It's been 72hrs and Telegram is not currently available in Kenya unless you are using a VPN or proxy. An article by Kictanet https://posts.kictanet.or.ke/tele-gone-telegram-down-is-it-an-internet-shut… noted this same time last year. Is it a coincidence? Some say it's to STOP exam cheating, others say it's a show of the government's mighty power. Partinet questions were asked on the article but since we did not get answers, it is back. No consequences. But I ask the same questions again. "After Telegram, what else will be shut down? What will be the next excuse? What direction do we want to take as a country?" On the matter of cheating in exams

Friends, It looks like this is a worldwide phenomenon. On our part in Kenya, many students and graduates of Kenya universities earn pretty well from writing papers for folks worldwide. I am not sure whether anyone has formally studied this. According to the attached document (it's long) an American professor laments the change in attitude towards cheating. She argues that, while in the past people could be ashamed of being caught cheating and that folks were proud of the 'sweat of their labour' that is no longer the case. In my view, cheating happens because all around us people are cheating and (apparently) getting ahead of others; even those who get caught manage to game the system and get away with it. It is happening everywhere: in homes, churches, schools, government, private sector, etc. ... Name it! Gaming the system and beating it is a triumph for many! Second, in the old days, some taboos limited people's will to act beyond certain limits. A person could, for instance, fear that a curse might befall them! ... No more: people are cheating, getting ahead and no curse seems to come their way! All this has eroded the work ethic where folks could be proud that 'the sweat of their labour' has made them attain success. So just because someone works hard, has integrity and 'gives to Caesar what belongs to Caesar' does not underlie the person's status in that society. Thieves and scoundrels (and just because they are loaded with mbesha, regardless of how it was earned) seem to win! The Ministry of Health holds that the ongoing enrolment of Kenyans into the Social Health Insurance Fund (SHIF) without their consent is legal. As SHIF’s rolling out kicked off on Tuesday, October 1, members of the National Health Insurance Fund (NHIF) – the public health insurance scheme SHIF replaced – have been getting SMS messages that they have been automatically registered for the controversial new plan. In a statement on Thursday, Health Principal Secretary Harry Kimtai said: “The Ministry has received inquiries regarding the transition of existing NHIF members to SHA. Dear Listers, This month, we will be focusing on an important issue that impacts countless individuals, particularly women: Online Gender-Based Violence (OGBV). OGBV is a form of gender-based violence facilitated by technology, and it takes various harmful forms, including bullying, defamation, hate speech, sexual harassment, and stalking. Here are some important statistics: - 85% of women globally have experienced some form of online violence. - 65% of women know others in their circles who have been targeted online. - 38% of women have personally faced online violence. Morning Listers, Telegram has been blocked in Kenya for the since yesterday on Safaricom network. I have run tests since yesterday on OONI and seems something is up. The Kenya Revenue Authority (KRA) plans to introduce a WhatsApp chatbot to help small traders generate electronic tax invoices. This initiative aims to enhance voluntary tax compliance among micro, small, and medium enterprises (MSMEs) by simplifying the tax invoicing process through the electronic tax invoice management system (eTIMS). The chatbot will allow traders to easily create tax invoices via WhatsApp, addressing issues of complexity and non-compliance that have plagued smaller businesses. Currently, only 18.1% of registered taxpayers have adopted eTIMS, with many smaller firms lacking the necessary technical infrastructure or understanding. The chatbot is expected to widen the tax base by facilitating compliance among traditionally hard-to-tax sectors. This initiative aims to support organizations in the Global South that are working to address pressing issues at the intersection of datafication and democracy. Formed in 2022 through collaborative efforts between Paradigm Initiative, Aapti Institute, and Data Privacy Brasil, the *Global South Alliance seeks *to unify NGOs dedicated to promoting mutual learning and advancing digital rights from a Global South perspective. Safaricom wins copyright infringement claim against innovator

An innovator has lost a copyright infringement claim against Safaricom regarding a mobile software application he submitted eight years ago. Solut Technology alleged that Safaricom exploited his idea for the Wavu application after rejecting it, launching a similar app called Thibitisha instead. High Court Judge Freda Mugambi dismissed the claim, stating that copyright law protects the expression of ideas, not the ideas themselves. The judge noted that the innovator failed to provide source code or evidence that Safaricom had access to his application. She emphasized that protecting mere ideas could hinder creativity and innovation. Tanzania’s Suluhu bans websites critical to her regime

Three of Tanzania's leading newspapers have been banned from publishing their online editions after they ran an animation deemed critical of President Samia Suluhu Hassan. The ban affects all websites, social media and YouTube platforms of the three newspapers, all run by Mwananchi Communication Limited (MCL). The Citizen, Mwananchi and Mwanaspoti newspapers have had their online licences suspended for 30 days over the viral animated clip, which has since been removed. The clip, just over a minute long, published by the Citizen on social media highlighted the increasing cases of abductions and disappearances in the country. The media regulator said the content "threatens and is likely to affect and harm national unity and social peace of the United Republic of Tanzania". Rights groups have accused President Samia's government of stifling dissent and targeting opponents ahead of next year's general elections. It follows a recent wave of abductions, arrests and the brutal killing of an opposition official in the country. LinkedIn’s New Generative AI Feature: What You Need to Know

Dear listers, LinkedIn has stirred up controversy by introducing a feature allowing the platform and its affiliates to use personal data and user-generated content to train generative AI models <https://www.linkedin.com/help/linkedin/answer/a6278444>. While this move reflects the growing trend of data commodification in the age of artificial intelligence, it raises serious concerns regarding user consent and privacy. The new feature allows LinkedIn to leverage the vast amount of data generated by its users to enhance its AI capabilities. This decision is not unexpected; as AI technology becomes more sophisticated, data is increasingly recognized as a valuable asset. However, LinkedIn’s implementation has come under fire for its lack of transparency. *Many users were automatically opted in to this feature without prior notification*, igniting fears over data misuse. The company has just updated the privacy policy on its website <https://www.linkedin.com/legal/privacy-policy#use> to reflect the new changes, effective September 18, 2024. According to LinkedIn's FAQs <https://www.linkedin.com/help/linkedin/answer/a5538339>, opting out means that the platform and its affiliates won’t use your personal data or content to train models going forward. However, this does not affect any training that has already taken place. Furthermore, opting out does not prevent LinkedIn from using your personal data for training non-content-generating generative AI models. Users must object to this latter use by filling out a separate opt-out form provided by LinkedIn <https://nam06.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.linke…> . The move appears to contravene several important regulations designed to protect user privacy. Under the General Data Protection Regulation (GDPR) in the EU, Article 6 stipulates that personal data must be processed lawfully, fairly, and transparently. LinkedIn’s failure to notify users may violate these principles, particularly the requirement for informed consent. Furthermore, Article 7 mandates that consent must be freely given and can be withdrawn at any time. LinkedIn's FAQ for its AI training claims that it uses “privacy-enhancing technologies to redact or remove personal data” from its training sets. Notably, the platform states it does not train its models on users located in the EU, EEA, or Switzerland, which may provide some level of assurance for users in those regions. Similarly, the Kenya Data Protection Act (2019) emphasizes the importance of consent. Section 26 of this act requires data controllers to obtain explicit consent from users before processing their personal data. By automatically opting users in, LinkedIn could be infringing upon these legal protections, raising significant questions about its compliance with data protection laws. Notably, LinkedIn's recent move isn't an isolated case but is part of a broader trend where tech giants exploit user data to fuel AI advancements. Only recently, Meta allegedly confessed to using all public text and photos of adult Facebook and Instagram users to train its AI models since 2007 <https://www.theverge.com/2024/9/12/24242789/meta-training-ai-models-faceboo…> . Such practices raise important questions about user rights, data ownership, and ethical considerations in AI development. While the potential for innovation is significant, the risks associated with unauthorized data use cannot be overlooked. Tech giants will continue to push the boundaries of data utilization, and we are likely to see increasing scrutiny from governments and regulatory bodies worldwide. Nonetheless, existing laws may not be sufficient to address the complexities introduced by AI and big data, and the need for robust legislation to increase transparency, consent, and accountability in data usage has never been more pressing. Regulation of mobile surveillance technologies in Kenya

In the past decade a lot of mobile surveillance technology has become available to the general public on ecommerce sites and tech product retailers. This includes Apple's Airtag which is a tracking device paired to one's phone, concealed cameras and recording devices, among others. I happened across a video discussing Australian authorities in New South Wales discussing offences involving these devices, and how a share of these offences, which are still underreported, are committed by family and domestic abuse suspects. In Kenya, are these products monitored in the market? Is there any regulation as to their use by the general public without security approvals?

The decision comes as part of Mozilla's strategic shift to focus its resources on its core products, including the Firefox web browser and emerging technologies like artificial intelligence (AI). Mozilla.social, which was launched as an experiment in the open social web or 'fediverse', had a relatively small user base compared to other Mastodon instances. Starlink targets short-term customers with rented internet kits

Starlink has introduced a rental plan for its equipment in Kenya, aiming to expand its customer base. Customers can now rent the Starlink kit for a monthly fee of 1,950 Kenyan shillings (KES) in addition to the data plan charges. With the rental plan, customers opting for the KES 1,300 50GB data plan will pay a total of KES 5,950 per month, including a one-off activation fee. Starlink disconnects South Africa - what are regulations in Kenya?

Starlink is terminating the packages of users in South Africa. Many people who had been using Starlink in South Africa took to local Starlink Facebook groups over the weekend, complaining that their services had been terminated. Starlink, sent emails to customers accessing services in countries where the satellite internet provider didn't have regulatory approval earlier this month. The company said their services would be off after 21 August. Safaricom had written to Communications Authority of Kenya for regulations around global satellite companies like Starlink. What is the stand of the Kenyan regulator on Starlink entry into Kenya, and what are the license fees paid? Let us remember Airtel and Safaricom each paid around USD 25m for 4G license and nearly a similar amount for 5G license. Starlink has not applied for a licence to operate in South Africa, with ownership equity requirements in the Electronic Communication Act thought to be the biggest stumbling block. The act requires holders of communications licences to be 30%-owned by historically disadvantaged groups. While it has not been possible to import a Starlink kit or take out a subscription in South Africa, some people got around this by taking out a regional roaming package that allows the kit to be used beyond the borders of the home country. Users could then bring the kit into South Africa. The Independent Communications Regulator of South Africa (Icasa) published a Government Gazette notice late last year, which stated that using a Starlink in this way was illegal. Until now, though, the illegal connections had largely been untroubled and unpunished. Google declared an illegal monopoly by a US court in Landmark Antitrust Case

The Hasso Plattner Institute (HPI) at the University of Potsdam is one of Germany’s top-ranked computer science institutes. Its PhD school "Data Science and Engineering" currenty supports 20 PhD students. Annually, we seek to add talented young researchers and offer 10 full Ph.D. and Postdoc Scholarships for a support of up to four years in our Potsdam location, on the border of Berlin. Students and Postdocs enjoy a great research environment, close mentorship by professors and postdocs, interaction with many peers, enormous computing power with HPI’s Data Lab, and significant travel funding.
