder if you had any luck in reaching Eng Kidenda for an open debate. While on this subject, I am wondering whether the ministry has communications personnel to address such public concerns. With the plethora or media outlets (FM radio, sms, twitter, facebook, etc.) they could be putting appropriate messages out there to keep the public informed, e.g. road closures, accidents, speeding warnings, etc. Ama? Regarding being upright citizens and driving according to the traffic code, I must repeat what I have said once: you lose if you are the only one following the rules. As well, without an effective stick to penalize offenders, little will change. Here the "bullies" win and the tendency them is for everyone to become a bully, breaking the rules because it appears to "pay" for the bullies. Having the law is one thing; enforcing it is quite another. A law with no enforcement serves no purpose. Yes, this is one of the cases I know about. I wouldn't even be surprised both Kidenda and his PA know very little about e-mail communication! Write a letter by snail mail and you are very likely to get an acknowledgement/response. In certain quarters, they don't take e-mail that seriously. Africa’s tech hub, Kenya, is a pioneer A decade ago, there were little more than 50m mobile phones being used in Africa. Today, you can add a zero to that figure and then some, making the continent the world’s fastest-growing region for mobile penetration, with more subscribers than the US or the European Union. In certain countries, more citizens now have access to mobile phones than to clean water, a bank account, or electricity, and for these individuals, the cell phone means a lot more than ease of contact. Africa’s technology revolution means access to data and to financial services. For governments, it means a new way to overcome bottlenecks, roll out services and achieve development targets. “Back in 2000 the whole continent had less connectivity than Luxembourg – Africa with almost 1bn people, and Luxembourg with less than 1m – but that’s changed significantly,” explains Tim Kelly, lead ICT policy specialist at the World Bank. That is due to new undersea fibre optic cables, such as The East African Marine System, as well as better inland connectivity, he says. “Putting that connectivity together with much wider access to ICTs, particularly mobile phones, you’ve got the makings of a success story.” Used as an outlet for political frustration, mobile phones, internet and social networking can help topple governments – for proof, look to the Arab Spring. They have the power to make administrations more democratic, transparent and accountable. They offer citizens real-time political participation and the chance to expose corruption. Yet the real potential of these technologies is not in sweeping democratic reforms, but in “the less glamorous side of democracy”, Mr Kelly argues: issues such as “fixing your water pump”. Aware of all this, many municipalities are taking advantage of the rise of ICTs to improve the lives of their citizens and overhaul the way in which populations and businesses can interact with public sector representatives. In Kenya, a trailblazer in the sector, the government’s development blueprint – the Kenya Vision 2030 – draws heavily on science, technology and innovation as foundations for growth. “There has been a lot of progress in building the infrastructure, developing local content and local applications. Kenya’s IT infrastructure is actually better than most developed countries, and the diffusion of IT in Kenya has been very high,” says an enthusiastic Bitange Ndemo, permanent secretary at Kenya’s Ministry of Information and Communications, citing the now universally-touted example of Vodacom’s mobile money platform M-Pesa. It is now time for the public sector to play catch-up, he says: “We have been able to develop applications that have put Kenya on the world map in terms of software development… Now, we want to get to a point where we can use the mobile platform for the interface between the citizens and government – so they can deal with the government without necessarily having to travel to government sites.” This requires further progress in basic ICT infrastructure, though, and the fast transfer of government data to online platforms. Under the country’s Open Data Initiative – launched last year – the government has been working with World Bank support to upload almost all existing government registries. Data on everything from national censuses and exam results, to government expenditure and public service locations – and everything in between – is being digitised. “We’ve made a lot of progress in areas like the judiciary and land registry, and we are now digitising health records – starting with Kenyatta National Hospital and moving onto the district level,” Mr Ndemo explains. Those records mean big savings in terms of efficiency, but have broader implications: “To be able to provide records over periods of years – this is what we never used to have in Africa, but we are changing that,” he says. Records will provide crucial insights into health trends and support local research. From next year, the government will roll out its focus to e-procurement services, which could save it an annual $1bn. Add that to the estimated $2bn in potential savings by putting judicial records online, and an additional $5bn from efficiency gains within agriculture, he says, and the gains become clear. “We thought about using technology to focus on business process outsourcing for countries like Britain and the US – like India did,” Mr Ndemo says. “But India looked more to the outside world and has not utilised IT to improve livelihoods. There is nowhere we could get up to $10bn from and be able to bring that back to the economy. Better for us to use IT to look at our internal inefficiencies, and net the savings to improve the livelihoods of your citizens.” When it comes to evolving strategies for e-government, Kenya is by no means alone. Countries from Mauritius to Sierra Leone and Uganda have had success in implementing so-called integrated financial management information systems which let governments manage their budgets and report revenues. In 2010, the continent’s economic powerhouse, South Africa, declared the ICT sector a top priority. While progress in the field has been uneven, donors hold up the country’s electronic tax filing systems – managed by South African Revenue Services – as a world class model. For governments, providing these services means better collaboration, both between ministries and with the private sector. “Smart City” initiatives are being rolled out in cities such as Cape Town, and here too Kenya’s government has embarked on a project – this time in partnership with IBM, which is hoping to provide solutions for energy, security and, above all, traffic issues in Nairobi. The group hopes to use cell phones, for instance, to pinpoint traffic build ups in the notoriously congested capital city. By collecting this data, “you can start to predict and make analyses of alternative routes, and provide that information either to the city planners, or to the traffic police, or to emergency vehicles,” explains Anthony Mwai, country general manager, IBM East Africa. Across the continent, governments are working with businesses to roll out services that can help overcome constraints such as low agricultural productivity, and the dearth of doctors and educated teachers. “What we need now is to deepen the services we provide and innovate in other areas: health, agriculture, e-learning – we want to leverage on IT across every sector,” Mr Ndemo says. In Kenya, where there are only around 1.5 health workers per 1000 of a 40 million population, many rural clinics do not have internet access or even electricity – creating problems for the delivery of test results to patients. Here, the traditional approach involved taking blood samples at rural clinics, which were sent on to five national health laboratories, with the results posted back. “It could take days, weeks, months, sometimes they didn’t even show up,” says Paul Ellingstad, director for global health at Hewlett Packard. “That created all sorts of problems. If you don’t have the results, the mother and father lose faith in the system, they don’t bring the child back. The child, because they are not diagnosed, isn’t started on antiretroviral treatment, and there is a 50 percent chance they will die by their second birthday.” Hewlett Packard recently partnered with the Clinton Health Access Initiative and Kenya’s Ministry of Health to develop SMS-enabled printers. “Instead of having to go through the post, you are texting back and printing out results at the rural health centre. So you have predictability, as well as compressing down into a matter of hours, or at most a day, the time taken to get results from the national lab to virtually any clinic around the country,” Mr Ellingstad explains. Mobile incubation hubs are popping up across Africa, bringing together mobile tech entrepreneurs and innovators. Of two supported by the World Bank, one is in South Africa, the other Kenya. Out of Nairobi’s not yet year old m:lab have sprung groups such as Shimba Technologies – a startup which recently released MEDAfrica, a smartphone app which wants to bypass the country’s shortfall of doctors by providing symptom checkers and medical advice. When users have identified their ailments, the app can then point them to certified specialists –thereby avoiding fraudsters. And true to ambitions, similar developments are springing up across sectors. Agriculture is an area of focus: “Previously we never measured productivity, over-utilisation of the land or productivity drops,” Mr Ndemo says. That is being changed by applications such as M-Farm, a service the World Bank’s Mr Kelly describes as “a kind of Groupon for farmers”, which allows Kenyan farmers to receive information about market prices, and aggregate to purchase inputs at wholesale value, and find buyers – all via text message. The setup bypasses productivity curbs, such as costly inputs or the middlemen who offer farmers below-market prices for their produce. It is also a monitor for productivity levels. Across borders, the meeting point between these technologies could spell the onset of new and sustained development across the continent. Problems remain, not least resistance to change amongst less educated citizens – an issue which Mr Ndemo counts as Kenya’s “biggest dilemma”. But mobile technologies and growing connectivity mean a unique opportunity to leapfrog growth constraints. For Africa, the mobile is both a product and a driver of a stronger, wealthier, more engaged society. This is a timely topic that needs deeper discussion and more insightful examination than can happen on a mailing list. It almost requires a conference of its own to address the many facets of media and its role in society such as informing, educating, provoking thought, challenging society when necessary, etc. Investigative journalism has been the basis of revolutionary changes in some societies. We need more of this in Kenya. Media, however, cannot be divorced from the society in which it operates. We hear of hints of how some media personalities are in the pockets of "money bags" (yes on the take) with the latter assured of being headline subjects regardless of whether what they do is significant or not. Rumours abound of stories get killed, stymied or "pumped up" once money is thrown into the works. Back in the 1990s Kenneth Matiba, in one of his rumbling press conferences, attacked the very same media he was addressing. It is said he fingered even the person that was exacting bribes from him in return for favourable coverage. Like other areas in our society, media is ethics challenged. Most professions in the country face the same; we need a social rebirth to entrench professionalism in service of the country. Yet, we must NOT condemn all media. Like in all other professions and society strata, there are a lot of good people struggling to do the right thing through and through. However, as a friend once remarked while we were stuck in a Nairobi traffic jam: if one is in an environment where everyone (majority sounds better) is breaking the rules, those that follow the rules suffer. The role of Media in political developement

Listers, Having watched a couple of programmes focusing on current political happenings i am left wondering on the role of the media, are some of this media houses engaged in political activism or are they educating the masses?. Why cant media houses be more innovative and focus on debates such as what we had on this list (Ndemo for president). This populist debates centered around opinions are a recipe for chaos. One just needs to look at what happened in Sabatia to know what can happen when this opinion contests are not handled well. The Committee on Development and Intellectual Property (CDIP) is meeting from 7-11 May <http://www.wipo.int/meetings/en/details.jsp?meeting_id=25013>. The committee exists to implement the 2007 WIPO Development Agenda. In general, it could be said that developing countries, which initiated the movement that led to the Development Agenda, are working to enact a substantive transformation at the organisation, while developed countries are eager to make improvements without drastically altering the agency. The work in the CDIP addresses a full range of WIPO activities. With a wide range of reports and activities being carried out, a wide range of WIPO professional staff and consultants are cycling through the committee. Projects range from databases, to competition policy, to flexibilities in IP law, to the public domain. Technical assistance is only one aspect, but it reaches into the core of the organisation’s orientation. On the first day, an attempt was made again by developing countries to create a permanent agenda item on “IP and development,” which developed countries again resisted on the grounds that it is repetitive with the title of the committee itself. But developing countries’ concern is that broader issues of IP and development do not have a place in a committee that spends most of its time working through specific projects. They have raised this issue for several years. The first day also saw a discussion of the relation of the CIP to other committees and activities within WIPO, which raises recurrent issues of how far-reaching the committee’s work is. The remainder of the week will focus on the WIPO secretariat’s extensive report on the implementation of the Development Agenda, and numerous project reports as well as evaluations of past projects. There are now some 23 projects completed or in the process of being completed, according to the secretariat. Deere/Roca Report A key element of the week’s agenda is to address an external review of WIPO technical assistance called for by member states and co-authored by Carolyn Deere and Santiago Roca. The report found numerous areas for improvement for member states to consider. Yesterday, the entire day was spent discussing the report, but no decisions were made on how to proceed. The chair is expected to draft a summary of this and other activities by week’s end. The day opened with a presentation to the plenary by Deere, who outlined a number of key recommendations from the report. These fell into the areas of transparency and mutual accountability, management and strategic planning, effectiveness and impact, good governance, and orientation. Deere, who is a senior researcher in the Global Economic Governance Programme at Oxford University, told the plenary that the report research was completed in August 2011. At the last CDIP in November 2011, the committee set up an ad hoc working group to look at the report and among other things identify where there might be redundancy in the report recommendations and help prepare for a committee decision on how to proceed (*IPW*, WIPO, 18 November 2012<http://www.ip-watch.org/2011/11/18/wipo-development-committee-completes-wor…>). Also at the last CDIP meeting, the WIPO secretariat was asked to respond to the Deere/Roca report. The WIPO management response was completed in March and reflects a number of improvements, including many in the past few months, leading to a debate over which Deere/Roca recommendations had already been addressed or whether and how the WIPO secretariat’s claims need to be confirmed. The secretariat clustered the Deere/Roca recommendations into three categories. Cluster A are those which are “already reflected in WIPO activities, or ongoing reform programs.” Cluster B is made up of those which “merit further consideration.” And Cluster C represents those which “raise concerns as to implementation.” The management response is here<http://www.wipo.int/meetings/en/doc_details.jsp?doc_id=199874>. Some developing country members said that some recommendations listed as completed in Cluster A may need to be confirmed. Co-author Deere took a similar view on this, suggesting the regularisation of a monitoring mechanism would be helpful. The Group B developed countries generally accepted the secretariat response and moved right into discussing items in Cluster B. But Group B appears to be looking to slow down the work of the committee. The *ad hoc* working group only began meeting in March, and was crippled in part by a lack of translation services. New DAG/African Group Proposal The African Group and the Development Agenda Group (which includes countries from other regions) issued a large, new proposal today on ways to take forward the Deere/Roca report. Under “relevance and orientation,” the groups proposed experts to develop guidelines with details on how to plan and implement more development-oriented assistance. The 17-page document also includes proposals for the WIPO program and budget, including moving “funds-in-trust” – targeted funding from governments intended for specific activities – into the regular WIPO budget, programming and reporting processes. Other proposals lay out steps for addressing: extra-budgetary resources; human resources; expert/consultants; transparency and communication; redesigning the technical assistance database; assessing impact, monitoring and evaluation; IP policies and strategies in countries; provision of legislative and regulatory assistance; IP office modernization, training and capacity building; coordination; and follow-up. The joint proposal also includes a 25-point appendix of guidance for WIPO, such as ensuring development cooperation assistance is more than just responding to requests, but also a dialogue with appropriate assistance. A presentation on the new set of proposals was made by Algeria on behalf of the DAG, but it could not be agreed by the committee how to proceed on it. Developed countries suggested they would need time to review the proposal. Protection and Development The WIPO Development Agenda’s 45 recommendations reach well beyond technical assistance and development cooperation, but there continues to be disagreement on how far they should go in the organisation’s activities. Last week, for instance, there was disagreement over whether it relates to the WIPO Committee on Standards. The discussion is reaching into the original purpose of the organisation, as the United States and Japan today raised Article 3 of the original WIPO Convention, noting that it does not mention development but does emphasise IP protection. The United States said a shift from an “IP-centric” to development-oriented WIPO would contravene Article 3. Victor ______________________ *The African Development Bank launches an eHealth award - Please share the information* On 19 April, the African Development Bank (AfDB) launched a competition for innovative and sustainable information and communication technology (ICT) solutions for the health sector in Africa. The eHealth Award aims to discover current work being done in the fields of e- and m-health in Africa; to encourage the production and sharing of knowledge on eHealth solutions, and provide added value through the sharing of lessons learnt in e- and m-health. The award targets a range of participants, including individuals, NGOs, development organizations, companies, academic institutions and research facilities. The criteria and focus of the award are centered on a) using ICT to increase access to health services, particularly for the poor and marginalized b) using ICT to increase the utilization of essential health services and/or c) the evaluation of eHealth solutions to improve efficiency in the delivery of health services. The deadline for submissions from participants is 30 May 2012. Submissions should be an abstract of 500 words from their projects, after which the shortlisted candidates will need to produce an evaluation report. Lack of Public Internet hot spots in Nairobi

Hi Listers, Just wondering aloud, are there hotspots in nairobi where the public can surf for free without having to seek permission/passwords. this happens in other large cities where broadband seems to be a human right. We start with the first part of a challenging look at a hallowed institution: the board of directors. The corporate board is on fire. Across the world, boards are under unprecedented pressure. Directors of listed companies are wilting under the glare of the spotlight of unrelenting public scrutiny. And many business thinkers now believe that this will be the decade in which we dramatically redesign the entire concept of the board of directors. That is entirely as it should be. The venerable institution called the board of directors has, in essence, remained unchanged for many decades. During this period, the business world has undergone dramatic upheavals. Information and communications technology has transformed the way business is done the world over. Globalisation has provided a quantum leap in the scale of operations of many corporations – whilst simultaneously opening them up to ferocious competition. Customers have used this new freeing of markets and the remarkable array of consumer technology now available to them to tremendous effect: to demand – and get – unprecedented choice and value for money. In response to this wave of unparalleled change, businesses have had to uproot their deepest structures. Organisational design has moved away from functional ‘silos’ to customer-facing processes. Companies have learned to define their ‘core competencies’ and narrow the scope of operations to doing that which they do unambiguously well – and outsourcing the rest. Information technology has penetrated every facet of the modern corporation. Reward and incentive systems have been transformed as the importance of attracting and retaining the best human talent is recognised in company after company. Yet the governance mechanism sitting right at the top of the corporation – the board of directors – has managed, by and large, to emerge unscathed from this turmoil. The structure is unchanged: a chairman and a dozen or so directors, some of whom are executives and others outsiders. Board composition is pretty much standard: retired (and tired) CEOs, politicians and professionals, mostly male. And board processes – how the board’s work is done – are largely as they were: quarterly meetings, following a rigid agenda; information provided by management in standard, predictable formats; a stage-managed annual general meeting where shareholders are wined and dined and thrown dividends. Is it really any surprise that this institution is in crisis? Where management teams have had to learn to be agile and nimble, boards have managed to remain slow and unwieldy. Where managers are being forced to rethink the fundamentals of their businesses every two years or so, board directors remain steeped in tradition and the business lore of yesteryear. Where managers rely on information that changes daily on the computer screens at their desks, directors receive carefully vetted, sturdily bound board papers that they have neither the time nor the inclination to peruse in any depth. This was a fire waiting to be lit. And once the first spark came, the flames exploded and spread right across the globe. We have seen a seemingly endless train of corporate scandals: from Enron, Tyco and WorldCom in the USA, to Marconi and Parmalat in Europe, and to the woes of HIH Insurance, Australia’s biggest insurer. Every time, the same message is rammed home: traditionally constituted boards of directors can do very little to prevent massive failures in management and ethics from taking place beneath their very feet. As billions of dollars of shareholders’ funds and employees’ dues have gone up in smoke, the reaction worldwide has undoubtedly been swift and emphatic. Presidents of nations have intervened, and committees and task forces have been convened. Grey heads have been asked to look at the failure in governance and recommend a way forward. And an apparently inexhaustible procession of codes of practice has emerged. Many years of weighty discussions and many acres of rainforest later, a consensus appears to be emerging with regard to ‘best practice’ in corporate governance. These things are good: a majority of ‘independent’ directors and an ever-tighter definition of ‘independence’; a separation of the roles of the CEO and chairman of the board; three core committees (audit, compensation and governance), all consisting of independent directors; board approval of company strategy; formal board evaluation of CEO performance; and, of course, handsome remuneration for directors for engaging in these arduous activities. These things are bad: an overly powerful CEO who has other directors in his thrall; non-executive directors with powerful incentives to influence board decisions in their own financial interest; large boards with unnecessary directors entrenched by history; boards that talk too much; boards that talk too little. So, out of the ferment of recent years, a consensus of sorts is forming. At its core are a couple of basic propositions: that boards need to be empowered to act on behalf of shareholders; and that board incentives need to be aligned with those of shareholders. The best way to achieve this, so the consensus thinking goes, is to ensure that board control is in the hands of directors who are independent of management. In short, the focus is on protecting shareholders from the nefarious designs of managers. And companies are at present falling over themselves to demonstrate their willingness to adopt these best-practice codes. Where are we in East Africa in this whole debate? Let us start by being quite frank: what does a position as a director in many of the region’s leading corporations entail? Firstly, one is generally invited to the board by one’s friends and allies in the corporate world, usually to join a particular political camp in that board. Secondly, one often actively seeks conflicts of interest: if one is a professional, one tries to sell one’s services to the company; if one is a politician, one marshals the company’s resources for personal use, particularly at election time. Thirdly, one really expects to have very little to do as a board member: a few tedious meetings every year followed by a sumptuous lunch; a board retreat or two at a beach hotel or 5-star lodge; a generally uneventful AGM where an occasionally troublesome shareholder livens up proceedings. Traditionally, local directors in eminent boards tend to be drawn from one of two sources. First, from the pool of retired CEOs who made their reputations in the boom years of the 1970s and 1980s (in Kenya at least), and who bring grey hairs, a certain fame and a stack of business stories from the monopolies of yesteryear to the table. Second, from the pool of politicians and political operatives who bring the possibility of putting the company on the inside track with regard to lucrative government procurement, or who can pick up the telephone to smooth out tricky problems that the company might face from time to time. I am generalising deliberately. Of course there are companies that are very competently governed, and directors who provide wise independent counsel through good times and bad. But there are very few. By and large, we are retaining structures that are totally irrelevant to the demands of the 21st century. We are appointing individuals that at best are invisible and at worst are subtracting value from the corporation. And we are stuck with information processes with that leave directors completely in the dark as to what is really happening within the company. In East Africa, executives are used to whining about the state of the region’s infrastructure, about what additional costs are imposed by insecurity and corruption, about the inconsistencies of fiscal and monetary policy. We are less used to taking a hard and honest look at the very structures and systems by which we manage and govern ourselves. If we start at the very top, we will see that the role and operation of the board of directors itself needs a fundamental overhaul. East African companies come in all shapes and sizes, from the large multinational to the small, rapidly growing trading companies located in the back streets of Nairobi, Kampala and Dar-es-Salaam. Good corporate governance is necessary in all of them. The interests of minority shareholders must be protected at all times, even in small family-owned companies. Society, too, increasingly expects responsible behaviour from all corporate entities. Not-for-profit organisations like schools, hospitals and NGOs must also account for themselves in a professional manner. No organisation is exempt from the need to take governance to a different level. Given that we are starting from farther back than the rest of the world, adopting the best-practice codes of conduct that are sweeping through boards everywhere would be no bad thing. We certainly need to protect shareholders from managers who have consistently and systematically denuded them. We certainly need to embed the idea of the independent director, in a corporate culture that has yet to grasp its import. And we certainly need to limit the often-ridiculous powers we grant to our chief executives. Yet the opportunity is far greater. We would limit ourselves severely if we went for wholesale adoption of codes of practice and then settled back to our cigars and brandies, our work done. The true frontier of change in corporate governance is elsewhere. The most enlightened corporations are looking far beyond best practice. They are looking at a fundamental redesign of the board of directors from first principles, a complete overhaul of structure, composition and processes. Hi all, It has been a challenge finding an appropriate tool for the collaboration and coordination of multiple inputs needed on the #140Friday Policy Paper. We have tried to use Google Docs but that hasn't worked out very well. I have found a lighter, and seemingly more appropriate tool called Sync.in - please find the current draft at http://sync.in/uQhr7V3IO4 (which I am continuing to update with scattered inputs gathered over the past 6 weeks from here and there). Please type in your name in the field on the right so that we can be able to make attributions when the time comes. Let's hope this works! Paul, There's a possibility that within this list lies a great deal of wisdom that, when included in the #140friday conversation, would result in a document the PS would be glad to put before the Cabinet. Is it possible to have the working policy document on here for discussion? It is an ICT policy issue after all, isn't it? Paul, capability and capacity problems are solved in part through education. Is the KICTB consulting with the MoE on ways to improve this? Is there anyway KICTANET can contribute to help the conversation along? Alex Thanks for your response. It was interesting. And indeed, I may have changed the metaphor from Elephant to Bull, but I'm assured it is well understood. An important clarification for worth communicating here. IT projects are rarely just about the technical software, hardware piece. Most substantial public sector, and indeed most IT projects in general are rarely just about buying a software or hardware. They are about transforming a business process to work more efficiently to achieve a service or business outcome. This therefore requires skill sets in business analysis, business process transformation, change management and project management. The role of the head of IT, commonly referred to as the chief information officer or CIO is to develop the enterprise architecture. Meaning how the how organizations information flow is structured to support the business. How accounting systems will work with sales systems for example. How the sales system will support multiple locations, how stock management can be optimized so that there is less holding of expansive stocks. The core IT piece Is crucial but comes only when that the puzzle is understood. This is the world in which large scale consulting firms live and this is the value that their clients seek. This is where the large IT contracts swim around globally. In fact most outsourcing is done to farm out the basic IT parts to companies that can understand this while leaving the main organization to focus on value addition. Our discussions with the local IT players have included sensitization of IT service providers to the wider opportunity. Many already play in this space. some of the techies may well be service providers to these larger organizations as part of the value chain of service provision. Ocassionaly the task may boil down to a simple IT talk that can be sourced directly to a techie. This is rare and would not usually be a high value transaction. The rule of thumb is the more strategic it is, the higher its shilling value. Sometimes just designing a change and process program is worth much more than the actual IT deployment. As for the #140Friday debate, if you care to share what you heard, I'd be happy to understand what the conspiracy was about. It would not change the substantive arguments in any way. CCK releases 2nd quarter ICT sector statistics for 2011/2012 <http://www.cck.go.ke/news/2012/ICT_Sector_statistics.html> The number of Internet subscribers in Kenya increased by 13.48 percent from 5.42 million to 6.15 million between September 1 and December 31 last year. During the same period, the estimated number of Internet users rose to 17.38 million up from 14.30 million, representing an increase of 21.55 per cent. According to the CCK 2nd Quarter ICT Sector Statistics for 2011/2012 released today, broadband subscriptions increased to 131,829, posting a 4.14% growth from the previous period. Of the total Internet subscribers in the country, broadband subscription represented only 2.14 per cent. Meanwhile, the total mobile traffic declined to 6.70 billion minutes from 7.09 billion recorded in the previous quarter. This represented a 5.5 per cent drop in voice traffic. Similarly, Minutes of Use (MoU) per subscriber per month declined to 79.9 down from 89.3 recorded in the previous quarter (i.e. July to September 2011), posting a 10.53 per cent decrease. The number of SMS per subscriber per month also declined from 17.42 in September 2011 to 10.42 SMS by the end December 2011, representing a decline of 38.52 percent. The report further indicates that the number of mobile subscribers increased to 28.08 million up from 26.49 million recorded during the previous period, posting an increase of 5.99%. Mobile penetration increased to 71.3 percent during the same period from 67.2 per cent recorded during the first quarter. DEADLY THIKA ROAD - WHO IS LISTENING?

Listers, One may ask, why talk about roads on an ICT list? As a vision 2030 project like Konza City, I thought it's important to bring to our attention the dangers of cutting corners...I hope this will NOT happen with Konza city. I would like to address this note to Mugo Kibati as Director of V2030. On Friday, amidst the pounding rain, I ventured out on Thika road (for the first time, since the super highway was done)....I've been avoiding the road like a plague given the grisly stories I hear about thika road. But this time, it was out of necessity. I've seen the dazzling roads of south Africa, Dubai, the US, Japan...you name it....so in my mind I thought a "slip road" would be the standard slip road it ought to be; sign boards would be clear so I know where to go and when to turn off; and that I should NOT expect (NEVER) to find a speed bump smack right in the middle of the highway when I've hit 100+km per hour and enjoying the cruise. We appreciate the development (one should not question that), but can we do things with excellence? First, I was on a lane around Parklands heading towards Thika, when suddenly I noticed on-coming cars flashing, warning me that while I was right to use that lane as a short diversion, I had missed an opening that should have taken me back to the right lane! I promptly took the next left turning to get back to the right lane, luckily I was driving at snail speed. The next encounter was when I suddenly came across a notice board indicating that the road was closed, but it was not clear which one - the one ahead or the one to my right...my sixth sense suggested a take the road on the right, when I did, it happened to be the right one, but yet again, there were cars coming from the right side of that road from behind me and a had a near miss with a speeding country bus...and you know how they zoom! (I understand later another car did not know which route to take at this same spot and crashed the barriers at high speed and the driver was removed from his car unconscious! possibly dead!). My next headache was to find out which slip road to take off Thika road to my destination - I have never seen 90o slip roads....the standard from my lay knowledge is that they are around 350 - 45o - Thika road has 90o slip roads!!! - how do you do that from a highway! Finally, on my way back, I had to make some maneuvers below a bridge to get back onto the road coming back to Nairobi (with huge concrete walls on the side so you can't see other cars coming from all directions) - I've never seen interchanges under a bridge with blind spots and cars coming in all directions! Thika road is a death trap and needs to be sorted out as soon as possible. Summary 1. The slips roads need to be made proper slip roads with clear signs 2. The bumps on the highways should be removed and foot bridges constructed for pedestrians 3. The interchanges, need to be rectified and ensure people moving in different directions do so without meeting cars coming in the opposite directions (at a blind spot with concrete walls - the Museum area is a classic example) - do 2-3 layers of road even consider underground passages, but for heavens sake don't let ongoing cars meet under a bridge with blind spots. 4. Have proper legible sign boards erected urgently. While the road is under construction and one can dismiss issues raised about Thika road indicating that diversions are just temporary, the main point of my intervention is with the design and its usability in a safe manner. The fact is that Thika road is not safe as it's currently designed - it does not give the impression that it was done by those who have done the roads we see in other countries that work. Mugo, I look forward to hearing from you and trust that you will have discussions with your counterparts at the Ministry of Roads so Kenyans know that something will be done about Thika Road. It is sad that while many Kenyans have complained about this road among themselves, we do not have forums to bring this to the attention of the decision-makers. This is my attempt and I believe we will hear from you. Lets design and implement Konza differently....we must never compromise on standards. Edith (personal opinion)

In a tiny (population: 1.4 million) and newly independent country like Estonia, politicians realised computers could help quickly compensate for both a minuscule workforce and a chronic lack of physical infrastructure. Seventeen years on, the internet<http://www.guardian.co.uk/technology/internet> has done more than just help. It is now tightly entwined with Estonia's identity. "For other countries, the internet is just another service, like tap water, or clean streets," said Linnar Viik, a lecturer at the Estonian IT College, a government adviser and a man almost synonymous in Estonia with the rise of the web<http://www.eubusiness.com/europe/estonia/040420021538.qhs3vusx> . "But for young Estonians, the internet is a manifestation of something more than a service – it's a symbol of democracy and freedom." To see why, you just have to go outside. Free Wi-Fi<http://www.guardian.co.uk/technology/wifi> is everywhere, and has been for a decade. Viik says you could walk 100 miles – from the pastel-coloured turrets here in medieval Tallinn <http://www.guardian.co.uk/travel/tallinn> to the university spires of Tartu – and never lose internet connection. "We realised that if the government was going to use the internet, the internet had to be available to everybody," Viik said. "So we built a huge network of public internet access points for people who couldn't afford them at home." The country took a similar approach to education. By 1997, thanks to a campaign led in part by Ilves, a staggering 97% of Estonian schools already had internet <http://www.tiigrihype.ee/?op=body&id=45>. Now 42 Estonian services are now managed mainly through the internet. Last year, 94% of tax returns were made online, usually within five minutes. You can vote on your laptop <http://news.bbc.co.uk/1/hi/world/europe/6407269.stm> (at the last election, Ilves did it from Macedonia) and sign legal documents on a smartphone. Cabinet meetings have been paperless since 2000. Doctors only issue prescriptions electronically, while in the main cities you can pay by text for bus tickets, parking, and – in some cases – a pint of beer. Not bad for country where, two decades ago, half the population had no phone line <http://news.bbc.co.uk/1/hi/world/europe/3603943.stm>. Central to the Estonian project is the ID card, introduced in 2002. Nine in 10 Estonians have one, and – by slotting it into their computer – citizens can use their card to vote online, transfer money and access all the information the state has on them. "There's nothing on the ID card itself, because that could be dangerous if you lost it," says Katrin Pärgmäe, who is in charge of public awareness at RIA, the country's internet authority <http://www.ria.ee/en>. "It only gives you access to the database if you type in the right code." You can also present the card at the pharmacy to pick up a prescription. On public transport, it doubles as a ticket. Many people also have special ID chips on their mobile sim cards that allow them to pay people by text. To a British audience, the ID card will have a whiff of Big Brother. But many Estonians argue the opposite: that it allows them to keep tabs on the state, rather than the other way round. "You'd think, given our history, we'd have a problem with it," said Ilves, in an oblique reference to the days when the KGB had an office down a cobbled street in central Tallinn. "But I feel much more secure with a digital ID. If anyone goes into my files, they're flagged. Whereas if my files – which would exist anyway – were made of paper, no one would know who was looking at them." Every Estonian can see who has visited their data, and they can challenge any suspicious behaviour. In one famous case, a policewoman was caught accessing information about her boyfriend. During a recent election campaign, a candidate was swiftly punished for accessing personal information about would-be constituents. "I don't know what the idiot was thinking," said Viik. "You can't hide." To an outsider, it is not immediately clear why Estonia took to the internet so much faster than its Baltic cousins, Latvia and Lithuania. All three won independence at the same time. All three needed quick ways of revamping their ailing infrastructure. But to Estonians, the reason is simple. Estonia has a sizeable Russian-speaking minority, but the country's ethnic Estonian majority feel Nordic, rather than Slavic or eastern European. In the early 90s, this meant they looked to tech-happy Scandinavia for both inspiration and investment. Those Finnish and Swedish businesses that did invest expected their Estonian counterparts to communicate by email rather than fax. And pretty soon it was the newcomers who were leading the way. "I remember when one of our banks was bought by a Swedish one, they came over and said: 'And now we're going to teach you how to do computer banking'," recalled Ilves. "And we said, 'well, you might want to look at what we're actually doing with computer banking ourselves.'" At the last count, 99% of Estonian bank transfers were online. It helped that many politicians in the early 90s were unusually quick to "get" the internet. "The people in power after the collapse of the Soviet Union were really young," said Jaan Tallinn, the co-founder of Skype, the Estonian internet telephone company, and a co-developer of file-sharingwebsite Kazaa <http://www.guardian.co.uk/technology/2012/apr/15/www.kazaa.com>. "They knew what was going on." Mart Laar was 32 when he became prime minister in 1992. Ilves is slightly older, but had learned to code as a child, growing up in exile in the US. "I thought if I can do it, anyone can," he said in his strong New Jersey accent. "I was completely at ease with computers." The internet was also seen as a buffer to Russia<http://www.guardian.co.uk/world/russia> . "We were afraid that Russian armies might take down the TV tower, the central radio station, or newspaper press," said Viik. "Three addresses shut down, and we would have been disconnected from the rest of the world. "But the internet would still work – and so we realised that this would be a great way of keeping in touch with the world in case of emergency." Ironically, when an attack did finally come, it came via the internet – and promptly disconnected Estonia from the rest of the world. In 2007, the government infuriated its Russian-speaking minority by moving a Soviet war memorial from central Tallinn to a cemetery on the city's outskirts. Violence flared on the streets, and later reached the internet. The first cyberattack was simplistic, and easily dealt with: thousands of unknown individuals bombarding government, media and banking websites with "denial of service" (DoS) attacks. "It was like an internet riot," said Hillar Aarelaid, who led Estonia's response, at the time. But what started as an emotional backlash soon became a far larger, longer and better co-ordinated assault on Estonia's very being. It lasted three weeks and could only be contained by restricting internet traffic in and out of the country. It was, in effect, a cybersiege. "This is how a lot of myths were created," remembered Pärgmäe. "Those outside the country couldn't access Estonian websites, but they didn't realise that people inside still could." Rumours circulated about the collapse of the Estonian online banking system, and how people were struggling to buy groceries. "But actually the longest downtime for a bank's website was just one and a half hours." The debacle had two positive effects. First: Nato founded a cyberwarfare thinktank in Estonia<http://en.wikipedia.org/wiki/Cooperative_Cyber_Defence_Centre_of_Excellence>, to learn from the experience. Second: the government set up the Cyber Defence League<https://www.eesti.ee/eng/riigikaitse/eesti_kaitsejoud/kaitsevagi>, a network of 100 volunteers from the cybersector who, among other roles, will form – a kind of territorial army during future strife. "Traditionally in western countries," said Ilves, "you've had a weekend-warrior thing where volunteers run off into the woods and do target practice. In Estonia, we have a unit of IT people from banks, software companies who in their spare time for one day a week work on cyber issues." This kind of collaboration between private and public sectors was also central to Estonian innovation in the 90s, Viik claims. "The government started several IT programmes as a catalyst," he said. "But only in a few was it the main sponsor. From the early days, government philosophy was not to hire programmers, but to use the services of private companies, which in turn increased the competitiveness of the Estonian IT sector." Case in point: the ID card. "It's private companies who developed and manage the service – and who can now export their new-found competencies to other countries." Viik argues that this benefits both the private sector and the state, who otherwise would not have the resources for ID card technology. But some think the overlap between occasionally threatens Estonia's open internet. For many years, each Estonian citizen had the right to a free domain name. As in the UK, they could not register top-level domain names – but they could bag a ".pri.ee" site, similar to a ".co.uk" site in Britain. In 2010, that changed: the government outsourced the responsibility of allocating domain names to private registrars. The pri.ee domains were abolished, and individuals were instead given the right to top-level ".ee" websites. The only catch was a £15 price-tag – one of the highest rates in Europe<http://www.guardian.co.uk/world/europe-news> . Many academics and high-profile techies were outraged<http://kogukond.org/in-english/>, and some founded a pressure group – the Estonian Internet Community (EIC) – that campaigns to give ordinary citizens more of a say in how Estonia's internet is run. After public outcry, a new set of free domain-names - era.ee - were introduced. More generally, it is feared that the same politicians who had such enlightened attitudes to the internet in the 90s may be starting to lose their progressive edge. "They're still in power," said Jaan Tallinn, "but I'm not sure they still understand what's going on. Technology keeps progressing. Young people follow the curve. But as they get older they get inertia, and they start deviating from that curve." Ilves himself is fairly critical of parts of Acta<http://en.wikipedia.org/wiki/Anti-Counterfeiting_Trade_Agreement>, the hugely controversial international agreement that opponents fear will curtail the rights of individual internet users. But there is a perception that other politicians could be doing more to oppose its introduction. "It's difficult because it's actually an EU agreement," admitted Jaagup Irve, a PhD student at the Tallinn University of Technology, and an EIC board member. "But the government isn't doing enough to stop Acta<http://www.guardian.co.uk/technology/acta> ." Viik says that among politicians of all stripes there has always been "a silent consensus" about the importance of the internet. For many years, Estonians could expect whomever they elected to have the best interests of the internet at heart. But Irve thinks the public can no longer be so complacent. "People think a government is like a smart missile: the thing practically flies itself," he argued. "But today it's more like a bomb that we have to guide. Listers I thought id share from my latest blog post (www.paulkukubo.co.ke) I have pasted the entire piece here. The size of this Elephant. The recent #140friday twitter and off twitter debate was centred around a simple and important theme. If the Kenya Government procurement ecosystem developed a preferential orientation towards local firms, the result would be that we would develop greater capability. It was argued by some that the government seemed to indicate an inclination towards foreign big name firms. Whereas the facts don’t necessarily support the claim, I doubt anyone would argue with the basic premise of the argument. Local businesses should benefit from tax based projects. I offer some discussion points that may guide the continuing discussion. How do we turn preferential advantage into true national capacity? The recent procurement of seats from the Prisons department for the national assembly is a welcome effort by any measure. Without the benefit of detail, one hopes that the process has created capacity for the Prisons department to be competitive in furniture making regionally and even become a net exporter. One hopes they have worked with some of the best furniture designers locally and created synergies that can be replicated. One hopes that the low cost of prison labour has also been value added by developing prisoners who can become great furniture makers once they leave. Use of materials is important. Have we used woods plastics, composites that wee sourced from locally sustainable sources. Parliaments are important national symbols in so many ways. They must represent the best of our national collective aspiration. How they look and feel is important to our national psyche. We can draw parrellels here for ICT. 2. Sometimes,even the government does not necessarily know what it does not know and is often seeking to know what it should know first, before seeking answers. The whole area of drilling down from service objectives to architecting an ICT solution can be daunting. For example, we need to have a simple, easy to use lands information management system so that Kenyans can search for land titles. One issue that may arise here is that only 30% of Kenyan land mass has been adjudicated, and surveyed and provided with title. Your ancestral land may not be under title yet. So how is a lands system relaxant just yet for you, some may argue. Another issue might be that the lands ministry collectes substantial revenue in fees and rates that has to be remitted to the treasury every year. The same department then has to go back to treasury to seek finance for a new system to support its operations. Treasury has myriads of pressing priorities. The Kenya ICT Board proposes a system that allows a private sector partner to provide a system and recover its revenue from the collected fees. The issue becomes one of structuring the deal so that the best in class partner can be found and government is guaranteed of improved revenue whilst having a system that can carry us to the next generation. Many systems in government can be delivered like this. The task and the system goes beyond the technology implementation to change management, capacity and capability development. Indeed the systems and processes will need to change to accommodate this need. The partner in question must therefore have capability to underwrite this massive task. 3. There is great public sensitivity around this subject of local capability. I choose to use capability instead of capacity, because capacity may imply the potential given the right mix of circumstances, whearas capability would mean the collective experience. Telling private sector that certain capability does not exist locally even when it might be true, raises huge emotion and rightly so. What does one mean? How dare one? The intended service outcomes occasioned by the new constitution are huge. 47 counties that must replicate central government capability in the management of their affairs. The experience with local governments provides lessons about how comes this can be. Do elected officials make good administrators?, Do counties as autonomous entities have the structural capacity to manage their affairs? ICT offers interesting options here. We can share critical systems across counties reducing the need to duplicate say financial and HR systems and indeed people. Is the private sector in the. Idle of this conversation? 4. The past experience on major ICT projects as projected in mainstream media has been less about the intended service outcomes and more around the procurement. In the past there may have been substantial capital made out of over specified, created for self gain ICT projects. This has changed, but the private sector appetite by some may of have. Obfuscate the issue, create a project that no one really understands, make money and run is common in many economies in the world. The onus is on us all to create a new confidence in this space. A new governance contract which says we ad committed to right priorities. The private sector especially can do this by collectively aligning to national priorities. 5. National capacity building is mostly a discussion about what talent I’d needed from the universities. Some major changes are in the offing here with both task forces of government education reform. The issue is that the building local companies that have capability is a continuous process involving planting the right seeds in school, developing talent, allowing the right ecosystem to thrive in terms of capital and talent flows, business and market access, the right local and international partnering, national incentives systems. And most of all time. Like we say in Swahili, nothing is better that experience and we must eat salt. Lazma tule chumvi. The responsibility of Institutions like the Kenya ICT Board therefore is to ensure we stay in touch with the sector intimately enough to understand their pressing issues and work with other government agencies to direct critical concerns as they emerge. Another responsibility is to help the private sector understand the public sector better in meeting their needs. Having said that, the public sector pie is very big. And there is much hard work done to make public efficient and effective. Indeed looking at the presentation made by the the PS Ministry of Information and Communications, the ICT Secretary, and various permanent secretaries, government directors and state corporation CEOs during 4th Connected Kenya Summit recently, one can attest to this. A true partnership between public and private sector is emerging through consultation and this must be encouraged. The elephant is big and fat and has to be eaten a piece at a time.. Re: How To Revive Postal Service Amenya You are living in the past. Postal services worldwide are declining and only those with futuristic leadership will enable their corporations adopt. Part of the reason is the growth of electronic communications (fast, reliable, etc.) and competition from other carriers: courier companies, etc (in fact in Kenya bus companies deliver parcels more reliably than Posta) and more. In the advanced western economies, futuristic postal corporations have created virtual mailboxes for almost entire populations. Here one gets their bills, statements, etc electronically; documents that can be accessed via a secure web portal. Smart phone growth has been a key enabler of such services, which allow you to scan your documents, pay your bills, etc. Two years ago we approached PCK on a similar approach. The idea was for us to help them craft a strategy to position themselves for survival in the future. Much of our strategy is based on use of technology, taking advantage of their reach across the country, agency banking, etc. Our good general looked at us without betraying a sense of whether he understood what we were saying or not. He dispatched us to the ICT department, composed of very good knowledgeable people working under very difficult circumstances. Long story short: we hit a brick wall. The PCK leadership is archaic, doesn't understand business. Most of them have the civil service mentality .... hang your coat, go roast meat/check how your matatu is doing, come back 3-4 hours later, review one file, go home and for sure there will be a pay cheque at the end of the month! Zip productivity! I could write tons about the unrealized PCK potential but let that be for another day! In the meantime you may wish to check the story of PostaPay which was supposed to compete with MoneyGram and Western Union in international money transfer business! We launched this with pomp ... a few years later, the same people with who we were singing songs of patriotism, were in the dock for embezzlement. Edwin, I suggest that we try to lobby to have an apex ICT society representing all spheres of ICT be entrenched in an Act of parliament (maybe the ICT Bill) just like the accountants and lawyers have ICPAK and LSK respectively. I believe this is a better way of having a more representative and effective organization. I don't know what's your take on this. identity.go.ke still not working

Dear colleagues, It has been over 6 months since I wrote about this last, yet my sister still does not have an identity card (It has taken over a year and a half, and no results). In addition, the website of identity.go.ke does not come up, and as you can see below, the email of the director is still bouncing. Maybe there is a new website. If so, please let me know. Sigh. Kibaki comes from my home area of Othaya, and I think that efficiency has increased in some areas. That being said, we have some work to do. Furthermore, as a political scientist/public policy person, it strikes me that perhaps we see greater efficiency in areas used by the elite, (i.e. passports) and lesser efficiency in areas used by wananchi, because wananchi have less political capital. Thoughts? CCK Should Provide Tools for Service Monitoring

I've given up on my ISP. I am currently receiving 1/16th of the advertised bandwidth according to various independent tests. Even for a shared connection this is outrageous. They insist that I should only use their tool to measure my provisioned bandwidth, a tool that measures speeds between my premises and theirs. A pointless exercise since I subscribed to Internet services not a local loop connection. Now if the CCK could provide consumers with an online tool to measure what they are actually receiving, as well as compelling ISPs to clearly state the performance limitations of their service, we would all make informed decisions on who to purchase Internet services from. PRESS RELEASE 23rd April 2012 Listers CCK's response to media reports on alleged collusion to fix retail mobile voice prices The attention of the Communications Commission of Kenya (CCK) has been drawn to media reports alleging a plan to fix retail voice tariffs by a section of the mobile service providers ostensibly with tacit approval of CCK. The CCK wishes to state as follows: 1. CCK considers the retail mobile voice market as sufficiently competitive, thus making it unnecessary to impose any stringent retail price regulatory obligations on the licensed mobile operators. However, even for such competitive market segments where the Commission does not impose retail price setting obligations, the law (i.e. clause 4(3) of the Kenya Information and Communications (Tariff) Regulations, 2010,) prohibits licensees from applying tariffs that distort competition, exploit consumers and, possibly even prevent market entry. 2. Therefore, all mobile operators set their retail prices independently guided primarily by their costs of providing a particular service and are only obligated to file with the Commission their retail rates as provided for in their respective licences. 3. While the CCK recently held discussions with some licensees regarding the wholesale interconnection rate and the attendant glide path, no request has been officially made regarding the intention to fix the retail mobile voice tariff either by those players on any other licensee. As such, no such approval has been granted. 4. Retail price fixing as practiced in collusive oligopoly markets is an anti-competitive business practice that is contrary to the prevailing competition law and policy. Retail price fixing in the mobile voice market in Kenya would, therefore, be in breach of the law; and as such no approval can be granted. 5. The Commission is currently carrying out a study to evaluate the impact of competition on the mobile voice market on the entire economy. We would like to clarify that the study, which is being undertaken by the Kenya Institute of Public Policy Research and Analysis (KIPPRA), is in not in any way meant to determine interconnection rates for the mobile telecoms market. My community has been targeted for casino development and I am looking to expand my business. Could you possibly provide some advice on how to find venture capital?* * * For someone who lives in the startup world, this looks pretty silly. But I’m sure I’d say a lot of silly things if I were getting in to the taxi business, too. So I figured I’d point him to a simple explanation of why taxi companies (actually, services companies in general) aren’t appropriate for VC. I did the Google thing for a bit to find a good article. And no luck. Well, you know what they say: when the internet fails you, make more internet. Here, then, are a very good set of reasons not to take venture capital (or – why venture capital won’t take you). *1. You want to build a profitable company* First day of Founder's Institute I ask how many people want to raise venture capital. Most of the hands go up. I then ask who wants to build a profitable company. Again, most hands go up. The funny thing about this is – VCs don’t actually like their companies to be profitable. Someday, sure, but not on their watch. You see, profitability means that the company *wont grow any faster*. This seems odd, but think about this for a minute. At the early stages, a company may be making money, but it’s almost certainly investing every penny it makes back in to the business. If it has access to outside capital (e.g. a VCs), it’s investing *more* than it makes. And that’s exactly what VCs like: companies that can grow at amazing speed, and never slow down their burn rate to amass cash. They like this for two reasons. First, VCs want to invest in companies that can grow explosively. That means huge markets, executives who can scale up a business fast, and a willingness on the part of management to double down on a winning bet – over, and over, and over again. Second, because it means the company *keeps coming back to the VC for more money*on positive terms. That means the VC keeps getting to buy more and more of the growing concern. Of course, this is something of an over-broad generalization. I’m required to include one per post or I lose my startup blogging license. In fact many venture backed companies are profitable, it’s very impressive to bootstrap your company to profitability in a few months before raising outside investment, etc. But if you are excited about a profitable business that can cut you giant dividend checks (not that most VCs can even accept divided checks - long story), realize that VCs will not be pleased with that approach to running the business. They will want you to plow those earnings back in to the business. And when the day comes that a VC-backed business generates cash faster than it can effectively spend it? They sell the company, or IPO (which is technically also selling the company), or replace the CEO with someone who can spend faster. A taxi business should be run for profits. That’s not VC style. *2. Your business has reasonable margins* As a general rule, VCs don’t like reasonable margins. They are exclusively interested in *outrageous* margins. Ludicrous margins. We’re talking about sneering at 50%, and hoping for 80%, 90%, crazy astronomy stuff. Venture capital is all about investing a little bit of money to create a business with massive scale and huge multiples – investing tens of millions to build software that then can be duplicated or served up for virtually nothing extra per-person with a total market size of billions. In particular, VCs don’t like businesses that are people-powered. Software businesses are awesome, but their evil twin – software consultancies – are near-pariah to VCs. If adding revenue means adding bodies, they don’t like it. In fact, enterprise software companies, which can tread a fine line between software consulting & software development, sometimes get really creative <http://kellblog.com/2011/06/27/why-palantir-makes-my-head-hurt/>to come down on the right side of the line. So the rule of thumb is that VCs like product companies: software, drugs, cleantech, and so on. And they don’t like the manufacturing, service industry, and consulting businesses that often are just a tiny shift of business model away. Every new taxi requires a… well, a new taxi. And a new taxi driver. Not the right business for VC. *3. You are going to double your investors’ money* I’ve covered this before, but VCs really don’t want to double their money<http://www.danshapiro.com/blog/2010/08/vc-insanity-economics/>. Strange though it sounds, their economics make that look like a failure. They need to target a 10x return on their investment, and that means – depending on stage and fund size – that you company has to grow to somewhere in the hundreds-of-millions to billions range to be interesting. That means taking your taxi business from $20MM in annual revenue to $40MM just doesn’t do it for them. Particularly because the valuation multiples on the aforementioned lower-margin businesses are smaller. *4. VCs probably don’t want to invest in you* Here are the people VCs *really love* to invest in: - Entrepreneurs who’ve already made them lots of money - Their closest buddies Here are the people who VCs *can be convinced* to invest in: - People who have been wildly successful at high-profile past jobs that are related to their new business (e.g. a former executive VP at a Fortune 500 company, inventor of thingamajig that everyone knows) - New graduates from top-of-the-top tier schools who have built something amazingly cool already - Extremely charismatic type-A personalities Anyone else is possible, but our taxi driver is going to have a devil of a time. *5. You have better things to do with 9 months, and you will probably fail* That’s how long it took me to do my Series A for Ontela. 9 months before the first check came in. Average is 6-12. That’s because a busy VC will look at a few companies a day, and will make a few investments a year. The math says the hit rate is well under 1%. That matches my experience – I pitched over 100 times during our Series A investment. Not only that, but most of the companies pitching the same events and people that I saw worked just as hard as I did, and did not get funded. And fundraising is a near-full time job; you won’t have much time for actually driving your taxi. *6. You will have a new boss* You know the great thing about working for yourself? Well, if you raise VC, you probably don’t have that thing any more. Raising VC usually means forming a board that includes your investors, and that board is charged with, among other things, potentially firing and replacing you. I’ve worked with a number of boards and have been lucky in that they were all awesome and I would recommend those folks to anybody. But if you like your freedom, then bringing on VC may feel somewhat familiar – in an “I have a boss again” way you probably won’t enjoy. *What are my alternatives?* VC is really only appropriate for a tiny fraction of a fraction of the companies in the US. But there are numerous alternatives. - *Angel investors* are individual investors who can invest larger amounts, on more flexible terms, and with less onerous restrictions. Many companies that take VC money actually start with angel investments – but lots of companies never do VC, and just grow off of angel investment. - *Traditional bank loans* are always an option if you have a sufficiently traditional company – while they may not be right for many purposes, they’re definitely the best terms you will find for bringing in capital. - A *Revenue Loan* from a company like Lighter Capital<http://www.lightercapital.com/>is a way for companies with revenue to bring in capital with a debt structure – without giving up control to outside investors. - And, of course, *Bootstrapping* is arguably the best way of all – re-investing your company’s profits in your own growth, and building a strong company based on the revenues from your business. *…So does this mean I shouldn’t raise VC?* Look. I’ve raised over $30mm from 7 different firms in the course of my two startups. I will tell you: if you are the right kind of company, and find the right kind of investor, then VC is *awesome*. It’s an instant infusion of cash, connections, experience, credibility, and confidence at the stroke of a pen. It accelerates everything. It focuses the mind. I can’t recommend it highly enough. But most companies are not the right kind of companies. And the only thing more frustrating and time consuming than raising a VC round is failing to raise a VC round. So think hard. @10rdmwesh - being a Prof. is not easy ;-) Anyhow, your question maybe be better handled by the next Board, however I can give some personal analysis from experience. 1. Despite AfriNIC training thousands of Internet Engineers in IPv6, you will agree that adoption/uptake of IPv6 has been comparatively poor. So expect to see more emphasise on IPv6 Training for "Non-Techies" i.e. Business & Government Leaders in an attempt to present the case for IPv6 in non-technical jargon in order to reach decision makers outside the hard-core tech-field. 2. As IPv4 (the original Internet Protocol "Platform") numbers get depleted in other regions (e.g. Asia, Europe) expect the black-market for IPv4 trading which does exist in developed economies to start focusing on the large perhaps "idle" African IP resources. So the next Board has to deal with this reality sooner rather than later. 3. Cyber Security: As the African region gets more and more online, the Cyber Incidences and issues will become more prominent and more people (Governments) especially will begin to justifiably wonder how and if the critical building block of the the Internet - the IP number - can be used to enhance Security. So expect to see a more pronounced outreach to Governments as an effort to better understand how both stakeholders can work together rather against each other to enhance Cyber-security. 4. Listers A writer's reputation can sometimes precede the message. I will confess that I did not understand that it was irony or sarcasm that was intended. The biggest opinion shapers have the greatest responsibility to always be clear, factual, empathetic. Robert Yawe is one such opinion shaper no doubt. So the matter merited clarification. And I certainly could not relate to the 'King is Dead, Long Live the King' reference to this story.We we can have a long debate about how that analogy could have been best used in the context of that particular story. My suggestion would be that the headline should have said. "The Mainframe is dead, long live the Mainframe." The issue of the headline has been clarified. Some clarification is needed based on a few comments. There does not exist a prevailing sentiment that IBM is struggling as some imply here. The list is divided into two strands. Those reacting to the substance of the article (no controversy here really), and others reacting to the idea that Robert has the right to use dramatic effect to get the attention to the issue. The challenge of Kictanet lies here. The issue is that if you don't read the story and jump to conclusions you can miss the point. A few reactions suggest that some did not and have further not read it and are using the discourse to further the argument that we can express ourselves as we see fit because the end justifies the means. The drama trumps the substance. In forums such as this which are largely professional groupings, this should not be the case. Professional Journals, forums, groupings thrive because they provide professionals with safe space away from popular, headline driven media. In forums like this we should dig deep into issues if we so please and feel professional protected. I would agree that a healthy dose of drama and substance is good. Professionals have a responsibility to dig deep. This forum it flows freely. Some feel some arguments are too personal, too opinionated and some have too much conjecture. Others feel that when facts and serious issues are presented, they are seen as boring. We get the headlines we deserve and the blame the media. There are many who won't come out of the "closet" and just say, sometimes they think kictanet can be a big vendetta machine driven by established groupings who pre-agree attacks on individuals and agree to prop up others. These individuals you can call fearful lurkers. My view is that they are a substantial group. kictanet has improved a lot in recent months and continues to be an important forum. We need to get wider opinion and so move the platform onto wider areas, Facebook, twitter, a public blog. It will not take away the controversy but it will get us fresh ideas as well. we need to drive up the numbers. As an example, I don't allow my staff to post any official comments on this forum. we hardly get contributions from the leading technology voices. we learn more things outside this forum. The #140Friday meetings and discussions are taking place outside this forum. The Connected Kenya summit attended by over 400 people this year was highly successful and not discussed here. The CIO forum in South Africa that I have just attended, The global meeting on Open Government. The moderator should be given information that feeds discussion and information. The list format does not work for all information types and it is time to put this on a portal. A few more facts on IBM to enrich the substantive discussion. 1. IBM is now primarily a services company ( http://www.ibm.com/annualreport/2011/ghv/) In 2000 the revenue composition was 35% Hardware/Financing, 38% Services, 27% Software. in 2011 it was 16% Hardware/Financing, 41% Services, and 44% Software. Big change of strategy over the years that saw it dispose of its desktop business to Lenovo during that period. Anyone ever read their former CEO's book "who said elephants can't dance?" about their shift of strategy from hardware to consulting and services as a long term strategy. 2. 2011 revenue was 110 USD Billion and it had grown 10 consecutive years. 3. If anyone can remember, last year, Warren Buffet the world's leading investor bought IBM stock, his first technology stocks ever. 4. Of particular note is how some of that growth is achieved. "the beginning of 2000, [IBM] have acquired 130 companies in strategic areas including analytics, cloud, security and Smarter Commerce. IBM expect to spend $20 billion in acquisitions over the 2015 Road Map period to support growth initiatives". This should excite well positioned Kenyan firms whose investors need an exit strategy. As a matter of interest there are certain other thematic areas that are worth studying, tracking understanding as part of understanding this sector. These discussions can enrich a list of this nature 1. How Kenyan Telco companies make strategic shifts in a market in which voice revenues will continue to be less significant. 2. Apple's history and its impact on the whole tech sector. Steve Jobs Biography is an excellent read in this respect. 3. How Yahoo which pioneered the search sector will manage its current turnaround. 4. how HP another global giant will manage is strategic issues in the context of its announcement by the immediate past CEO that it would sell of its hardware business. 5. How our emerging tech business leaders (Seven Seas, Cellulant, Alliance technologies, Verve, Kencall, Pespal,Ushahidi to name a few ) drive their growth, develop strategy and the role of venture capital and the supporting ecosystem. and their relationship to multinationals and the more relatively established older tech companies (Copy Cat, Technology Associates, Lantech, Symphony, Fintec, Jamii). 6. The role of regional opportunity, south Africa (partnerships,JV), East Africa,( markets growth, scale) West Africa (Huge market). etc Part of positioning a country is business owners alignment to opportunity. Friends Newspaper folks know the art: capture someone attention and s/he may buy the paper. And yes, sometime the headlines scream more than (and even opposite stuff to) the story itself. Yet, they would have succeeded in us reading the story. If the intention was to communicate, they would have succeeded in their objective. There is also a quote (don't recall by who?) to the effect that "any publicity is good publicity"; and that it gives an opportunity for the subject to communicate their message. It has just happened here. With that headline many now know about IBM's cloud services and innovation thereof; and it has given a chance to Paul Kukubo to enunciate more on how IBM re-seller model has benefited local ICT firms. .... All these: things we would not have known. Gilda is on the money about stereotyping, pigeon-holing and paint-brushing entire populations. It is a dangerous proposition that may work in a comedy club versus being the basis of policy and action. And it could become self-fulfilling prophecy for reasons of what psychologists term Pygamilion Effect (people live up to the expectations of others and their environment). Robert's headline contradicts the articles actual substance and may send the wrong tone. And if as some on this forum would suggest he did it to be sensational then it is unfortunate that we must be negatively sensationalist or dramatic for effect. Perhaps a factual sensationalistion would better deserved. What the article details is innovation that makes it possible for business to deploy cloud better. IBM have been in cloud for a long time. Indeed our government data centre is an IBM machine and the efforts are now about how to make that a true cloud offering for government. (a discussion for another day). The facts as I read them in the article are that it will be easier to provision cloud services via this model that IBM proposes. Also one interesting fact that comes through is how IBM works with ISVs, essentially channel partners with specialist expertise, as part of its delivery of services. Something they and other multinationals are doing in Kenya and one way for local companies to leverage international Global R&D companies to create jobs and provide services. I happen to know Rod Atkins quoted in the article from his visit to Kenya last year and our subsequent visit to IBM. It is prudent to suggest that we need to stand on the shoulders of these global companies for our local firms to deepen skills and expertise and dominate Africa. There are many emerging Kenyan firms that have skilled up to be channel partners for global firms across various areas. Indeed many of our largest ICT firms are large because of this reseller model. ICT investors both local and international must get the right messages about this market. And sentiment is part of messaging and is a very strong driver of investment decision making especially in Africa. For those who may not read the article (and I suspect some will not have), it not as it is stated in Robert's headline, about the demise of the company.
