Good afternoon Listers, The *KICTANet Digital Accessibility* team in their pursuit of ICT accessibility and equality for persons with disabilities, conducted an assessment of the *Accessibility of Kenya Government Websites to Persons with Disabilities* and developed a scorecard. The purpose of conducting the assessment is to influence persons with disabilities access to ICTs, their lived experiences, and their input towards ICT policy in Kenya. It is important that information posted for public consumption reaches and remains the same for all. This is to promote equity and equality in access to information and online services. A basic human right provisioned in the Constitution of Kenya 2010, Article 35. Kenya falls a cliff in press freedom

According to Reporters Without Borders, Kenya’s ranking in press freedom has slid from position 69 globally in 2022 to position 116 in 2023. In Africa, Namibia (22), South Africa (25), and Cabo Verde (33) lead the pack. Sudan (148, Djibouti (162), and Eritrea (174) are the least ranked in the continent which is now described as the ”new disinformation and propaganda laboratory”. Norway (1), Ireland (2), and Denmark (3) lead in press freedom with Vietnam (178), China (179), and North Korea holding the tail at position 180 of all ranked countries. Mulot SIM Swap

Just how easy is it to do SIM Swap? Seems like the chaps at Mulot bado wanafanya ile kitu. Story below from a recent complaint on Safcom's FB page today: Safaricom PLC you people will loose customers because of this sim swap thing. On 11th April 2023 at around 9:30am, I was at work when all of a sudden my phone's network went off.I couldn't neither make nor receive any calls or messages. I tried restarting the phone all to no avail, I just assumed it was a network error and put the phone on my bag.During lunch break I went home to my daughter who tried all tactics but still nothing. That's when we called customer care and were informed to visit the nearest safaricom shop. We went to Safaricom Nyali,City Mall. That's when I was shocked to hear that my line has been replaced and the following has happened :- 1. Kcb mpesa loan of 79,600 was taken 2. 30,063 was withdrawn from mshwari 3.Mshwari loan of 29,000 was taken 4.Fuliza of 2950 also taken 5.3600 was withdrawn via mobile banking 6.Mpesa balance of 58,525 All this collectively sent to one Dorica Manono and Evans Gucho.These are people I do not know. I reported to Nyali police station under OB number 35/11/04/2023 , I was later informed that the sim swap happened in Mulot area in Bomet. How is that possible yet I stay in Mombasa? KCB and Mshwari are on my neck to pay the said loans.Intrest is already accruing. Some of the cash are for chamas. I tried following up but nothing. My question is , how safe is my money on Safaricom? I need this issue sorted as soon as possible.I can't loose over 200,000 just like that , with this economy.NO!!!!!

The memorandum captures the concerns and highlights the proposals on relevant provisions of each of the Regulations. We would be glad to provide further input and perspectives on the Regulations, as and when required, and the debate can still go on. (l) ensure content aired during watershed period is appropriately classified and suitable for the period; (m) ensure that programming on betting and gaming activities is duly authorized by Betting Control and Licensing Board Section 47 (4) The Authority may, by notice in the Gazette, declare a person or institution to be a “dominant telecommunications service provider” for the purposes of this Act. (5) In making a declaration under subsection (4), the Authority shall consider — (a) the market shares of the telecommunications service provider being at least fifty per cent of the total revenue of the entire telecommunications market; (b) significant market power enjoyed by the telecommunications service provider; and (c) any other consideration the Authority may determine Section 48 (4)The Authority in consultation with the National Treasury and on the recommendation of the Cabinet Secretary may waive spectrum fees where appropriate, to facilitate the provision of universal service in unserved and underserved areas of Kenya. The platform's members will also contribute to the advancement of all the ethical provisions in the UNESCO's Recommendation. At a time when digital technologies are reshaping everyday life, women are under-represented in the research and design of these technologies, Their needs and experiences are also overlooked by designers, and the data used to train AI is often biased against women and girls. Today, globally, women and girls are 25% less likely than men to know how to leverage digital technology for basic purposes, 4 times less likely to know how to programme computers and 13 times less likely to file for an ICT patent. Only 20% of employees in technical roles in machine learning companies, 12% of artificial intelligence researchers globally and 6% of professional software developers are women. *The Kenya Youth IGF Multistakeholder Advisory Group* (Youth MAG) role is to assist in convening the Kenya Youth IGF Meeting by preparing the programme, logistics and schedule and improving the youth engagement and meaningful participation in the IGF process through community consultations, outreach and stakeholder engagement. Youth MAG members shall volunteer and serve in their personal capacity, and are expected to have established linkages with their respective stakeholder groups and communities. The key tasks include the following: - Develop the detailed programme of the Youth IGF meeting, including the identification of themes, taking into account inputs of all relevant stakeholders; - Determine how best to plan, organise and facilitate the annual IGF meeting; - Coordinate panels and provide support and guidance to panellists, moderators and speakers at the meeting; - Promote the work of the IGF amongst all stakeholders and foster multi-stakeholder participation and collaboration; - Attend MAG meetings – virtual or in-person as and when the situation warrants; - Engage in outreach communication to the wider community and bring other networks related to Internet governance into the discussions and planning; - Explore new networking and fundraising opportunities for contributions to support the event; - Identify emerging Internet governance issues and other areas in need of discussion, research or recommendation; and, - Support any other function of the larger Kenya IGF and provide accountability to the community. It’s important to note that the decisions in the Youth MAG meetings are by consensus, and members will have equal say. The discussions and planning will continue to take place throughout the course of April and June through in-person and virtual meetings. Youth MAG membership shall be renewed on a yearly basis contingent on their engagement and contributions and thereafter is rotated to enhance diversity and bring in new viewpoints. Dear Listers, Something great is going to be launched on *Tuesday, 25 April 2023, 0800 – 1400 hours EAT Nairobi, and Zoom.* *The Tatua Digital Resilience Centre.* KICTANet together with other Africa Internet Rights Alliance (AIRA) coalition members established the Tatua Digital Resilience Centre to offer a bouquet of services to SJOs in East Africa to enhance their digital resilience, quickly respond to and recover from digital threats, and harness the power of technology to enable them to achieve their mission in a digitally changing environment. The Centre will initially provide support to SJOs in Kenya, Tanzania and Uganda working to advance digital rights, and thereafter scale to other organisations in East Africa, and ultimately, the continent. The Centre is also part of a wider network of resilience hubs in the region under the Ford Foundation’s Weaving Resilience initiative for Stronger Civil Society in the Global South. Under the theme of “building a sustainable internet for all,” where conversations on digital policies are debated and deliberated on and partnerships are forged for action. Good afternoon, Following the announcement that Kenya IGF 2023 will be held on Thursday 22nd June 2023 and the series of events from 19th -22nd of June that all make up the IGF Week, we the Multi Advisory Group (MAG) that assists in the coordination of IGF hereby make a call for topics to be discussed throughout the IGF week. The topics should be based on the global IGF sub themes as well as any other contemporary topics that form key internet governance concerns in Kenya. As earlier advised, the theme for Kenya IGF 2023 will mirror the global IGF theme “'The Internet We Want - Empowering All People''. The Subthemes will be centered around 1. AI & Emerging Technologies 2. Cybersecurity, Cybercrime, and Online Safety 3. Data Governance and Trust 4. Digital Divides and Inclusion 5. Human Rights and Freedoms 6. Sustainability & Environment Some other themes to consider will be 7. Avoid Internet Fragmentation 8. Election Technology and Electoral Justice In Kenya

Dear Listers, ICJ Kenya recently produced a technical brief on Election Technology and Electoral Justice In Kenya. The brief considers the steps taken in the integration of election technology. It also assesses the context of integration of election technology and the impetus provided by the standards provided under the Constitution of Kenya 2010. The brief notes the historical uncertainty in the management of free and fair elections, the high constitutional standards, and the essence and substance of technology in election management. It recognizes the opportunities presented by technology in achieving the principles and objects set in the constitution. It proposes a principle and value-based approach by IEBC and the courts called upon to apply and interpret the legal framework. This brief notes that, in the past, there has been an attitude of election managers to attain bare minimalist compliance with the law. This brief note that the minimalist and full deference to the IEBC in explaining technology failure in 2013 was followed by a more substantive and principle-based consideration in 2017. There are instances where there has been targeted litigation that are clearly intended to curtail the transformative focus of the Constitution in election management and reinforce the minimalist approach. CA notice Protests

Hi all, The CA yesterday issued a warning to several media houses over their coverage of the demonstrations on Monday. It's not posted to their website yet as far as I can tell but it has been posted to their office twitter handle here <https://twitter.com/CA_Kenya/status/1638597216595050515>: https://twitter.com/CA_Kenya/status/1638597216595050515 I'd like to take sometime to explain why I think their statement is wrong: *ALL BROADCASTERS RE: BROADCAST COVERAGE OF DEMONSTRATIONS* So the CA understands these are demonstrations. That's good *Today, the Authority completed a review of Broadcast Coverage of Opposition demonstrations held on 20th March 2023. The Authority has established that at least Six (6) TV stations, namely, Citizen TV, NTV, K24, KBC, TV47 and Ebru TV, provided coverage in a manner that violated the Programming Code. The coverage depicted scenes that could cause panic or incitement to the public, threating peace and cohesion in the country. The Authority has, in accordance with the relevant provisions of the law, issued notices to the identified broadcasters to take immediate remedial actions.* *1. Section 33 of the Constitution of Kenya as read together with Section 5B of the Kenya Information and Communication Act, which provide that the constitutionally guaranteed right to Freedom of Expression, does not extend to propaganda for war, incitement to violence, hate speech or advocacy of hatred that constitutes ethnic incitement, vilification of others, or incitement to cause harm or discrimination;* The protests and the actions leading to them have been well covered. The initiator of these protests was the opposition and they made it clear why they were being called was a perceived disputed election, what they saw as poor leadership, and raising cost of living. It is their right as enshrined in the constitution, projected by freedom of speech and by the freedom to demo, picket and present petitions to public bodies. Meanwhile those of us who followed the protests on the various media mentioned by the CA were treated to scenes of people protesting the rising cost of living especially the cost of food. Nowhere was *propaganda for war, incitement to violence, hate speech or advocacy of hatred that constitutes ethnic incitement, vilification of others, or incitement to cause harm or discrimination * *2. Clauses 461 (1) (a) Kenya Information and Communications Act which requires licensed broadcasters to provide responsible and responsive programming that caters for the varied needs and susceptibilities of different sections of the Kenyan community;* Planned and executed nationwide protests I would think is coverage that whole country would be interested in. *3. Clauses 19 (1) (c) and (d) Kenya Information and Communications (Broadcasting) Regulations which requires a licensee to ensure that no broadcasts by its station "glorifies violence or depicts violence in an offensive manner; or is likely to incite, perpetuate hatred, vilify any person or section of the community;* If we were to go by the broadcasts I saw, and of course this could have been biased, the only glorification of violence and depict of it in an offensive manner was done by our police forces. The only report of a death across the entire country on Monday came at the hands of the police in Maseno. In fact it could be said, and has by some media houses, the escalation of violence was by the police. *4. Clause 10.2.1 of the Programming Code which requires broadcasters to take care in coverage of crisis situations so as not to hinder or obstruct efforts by authorities to resolve the situation;* I don't have much to say on this other than can the CA please provide evidence where a boradcastor blocked the police and any other emergency service trying to do their jobs? Or is the implication of this that they can't do their jobs while being recorded or somehow their work is secret and covert? *5. Section 5.8.4 of the Programming Code which states that presentation of news and commentaries must not be done in a way that would create unnecessary panic or alarm;* I'd like specific examples of this. *6. Section 5.8.3 of the Programming Code which states that morbid, violent, sensational or alarming details that are not essential to factual reporting are not permissible* Again. I'd like specific examples of this. *7. Clause 2.4 of the Programming Code which states that broadcasters are responsible for the broadcast materials relayed on their stations, regardless of their source, as well as professional activities of its employees.* This is the only thing in the entire statement I have no issues with. It is reasonable. I very strongly disagree with almost everything in this statement. I understand that some of these laws and policies were put into place after what we went through as a country in 2007/08 but them being used like this is a worrying assault of our freedoms, particularly those of expression. The Thomson Reuters Foundation (TRF) is implementing the Building Resilient and Independent Media Ecosystems in Africa (BRIMEA) Project, a two-year programme seeking to enable more resilient media ecosystems in Kenya, South Africa, and Zambia through a combination of legal and media interventions. The initiative provides journalists and newsrooms with media-related and legal support to strengthen their editorial independence and financial sustainability. In line with this, TRF is developing legal research and providing legal support, while also building the capacity of media practitioners and media organisations, both conventional and digital/social media. The project has conducted research on the legal and regulatory environment in the target countries in addition to research on the legal needs of media practitioners. Insights from these reports will be shared with an audience of lawyers, media support organisations, media associations, and media practitioners in dissemination events in the three countries. TRF seeks a consultant to develop a presentation that focuses on sharing key insights from the legal and regulatory reports from Kenya, South Africa and Zambia as well as the legal needs assessment. The country level reports explore the legal and regulatory framework of the media, including the framework on the regulation of foreign ownership and transparency of ownership of media. The legal needs assessment identifies legal vulnerabilities and needs of both media outlets and individual media practitioners. TRF seeks a consultant to synthesize key themes and identified needs from across the four reports and create a dynamic presentation package that includes speaker notes, a PowerPoint presentation, and suggestions for dynamic delivery from an information sharing perspective. The consultant will also develop a set of discussion questions for group discussion sessions lead by media freedom legal professionals with the group in attendance at the presentation session(s). The ICT fraternity mourns the passing of the former Director-General of the Communications Authority of Kenya ( 2012 to 2019). Mr Wangusi joined the then Communications Commission of Kenya (CCK) in 2000 at the level of Assistant Director and rose through the ranks to his current position. He served as the Director in charge of Broadcasting and Special Projects as well as the Director in charge of Licensing, Compliance and Standards. Mr Wangusi oversaw significant milestones in the ICT industry, including the transition to digital television broadcasting, operationalisation of the USF, the National Broadband Strategy, and the sector's exponential growth during his tenure until retirement. He was a key supporter of public participation and graced many KICTANet events. May he rest in peace as we condole with his family, friends, and colleagues. Good people I've been very vocal about these annoying, untargeted, spray-and-pray marketing tactics of many brands. Today I want to demonstrate why they are annoying and have the opposite effect of what they are intended for. And how we can do things better. Bear with me guys as I demonstrate. 1. Pay attention to graphic No.1 below. I give this brand 3k every month. On top of that, I pre-pay at least 4-5k a month for international calls where WhatsApp <https://www.linkedin.com/company/whatsapp./> calls are blocked and it's too cumbersome to get on Zoom <https://www.linkedin.com/company/zoom-video-communications/>, etc, on the fly. Now see my balance of bundles (I'm not being a Luopean, just stating facts. 😀 ). So why then would this brand be hawking to me Kshs 10 worth of bundles every day? 2. Now pay attention to graphic No. 2 below. Why, why, are you annoying me with these unsolicited, untargeted, spray-and-pray SMSs day in and day out? Is there a better way? 3. You bet there is! The Common Agenda proposes a Global Digital Compact to be agreed at the Summit of the Future in September 2024 through a technology track involving all stakeholders: governments, the United Nations system, the private sector (including tech companies), civil society, grass-roots organizations, academia, and individuals, including youth. The Global Digital Compact is expected to “outline shared principles for an open, free and secure digital future for all”. JURISDICTION ON DATA PRIVACY BREACH COMPLAINTS

Recently, there was a thread on the case against Safaricom by it's users on the privacy concerns in light of it's terms and conditions. I remember an argument as to which institution is specialised to handle such complaints - the Constitutional Court or the ODPC. I argued for the latter, here is an interesting case to support that. In Mwangi & another v Naivasha County Hotel t/a Sawela Lodges (Petition E003 of 2021) [2022] KEHC 10975 (KLR) (19 July 2022) (Ruling) The Petitioners alleged that the Respondent took photographs of them during a team building activity at the Respondent’s premises and proceeded to make posts on various social media platforms using the said pictures with the intention of marketing the Respondent’s products. The Petitioners averred that the actions of the Respondent violated their right to privacy as they did not consent to having their photos taken and the used The Court held that the matters raised by the Petitioners fall under the jurisdiction of the Data Protection Commissioner established under the Data Protection Act, 2019 and the Honourable Court acted to discourage invocation of the constitutional process where there exists a parallel or alternative statutory remedy. Will the class action against Safaricom suffer the same fate? And why the difference in jurisprudence emanating from the High Court? Why did they admit the Njeri Wanjiru V Machakos University case and throw this one out? What can be done to ensure the Courts develop consistent and synchronous decisions in this area? What can you possibly get done with 500? When did the terms for NHIF change? FULIZA LOSES CLOSE TO SH 500 MILLION TO SCAMMERS

Seems our friends from Mulot are giving Safaricom a run for their money. Great to see that law enforcement are catching up. It will be interesting to see whether ODPP can successfully prosecute the offences and recover the funds. ****** Detectives have uncovered a high level syndicate where scammers have obtained close to Sh500 million through a popular mobile phone platform supported by mobile communication service provider, Safaricom. The service provider through its Fuliza overdraft service where customers can complete their MPESA transactions even when they do not have enough funds in their M-PESA account, lost the money in a well coordinated scheme by eight young men based in Nakuru and Trans-Nzoia counties. Isaack Kipkemoi, Gideon Rono, Maxwell Ributhu, Gideon Kirui, Moses Rono, Collins Kipyegon and Edwin Cheruiyot were arrested at an apartment in Kiamunyi, while the mastermind Peter Gitahi was arrested in Kitale, Trans-Nzoia County following the meticulous operation by our officers. The young men who were found in possession of thousands of Safaricom and Airtel SIM cards were using fraudulently generated identity cards numbers to register the SIM cards before proceeding to borrow money through the application. Detectives began investigations into this well choreographed fraud after a report was filled to the Banking Fraud Investigations Unit (BFIU) in August 2022, after the managers of the fund detected an unusual spike in Fuliza loan uptakes that were way above their performance scale and the borrowers were not repaying the loans. According to sleuths from BFIU, over 123,000 new mobile phone numbers opted into fuliza and took up loans in January 2022. Thereafter, the SIM cards were either fraudulently vacated or switched off and efforts to reach the customers turned futile. It is after further investigations that detectives realized that the SIM cards had been registered fraudulently by one of the suspects identified as Peter Gitahi, who is suspected to have access to the National Registration Bureau database, where he develops falsified identity numbers used in the high profile fraud. Preliminary investigations indicate that after developing the numbers and registering the lines he would sell them to his accomplices based in Nakuru who would then perpetuate the fraud. Further, the detectives uncovered that some of the lines had been registered as Safaricom agents where the borrowed funds would be deposited to personal bank accounts belonging to the individuals, disguised as Mpesa float. The seemingly industrious suspects would initially borrow money and repay thereby improving their credit scores, until the SIM cards achieved their limits when they would borrow for the last time before disposing the SIM card. One identity card would be used to register 5 lines in the daring SIM scam perpetuated by the young men, aged between 24-30 years. The suspects who live large in an apartment at Kiamunyi, have through their craft acquired 2 brand new Subarus, one Toyota Mark X, a Toyota Probox and two motorbikes for their ease of movement. During the operation, the detectives recovered 14 mobicom phones used in registering MPESA user SIM cards, 6laptops over 40 mobile phones, 7 routers, assorted Safaricom lines, over 1000 Safaricom subscribers registration forms, over 200 ATM cards from all major banks, car agreements among other exhibits. The High Court has allowed millions of Safaricom subscribers to join a class action suit against the telecoms operator over a clause in the SIM card registration rules that allows the firm to collect bank details of mobile phone users. Clause 3.2.1 in the data privacy statement, which subscribers filled as part of the re-registration process, states that the telecoms operator can “collect and store information including credit or debit card information, information on bank account numbers, Swift codes or other banking information”. This will result in the presentation by UNESCO, in mid-2023, of global guidelines for governments, regulatory bodies and digital companies. "The call is now coming loud and clear from all quarters. It is time to address one of the defining questions of our age, with implications for democracy and human rights worldwide: the challenge of how to support States in developing principles and rules for digital platforms so that they enable freedom of expression, and promote the availability of accurate and reliable information," said Audrey Azoulay, UNESCO's Director-General. A flawed business model Social media and other digital platforms have empowered people all over the world to communicate, share information, and transform their societies. But increasingly, these platforms are also breeding grounds for disinformation, hate speech and conspiracy theories. In recent years, the issue of monitoring and moderating content has been an important factor in violence, insurrection, marred elections and democratic transfers of power in scores of countries. Studies show that engagement can often be prioritized at any cost. This leads to algorithms favoring the most controversial content, because it triggers the most reaction, in spite of the evidence that this content can damage the fabric of our societies, sowing distrust, helping to seed extremism, and undermining fundamental human rights. There appear to be vast imbalances between regions and languages, with moderation resources sometimes distributed on the basis of financial or political interests, or far too late, in response to public outrage once violence or election meddling has already occurred. Global issues require global guidelines Many countries are advancing regulation to respond to these issues, but this has so far been uncoordinated and fragmented, with some countries clearly not in line with international norms on freedom of expression. Given the global dominance of a limited number of players, the need for a consistent global approach has never been more pressing than right now. As the United Nations agency for communication and information issues, UNESCO is leading global consultations on this topic, involving governments, regulatory bodies, digital companies, academia, civil society and UN agencies. This global dialogue will culminate in what is believed to be the first global conference specifically focused on guidance for the regulation of digital platforms, from 21 to 23 February 2023. Thousands of representatives from these groups are already registered to participate. Regards, JG KRA ACCESS TO M-PESA TRANSACTIONS IS A GRAVE THREAT TO PRIVACY ON DATA PROTECTION WEEK BY JAMES MBUGUA As the Kenyan government looks for new ways to increase revenue collection and curb tax cheating, the Kenya Revenue Authority has announced plans to gain direct and warrantless access to M-Pesa transactions. While the intentions of (KRA) may be noble, the methods proposed raise serious concerns about privacy rights and the protection of personal data. In fact, they constitute illegal searches and seizures contrary to Article 31 of the Constitution of Kenya, and well established jurisprudence on privacy rights from around the world. Article 31 provides for the right to privacy and states that every person has the right to privacy, which includes the right not to have their person, home or property searched; their possessions seized; information relating to their family or private affairs unnecessarily required or revealed; or the privacy of their communications infringed. Kenya’s Data Protection Act of 2019, provides in Section 4 that a data subject’s consent must be sought before their data is collected and processed. Section 15 requires data controllers to obtain a warrant from a court of law before accessing personal data. This is to ensure that the collection, processing and sharing of personal data is necessary and proportionate. The High Court of Kenya, in the case of Center for Rights Education and Awareness (CREAW) v Attorney General [2013] , as well as in Maina Kiai v Attorney General held that the government's surveillance of citizens' communications without a warrant is a violation of the right to privacy protected under the Constitution. KRA’s proposal in the Budget Policy Statement released by the National Treasury last week, ironically came on the eve of Data Protection Week when the world marks the International Data Protection Day, on 28th January. In Europe, whose General Data Protection Regulation (GDPR) we largely modelled our Act on, the principle of necessity and proportionality, in collection of personal data, has repeatedly been upheld by courts when government agencies have tried to access citizens’ telecommunications information without warrants. The courts have ruled that general and indiscriminate retention of personal data is incompatible with EU laws and constitutional rights, because it represents a serious interference with the right to privacy and the protection of personal data In the Digital Rights Ireland vs. Minister for Communications case, as well as another called the Tele2 case, the European Court of Justice (ECJ) ruled that a law requiring telecommunications service providers to retain traffic and location data for a period specified by national law in order to detect, investigate and prosecute crime was invalid. The Court emphasized that any interference with the right to privacy and the protection of personal data must be proportionate to the legitimate aim pursued. These cases reinforced the principle that any data retention measures must be limited to what is strictly necessary to achieve a legitimate aim. In Kenya’s case, it can be argued that KRA can achieve its mandate through other means without large scale surveillance and interference with people’s privacy. Further, granting KRA unfettered access to M-Pesa transactions data without the need for court orders, violates constitutional protection against illegal searches and seizures, also provided for under Article 31 of the Constitution. In the United States, for example, the Supreme Court has ruled that the government's warrantless access to historical cell phone location data is a violation of the Fourth Amendment, which protects individuals against unreasonable searches and seizures. Introduction KICTANET is currently seeking applications for independent researchers to audit the accessibility of public service websites in Kenya for Persons with Disabilities (PWDs). This research project is part of KICTANET’s Digital Access Program that seeks to promote the accessibility of digital technologies and platforms for Persons with Disability. The researcher will work closely with Accessibility fellows throughout the research project. Background According to the 2019 Kenya National Census, about 1 million Kenyans have some form of disability. Persons with Disabilities (PWDs) have a right to social justice and equality but can also make immense contributions to society if given the proper assistive tools. However, this is different. The challenges PWDs face in accessing information and services in the digital space became more pronounced during the COVID-19 Pandemic when multiple essential services from the government and the private sector were moved online for continuity. Information and services remained inaccessible to people with disabilities, especially those with visual, hearing, intellectual and physical disabilities. What seemed to be an effective response to the COVID-19 Pandemic had a completely opposite impact on Persons with disabilities. It is against this backdrop, KICTANET is conducting research on the ‘Accessibility of the government of Kenya websites for persons with disability.’ This initial research will focus on visual, hearing, and cognitive disabilities. AI and ethics. Samasource and ChatGPT: OpenAI Used Kenyan Workers to Make ChatGPT Less Toxic

*This is a human centric story on Artificial Intelligence (AI) Ethics.* *An interesting piece by Time magazine on the role and dangers of teaching AI, where Kenyan workers were used to train ChatGPT models.* *I have left the graphical parts out. For anyone who want to read through, the link is shared at the end. But this shows how we are creating psychologically disturbed workers in our communities. How are these workers integrated back to the community without being damaged?* Documents reviewed by TIME show that OpenAI signed three contracts worth about $200,000 in total with Sama in late 2021 to label textual descriptions of sexual abuse, hate speech, and violence. Around three dozen workers were split into three teams, one focusing on each subject. Three employees told TIME they were expected to read and label between 150 and 250 passages of text per nine-hour shift. Those snippets could range from around 100 words to well over 1,000. All of the four employees interviewed by TIME described being mentally scarred by the work. Although they were entitled to attend sessions with “wellness” counselors, all four said these sessions were unhelpful and rare due to high demands to be more productive at work. Two said they were only given the option to attend group sessions, and one said their requests to see counselors on a one-to-one basis instead were repeatedly denied by Sama management. *Is Samasource breaking any local laws by handling data that is proscribed by several acts in Kenya? Read on.* In February 2022, Sama and OpenAI’s relationship briefly deepened, only to falter. That month, Sama began pilot work for a separate project for OpenAI: collecting sexual and violent images—some of them illegal under U.S. law—to deliver to OpenAI. The work of labeling images appears to be unrelated to ChatGPT*.* In a statement, an OpenAI spokesperson did not specify the purpose of the images the company sought from Sama, but said labeling harmful images was “a necessary step” in making its AI tools safer. (OpenAI also builds image-generation <https://time.com/collection/best-inventions-2022/6225486/dall-e-2/> technology.) In February, according to one billing document reviewed by TIME, Sama delivered OpenAI a sample batch of 1,400 images. Some of those images were categorized as “C4”—OpenAI’s internal label denoting child sexual abuse—according to the document. Also included in the batch were “C3” images (including bestiality, rape, and sexual slavery,) and “V3” images depicting graphic detail of death, violence or serious physical injury, according to the billing document. OpenAI paid Sama a total of $787.50 for collecting the images, the document shows. Questions to ask ourselves: *Who should review AI systems if not humans? * *How should the humans be treated?* *What laws govern these new spheres of concern?* *The silver lining is that Samasource is working to provide a safer environment for its workers, and to an extension the Kenyan public. It has terminated contracts from projects that are traumatizing its employees. The sad bit is that some employees were also laid off due to lost revenue*. The MWI Fellowship is an opportunity for a research scholar to build and engage with a community of majority world scholars, nurturing their ideas and finding ways to publish and amplify them. A J.D., Ph.D., or equivalent degree is required. The ideal candidate will be familiar with social media governance scholarship and with the challenges majority world researchers face while thinking and writing about global online platforms. They will also have excellent interpersonal and organizational skills, will be capable of writing persuasively. We encourage candidates from the majority world to apply. Since then, Kenya has established the Office of the Data Protection Commissioner whose mandate is to enforce data protection rights and principles as envisioned in the DPA. Hi Listers, As some of you may know, and have experienced, Zuku has been down since late Friday. Communication has been nonexistent and even when you finally get through to customer care after several minutes of hold you don't get any timelines on the restoration of service. This has led me to looking through a few of the CA's reports looking to see if there's any data on down times and other metrics that a home internet provider might be measured on. I couldn't find any. Does anyone know if the CA collects such data? If they do, where is it located? If not, what do they collect on home internet connections? If this data doesn't exist with CA does it exist somewhere else? I'd really like to change my provider using some data rather than anecdotal evidence. What are the other measures I can take, other than reporting to the CA, about this?
