M-Pesa is a critical resource that should never fail

Listers In Summary M-Pesa has grown from an option to literally being a must-have financial service for millions of Kenyans. It has also become integrated in the lifestyles of Kenyans in terms of paying for anything, ranging from groceries to school fees and even bribes. With over 25 million mobile money subscribers, the platform's going down translates into the economy slowing down. The regulator must require additional and external information security checks to provide assurance that the potential risks and threats have been identified and mitigated. How Safaricom lost its way

It was evening of 7th December 2018. Consumers had challenges using mpesa from around 6.40pm. I tried paying for a product, but did not get a response for around 40 minutes. Then, I got this SMS: "M-PESA is not able to process your request. Go to M-PESA>My account>Update menu>M-PESA PIN>Send. Then try again." Then this "MPESA is experiencing delays, and is not able to accept your request. Please wait for 10 minutes before trying again." Then finally after an hour, reality hit home: "MPESA is currently unavailable. We apologize for any inconvenience caused." At this point, people were stranded in weird places. Car owners were stranded at petrol stations having ordered full tank hoping to pay with the often reliable MPESA. They had to park their car as they sought alternative ways to settle their bills. Revelers at the many entertainment joints had extended hours trying to pay their bills. Patients at hospitals were turned away. Queues and queues of Shoppers at supermarkets left their full baskets at tills. Online platforms were not spared either. The shopping carts were abandoned. I was stranded like the rest, and finally managed to pay with the mpesa at 8.08pm. See, I was determined. I had consumed products, and I did not have any alternative way to pay. That is how successful Safaricom has managed to make Mpesa part of our lives. At around 9.24pm, Safaricom sent this SMS "M-PESA is undergoing scheduled maintenance." Of course that downtime was not a scheduled maintenance. So now a respected company with a top notch communications team had resorted to small lies that add no value to their brand. Desperate times truly calls for desperate measures. An unexpected downtime is not the same as scheduled maintenance. Scheduled maintenance is communicated early in advance to all parties. This was not the case with this particular scenario. Back to my payment, I manged to sneak in the payment in the midst of the "scheduled maintenance". But the deductions of my mpesa balance were completely off. I informed the establishment. They investigate from their system (which is just mpesa SMSes from their feature phone), and them too had got one message indicating my payment. My previous balance did not add up when the current purchase is included. It was way less. The mpesa statement could also not reconcile where the difference of my balance had gone. It only showed one transaction. So for example, if I had a balance of Ksh20,000, and make a purchase of Ksh5,000, the balance should be Ksh15,000. But now my balance read Ksh10,000. Today is Tuesday, 11th December, and I'm yet to be united with my funds. It's good the CS Hon Mucheru has asked for a systems audit of the mpesa platform. In the audit, they should capture how many transactions were eronouse, and where users' balances disappeared to. It may be mischievous individuals carting our balances the NHIF and KPC way.

Hi listers, Im following a debate on cnn about this south sudanese 'baby bride' who was auctioned on fb. It brings me back to this question, who should regulate facebook? Some argue fb is too big to regulate all the things that happen on their platform. Who should police fb? Is it us? We have power to shut down our pages if we dont agree with what goes on in their...but we don't. Why? Is it facebook? Do they care about being responsible especially in Africa? Is it government? A number of issues demanded by Telcos and other players are already in motion. 1. Access to Agents. That’s already happening in a big way. Maybe we can learn from US reservations (not just EU regulations :) http://fortune.com/2018/10/23/california-data-privacy-law-gdpr/ California’s New Data Privacy Law Could Begin a Regulatory Disaster By DANNY ALLAN | October 23, 2018 When the European Union adopted the General Data Protection Regulation (GDPR) in 2016, many in the technology industry saw it as just the first of many such data privacy laws to come. They were right. And, as a result, we may be on the brink of a convoluted regulatory disaster. In June, California became the first U.S. state to pass its own data privacy law, the California Consumer Privacy Act. When it goes into effect on Jan. 1, 2020, the act will provide the state’s 40 million residents with rights similar to those granted to European citizens through the GDPR. The hastily approved act gives all California residents the right to see what personal information is being collected by businesses and to request that this data be deleted. They will also be able to discover whether organizations are selling their information to third parties, such as advertisers, and to request those organizations stop doing so. It will be the most comprehensive data privacy law in the country. That said, while the GDPR was criticized for being too ambiguous, it looks downright hyper-specific in comparison to the California law. For example, thanks to some loose categorization of businesses to which the act applies, it has the potential to include not just organizations that sell individuals’ data for financial gain, but also websites that collect IP addresses from millions of unique visitors per day. In 2017 alone, over 1.9 billion files were leaked through security breaches. After the California Consumer Privacy Act comes into force, organizations mishandling data could be fined up to $7,500 for each violation. The financial impact to businesses could be enormous—and that doesn’t even take into account the soft costs associated with loss of customer and employee confidence and damage to brand reputation. Data privacy regulation in America is about to become seriously confusing. Since the GDPR came into effect, only some states have expanded their data protection regulations to include breach notification requirements. And state laws governing data breaches vary significantly: Texas imposes civil fines of up to $50,000 per violation, while Georgia imposes no penalty at all. It’s likely that other states will soon pass their own data privacy legislation. Just over half the public (51%) thinks technology companies should be regulated more than they are now, according to a June 2018 report from the Pew Research Center. As security breaches and privacy concerns continue to make headlines, public awareness of and demand for stronger data protection practices are likely to increase. If each state takes on a local approach to data privacy, America will become a patchwork quilt of regulation, making it an extremely challenging place to do business. Imagine having to ensure that datasets with personal information on millions of people comply not just with the GDPR, but also with 50 different and sometimes contradictory policies? As people move from one state to another, presumably the rules regulating their data would also change. How can organizations possibly keep track? This is the stuff CIO nightmares are made of. What we need is common set of rules for everyone, ideally similar to the GDPR’s, which U.S. organizations doing business in the EU are already following. This would minimize the regulatory burden while also providing U.S. citizens with substantial control over their personal information. A discussion draft of a new proposed House law, the Data Acquisition and Technology Accountability and Security Act, would create federal standards for breach notification that would preempt state laws. However, the bill is too focused on notifying customers of data theft, failing to provide them with the more comprehensive rights they need to adequately control their personal data. It will need to be strengthened significantly to meet the privacy demands of U.S. citizens. In any case, Washington needs to act soon. Otherwise, the U.S. may end up with a regulatory scheme that makes GDPR compliance look like a walk in the park. Danny Allan is the vice president of product strategy at Veeam.

ICYMI: Tech bombshell of the year (link below). According to the trending NYT article, it looks like Facebook has been caught knowingly weaponizing fake news to try muzzle (by smearing/discrediting) people raising concerns about the proliferation of fake news on its platform and/or to divert meaningful discourse on the topic away from Facebook. Apparently the M.O. even included pandering to racist / white supremacist / hate media channels and narratives? Ok, this stuff only happens in movies. Please say it ain't so fb... Incredibly ironic development, but completely vindicates the growing concerns worldwide about the growing dangers of platform concentration, unregulated market power and unregulated PR/media muscle in giant multinationals. It will be interesting to see whether (and how) the US gov will discipline its misbehaving, but financially lucrative babies. Is our media truly independent, objective and fearless as they claim - especially when it comes to reporting on their most lucrative customers? Compare to the prominence and coverage of reports on Government website downtime, as well as Huduma downtimes for example... My take is, when you have an entity (or group of entities) that the media appears to "fear" or "favor" more than the Government, the potential for impunity and abuse that comes with such power should be of great concern to any regulator. At the very least, it can allow public interest problems (or their impact) to stay under the radar for a long time with a heavy cost to the wider economy. A healthy (and free) media should have well diversified revenue streams such that there is minimum conflict of interest that is potentially attributable to the concentration of market power. Yet another solid reason (imo) for modernization of our anti-trust regulations. ====I wonder if the CCTVs are affected.. hopefully there is a proper continuity plan in place. ====As stated in my earlier email just a few days ago, dominant players should be mandated by law to demonstrate adequate provision for continuity and resiliency across all economic sectors where they are active - with independent audits, certification and testing of their BCP, DRP etc - the frequency of which should be aligned with potential severity of downtimes. ==== Have a great weekend!Patrick. He said a key disagreement was over the business model – with Marx and his fellow co-founders wanting to focus more on generating revenue from the web platform itself, and Silvertree wanting to shift the focus to the brokerage linked to the startup, that provided clients with insurance quotes. The three in August last year founded MoneyPanda, which essentially offers the same thing that CompareGuru does......Torr says in addition he has separate business interest with Koser. It could be why he’s smiling. Or, because he had Silvertree remove a clause from the contract he and Verster Cohen signed when the investor approached UCook to invest in the business. Morning Ali, Today's big tech were yesterday's startups who benefitted from preferential competition regulations that protected them from being crushed by the giants of that period or at least allowed them to grab a solid marketshare through some limited exclusivity arrangement. Research any monopolistic big tech and you will likely find a string of affirmative actions by its Government during its early stages of growth. As a young startup, Microsoft reportedly benefitted from regulations that clipped IBM's powers; then it grew too powerful and was perceived to be hindering innovation leading to anti-trust regulations against it, that are believed to have paved way for the FANG quintet (among others)... Now the FANGs are too powerful (and no longer as innovative) so there is talk of clipping them to pave way for a new wave of innovative technologies. That is how you maximize innovation ecosystems and technological progress. Darlings evolve from tiny vulnerable babies to giant elephants, then become *dinosaurs* and if they are allowed to maintain status quo, they crush innovators leading to slow down of progress and a steady loss of competitive advantage for the host country (in our case, Kenya). By creating space for new generations of startups to thrive - governments facilitate the next wave of tech revolution / transformation. For example, no matter how well Safaricom, a telcomms pipe tech expert, claims to know eCommerce, music, agriculture, or health, or edu, or security, or social, or TV, you can bet there is a laser focused local start-up with *far better* technical ability and insights that has been pushed out of that space due to sheer resource and market power imbalance. This is how innovation is being stifled in Kenya. Safaricom easily leverages its subscriber/agency/marketing network for example to quickly dominate a space. But this is not a good thing because its a *blocking* move by a dinosaur that fears innovation, rather than a transformation move IMO. An established player cannot have the same level of hunger, passion, agility and insights in *multiple* sectors compared to a young startup dedicated to that sector. Are we thriving to become a "police" state where every conversation is looked as a threat to governments. 3. Should they cooperate with Gov to eliminate risks of criminal abuse? If not, why not?Like any legal requirement if there is a criminal element to the dissemination of information, then the burden of proof is for the government to furnish the proof for these companies to comply with the law. However, just by saying "this is a threat" to a government, that does not hold water, the state must prove it's argument, otherwise just as well shut the entire ecosystem, and then deal with the masses and the consequences of free speech. 4. When these apps collect data (resource extraction - just like oil/gold extraction) should a country be compensated? If not, why not?The collection of data happens with every software you use, it is a choice a consumer makes for one to use such an app. The better the informed public is about the data, the better choices one makes. In my opinion parts of GDPR are good for privacy for citizens, and maybe those should be adapted locally if done properly, it should not be a copy and paste exercise. 5. When these apps manipulate people psychologically to promote repeated engagement (thereby distracting local human resources from engaging in local economic activity or reducing productivity) should they pay for that engagement? If not why not? Keep in mind user engagement is a billion dollar 21st century resource!Like any business everything is being manipulated. Look at consumer goods companies that sell their products, there is a form of manipulation going on. For example look at the way the food and beverage companies manipulate people to believing their products are good for health etc when in actual fact they are not good for health. These apps (and their problematic architectures) are well known and Governments worldwide are scrambling to find solutions to the problems that they have enabled/amplified by design. Why should Kenyan taxpayers *subsidize* the fixing of costly problems caused/facilitated/amplified by these foreign billion dollar apps who don't contribute their share of taxes locally or accept their share of responsibility? This is a form of reverse taxation where our Government is effectively "paying" taxes to Facebook and Whatsapp! Tobacco analogy might help elucidate the issue: When tax funds are spent on lung cancer treatment for cigarette smokers, isn't that a subsidy paid by taxpayers - including non-smokers, to Tobacco companies? Looks like a no-brainer nowadays but it took a while (and similar debates) for Tobacco companies to accept because it takes decades for lung cancer to form. Many even paid for fake scientific studies to disprove claims that Tobacco smoking is harmful. Very similar to what some notorious data aggregating multinationals have been accused of doing. Glad that you accept that there is indeed a cost burden for Government (and society) from fake news that is amplified by these social media platforms like Facebook and whatsapp. At least we have a common understanding that there is a real problem. A smart government would create modernized laws to tax VC funded Silicon Valley companies e.g. on the basis of *funding rounds* and *valuations* because this is their *real* business i.e. its how the investors intend to make money from day one - and the primary reason they push for perpetual losses! There should also be a turnover tax and VAT on online revenue earned in Kenya by foreign billion dollar internet companies (e.g. advertisement revenue and appstore revenue), to level the tax playing field for local businesses. Looks like a no-brainer nowadays but it took a while (and similar debates) for Tobacco companies to accept because it takes decades for lung cancer to form. Many even paid for fake scientific studies to disprove claims that Tobacco smoking is harmful. Very similar to what some notorious data aggregating multinationals have been accused of doing. Glad that you accept that there is indeed a cost burden for Government (and society) from fake news that is amplified by these social media platforms like Facebook and whatsapp. At least we have a common understanding that there is a real problem. A smart government would create modernized laws to tax VC funded Silicon Valley companies e.g. on the basis of *funding rounds* and *valuations* because this is their *real* business i.e. its how the investors intend to make money from day one - and the primary reason they push for perpetual losses! There should also be a turnover tax and VAT on online revenue earned in Kenya by foreign billion dollar internet companies (e.g. advertisement revenue and appstore revenue), to level the tax playing field for local businesses. Similar to what other countries like the UK are working on: https://www.wired.co.uk/article/facebook-uk-tax-bill CA will obviously have a hard time monitoring and enforcing though, under the current traditional framework due to technical barriers (e.g. encryption) and also due to jurisdictional challenges. So the other thing that CA really needs to do once the rules are set is to consider blocking non-compliant foreign apps completely at ISP level (especially now that political temperatures are cool and people and thinking clearly). Lets have local startups filling any gaps with copycat apps China-style. To be clear, I support free speech and privacy. But I also support peace, stability, safe neighbourhoods, democracy, sovereignty and economic predictability! Brother Francis, The risks are real (its a fact - not an opinion) and they have actually materialized in other countries - including mature democracies like the US and emerging economies like India (where innocent people have been murdered due to fake whatsapp posts). I have pasted some links with more info from broad sources at the bottom of my message. Please be sure to have a look. We are not immune. Kenya is a fragile and flawed "democracy" where leaders heavily rely on identity politics to acquire or keep power. The intensity and increasingly high stakes of our winner take all politics should not be taken lightly. As much as we claim high literary levels, our education system does not teach us *how* to think with a view of forming rational and well informed opinions of events around us. This makes most Kenyans highly susceptible to manipulation though disinformation - especially on emotive issues. What many of us take for "normal" (partly because we haven't seen anything else), including the 4-5 year sprints of fragile peace (which is more like a pause in hostilities imo), is in reality utter *insanity* when one does a comparative evaluation against mature democracies: we, a poor developing country, have the world's most expensive elections for example, and every 4 years the economy literally grinds to a halt as politics takes over and holds everyone hostage. Is this normal? I don't think so! On Kenyan media... Truth be told, our media has failed us by exploiting, perpetuating (and therefore entrenching) ethnic divisions and tensions to boost their own profits (literally playing with fire). Media has the capacity to mould public thought away from ethnic kingpinship and towards real issues like economy, jobs, health, human rights and a systematization culture - rather than personality/saviour orientation. For example, why not disseminate a quarterly dashboard to inform the public on how their leaders are delivering on promises / targets along these *real* issues? One might argue that media is delivering by highlighting corruption but to me it looks like they are not really doing it for us common wananchi; corruption is sensational and reporting on corruption sells. It also creates political ammo that further feeds into our divisive high-stakes politics. Is there a better way? Why not proactively track how counties and state agencies are implementing anti-corruption systems to identify and seal loopholes? It looks to me like as much as that is what is needed, it does not make a "big story". It is boring and doesn't pay, so they don't bother. This is why NYS happened *twice* (and will keep happening) because it is more profitable to yell that the horse has bolted than to help close the barn door... and in that respect the media is a complicit participant and beneficiary in the corruption ecosystem. A smart government would create modernized laws to tax VC funded Silicon Valley companies e.g. on the basis of *funding rounds* and *valuations* because this is their *real* business i.e. its how the investors intend to make money from day one - and the primary reason they push for perpetual losses! There should also be a turnover tax and VAT on online revenue earned in Kenya by foreign billion dollar internet companies (e.g. advertisement revenue and appstore revenue), to level the tax playing field for local businesses. Lets have local startups filling any gaps with copycat apps China-style. To be clear, I support free speech and privacy. But I also support peace, stability, safe neighbourhoods, democracy, sovereignty and economic predictability! Lets assume you are a popular and reputable doctor practising under your own name and someone cybersquats with your name - and places an ad script on the landing page. Now the google crawler detects your online activity elsewhere and figures out that your name is associated with medicine. So the impersonator's temp landing page gets filled with ads competing doctors (including quacks or even worse). In such a case you'd be able to sue for trade name infringement and take them down. In this particular case, the value (and limited exclusivity) of your name's IP is linked to your popularity, the uniqueness of your reputation and the specific circumstances around the cybersquat e.g. the doctor's example above. The medical field relies on IP protection (otherwise we'd all be in trouble for slow progress on disease management). Your car contains patented products that enhance safety... I could go on and on.. Secondly the defective argument casually brushes off the interests of the original inventor. Does it not matter that the inventor was not rewarded for contributing to the incremental advancement of humanity? If the inventor is from a poor country, it *should matter a lot*. Overwhelming factual evidence shows that in any industry or sector, when the key actors fail to organise for collective benefit, they get exploited by predatory gatekeepers and middlemen. This prevents entire sectors from taking off despite the potential. Music/movie pirates claim that they are popularizing the artists, but the most pirated music/film belongs to artists who were *already* popular, having sunk a ton of sweat and money into marketing. What piracy really does is *deny* the artist income for their efforts and creativity, making it extremely hard (financially and motivationwise) to come up with the next hit. This leads to wasted talent and destroyed potential. No one documents *that*. The music industry in Kenya became profitable after the artists came together to form collective rights management organisations (similar in concept to IP focused Cooperative). Prior to that, artists could be exploited by everyone, especially corporates and media houses. Now, you can be a millionaire with music. This proves that rewarding innovators/IP fairly promotes more innovation/IP leading to a virtuous cycle of growth and prosperity. ICT, Film and TV producers have failed to organize and so they are struggling in an industry that makes numerous (not just one or two) multi-millionaires elsewhere e.g. in Nigeria, India, South Africa (and to a lesser extent, TZ for film/tv). So... when someone uses flawed reasoning to push an argument, it helps to question whether the person is aware that the reasoning is defective, and if it turns out that the person doesn't care, the issue of *motive* (red flag) needs to come up at the back of your mind. Without the exclusivity offered by IP protection, anyone can launch any product and that leads to a downward spiral of value destruction. Did you know that even your name is a form of IP (hence your gov issued certificate i.e. "ID" that prevents people from impersonating you to profit from or harm your brand)? Imagine if 1,000 people with fake IDs report to your workplace tomorrow and claim to be the real you, then demand your job or Salary. How would the employer know the real you? This is why your name (your personal trademark) is protected in law such that even you can't change it without going through a complicated legal process e.g. swearing an Affidavit in front of a magistrate. You don't even need to register a business name if you do business using your own name. Its a legal tradename already. Your fundamental IP. IP protection deters predation and freeloading. It encourages the rewarding of legitimate Innovators and allows everyone associated with them to win, including the entrepreneur, investors etc by giving them a critical and exclusive window of opportunity to recoup their risky investment. Without IP protection frameworks, there is very little incentive to invent, innovate or commercialise. Too much competition, common with unprotected ideas, leads to razor thin margins and no funds for further R&D. Thank you Patrick for a comprehensive look at the cons of the Whitebox. We have seen so many of these "innovation harvesting" competitions, hackathons and organisations, we should have learnt something by now. Having been part of an award winning team at the Pivot East conference, I can tell you what it takes to "impress" the judges. To get that the winning idea to escape gravity is where the work is. Then, VCs were not serious. I don't know about today. But one thing that has remained the same is the rhetoric. I expect whitebox to spectacularly fail. The guys with good ideas are executing them against all odds. If we don't fix the virtual infrastructure like "idea/innovation protectionism" and get everyone to understand this requires all sectors to pull in the same direction, let us at the very least grow the human capital through the Andelas and Moringas of this world. One day we will build everything here, constantly innovating and iterating to stay ahead of the sharks. Right now, I imagine that trying to bring innovators into a cooperative group is like herding cats. We are not ready yet. Patrick has given us very good ideas. But execution ... As many founders have already observed, the concept of "judges" or "idea evaluators" in such competitions is utterly ridiculous. There is no one on this planet who is capable of identifying great ideas/businesses by relying on pitches (or even with the benefit of traction data). Such a person would already?be a GAZILLIONAIRE with his/her *own money* (and hence have no time nor inclination to judge competitions). Way forward: 1. No matter how tantalizing the opportunity, the odds for all of us improve *only* when we *unite* and negotiate with *one voice*. 2. Let's build leverage: a. The debate on revitalising our .ke ccTLD registry continues today. Yesterday, we tackled Governance issues. Suggestions were made, the major ones dealing with Transparency at the .ke registry, and Equality on representation. Thank you for contributing, reading, and listening. Please feel free to continue contributing to that thread, as we go to the theme of the day. Today we will tackle Stakeholder Engagement and Operational Issues. Public / Stakeholder Engagements 1. Should KeNIC hold Annual General Meetings? Is there value in holding the AGMs? 2. When was the last AGM held? 3. Can the annual reports, and deliberations of the AGMs be published on the KeNIC website? 4. Should the AGM be open to the public? 5. Accountability: How accountable is KeNIC? To whom does it account to? Operational Issues 1. A great effort has been made to popularise the .ke brand, including some popular advertisements, using patriotism to encourage Kenyans, and opening up the second level. But numbers don't lie. Currently, we are at around 80,000 .ke domains, while South Africa is at 1.3million. Is there more work that can be done to make .Ke popular? 2. What are the challenges in selling the .ke brand? What are the opportunities? 3. Is there a challenge in generating content for the KeNIC website? Some pages as noted yesterday have not been updated for some years now. 4. What support does KeNIC give to Registrars? Here are some statistics that I had shared on Tuesday, that may help in stimulating the debate. Germany population 82.67 million .de domains: 16 million domains (one domain for every 5 people) Percentage Domain penetration: 19% .de is the third largest registry in the world and is ran by DENIC which is a non-regulated not-for-profit cooperative owned by registrars. South Africa Population 56 million .za domain: 1.3 million domains (one domain for every 46 people) Percentage Domain penetration: 2.3% .za is the largest ccTLD in Africa, managed and regulated by ZADNA which is an agency of South African government under the Department of Telecommunications and Postal Services. The debate on revitalising KENIC will seek to tackle the following : 1. Governance Issues 2. Public /Stakeholder Engagements 3. Operational Issues Today Day1, we will seek to address the Governance issues. There is no restriction to debate the other two issues, or any other issue you feel is important, although we will strive to answer the other two issues tomorrow. How is the board currently constituted? KENIC was licensed by CA in 2015 to manage the .ke namespace following gazzettement of new Information and Communication Regulations. Currently. The KENIC board comprises members from Kenya Education Network (KENET), Domain Registrars Association of Kenya (DRAKE), ICT Authority (ICTA), and Technology Service Providers of Kenya (TESPOK). There are associate directors comprising the immediate past Chairman of the board, and some three other organisations (Google, KO Associates, and ICEA Lion). More clarification on the current board is needed since their website is blank on this. The KENIC page on the board was last updated in 2014 http://kenic.or.ke/index.php/en/home/kenic-board-management Questions that come to mind at this point are a) Is a review of the governance structure at KENIC due? How would that structure look like? b) Which Organisations should nominate Directors? Even as it unfolds, there is need to start thinking of a better way to manage such an important e-government programme and have it embedded in a specific policy, law and institution. ________________ A court battle between the eCitizen developer, a company that has been collecting funds through the system, and the Treasury has not only revealed several holes in the project implementation, but has also complicated matters. Goldrock Capital, which has been collecting money and remitting to government from the platform, has sued the Treasury for locking it out of the mobile money collection portal. Goldrock has made party to its suit Webmasters Kenya which developed the portal and which contracted it to do the collections. At the same time, the government is seeking to shore up defences against cyber attacks. One area it is looking to spend on is the fight against malware infiltrating its computer systems using advanced threat analytics and automation. This year’s government infocomm technology spending is projected to be lower than last year’s, which stood at S$2.8 billion. Speaking to attendees from the industry, GovTech chief executive Jacqueline Poh said it was looking to small and medium enterprises (SMEs) to take on some of the new jobs. “Besides the established companies, we are glad that there is a growing pool of small and medium enterprises (SMEs) that have stepped up and embraced new technologies,” she noted. “Last year, SMEs accounted for about two-thirds of the total number of ICT contracts awarded.” One local technology SME cited by GovTech is DC Frontiers. Since winning a contract last year from the government, it now helps analyse networks of connections between people and companies to give users insights into, among other things, legal ownership, conflicts of interest and possible fraud. Last year, it began working with procurement and internal audit teams in the government to enhance and automate checks for conflict of interest.

Adequacy status for our data protection framework

Dear listers, Today the Taskforce on Data Protection/Ministry of ICT held a public participation forum where stakeholders made submissions on the proposed policy and bill. Some golden threads in the discussions: independence of data protection authority ; funding and how the policy will be implemented; cross border transfers/localisation of data; access to personal data by state agencies such as KRA; how public agencies/government controllers and processors will be treated by the law; and how other regulators eg financial services will interact with the framework. On process, policy makers stated that the draft Bill will be published by the National Assembly and merged with the Senate one. Most of these issues have been discussed here in one way or another. One interesting side discussion apart from the above was on how the law, once enacted, could be submitted to Europe for assessment for adequacy status. Under GDPR, adequacy status may be granted by the European Commission to non-EEA countries who provide a level of personal data protection that is "essentially equivalent" to that provided in European law. Morocco is one African country that has been pursuing adequacy status. Over the years, Kenyans have come to rely on the unique .ke domain brand to announce their presence to the world. Recently, there have been board wrangles at KeNIC, affecting the performance and operations of the organisation. There have been preliminary discussion on this list regarding the state of KeNIC. We will have a two day moderated debate starting on Thursday on the KICTANet list for the community to give their views on which way KeNIC should take, and the corporate governance structures that should be put in place to have a professionally run, and efficient Country Code Level domain (ccTLD) for Kenya. Members are welcomed to ask hard questions, and give suggestions, and way forward for KeNIC. Just some background on the ccTLD market around the world, and comparison to the much famed Silicon Savannah. Are we punching below our weight? China population 1.379 billion .cn domains: 21 million domains (one domain for every 65 people) Percentage Domain penetration: 1.5% .cn is the second largest registry after .com and is ran by the CNNIC which is a department of China Ministry of Industry and Information. Germany population 82.67 million .de domains: 16 million domains (one domain for every 5 people) Percentage Domain penetration: 19% .de is the third largest registry in the world and is ran by DENIC which is a non-regulated not-for-profit cooperative owned by registrars. South Africa Population 56 million .za domain: 1.3 million domains (one domain for every 46 people) Percentage Domain penetration: 2.3% .za is the largest ccTLD in Africa, managed and regulated by ZADNA which is an agency of South African government under the Department of Telecommunications and Postal Services. For example the Registration of Persons Act (ID Card law) will need an additional provision on how data protection will apply to ID data. What should happen to personal data when someone dies?

Listers, As we continue to discuss the data protection bill, an issue that has come up and is not captured in the proposed laws is the issue of legacy. For example, a viral clipping in social media has a newspaper report stating that a woman who was recently murdered was HIV positive. Normally, HIV status is sensitive personal information that would not be disclosed. Which begs the question, what should happen to personal data on the death of a person? Should we treat data as property that is transferred during succession or should anyone with a legitimate interest be able to access it? Should data processors/controllers have to delete such data? CA’s Position on Service Provider’s exclusive deals with MDU Owners.

Good evening Listers, Hope you are having a good weekend. => Ill be short and to the point: Say there is a large residential neighbourhood V.R. With a significantly large number of tenants: => Then a provider S, who wields considerable sway on the management of V.R. => Lets say there are clients , living in V.R who are interested in getting service from a different provider B. and B, on approaching V.R is told that they have signed an exclusive deal with S, to disallow anyone from accessing the market at V.R. It obviously can be argued either way considering there is a Willing Buyer, Willing Seller agreement there, But What exactly does CA have to say about this? I ask because some providers wield enough financial muscle to actually buy out my County and sign an exclusive deal with my Governor, preventing me from operating in my own backyard…. Listers, The KENIC saga was in the papers today >From the leaked letters, it appeared DRAKE was complaining to the Communications Authority (CA) that the KENIC board affairs are not being run above board, but more specifically, that the position of chairman has never gone to them. I could not trace the current constitution of KENIC to ascertain how the current chairman of the KENIC board is appointed but previously, KENIC has served as the best reference point for multi-stakeholder governance systems. Intermediary liability law in African countries (and the AU)

Greetings everyone, I am new to the channel, so apologies if I have missed any relevant discussion on this. I signed up to consult this group on recent developments on intermediary liability in Africa. As you might know, APC had a few papers in 2012 on intermediary liability in Nigeria, Kenya, South Africa and Uganda <https://www.apc.org/en/node/15623/>. I also wrote for them a report on best practices for intermediary liability in 2013 <https://www.apc.org/sites/default/files/APCInternetIntermediaryLiability_Be…>. Following from that, I have been recently contacted to write a chapter for an upcoming Oxford handbook on intermediary liability, which looks back into developments on the subject over the last few years in Africa (2012-2018). I want this to be as complete and accurate as possible, but the material I have been able to find online regarding new laws and court decisions is rather limited. I would therefore be very grateful to any of you who took the time to share, *in or off-list*, *notable developments in your country relating to liability of intermediaries* (in a broad sense: digital platforms, but also ISPs and other types of intermediaries, e.g. registrars and domain name operators, or payment companies). I would also be curious to hear of *any regulation or policy coordination relating to intermediaries in the context of the African Union*, which at the time I wrote the 2013 paper appeared to be a suitable forum to develop some common principles in this field. Has anything happened on that front? Thank you really very much in advance for anything you're able to contribute. Dear Listers, Here is an excerpt from the President’s Memorandum which is up for consideration before the National Assembly tomorrow. He proposes taxation of telephone and internet data services. Safaricom, Airtel, Telkom etc do you have a projection of what this could mean for your consumers? Now I am only but a simple lawyer, but I would think that this will enlarge the chasm between the haves and have nots in an already inequitable country. I wonder what this will mean for data costs, internet access and penetration levels, innovation, employment (esp for the youth) and generally keeping up with the new age. It was laughable when this was happening in Uganda, little did we know we were up next.
