This also extends to: Do we have competent and constant learning teams in police departments who can carry out investigations regarding IT, a team/division in the office of #ODPP who can construct prosecutions that can't be easily tossed and finally a team/division in the judiciary that can substantively and effectively determine matters regarding IT? As Bruce Schneier likes to say, Computers are essentially now in everything! The "*Ubiquitous/Everywhere Computing*". It simply cuts across many if not all aspects of people's lives today! In fact there should be an agency/ministry regulating this! Do you have a medical device/implant in your body like an insulin pump or A pacemaker that monitors your heart's electrical impulses or an artificial assistive heart pumping device? Does your tractor use computers to determine & adjust the angle/slope of your soil during sowing/planting? Do you use digital payment systems(m-pesa, credit cards etc) and online banking? What controls the automotive controls in your car like how hard to accelerate or brake(+ ABS which avoids locking of wheels that negates rubber becoming like ice!) etc etc It's possible for many wins to come out of precedent rule makings. I'm starting to see interesting questions pop up and even statements like every technology is not perfect but .... 1. Can we ascertain & inventory versions & dependencies in the software used in the #KIEMS kits and IEBC's front & back-end servers? Were these pieces of software current/up-to-date? Vulnerable? Have publicly assigned #CVEs and/or exploits in the wild? 2. Are there security features for the configs/databases loaded onto the #KIEMS kits? If yes, have there been analyses for both hardware + software risks? 3. A #KIEMS kit for a polling station is the only device that can transmit(images of the Form34A) and there are limited chances to do so ...Are there tests and security analyses to substantiate authentication(verification) + authorization of these devices? 3.1 What's the process/flow of replacing a failed #KIEMS kit for a polling station ... 4. On transmission ...It is well known that IMSI catchers aka "Fake Cell Towers" are readily and aren't exorbitantly expensive. Considering many polling stations are clustered in a small geographical area this is even more feasible. There is even a 5G version of the device. Were #KIEMS kits' modems and/or cell towers hardened to mitigate well known issues like root-kits/backdoors can be injected into the SIM modules, access storage on a device, read messages and even intercept connections on a VPN!? ...sometimes the modem is given free reign to access the entire system! Yes this will limit companies you can contract with in the future but for the sake of transparency, accountability and potentially identifying, quantifying & thwarting risks do this! As we reach the crescendo in the election cycle to usher in a new government, the 2017-2022 regime is winding up its work. One important document that has been launched is The Kenya National Digital Master Plan 2022-2032. This is a progression of the 2014-2017 document. This Master Plan has four pillars that are responsible for the provision of digital services to citizens, businesses and other stakeholders: a. Digital Infrastructure: For equitable access to national service through a pervasive and ubiquitous national ICT infrastructure; b. Digital Government Service, Product and Data Management: For provision of e-Government information and services for improved productivity, efficiency, effectiveness and governance in all sectors. It also considers technology related products and services. c. Digital Skills: For the development of a digitally skilled workforce and citizenry that is grounded on ethical practices and social cultural values to implement and operationalize this master plan; and d. Digital Innovation, Enterprise and Digital Business: For enhancing the innovation value chain in order to turn innovative ideas into sustainable businesses and operating models. The pillar also aims to migrate businesses onto the digital platform. @awatila Thanks just noted they don't handle/listen to requests without "www" on their main site. However, if you add the "www" for verify.iebc.or.ke it also is NOT handled/listened to? Must be Inconsistencies in configuration for their web servers. We are researchers in the Department of Information Science at Cornell University, Ithaca, New York. We are conducting a research study on mobile money’s history in East Africa, drawing on user innovations and social practices such as informal airtime sharing, ‘beeping’ or ‘flashing,’ among others. In particular, we’re interested in the ways people have exchanged things like currency, services, or information; we are calling this broad category, technologies of exchange. We aim to chart historical, missed, and potential future pathways for technologies of exchange in Sub-Saharan Africa. We are seeking nominations for professionals and social commentators in private, public, and donor sectors who were active in the intersection of technology and value exchange in East Africa in the years around mobile money’s gestation (~1998 – 2009). But the research still welcomes nominations for relevant actors from periods other than the aforementioned. You can nominate yourself or someone else. Typically, much of the reaction to the story from Nigeria managed to completely sidestep the material facts of the case and turn it into an African macrocosm of Nigeria’s usual ethno-tribal discourse. Flutterwave, according to the narrative, was merely being unfairly targeted because it is a successful Nigerian company operating in Kenya. The “jealous” Kenyan authorities were simply acting as proxies for Flutterwave’s Kenyan competitors who wanted to protect their market share from “de Najeeryans.” When the point was raised that Flutterwave was, in fact, operating illegally in Kenya, in addition to being in clear violation of Anti Money Laundering regulations, the reply that came was, “Obtaining a Kenyan licence is hard. Innovation always precedes regulation.” I have written previously about how there exists a dangerous narrative in Nigerian tech – Fintech especially – that rules are secondary considerations that tech is somehow exempt from. Now, it is time to critically analyse this idea so that if it turns out to lack merit, perhaps we can start the process of killing it dead once and for all. Here goes. “Tech is special” – says who? Earlier in the year, I was approached for a private investigation engagement focusing on an investment scheme promoter who had made away with billions of naira worth of client money. Having registered his investment scheme with the Corporate Affairs Commission, he managed to convince investors that having CAC registration somehow had anything to do with being licensed to offer investment or crowdfunding services in Nigeria. Meanwhile, as anyone with the slightest regulatory awareness knows, only the Securities and Exchange Commission (SEC) has the ability to license investment companies. Unsurprisingly after he disappeared into the night with hundreds of people’s money, there was no way to do anything to him. Because the company had no SEC registration, the commission had nothing to freeze, revoke or investigate. It wasn’t even interested, which is why I was approached. At the point when I was approached, every informed reaction I came across treated the matter as a lesson in the importance of due diligence and making sure that investment schemes have the appropriate regulatory compliance before putting money into them. Nobody made the fatuous argument that perhaps the scheme started off legitimately, and the promoters just needed to get it off the ground first before worrying about SEC registration later. Instead, it was correctly recognised as fraudulent behaviour where other people’s money was involved. Just a few weeks later, however, when news emerged that GetEquity, a tech investment platform purporting to offer access to American stocks was doing exactly the same thing, plus the added illegality of an unrecognised, unenforceable “digital investment token,” the reaction was completely different. This time around, that fatuous argument was thrown around with such regularity that one might have almost begun thinking it was some kind of accepted wisdom. Apparently, when Maxwell Odum floats an investment scheme that has no SEC registration and fraudulently portrays CAC business name registration as “regulatory compliance,” he is correctly recognised as a fraudster who should be prosecuted. When Jude Dike does the EXACT same thing, but slaps a mobile app, a dot io website and a little tryhard tech PR branding on it, he is an “innovator,” a “striver” and a “disruptor” who “moves fast and breaks stuff.” When the story inevitably ends the same way, instead of having private investigators hired to tail his movements around the world, he will instead get to live in peace and security, undisturbed by anyone because apparently fraudulent behaviour is bad, but when you call it https://fraudulentbehaviour.io, it becomes something else. This giant mental black spot is the reason why tech is used to facilitate and abet different kinds of criminality in Africa without so much as an eyelid being raised. Once again, rules exist for a reason In my line of work, a truism that I often come across goes like this: “There is never only one cockroach.” What this statement means to investigators and auditors is that where one serious regulatory or cultural lapse can be observed in an organisation, there will almost certainly be other serious issues afflicting that organisation. In the case of Uber, the initial cockroach was the company’s studious refusal to cooperate with local laws around the world as it followed its “Always Be Hustling” internal motto, moving fast and breaking stuff until the things getting broken were no longer just rules. Read also: Nigerian fintechs grapple with KYC amid rapid growth First came the women who complained about sexual harassment by unvetted Uber drivers, and then came the more serious stuff. Rapes. Homicides. Deaths from traffic accidents caused by fatigued Uber drivers struggling desperately to maintain their near 5-star ratings so as to keep earning a living, while Uber used loss of ratings as grounds for account removal and potential loss of livelihood. All of these issues were avoidable if Uber had spent a few months working with authorities to ensure full compliance first, but “moving fast and breaking stuff” was more important. The story is much the same with Flutterwave, which not only began operating without a licence in Kenya, but then began actively and brazenly facilitating money laundering on its platform in the jurisdiction where it was already operating illegally. It is difficult to picture any other commercial space where such behaviour would not have resulted in conferment of societal pariah status. Can you imagine, say, a Nigerian construction company opening up illegally in Kenya and then deliberately using substandard construction materials resulting in Kenyans’ deaths? Would Nigerians feel moved to defend such a thing? Why then, do so many Nigerian techies feel obliged to defend Flutterwave and its money laundering activities in a country whose last major terror attack was planned and funded using electronic payment platforms? These are the questions that we must ask ourselves as we react to stories like that of Flutterwave. The rules exist for a reason – they are not impediments to the individual egos of people with behavioural disorders who think that they exist as protagonists in a videogame where they can do as they please. The aim of this meeting was to discuss the role of technology in the upcoming elections and beyond, and how KICTANet can collaborate with the IEBC in line with its mandate of delivering free, fair, and credible elections. New Reports Launched During Kenya IGF Week

[image: Reports.png] Dear Listers, During the Kenya IGF Week, several reports were launched and we believe they are very useful and core in realising our four pillars: *Disinformation Pathways Study* This study was part of 5 African country reports on disinformation(Cameroon, Ethiopia, Kenya, Nigeria, and Uganda). The Kenya country study was conducted in the period of June-December 2021. It highlights the main factors around periods of political contestation such as elections and anti-government protests, as well as those that are related to hate speech. The aim was to understand the nature, perpetrators, strategies, and pathways of disinformation, and its effects on democracy actors including civil society, bloggers, government critics, and activists. Further, the study documented the adequacy and effectiveness of remedial measures by platforms, as well as government responses to disinformation. Facebook becoming more than ridiculous

With so much hate all over Kenyan FB, it's amazing that Facebook "fact checkers" even have time to police and fact check internet memes. My FB account has been restricted for 90 DAYS for sharing the following memes in jest! NO APPEAL option. It's ridiculous to say the least! I know the "independent fact checkers" have to earn their bread but gimme a break 🤣🤣🤣 I suspect a Kenya politician's team not happy with my posts has probably paid the so called fact checkers. Anyway, we need our own social media platforms! Good morning, *Topics of Discussion * Day 1 Governing data and protecting privacy. Day 2 ICT's and the upcoming elections. Day 3 Connecting all people and promoting cyber hygiene and emerging issues including youth, online work, inclusion and regulation. Day 1: *Governing Data and Protecting Privacy* *Noted:* The Kenya Data Protection Act <https://www.odpc.go.ke/dpa-act/>was gazetted in 2019, An Act of Parliament to give effect to Article 31(c) and (d) of the Constitution of Kenya, 2010 (Right to privacy); - To establish the Office of the Data Protection Commissioner; - To make provision for the regulation of the processing of personal data; - To provide for the rights of data subjects and obligations of data controllers and processors; and for connected purposes. - *Asked:* as a lister how safe do you feel about the safety of your personal data online? What do you think could be done better to improve the protection of data online? *Answered:* people are over fearful regarding the issue of data protection. It was suggested there is need to take the same approach as organizations are doing by conducting a personal data privacy impact assessment. E.g. what is the real risk of your personal identifiable Information leaking? One example was the personal telephone number. You hide it online but hand out your business cards that have your contact details. *Asked:* how safe are children and persons with disabilities on their data privacy? *Observed:* recently the number of Socially Engineered emails received is at an all-time high. Spam calls also seem to be on the rise. It looks like scammers have realized that the new field of play is the Internet as such I am increasingly weary about engaging in e-commerce transactions online especially using public networks. *Concerned:* to know the current statistics in so far as Internet related fraud is concerned and how many people have actually been charged for perpetrating such acts. Maybe the Ke-CIRT team can assist us with the statistics. *Emphasized:* children are ever ahead of adults in discovering and using tech applications and tool. The Communications Authority has been running a Child Online Protection program for a while and would be keen to know the current state of play in so far as data protection is concerned*. * *Noted: *@Lillian <lillian(a)watotowatchnetwork.org> recently posted an article from Human Rights Watch on misuse of data by companies targeting children, it would be interesting to hear if any measures have been taken by the Office of the Data Protection Commissioner to curb this. *Recommended:* If I may offer you a tip and a safeguard on e-commerce: there are cards that banks issue whether you bank with them or not, which you can load using Mpesa and use to transact online so that you do not expose your main card to fraudsters. I have had one from I&M Bank since 2011 (renewable), and I load it with just the money I need to make a purchase so I never worry about any unauthorized purchases on it. It is a great way to beat online fraud exposure. *Thanked:* Kathy, for the tip. *Asked:* whether all banks have these services and information for anyone and everyone or it is one of those *you must ask* . *Observed:* recently in the news CS Joe Mucheru, EGH opened a Data protection and compliance conference, https://www.youtube.com/watch?v=w59n41KX1QQ/. *Asked:* whether anyone here in this mailing list had an opportunity to attend and if there were any insights that can help us with our questions for the day. *Thanked:* Barrack for the questions, I do hope that those in the relevant institutions/positions will be able to assist or share further information, as we continue with the discussions. *Highlighted:* the main issue I have is that most services/websites/apps don’t give any options. You accept the Terms and Conditions or you don’t. It is good that nowadays, at least in Android that I know well, permissions can be easily denied or limited for apps in relation to accessing certain functions from the device. However this is not the same as using data itself. Hopefully in the future there will be more flexibility and options around what one accepts. With cookies, some websites give options (either a list of several things you can toggle on or off, or options of reject, minimum required, all) though other websites don’t give options at all. *Accentuated:* I am not aware of any voluntary standards in Kenya that a website/app/service could self-certify against or be independently verified against that shows they meet such standards around use of data protection/privacy. An Act really only defines illegal and legal, but it is good to have different options within legal that can show strong, stronger, very strong protections, for example, that are something that is voluntary but could be recognized by users. *Underlined:* we have tonnes of domesticated ISO 27,000 series Standards at the Kenya Bureau of Standards. Together with @John Walubengo <jwalubengo(a)kictanet.or.ke> and other listers we have been involved in local standards development. The Challenge we have always faced is that Standards focusing on ICT are voluntary. Only those touching on Health and Safety are mandatory. With creation of the Office of the Data Protection Commissioner, things might change. *Asked:* since organizations have Standards like the ISO 27000 series, where can individuals get credible standards for self-assessment? *Responded:* I think this would be critical tool kit that can supplement the Data protection laws. KICTANet has actually developed a Curriculum on Digital Security and Privacy that attempts to create awareness and empower Internet end users with skills that enable them to conduct self-assessment. *Asked:* Barrack, are those standards addressing the issue I raise around data protection and privacy, i.e. if you meet the standard then you do not share data to third parties, or that any data you share is anonymized, or to some other definition? I am not an ISO expert, but I thought they focus more on following processes than actual results, and may not be specific enough to convince me they are not sharing my data…. *Observed:* maybe I am just not well enough informed, in which case whoever promotes such ISO standards that can assure me of such are not promoting it very well, or have few apps/websites/services adopting such standards, or both….Being voluntary is a good thing. But there needs to be awareness of the benefits of those standards; and maybe some market pressure to adopt the standards *Emphasized:* the standards are pretty high level but they elicit a sense of responsibility from anyone who acquires them towards ensuring their information assets are properly managed and well protected. Digitalization revolves around processes, the standards actually address such processes. Not sure if there is a simpler solution among other bodies such as ISACA. Probably ISACA members on the list can shed some light. @Mwendwa Kivuva <kivuva(a)kictanet.or.ke> *Thanked:* Listers for the continued discussions, once again I would request those within these institutions that can shed some more light or share information, to kindly do so. *Noted:* one of the key things that I can pick from this discussion is that there is lack of awareness, i.e because within your network you are aware of e.g the standards, tools etc we assume that everyone knows. *Asked:* How do we create this awareness? Who should create this awareness? To whom? *Anticipated:* to hearing from you, we still have another day to share, even as we continue to engage with our day 2 discussion. Day 2: *ICTs and the Upcoming Elections* *Asked:* Our elections are a few weeks to come, are we confident in the preparations by IEBC and other agencies involved in electoral management? If not, how best can these agencies be supported to prepare for the election? What role has social media played during this election? *Asked:* one, the IEBC normally responds by sticking to the law and the regulations as passed by Bunge. Does that mean parliament normally pass things that they do not understand? Two, is there a need to re-look at the same laws and perhaps look at what can be amended before the election year? This is where we normally get it wrong every electoral cycle, we make elections an event and not a process. *Noted:* this is an important issue and I would like to thank you Wanjiru for leading this discussion. A research by Mozilla Fellow Odanga Madung revealed that there is disinformation being spread on TikTok and it violates the platform’s policies. This disinformation is similar in tone and quality to the Cambridge Analytica and Harris Media content that spread on Kenyan Facebook in 2017. In 2017 we did not have Tiktok but now we can see new platforms being used by politicians to push their agenda. *Link:* https://foundation.mozilla.org/en/campaigns/kenya-tiktok/ Emphasized: the campaigns are still ongoing and the social media discourse is becoming more political by the day. We can only hope for sanity, maturity and patriotism by those online. *Agreed:* with Francis, that recently SABC News interviewed digital strategies from two political parties in Kenya to understand how they are using social media during this campaign season. The interview highlighted that Political parties consider social media is very important to win elections as it provides avenues to speak to voters directly. Interesting was the role associated with Video content on all platforms but also TikTok, because of how the platform is designed. *Link:* https://www.youtube.com/watch?v=jIbiqyBdV4E *Asked:* what steps have platforms taken to minimize misuse of their platforms to spread misinformation, disinformation, hate speech or Online Gender based violence related content? Are the videos being collated and stored in a data pool/storage? I'm not sure about the platform's policies on the data. Is it a situation like Facebook where you cannot scrape or even screenshot posts legally? I'm not acquainted with the platform but how easy is it to get/copy these videos and their respective metadata from the platform? *Observed:* it would be an interesting resource afterwards or even act as a source of evidence. Day 3: * Connecting all people and promoting cyber hygiene and emerging issues including youth, online work, inclusion and regulation.* *Observed:* for the youthful population, what is their degree of awareness on existing regulations, as they engage online are they aware of how to enhance their privacy? On inclusion, is there existing data on persons with disabilities and their general consumption of the internet? *Noted:* especially for children, the Ministry of Public Service, Gender, Senior Citizens Affairs and Special Programmes developed a national plan of action to tackle online child sexual exploitation and abuse. The plan is grounded in the ‘We Protect Model National Response’ and has five key areas — law, policy leadership and coordination, prevention, capacity strengthening, response and support services, and monitoring and evaluating progress. *Emphasized:* 12 million children in Kenya have access to adult content. How can we mitigate this? Currently, though not rolled out in Africa, in future one will need an ID to register on Instagram. The situation seems very similar in Kenya, and making this kind of self taught learning process more effective is one way to increase ICT competencies for the general public. This years' cohort was drawn from a pool of 331 applications. According to the WHO, Kenya needs close to one million units of blood every year. The study is expected to benefit the healthcare industry with insights that could lead to innovative practices to boost blood donations and entrench a regular and voluntary donation culture. It will be carried out in 47 counties, and target public, private and mission-managed healthcare transfusion facilities, as well as the Kenyan public. The project underlines the IDRC’s commitment to supporting projects that have high impact potential on the lives of the people. On their part, Villgro Africa is committed to assisting start-ups whose work has high potential to benefit society in the continent and the rest of the world. In the past, Villgro Africa has supported Damu Sasa to build technology capabilities that enabled blood donations to continue even in the face of the COVID-19 Pandemic, specifically the physical distance requirements. Speaking at the project inauguration, the University of Nairobi’s Prof. Julius A. This affected both the cost of making calls ("airtime") and the cost of Internet (mobile "data bundles" or fixed broadband subscriptions), as telecoms network operators increased their prices to pass the costs onto their consumers. In this post, I look at the effect this has had on Internet adoption, how people use the Internet in Kenya, and broader economic development. The opposite of what was intended Recent statistics from the Kenya National Bureau of Statistics, reported by Business Daily Africa<https://www.businessdailyafrica.com/bd/economy/kra-loses-sh7-billion-on-hig…>, reveal that tax collections actually decreased by 20%, instead of the predicted increase of 22%. Interestingly this is the opposite of the effect when a previous increase from 10% to 15% in 2018 saw tax revenue increase by a massive 60%. However, that came at a time of rapid growth in Kenyans getting online, which has now slowed, and it occurred during a period of economic growth. Despite a trend of prices declining year-on-year generally, the tax-inspired higher prices in 2021 came at a time of economic shock during the pandemic, which affected the earnings of many Kenyans and led to consumers limiting their calls and Internet usage. This in turn caused the revenue growth of telecommunications companies to slow and reduced tax collections. The reason for excise duties Excise duties are generally seen as "sin taxes" with the dual aim of reducing demand for products that have negative social or environmental impacts and generating revenue that can be used to fund activities to offset such negative social or environmental impacts. Typical excise duties cover alcohol, betting, or tobacco products across the world, though in Kenya (and many other countries) they have been applied for airtime and also mobile money transactions, even though these overwhelmingly have positive social and economic impacts. Indeed, they stimulate economic growth and create indirect social and environmental benefits. In fact, in Kenya, airtime and data have become the biggest source of excise taxes ahead of beer, spirits, cigarettes, bottled water, and financial transactions. This is in addition to multiple other taxes on ICT, particularly the burden of paying VAT (currently 16%, though it was reduced to 14% for a year during the pandemic). VAT is also applicable to electronic devices, along with a further 2% Railway Development Levy and 3.5% Import Declaration Levy. There is also a 12% excise duty on mobile money payments and various license fees on telecommunications companies. Negative impact Such taxes not only hinder usage, but can also stifle innovation and overall development, as growth in ICT usage correlates with economic growth. In a wide-ranging study, the International Telecommunications Union (ITU)<https://www.itu.int/en/Pages/default.aspx> found that an increase of 10% in mobile broadband subscriber penetration yields an increase of 1.5% in gross domestic product (GDP). The impact of mobile broadband is more powerful still in developing economies at 2%. Moreover, ITU economists have more recently established that higher mobile adoption also mitigated the most damaging economic impacts of the COVID-19 pandemic. The ITU found that an increase of 10% in mobile broadband subscriber penetration yields an increase of 1.5% in GDP. During the pandemic, the ICT sector was one of the few sectors in Kenya that saw growth in 2020 (ICT was the second fastest growing sector in the economy that year), and played a crucial role in enabling Kenyans to work, trade, study, and get health information online. Yet in 2021, the telecommunications industry's growth slowed to 9.7% from 12.6% in 2020 (source<https://www.knbs.or.ke/wp-content/uploads/2022/05/2022-Economic-Survey1.pdf>, Table 2.4) - the increase in taxation that came into effect from July 2021 is a likely contributing factor to this trend. As Business Daily<https://www.businessdailyafrica.com/bd/economy/kra-loses-sh7-billion-on-hig…> reports, "Safaricom said although its data income grew impressively by 8.1% to Sh48.4 billion (approx. US$411.2 million), the growth was dampened in the second half of its financial year to March due to the new taxes. 'Data performance in the first half of 2022 was weighed down by absorbed excise duty adjustments from August 2021, which slowed down industry momentum and price rationalisation,' Safaricom CEO Peter Ndegwa said in the investor briefing." A March 2020 study<https://www.gsma.com/publicpolicy/resources/mobile-taxation-in-kenya-accele…> by GSMA<http://gsma.com/> reports that Kenya's mobile industry and consumers, despite being seen as a frontrunner in Africa, are one the region's most heavily taxed, inhibiting its potential to grow further and support other economic sectors. It states that while mobile market revenue accounts for 3% of Kenya's GDP, the sector's tax and fee payments account for around 6.5% of the government's total tax revenue. At the time, GSMA analysed the potential detrimental effects of a hypothetical increase of the excise duty on mobile services from 15% to 18%, finding that by 2025, tax revenue would decline by US$24 million, wider investment would decline by US$59 million, subscriber numbers would be 950,000 lower than otherwise, the sector revenue would be US$83 million lower, and GDP would be US$268 million lower. Last year in Kenya, the 5% tax increase led to a drop of US$63 million in mobile services excise tax revenue compared to 2020. Increasing taxation on mobile and Internet services is a common trend in Africa. In Uganda, excise duty on airtime as well as Internet data is 12%, in addition to 18% VAT. In Tanzania, excise on airtime and Internet is 17%, in addition to 18% VAT. However, recent increases in mobile money taxes were watered down after public pushback, and in 2021 the Finance Minister proposed removing VAT on smartphones, "to encourage the use of telecommunications services to achieve the target of 80% of Internet users by 2025 from the current 46%." Hopefully the evidence from Kenya-and maybe similar evidence related to smartphone sales that may come out of Tanzania-will make countries think twice about whether and how they tax mobile services and devices, particularly if it may conflict their strategies for achieving digital inclusion or a digital economy. In fact, there is growing economic evidence that the social benefits of digital economic development and closing digital divides exceeds that of private sector benefits. Current best-practice in policy discussions is for governments to increasingly support digital infrastructure rollout and adoption through fiscal instruments. Slowing growth in mobile Internet adoption When COVID-19 hit in Kenya, there was initially an increase in mobile broadband connections (up by 8% from March 2020 to September 2020) and smartphone connections (up by 20% from March 2020 to September 2020), compared to their trend line of around 5% growth. But today, only around 60% of Kenyans use mobile broadband on a smartphone, with the high cost of smartphones frequently cited as the biggest barrier. The price of smartphones has not declined significantly in Kenya over the last several years, having reached a limit of how much cheaper they can be manufactured from their component parts. It might be that only variable costs, such as shipping, distribution, marketing or taxation can be reduced to make smartphones more affordable. Taxation must be seriously considered. Even as broadband connection growth stagnates, data usage is also very low in Kenya, with the primary limiting factor being cost. For example, Safaricom is the largest mobile network operator in Kenya, with around two thirds of the market share. Of their 33 million active data customers, only 12.5 million use more than 100 MB a month including 7.7 million who use 1 GB a month. These statistics are per month, not per day, which might shock many people who would easily use 100 MB a day, and in some cases, 1 GB a day. This is particularly noteworthy when the vast majority of mobile users do not have a fixed Internet connection at their home or workplace (though some may use data from other networks on a second SIM card), and thus this mobile data usage is their entire usage. Even though Safaricom and other operators are reducing data costs year on year, the costs are still too high for many, with taxation a key part of this. High taxation on airtime, Internet data, and smartphones is a critical factor restricting deepening penetration, faster growth, and the greater impact of broadband in Kenya. The result is that those who could benefit most from using the Internet - those in more remote areas, those who cannot afford transport, those without employment, those without choice in buying goods and so on - are unable to afford smartphones and unable to use as much Internet as they would like, and are thus unable to improve their lives, or contribute to overall economic growth. When considering taxation, it is crucial to identify an approach that balances economic growth, quality of life, and tax revenue. Hello Listers, As the continent’s GDP reached $3.3-trillion in the past few years, so the cost of cybercrime climbed to $3.5bn, with Nigeria, Kenya, and SA recording the largest losses. Cybercrime is estimated to cost Kenya's economy some $300 million a year and the situation is running out of hand that the Kenya Government has asked for help from the FBI to train their Kenyan counterparts from the Directorate of Criminal Investigations (DCI). Financial institutions, businesses, and public agencies are the main targets of these attacks. Worse still, is the issue of investigation and presenting electronic evidence in a court of law. Electronic evidence is generally fragile and can easily lose its value not collected, preserved, and guarded in a proper and timely manner. Maintaining the integrity of computer-generated evidence is key in any court case involving electronic evidence. Integrity is the property of digital data not to have been altered in an unauthorized manner since the time they were created, transmitted, or stored by an authorized source. Proper procedures need to be followed to obtain evidence from a defendant’s computer in a manner that is legally admissible in a court of law. Sim card swap: How Farah Bashir lost Sh2.6m to fraudsters in hours

Morning Listers, In the news today: Farah Bashir is yet to come to terms with how his bank accounts were wiped clean by fraudsters, barely two days after he had landed in Johannesburg for a two-week assignment in February. He painfully recounted how he watched helplessly as Sh2.6 million was withdrawn by hackers in several transactions from his four different Absa Bank accounts between February 7 and February 9. I bet there are many sad tales from individuals who've lost collasal amounts due to sim swap fraud. How come we're not able to contain this crimes? Listers, I believe it is in order to congratulate one of us on his deserving appointment. Dr. BITANGE NDEMO has finally landed a government appointment as Kenya's new ambassador to Brussels-Belgium. Dr.NDEMO said after he was sacked as PS by the Jubilee govt in 2013 many of his friends deserted him.
