Good morning listers, KICTANet wishes to invite volunteers from the different stakeholder groups to assist in the preparation of the Kenya Internet Governance Forum (KIGF) 2024. The Kenya Internet Governance Forum (KIGF) is an annual meeting that brings together various stakeholder groups to dialogue on ICT and Internet policy. The Steering Team otherwise known as the Multistakeholder Advisory Group (MAG) role is to assist in convening the Kenya IGF by preparing the programme and schedule and to improve the IGF process through community consultations, outreach and stakeholder engagement. MAG members volunteer and serve in their personal capacity, and are expected to have established linkages with their respective stakeholder groups. Dear Lister, The Communication Authority of Kenya has published the Kenya Media Landscape Report for July-September 2023. This report <https://www.ca.go.ke/sites/default/files/2024-02/Audience%20Measurement%20a…> shows a diverse media landscape in Kenya with variations in preference across regions and demographics. While radio remains dominant in most areas, internet usage is growing, and media consumption patterns are evolving. *Kenya Media Landscape Highlights * *Radio:* - The highest listenership is in South Nyanza, followed by the Lake and Rift Valley regions. - Lowest listenership in the Eastern region. - Swahili is the most common language, followed by vernacular languages. - Western and Coast regions prefer Swahili stations. - Lake and Lower Eastern regions prefer vernacular stations. *Overall Media Consumption:* - Radio and TV lead in all regions except North Eastern, where internet usage is highest. - Newspaper readership is highest in Nairobi and Western regions. *Listenership Differences:* - Five regions have close radio listenership rates, ranging from 81% to 85%. - North Eastern region has the lowest radio listenership (54%) but the highest internet usage (64%). *Internet Usage:* - Nairobi has the highest internet usage (75%). - South Nyanza, with the highest radio listenership, has the lowest internet usage (44%). *Newspaper Readership:* - More males read newspapers than females. - Readership is similar across age groups. - The highest readership is in Nairobi, Western, and urban areas. *Media Advertising:* - Television is the most popular advertising platform, receiving Sh10.9 billion from a total Sh16 billion budget. - Radio received Sh3.6 billion, and print media received Sh1.6 billion. *Media Growth:* - Radio stations increased from 120 to 228 between 2015 and 2022. - TV stations increased from 9 to 182 between 2015 and 2022. - The increase in TV stations is attributed to the rise of digital media and streaming options. *1. Auditor General raises several queries regarding e-Citizen portal

The State has little control over the e-Citizen self-service and payment portal, Auditor-General Nancy Gathungu has said, warning that this could compromise accountability of the billions of shillings processed through the platform. Collections through the platform average Sh350 million daily, up from Sh50 million in the financial year ending June 2023. More than 19,000 public services are available on e-Citizen, of which 15,440 have been fully on-boarded. According to the OAG Report 2023 <https://www.oagkenya.go.ke/wp-content/uploads/2024/02/AUDITOR-GENERALS-REPO…>, there are several findings on e-citizen some of which I have highlighted below: 1. The completeness and accuracy of the receivers of revenue receipts amounting to Kshs.15,570,013,245 could not be confirmed. 2. The completeness and accuracy of the bank balances of Kshs.611,179,132 could not be confirmed. 3. The completeness and accuracy of the prior year's balances of Kshs.146,426,357 could not be confirmed. 4. The adequacy and effectiveness of the current IT controls on E-Citizen may not guarantee the integrity of the data processed through the system. 5. The adequacy of internal controls over reconciliations and settlements through the E-Citizen Government Digital Payments Platform could not be confirmed. 6. The governance arrangements in support of the E-Citizen platform could not be confirmed. 7. Users may not have any rules and procedures to follow to minimize the risk of errors, fraud and the loss of data confidentiality, integrity and availability. 8. The Office is undertaking a special E-Citizen Government Digital Platform audit whose outcome is not yet out. 9. The outcome of the out-of-court negotiation between the Treasury and the vendor was not disclosed at the time of the audit. 10. The Management has not resolved the issues raised in the previous year's Report on Revenue Statements nor explained the failure to resolve them. The continued use and integration of services on e-citizen has made the portal one of such national importance. Yet, at a policy and institutional level, there seem to be some glaring gaps. I do hope the governance of e-citizen is one of the issues that has been tackled by the task force reviewing the ICT policy and legal framework. Why IT experts want State to reject the new robotics bill

Information Technology experts have asked Parliament to reject the Robotics and Artificial Intelligence (AI) Society Bill, 2023 on grounds that it has a lot of glaring gaps. The American Chamber of Commerce (AMCHAM) says the Bill will precipitate a national disaster if it is enacted in its current form. The experts told the National Assembly’s Communication, Information, and Innovation (CII) committee that stakeholders in the AI and Robotics space were not involved at any stage before coming up with the Bill. Dear Listers, The J*owie Irungu and Jackie Maribe case concluded Friday.* Jowie was found guilty as charged in the murder of Monica Kimani, while Maribe was acquitted. The most interesting thing from the case, as revealed by Justice Grace Nzioka, is that the deceased's ID was stolen at Maribe's apartment security point, where private security guards are likely to have retained ID copies or scanned information. This stolen ID was then used to access Monica's apartment building, highlighting the potential consequences of such practices. Africa DNS Study and Webinar *- First, some listers may remember in 2016 ICANN initiated an in-depth study of the DNS ecosystem in Africa and members of this list as part of the larger community were key to the research output and its publication. M-pesa not working - resilience mechanisms needed

Today, Safaricom M-pesa has not been working. M-Pesa has been successful in promoting financial inclusion, especially for marginalized communities. M-pesa is a widely used mobile payment system in Kenya, and the government has based many of its payments on this platform. Local governments also base their rates and parking collection on M-pesa. Which other services use M-pesa as the only mode of payment? The downtime of M-pesa raises concerns about the country's dependence on a single payment platform and the need for resilience mechanisms for this critical national infrastructure. To mitigate the risks of downtime, it may be wise to consider additional payment systems and ensure that the existing infrastructure is robust and secure. Dear Listers, This week, KICTANet made general comments on the issue of Regular Institutional Dialogue, with the Chair of the Open-ended Working Group on the security of and the use of information and communications technologies 2021-2025. KICTANet suggests that civil society can facilitate dialogue and collaboration to ensure coordinated approaches to cybersecurity capacity building. Stakeholders should also be onboarded on national cybersecurity committees and CERTs for better coordination. Roll-out of Maisha Namba already manifestly flawed

Dear Listers, It is roughly two weeks to the launch of Maisha Namba. As they say, the train has left the station, or so it seems. But wait a minute, the proposed identification systems' weakest link appears to be located at where it ought to matter most - the people, the very sovereign, I must add. That the government has ambushed ordinary Kenyans with a launch date suggests that it has not learned its lessons from *Nubian Human Rights case*, *Katiba Institute cases* and the *Free Kenya Initiative case*. If it did make attempts to learn any lessons then I am certain it got it upside down. I will not, therefore, be surprised if the implementation faces serious legal hurdles and eventually suffers a fate similar to that of its infamous predecessor. What plays out shows how the citizens' interests may be so easily threatened and or slaughtered at the altar of competing economic and political interests conveniently couched in western constructs of so-called development. More so since at such times, as is the case with Maisha Namba, the State that owes the duty to protect is complicit, decides to look the other way or 'feigns evasive lunacy' in clearest of cases. Dear all, Let us all join in congratulating the disability community on the occasion of the International Day for Persons with Disabilities (IDPD). Since its inception in 1992, this day has marked significant progress in the inclusion and integration of Persons with Disabilities (PWDs) in society. This progress is worth celebrating. Notably, in Kenya, we have seen great initiatives aimed at empowering and improving the socio-economic participation of PWDs. Firstly, the KICTANet Digital Accessibility program has actively worked with PWDs, undertaking various initiatives such as research, capacity building, and advocacy to ensure equity and equality in the ICT sector for persons with disabilities. Secondly, on the 28th of November 2023, the National Council for People with Disabilities launched a Self-Registration service under E-Citizen, a few months after devolving the council services to the counties. This service will ease the previously tedious and cumbersome registration process for PWDs. Another win for persons with disabilities is the public-private partnership between NCPWD, Safaricom PLC, and FUZU to waive data charges for the NCPWD.FUZU job portal. I believe this will encourage more individuals with disabilities to join the workforce and actively participate in socioeconomic development towards self-independence. In conclusion, I believe that inclusion is achievable. Let us all celebrate this day and recognize the strides made in the inclusion and integration of persons with disabilities in society. *Dear Listers*, The government recently, through the State Department of Immigration and Citizen Services, revised the charges of some of its services including the *IPRS *charges as shown below: [image: image.png] The *Integrated Population Registration System (IPRS)* is a *centralized database* that serves as the authoritative source of information on all registered individuals residing in Kenya, including both *citizens *and *foreign nationals*. It provides automated services for verifying *national identification numbers* and* passport numbers* for both government and private entities, majorly the financial sector (banks) and telecommunications companies (Safaricom and Airtel). The applications of these services extend far beyond the financial and telecommunications sectors, with a *vast array of potential use cases*. However, the *introduction of a Ksh. 1 Million annual subscription fee and the hike in the verification fee from Ksh. 5 to Ksh. 20 *raise concerns about the accessibility of these services for* startups and smaller organizations*. Due to the public outcry, the government revoked this gazette notice and published a new one with minimal changes, IPRS charges remaining the same. Now the Ministry of Interior has invited *public participation* on the proposed charges which can be submitted via email *info.ctizenservices(a)interior.go.ke <info.ctizenservices(a)interior.go.ke> * on or before *8th Dec, 2023*. In my view, they should consider the approach by the *Office of the Data Protection Commissioner *where private sector companies are categorized in terms of their *annual turnover* and *number of employees* so as to be inclusive to start-ups. That said, the Ksh. 1 Million annual subscription is still too high and should be revised downwards. It is rare for a *Software of a Service to charge both a "Subscription Fee" and "Per Service Fee".* They should consider getting rid of the "Subscription Fee" altogether and also *reduce the "Verification Fee" to at most Ksh. 5*. *I will appreciate your perspectives on this matter*. Telegram has been down in Kenya. Users are reporting they can only access it using a VPN. An analysis by different platform including Ooni Observatory shows that the blocking of Telegram is across all networks. - https://twitter.com/OpenObservatory/status/1725202738370290053 Users across the major ISPs including Safaricom, Artel, and Jambonet reported not able to connect to Telegram. What is the experience of listers here? Have you had a challenge connecting to Telegram over the past week? The alleged reason for the blockage is to prevent cheating of the KCSE National examinations that are allegedly shared in the Telegram platform. Why only block Telegram? What is the percentage of Telegram usage compared to other popular platforms like WhatsApp and Signal? Can the blockade of Telegram in Kenya be considered a form of internet shutdown? Internet shutdown is defined as a deliberate disruption of internet or electronic communications, rendering them inaccessible or effectively unusable. The shutdown of one platform, such as Telegram, can be considered a form of internet shutdown, as it restricts access to a specific communication platform. Internet shutdowns are often used by governments to control information flow, stifle dissent, or prevent the coordination of protests and demonstrations. They can have significant social, economic, and political implications, affecting freedom of expression, access to information, and the ability to conduct business. After Telegram, what else will be shutdown? What will be the next excuse? What direction do we want to take as a country?

I did not see any changes in the Passport section as well as many citizens had reservations for. The increment is high for the common mwananchi. More efforts should be put into sorting the passport backlog first. Blank tape levy comes to effects in Kenya.

The cost of ICT devices had gone up after the blank tape levy came into force. What is a Blank Tape Levy? A nominal fee imposed on the sale of blank media and devices, such as CDs, DVDs, USB drives, and smartphones, which can be used to make personal copies of copyright content. The collected funds are then distributed to creatives. What is affected? Any device that can be used to store copyrighted content like a phone, computer, laptops, smart watches, CDs, tapes, memory card, TV, game consoles, printing papers, photocopying machines, hard disks or USB disk. Why? This levy is imposed by the Copyright law to compensate copyright holders for potential revenue lost when individuals make private copies of their copyrighted works, such as music, movies, or software. Private copying allows individuals to make personal backups or copies of copyrighted material for their own use, such as making a backup of a music CD or copying a movie to a personal device. What is the commencement date? 15th September 2023. UNESCO Guidelines for the governance of digital platforms Launched

Dear listers, UNESCO has launched the Guidelines for the Governance of Digital Platforms. These Guidelines outline a set of duties, responsibilities and roles for States, digital platforms, intergovernmental organizations, civil society, media, academia, the technical community and other stakeholders to enable the environment where freedom of expression and information is at the core of digital platforms governance processes. The Guidelines were produced through a multi-stakeholder consultation that gathered more than 10,000 comments from 134 countries. These global-scale consultations fostered inclusive participation, ensuring a diversity of voices to be heard, including those from groups in situations of marginalization and vulnerability. Citizen Data protection anomaly at Ministry of Interior

In the age of data protection, the Ministry of Interior is publishing at scale the names of all citizens who have successfully applied for passports. Every week since the CS initiated the rapid results initiative, the Immigration Department has been publishing publicly the names of all passports ready for collection. Kindiki may have been doing a good thing - expediency, but as they say, the road to hell is paved by good intentions. The list is available on the immigration department website here http://immigration.go.ke/category/rri-7/ for all passports ready for collection for 6th-10th November 2023. More data is available for other weeks. The data has tracking numbers, full passport holder names, and collection dates. Through quick analysis, this week alone has 18,654 names published and distributed as follows; Kisii 1500 Kisumu 1692 Eldoret 1787 Embu 1750 Mombasa 1552 Nakuru 1000 Nairobi 9373 Questions 1. What can go wrong? What can bad actors do with this data? 2. Do data subjects need to give consent for such data to be published in a public portal? 3. Does the government have the capacity to safely handle mass citizen data? 4. How have other government agencies provided verification services without compromising on privacy? IEBC had such a challenge before the 2022 elections and they instituted a verification process for accessing voter registration data. 5. Does the Ministry of Interior have the capacity to roll out the Digital ID dubbed Maisha namba? 6. Is the ODPC under the Data Protection Act 2019 up to the task of regulating and enforcing compliance of government agencies? 7. How can we help the government in handling citizen data? For demonstration purposes, what are the implications of a data breach at scale? Just this year, there were allegations that Fuliza scammers gained access to the National Registration Bureau Database and added new citizens. I am writing to express my deep concern and frustration regarding the poor quality of service for mobile and internet connectivity along the Standard Gauge Railway (SGR) corridor between Mombasa and Nairobi. The SGR has undoubtedly been a significant infrastructure development for our country, greatly improving transportation between these two major cities. However, the lack of reliable and consistent connectivity along this corridor is negatively impacting both travellers and businesses alike. As a frequent traveller on the SGR, I have experienced repeated disruptions in mobile and internet services during my journeys. These connectivity issues not only inconvenience passengers but also hinder productivity and communication for those who rely on the train as a workspace. The challenges I've faced include: 1. *Inconsistent Network Coverage:* The SGR corridor often lacks adequate network coverage, resulting in dead zones where passengers are unable to make calls, send emails, or access the internet. 2. *Slow and Unreliable Internet:* Even when there is signal, the internet speed is frustratingly slow, making it almost impossible to carry out essential online tasks, particularly for professionals who work remotely. 3. *Communication Breakdown:* Travelers, including business professionals, are finding it increasingly difficult to stay in touch with colleagues, clients, and family members while on the move. 4. *Missed Business Opportunities:* Entrepreneurs and businesses aiming to expand their operations or make crucial business decisions during their journey face significant hindrances due to connectivity issues. The SGR corridor has enormous potential not just for transportation but also for enhancing Kenya's digital infrastructure. As it stands, the inadequate connectivity is preventing us from fully benefiting from this world-class railway. I kindly request the Communication Authority of Kenya to investigate these connectivity issues along the SGR corridor and take necessary actions to improve the quality of service. Our nation's growth and development depend on a reliable and robust digital infrastructure, and it is imperative that travellers and businesses have access to efficient and uninterrupted connectivity. I would appreciate your prompt attention to this matter and would be willing to provide any further information or feedback that could assist in addressing these challenges.
