(AP) Washington, June 26: The world's second richest man has decided to donate about 85 per cent of his wealth to the world's richest man. The world's richest man, in turn, has decided to wind down his day-to-day work and concentrate more of his time and efforts on charitable work. A $37-billion gift by Warren Buffett - most of it to the charitable foundation run by Bill Gates in his name and that of his wife Melinda - has effectively doubled its capacity to spend on reducing poverty and increasing access to technology and health care for the poor in developing countries. Buffett's donation is the biggest single act of charity ever recorded in the US. Buffett, chief executive of Berkshire Hathaway, and Gates, the founder of Microsoft, have been good friends and bridge partners for many years. In addition, Gates is a director of Berkshire Hathaway, Buffett's investment firm. Buffett and Melinda together serve on the board of the Washington Post Company. In his letter to the Gates Foundation today, Buffett spoke of his admiration for the foundation, the world's largest charity with assets of $29.1 billion, and his desire to "materially extend its future capabilities". Buffett told Fortune magazine in an interview: "We agreed with Andrew Carnegie, who said that huge fortunes that flow in large part from society should in large part be returned to society." He said the philanthropy was encouraged by his wife, Susan, who died in 2004. The stake of Buffett, 75, in the company he founded is worth $44 billion. India's poor are expected to significantly benefit from Buffett's action. The Bill and Melinda Gates Foundation is involved in India, primarily in the prevention and treatment of HIV/AIDS. The foundation has also helped strengthen health services for women and children in India and has been engaged in earthquake relief and rehabilitation. In their response to Sunday's announcement about Buffett's gift, which preceded the release of his letter, Bill and Melinda Gates said in a statement: "Warren has not only an amazing intellect but also a strong sense of justice. Warren's wisdom will help us do a better job and make it more fun at the same time." That wisdom was obvious from the conditions Buffet has attached to his donation.Buffett wants all his money to be used in the year it is donated. It cannot be accumulated to the foundation's assets for future programmes. This represents a major challenge for the foundation, which already spends about $1.36 billion a year. With Buffet's condition, it would have to double its spending as soon as the first annual donation of $1.5 billion is available. Gates announced last week he would gradually give up his day-to-day role in Microsoft and concentrate on the work of the foundation. Buffett will join the Gates Foundation board but does not intend to get involved in its operations, or the other four philanthropic groups he is funding - one of which is in the name of his wife and the other three are run by his children, Howard, Susan and Peter. Buffett is a cult figure in the investing world. About 20,000 investors go to Omaha every year for the annual meeting of Berkshire - from which he derives the sobriquet, the Oracle of Omaha. He told Fortune he had always planned to have his wife oversee his charitable giving after his death. But after she died - and because he saw an opportunity to invest in an existing, well-respected foundation run by two "ungodly bright" people - he changed plans to start giving it away this year.

LONDON, UK -- The London School of Economics Department of Information Systems and the Association For Progressive Communications invite you to a forum on: Internet Governance Workshop on Rights and Development Saturday July 1st, 2pm to 5pm, Old Theatre, London School of Economics and Political Science, WC2A 2AE In October 2006, over 1000 people - from Government, Industry, Civil Society, the 'technical community, United Nations Agencies and international organisations - will come together in Athens for the first 'Internet Governance Forum'. Agreement by 190 governments to establish an annual Internet Governance Forum was one of the most concrete outcomes of the World Summit on the Information Society which concluded with the Tunis Summit, November 2005. The overall theme of the Athens IGF meeting will be 'Internet Governance and Development' and will address global public policy issues such as 'Openness, Security, Diversity and Access' in relation to governance of the internet. It will prioritise 'capacity building' in all of it's work and aims to incorporate a human rights based approach to it's work. Two of the most controversial human rights issues that are likely to be addressed by the IGF are freedom of expression and privacy. We are organising this meeting to feed into this new process. The London School of Economics (LSE) Department of Information Systems and the Association For Progressive Communications will host a public forum in preparation for the IGF, to address questions such as: * rights, development and internet governance: are rights integral to the 'development'process or a by-product? Can we codify human rights which are applicable to the Internet? * privacy: can the renewed emphasis on security emerging from the anti-terrorism and cybercrime agendas be resolved with privacy rights? Russell runs APC's Fibre for Africa Site which is full of resources on the issues on affordable international bandwidth for Africa. Check out this map to see the fat glowing white lines between the USA and Europe, and the US and Japan/South Korea, and the meagre lines which inch down Western Africa and around the Cape and then disappear leaving the entire East African coast fibreless. I can't put the map here because it's copyrighted but you can download it as wallpaper to your computer and be reminded on a daily basis about this outrageous situation. Session 2: Assessing investment in new VoIP opportunities VoIP produces very different types of opportunities. For example, grey market operators have taken advantage of the price arbitrage opportunities that exist. In other words, for example, they are able to compete on price against artificially high international calling prices. Once VoIP is more widely legalised, then this level of price arbitrage opportunity will decline or disappear as prices come down in the market. It will be important to look at the relationship between quality and pricing and to understand what latitude exists for differentiating different service offers. Some opportunities will allow new players to enter the market relatively cheaply whereas others will require capital investment in new infrastructure. The level of capital required along with an assessment of the risks inherent in different propositions will help clarify where any potential should be made and whether a new opportunity is suitable for your company. Lastly the session will examine timing issues and their impact. Some opportunities like those related to price-arbitrage are short or medium-term. Others like mobile VoIP are longer term because the technology is not yet available. All of these factors will be gathered into a simple matrix and scored so that participants can see where the better opportunities lie in Africa. Session 3: VoIP pricing and service strategies in a competitive market The last session of the workshop will look pricing and service strategies and how they develop in a competitive market. Russell Southwood will explain how operators tackle these issues and the way in which different approaches to service and pricing are reflected in the service offer to customers. He will examine the relationship between cost and the price of providing different levels of service. After this briefing, participants will be split into two groups to devise pricing and service strategies for two different companies, one a start-up and the other an existing operator. Organizers of workshops are asked to present their proposals making use of the template posted below. Proposals should respect the organizational principles and criteria for the selection of workshops. The Advisory Group will assess the proposals and establish a final programme for the Athens meeting in light of the proposals received. An online workshop proposal form will be posted on this Web site next week. Organizational Principles - The guiding organizational principle for holding workshops is the multi-stakeholder approach. Geographical diversity is an equally relevant factor. - There is no distinction between different types of meetings other than the one referring to General Sessions and Workshops. - All workshops will be held under the auspices of the Advisory Group and coordinated by the IGF Secretariat. - All proposals fulfilling the selection criteria and using the template will be posted on the IGF Web site. - Proposals should preferably be submitted in English. 24 August 2006 is set as the final deadline for submitting proposals in English. The deadline for submitting proposals in UN languages other than English is 31 July 2006. - Interested parties are encouraged to submit their proposals as early as possible, as the selection process will take place on an ongoing basis. An early decision will facilitate the planning of workshops. - The final selection will be made by the Advisory Group at its meeting on 7-8 September 2006. - The rooms reserved for workshops and all equipment, including a screen and a PC or laptop for projections and a projector (XGA/SVGA Data), will be available free of charge. Details related to the logistics will be made available in due course. No Secretariat funding is available for the organization of workshops. - There will be no interpretation available for workshops. Content and format - Workshops will focus on the specific issues relevant to the Athens meeting themes as well as on other topics of relevance to Internet Governance. - Most workshops are expected to deal with the first meeting's four broad themes. A number of workshop slots will be made available to deal with important topics that do not fit easily within the main themes of the conference but which are nonetheless of importance to many of the stakeholders. - Workshops dealing with topics that are addressed in the main meeting will not be scheduled at the same time as the main meeting. - Workshops should explore a theme from different angles and different stakeholders' perspectives. Pure advocacy workshops will not be considered. - All workshops will be audiocast. - Workshops should respect the general format of meetings and should be structured to be interactive, allowing a large portion of their time for open discussion and interaction with meeting attendees, such as a Q&A session. They could include keynote presentations, moderated panels and discussions both from the floor and from remote participants. Workshops should be designed with the format that is most appropriate to the particular topic under discussion. Selection criteria - Relevance to the overriding themes and topics. Priority will be given to proposals for workshops related to the main themes. - Demonstratively proposed and organized through multistakeholder collaboration. - Capacity to improve understanding of the IGF themes and topics. - Proven expertise and experience to manage the staging of the workshop, including raising the funds necessary to do so. Template for submitting proposals - Name of the sponsors of the workshop and their affiliation to various stakeholder groups. - Describe your past experience in organizing similar events. What is your budget and how do you plan to finance or raise the funds necessary to stage the workshop? - Describe how the sponsors/organizers will take steps to adhere to the multi-stakeholder principle, including geographical diversity. - Describe how the workshop would include different perspectives of different stakeholders and ensure an overall balance of views. - A concise formulation for the proposed workshop theme. Proposals for workshops on topics not related to the main themes should include an explanation as to why they should be discussed during the first IGF meeting. - Describe the workshop's conformity with the Tunis Agenda in terms of substance, and explain which paragraph(s) the workshop theme is referring to. - Describe its conformity with the mandate of the IGF as set out in para 72. - How does the workshop theme correspond to or enhance the understanding of the four main themes of the first IGF meeting? - Why do you think the proposed theme is important? - Why do you think this theme should be addressed in the first IGF meeting rather than in subsequent ones? - Describe the main actors in the field. Have you approached them and asked whether they would be willing to participate in the proposed workshop? - The proposal should not exceed 1000 words. Reporting back to the General Session One summary report of all the workshops held in one day in a UN working language (i.e. English or French) will be prepared by the Secretariat in cooperation with the organizers. This report will be read out at the recap session at the beginning of the General Session in the Main Hall and benefit from interpretation in all UN languages and real-time transcription. It will last no longer than 40 minutes.

>From Balancing act TOP STORY: KDN PIPS EASSY TO THE POST $115M DEAL WITH FLAG - COST OF BANDWIDTH COST? AROUND $150 PER MBPS PER MONTH _____________________________________________________________________ The EASSy saga, which has had more twists and turns than a mountain road, took what may be a final turn. Kenya Data Networks announced that it has secured a separate deal with Flag Telecom to build a spur from off the cost of Yemen to Mombasa. The deal is believed to be worth US$115 million and the pipe will be built before EASSy was planning to come on stream. And the cost of the bandwidth? An eye-wateringly low figure of around US$150 per mbps per month for Mombasa to London. Russell Southwood spoke to KDN's CEO Kai Wulff this week about how it will work. Flag is in the process of completing the Falcon system that runs through the Gulf and it will be up-and-running in early 2007. The spur to Mombasa will be completed at the latest by September 2007. In the deal with Flag, KDN is believed to be putting up a capacity guarantee and will in turn sell capacity to others in the region. The cost of this capacity will be at cost plus operating, maintenance and interest charges. Therefore this effective cost price will be around $150 per mbps per month, a figure that is considerably lower than any of those mentioned verbally by members of the EASSy consortium. Flag will manage the system and be responsible for maintenance. KDN's Kai Wulff has a very clear attitude to capacity sales:"We will take the capacity. We will be the guarantor. We will sell to all serious players at the cost price. We want everyone to be able to offer value-added services and infrastructure in the (national) market. We will not mark up capacity and we don't see why others should do so. We will have a huge chunk of capacity and will keep competition open by capping bandwidth at cost. When it comes to the next upgrade of the pipe, everyone can negotiate their own deal." "I don't want to dominate the market. If the international bandwidth is cheap, I will be so busy with other business that selling capacity will look like a joke. I'll leave that to the ISPs." He hopes that by 2008 that it will be possible to offer a 4 mb DSL line to users at between US$20-22, coming well below the current cheapest continental price being offered by Maroc Telecom. "We already outsource as many of KDN's function's as possible. We do it with satellite. We will do the same with fibre. There are not many serious private fibre operators and this is why we have ended up making the deal with Flag." And what of the EASSy consortium? "We will continue to be active in the EASSy consortium but we need to rethink the purpose of EASSy". He points out that having built this first link that the balance of the cost of the submarine link will halved:"We need to reach the other countries. They could follow us and speak to Flag and use the same model as we are.

Hi Bill, I do not know if they can rightfully raid premises, but I actually see the BSA move as a positive step in promoting Free and Open Source software solutions. As Dorcas says, the IP owners can legally seek to enforce their rights and since their business model is not sustainable in this market, we simply need to make consumers aware of the alternative solutions. About the Business Software Alliance (BSA)

The majority of these cases are reported to BSA either through one of its 65 piracy telephone hotlines, or through online report forms. After receiving a tip, BSA then sends the companies a note with an implicit threat of a forthcoming software licensing audit. If the BSA finds cases of software piracy, it assesses heavy monetary penalties. Some companies have switched to free software after having to pay such large fines (see [1], paragraph 7). BSA has not been reported to support Free Software Foundation or other free software groups in their actions of copyright enforcement. They do support software patents. [edit] Critique BSA has been heavily criticised for its aggressive tactics in forcing small businesses to allow BSA members onto their premises for audits, and for its presumption of guilt until an audit proves one innocent. It is also worthy of note that BSA is an organization founded in the USA, and is currently without official status in most European countries. They're also well known for lobbying for ENISA, the European Network and Information Security Agency, a suggested network security establishment that would operate within EU. See [2] and [3]. According to a Mother Jones (magazine) article[4], the BSA discovered in 1995 that Antel, the Uruguayan national telephone company, had pirated $100,000 worth of Microsoft, Novell, and Symantec software. The BSA's lawyers in Uruguay quickly filed suit, but dropped the suit in 1997 when Antel signed a "special agreement" with Microsoft to replace all of its software with Microsoft products. I take this opportunity to commend the Board of Directors and staff of Safaricom Limited for the exemplary manner in which they have managed the company. Today, Safaricom is one of the largest mobile phone services company in the region. Apart from directly employing about 900 people, Safaricom indirectly employs thousands of Kenyans in related fields, ranging from mobile phone support services to mobile phone stalls and calling booths across the country. Moreover, the company is now one of the leading taxpayers in the country, and attained the second position in the ranking of distinguished taxpayers in the last financial year. Ladies and Gentlemen, As you are aware, access to knowledge, information and communication is crucial to the development of any country today. By enabling people to communicate and interact, despite large physical distances, mobile communication has brought important changes in work practices and lifestyles. Indeed, investment in Information and Communication Technology infrastructure and development of appropriate human skills is key to ensuring the competitiveness of our country in the unfolding global digital society. It is for this reason that my Government created the Ministry of Information and Communications. This ministry is charged with the responsibility of managing two inter-related sub-sectors namely, Information and Broadcasting, and Information and Communication Technology. These sub-sectors are crucial catalysts to the growth of other sectors of the economy and are therefore expected to contribute immensely to economic recovery and wealth creation. The Government, through the Ministry of Information and Communications, is undertaking a wide range of measures aimed at developing the ICT sector in the country. These measures include, the liberalization of the information and communication sector, that has opened the way for numerous players to compete in providing services to wananchi. We are also carrying out human resource development for industry and investment in the necessary infrastructure such as the Very Small Aperture Technology. We are encouraging the growth of ICT because of its enormous potential to absorb our young people into gainful employment. Today, Information and Communication Technology is one of the fastest growing sectors in Kenya. The sector is providing investment and employment opportunities to a large number of Kenyans and consequently contributing to our national objective of poverty reduction. Mobile telephony has grown remarkably, with the number of mobile telephone lines increasing from 15,000 six years ago to the current 5.5 million. A few years ago, access to telephone services was a major problem for many Kenyans who had to walk long distances to the nearest public phone. With mobile telephony spreading to the rural areas, more Kenyans are benefiting from the rapid growth of mobile phone services taking place in our country. Today, many Kenyans are able to communicate easily and carry out their economic activities more effectively. Truly, the convergence in telecommunications is rapidly transforming our society into an information and communication society. It is encouraging to note that this growth has provided a reliable form of communication to rural communities thereby enabling our farmers to find markets for their produce. The mobile phone is today no longer a status symbol of the urban elite, but a vital tool of modern day communication. In spite of this progress, however, there is still room for continued growth and expansion of the ICT sector in the country. My government is putting in place an enabling environment to ensure expansion of the sector, which is expected to stimulate further economic growth. Indeed, the aim of my government is to create a modern and efficient telecommunications infrastructure in order to position Kenya as a hub of industrial, commercial, financial and ICT services in the region. To achieve this objective, we target to improve tele-density in rural and urban areas. We should expand our mobile telephone penetration from the current 18 percent of our population to 32 percent. Plans are also underway to expand the Internet bandwidth, to increase speeds in data processing and data transfer. Measures are also in place to implement a rural telecommunications programme that will cover all districts in the country in order to bring services closer to the people. We have achieved substantial progress in liberalizing the telecommunications industry. What Kenyans now expect is to reap the full benefits of these achievements in terms of cheaper telephone services and increased access. Indeed, while opening the outsourcing strategy conference in February this year, I announced the removal of duty on all computers and computer accessories as we continue our efforts of making Kenya a regional service centre. We must now move more boldly towards achieving the goal of making Kenya a leading technology centre. In this regard, I am directing the Ministry of Information and Communication and other related ministries to start a digitization campaign. The campaign should focus its strategies on how to reduce transaction costs, enhance local content and create employment opportunities for our youth. In addition, the Government will continue carrying out reforms in the sector, including restructuring of critical departments and parastatals. As part of this commitment, and as I announced three months ago, the Government has approved the restructuring of Telkom Kenya. Under this arrangement, 9 percent of Telkom's shareholding in Safaricom will be sold to finance the restructuring programme. The sale of Telkom shares through an Initial Public Offering is expected to be concluded by April 2007. In addition to this, the expansion and modernization of telecommunications services is on-going with the laying of a fiber optic network between Nairobi and Mombasa. I am also optimistic that both the government and private sector will find a way to fast track the laying of the undersea fibre optic cable. This project is crucial in order to further reduce the cost of connectivity in this country and the region. It will also enable us compete effectively as a regional telecommunications hub. I appeal to all parties involved in this project to resolve any outstanding issues speedily and to begin implementation of the project which will herald a new dawn in the area of telecommunications in our region. I also encourage investors to join hands with the Government in developing the ICT sector throughout the country. Indeed, there is vast investment potential in ICT, especially in the rural areas where tele-density remains unacceptably low. Investors should view the existing untapped potential as an investment and business opportunity, which should be fully exploited. I encourage mobile phone operators to deploy new technologies in rural areas in order to increase accessibility to internet. In particular, wireless broadband has both the potential and capability of providing communications connectivity to schools, government offices at the district and divisional levels, as well as offices for other rural-based organizations. As I conclude my remarks, I wish to commend the Safaricom Foundation, for it's support to a wide range of projects in health, education, culture, sports and the environment. I encourage you to continue ploughing back some of your profits into worthwhile social causes. Microsoft tries pay-as-you-go approach for Windows PCs

'While Microsoft's Windows operating system and software is popular worldwide, its relatively high price puts it out of the financial reach of many in the developing world. As a result, pirated copies of Windows and Office are endemic in some parts of the world, with the percentage of PCs running pirated software approaching 90 percent in some countries. Microsoft is trying a novel approach to deal with the problem of affordability: a pay-as-you-go model. Dubbed FlexGo, the plan operates much like a prepaid cellular phone. Consumers buy a FlexGo computer running Windows XP Home at a reduced price from a retailer, along with some prepaid access cards. Under the FlexGo model, usage is timed. As PC usage reaches a predefined limit, the computer goes into a limited-access state until more time is added. Users can add more time by purchasing scratch-off prepaid cards and entering the numeric code contained on the card onto the PC. The process repeats until the PC's owner has purchased a predefined amount of time on the PC. Once that occurs, all usage restrictions are lifted as the user now owns the PC outright. Microsoft has conducted a trial of the model in Brazil over the past year. FlexGo PCs were sold through the popular Brazilian retailer Magazine Luiza; all users needed to get one was a small down payment. The program proved to be very popular with Brazilian consumers, and Magazine Luiza reported that sales more than doubled. Of those who bought PCs using Microsoft's pay-as-you-go model, 31 percent said that they would not have purchased them had the FlexGo option not been possible. The Group includes 46 members from Government, the private sector and civil society, including the academic and technical communities, who represent all regions of the world (see list below). It is chaired by Nitin Desai, the Secretary-General’s Special Adviser for the World Summit on the Information Society (WSIS), who may also select special advisers to assist him. The Advisory Group will meet on 22 and 23 May in Geneva, following an open consultation on 19 May, also in Geneva. Its main task is to prepare the substantive agenda and programme for the first meeting of the Internet Governance Forum, which is to be held in Athens from 30 October to 2 November. Decisions on how to prepare subsequent meetings and on any future structure and working methods of the Forum will be taken in light of the experiences gained during the preparatory process for the Athens meeting. The Internet Governance Forum is an outcome of the Tunis phase of the WSIS, which took place in November 2005. In the Tunis Agenda for the Information Society, Governments asked the Secretary-General to convene the Forum, giving it the mandate to discuss the main public policy issues related to Internet governance, in order to foster the Internet’s sustainability, robustness, security, stability and development. Governments called for the Forum to be convened in an “open and inclusive process”. Accordingly, the Advisory Group will carry out its work in an open, inclusive and transparent manner, and will seek to make the best possible use of electronic working methods, including online consultations. fyi Florence Etta Nairobi, Kenya -------------------------------------------------------------------------------------------------- Call for Papers National television policies in the age of globalization Considerable discussion in the debate on globalisation within media studies has centred on the question over the impact of the forces of globalisation on the nature and dynamics of national policy-making. On one side of the debate are those who argue that technological change in the form of digitalisation, the expanded jurisdiction of supranational organisations, and the increased reach of global capital are challenging the capacity of national governments to assert control over their domestic electronic media industries This is engendering a pattern of convergent trends in broadcasting policy across countries. On the other side of the debate are those who claim that, despite a similar set of external constraints, national governments still retain key policy instruments to direct the evolution of their media industries in accordance with their policy goals, as demonstrated by the variety in national approaches to the various policy issues that are currently at the top of the political agenda. According to this line of argument, in order to account for contemporary dynamics in media policies, it is still essential to consider in the analysis the distinctive features of one country’s political system, its political culture, and the legacy of pre-existing arrangements in the organisation of the domestic media industry. We are looking for original, research-based papers that contribute to this debate by broadening the understanding of the interplay between global forces and the states in the making of contemporary national television policies. We welcome both national studies and comparative research across countries as well as research on policy-making at the supranational level (e.g. the European Union). Particularly welcomed are those contributions that attempt to incorporate into the analysis the theoretical approaches to the explanation of policy change and variation developed within the policy-orientated literature. Possible topics include but are not limited to: Policy approaches to digital cable, satellite, and terrestrial television; Digital switch-over strategies; The regulation of digital pay-TV access (CAS, API, EPGs) and interactive services; Policy approaches to IPTV; Policy approaches to HDTV; Policy approaches to Mobile TV; The reform of public service broadcasters; The reform of media ownership rules; The regulation of programme production and of particular types of television content; The reorganisation of the regulatory regime for the convergent communications sector. However, because technicians are in short supply, millions of dollars are paid every year to foreign specialists who work in the sector. A German training and consulting company, TOP Business AG, has introduced a human resource development programme, the GSM Academy, specifically to train skilled manpower for the African mobile telecommunications sector. The GSM Academy consists of an intensive three-month training at TOP Business AG's training centre and a 6 month-practical attachment with a network operator in Europe. The company, which has 15 years of experience in global mobile infrastructure education, trains workers for reputable companies such as Alcatel, Ericsson, Nokia, Nortel and Orange. The GSM Academy, which is based on efficient knowledge transfer, will train students to become BSS Operation & Maintenance Specialists, who will be equipped with the knowledge and practical experience, "with all the competence you need to start off work immediately", with a GSM Network Operator in Africa. Those who successfully undergo the training can be sure of finding a good job after graduation because their skills are in short supply in most African countries. What's more, technicians in mobile telecommunications are enjoying far higher wages than workers in most other industries. "There are so many positions available that people have a choice," says an assistant manager with a recruiting company in Lagos. Graduates of the Academy will also be able to become self-employed by setting up handset repair shops, for example. The GSM course, which normally costs 30,000 euros per trainee, is being offered to Africans for only 4,500 euros, as it is subsidized by international organisations in line with the new philosophy of development assistance, which puts priority on the training of skilled manpower for Africa. This will help the continent conserve foreign exchange it otherwise spends on foreign experts who are said to take billions of dollars out of the continent every year. According to Bernhard Kuhn, Vice President - Telecommunication Networks Training & Consulting, at TOP Business AG, "well trained professionals have better chances to get a job or improve their career. And as we can see these people as a knowledge kernel can multiply the specific know-how with their daily work". The GSM Academy is appropriate for candidates, who must have had education and/or training in electronics. Accommodation, health insurance and feeding of the participants will be provided for the duration of the school course. However trainees will be expected to meet their transport and other living expenses. Only 32 participants will be admitted for the first course and it will be on first-come, first-served basis. According to the Government, the envisaged Eastern Africa Submarine System (EASSy) cable project driven by 15 telecommunications firms from 13 Eastern Africa countries was taking too long. Dr Ndemo lamented that three-years since the project was envisaged nothing had been done apart from the holding of numerous meetings. "The costs of the meetings is almost half the total cost of the project," he added. Dr Ndemo spoke at an East African Regulatory, Posts and Telecommunications organisation meeting held in Nairobi yesterday. The PS said Kenya needed the cable more than any other country saying many foreign companies had expressed interest to invest in the country but were holding back due to connectivity problems. He, however, denied that the decision would put Kenya on collision course with other ESSAy members adding that one had to take the lead. "Somebody has to take control and start the project or else we will not get anywhere," he added. The fibre optic cable would be used to connect Nairobi and Mombasa to open up employment opportunities to thousands of youths in ICT. The money, the PS said would be raised using the Nairobi Stock Exchange where the public would buy shares. A meeting involving players in the industry has already been organised to deliberate of raising funds and will be attended by among others Kenya Data Networks, Celtel and Telkom Kenya. Interim Report: Review and analysis of the Kenya Information Communication Bill 2006

Dear KICTANET Members Below and attached is the interim report for the review and analysis of our IC bill. Thank you and best regards alice --------------------------------------------------------- 1.0 Introduction Following the publication of Kenya Information and Communications Bill 2006 by the Ministry of Information and Communications in Feb 2006, KICTAnet decided to establish an infrastructure to review the bill in a systematic manner. The purpose was to take on board comments emerging from stakeholders in an efficient, constructive and nationally engaging process. Consequently KICTAnet established a team to undertake the review. This an interim report of the work of the I&C Review Team 2.0 Team composition The Team was formally constituted in the beginning of May and comprise of the following facilitators and their theme of responsibility in the Bill review exercise as set out in Table 1. Table 1: team membership and area of focus 1. Telecommunications: Muruiki Mureithi 2. Legal/Regulatory: J. N. Kihanya 3. Social Dimensions, including gender, youth etc: Dorcas Muthoni 4. Broadcasting/Media: Grace Githaiga 5. Acadamia: Victor Kyalo 6. Internet and information technology: John Walubengo 7. Economics: Ndungu Kimani 8. Outreach: Alari Alare The team Chair is Mr Muriuki Mureithi 3.0 Activities At its first meeting held on April 10th the team - approved an innovative model to review the bill . The model developed by Summit Strategies Ltd breaks down the review process into three dimensions, namely carriage system(s), content and finally services provision environment over three time phases. A detailed description of the model is attached - reviewed and allocated responsibilities for each team member as indicated in Table 1 above - Agreed to finalise and present phase 1 – contextualisation by Tue April 25 - Requested the Chair to brief and seek collaboration from PS Ministry of Information and Communications - Decided to publicise the bill review process to get constructive engagement with broad participation by all stakeholders - Decided to engage an expert to help engage the media on the review process These activities were carried out and reported in the 2nd meeting held on April 19th .This second meeting took note of the following;- - Briefing on the meeting with PS on April 13th who committed to support the process as reported below Dear Colleagues Further to our concurrence to work with the Ministry of Infocom, I met the PS on Thursday April 13th at 1700hrs and briefed him - on the framework and strategy we are using to review the bill - that the motivation of the process was to create synergy among all stake holders and enhance efficiency in the review process - that it was an open process we seek to bring all stakeholder interest on board - the team is giving time as a national contribution to development of ICT in the country - being a phased approach we shall have a peer review meeting on May 12th and a national workshop towards end of May or early June to be determined by the publishing of the bill by the AG The PS expressed appreciation to the work we are doing and committed to support us in this noble activity. He indicated that he will send his staff on the meeting of May 12th and that the ministry will takeover ownership of the national workshop to ensure high level participation. His office is open for any consultations we may need or support to undertake research that we may need. The Asst minister also came in briefly in our meeting Email to team members dated April 18th , 2006 , by Muriuki Mureithi chair - very concise reports by all members on their respective themes - the process leading to publishing of the bill by the Attorney General explained below ‘My very rudimentary understanding of the Bills process will be that on finalisation by the AG, the Bill will be published and forwarded to the House Business Committee, which will in turn forward it to the relevant committee of the House. The Bill will then be presented for its first reading by the Minister for communications. This involves a paragraph by paragraph reading of the all clauses in the Bill..or highlight of the PARTS of the Bill...It will then go to the second stage where the house will convert itself into a committee and raise queries on the Bill and then refer the Bill to the appropriate committee for any amendments proposed. It will then come back to the House for a final third reading and if passed, will await presidential assent to become law. I hope this gives a guide of some sort ON THE TIME FRAME.I could make a detailed report after enquiries. I am not aware of the internal workings at the AGs but would assume that the relevant officers will make the relevant changes to accord the Bill a final parliamentary style and when passed by the AG, the process above would kick in..’ Submission to the team by J N Kihanya Legal/ regulatory on Parliamentary process April 18th - Low response from the KICTANET list members. The team tasked a specialist Mr Alari to develop a strategy to engage all stakeholders in the bill review process - Commenced phase 2 – analysis of the bill with a view to make substantive proposals on the bill. A guideline has been developed by the legal expert on how to make proposals to the text as below Section 58(1)(ICBill) “The Minister may, by notification in the Kenya gazette, declare that any computer system or computer network is s a protected system.” Comment Delete entire section. The data protection regime needs a more robust treatment and we should seek views in other jurisdictions on how they have achieved this. Mr J N Kihanya Legal expert - to hold a media owners/ senior editors workshop in the first week of May to brief the media on the process - others key stakeholders to be engaged and briefed include TESPOK, Telkom Kenya, Safaricom, Celtel , E-government Secretariat, Postal Corporation of Kenya, CCK, Civil Society of Organisation - to meet on May 10th to present output of Phase 2 - to present our findings to a ½ morning workshop for peer review on may 12th - 4.0 Status PS Ministry of I&C has confirmed to attend the breakfast media briefing workshop on May 5th. We are now finalising the logistics to organise the meeting and bring in Media owners and senior editors Team members have almost finalised the final reports of Phase 1 whose cut off was Tue April 25th 5.0 Future programme The team has planned the following near term activities a.. Brief the Minister on the review once the report is complete b.. To organise a one day workshop for ICT reporters once review is complete to educate them on the contents of the Bill and our proposals Once the Bill is published by the AG a.. Jointly with the Minister organise a one day national workshop b.. Jointly with IEA , ATPS hold a two day workshop for Members of Parliament Committee responsible for ICTs 6.0 Resources The team is literally donating time and expertise for these national activities. The team needs funding for the better honoraria to cover direct costs and funding to organise the National workshop as well as the two day workshop with Members of Parliament Committee responsible for ICTs. +++

Apologies for cross posting --------------------------------------------------------------------------------------------------- Do you or your organization want to influence decisions that shape the Internet? If you do, why not apply to be designated "At-Large Structure" and participate in the Internet Cooperation for Assigned Names and Numbers (ICANN) decisions critical to the Internet's end users? ICANN's Interim At-Large Advisory Committee (ALAC) is now accepting applications from existing or new groups that involve (or want to involve) individuals in Internet issues. Go to <http://alac.icann.org/> for more information. A new mechanism for individual Internet users participation in ICANN (the Internet Corporation for Assigned Names and Numbers) has been launched for people who want to be involved in issues that affect individuals use of the Internet's domain name system. ICANN is involved in shaping the Internet and is dealing with issues such as privacy protections for your personal domain registration information (called the WHOIS database), the implementation of internationalized domain names (use of non-ASCII characters), trade mark and domain name disputes and related matters, and how new top-level domains (i.e. .info, .name, .museum, etc.) are introduced. These are but a few ICANN issues on which the end-users voice needs to be heard. Groups throughout the world that deal with individual Internet users' interests are encouraged to register and participate in ICANN by submitting a simple application form. Groups that meet the minimum requirements will be designated as "At-Large Structures." The ALAC is an Advisory Committee to ICANN's Board charged with providing advice on activities of ICANN that relate to the interests of individual Internet users, and helping to organize At-Large groups throughout the world for structured involvement and informed participation of the individual Internet user community. Why become an At-Large Structure? By being designated an At-Large Structure, your group gets: a.. A recognized role in forming the policies that affect how individuals' use the Internet (ICANN is listening. Make sure your voice is heard!); b.. Quick and easy access to first-hand information on what's happening in ICANN and why it matters to end-users; c.. Opportunities to provide your members education on ICANN's work and Internet developments; d.. Participation in building your region's At-Large organization (RALO), and opportunities to network with other groups in your country and region as At-Large grows; e.. Representation in ICANN at the regional and international level, plus your group's members will be eligible to serve on important regional and international decision-making bodies in ICANN; f.. A free web page and other Internet-based mechanisms to support your group's work; and g.. Opportunities for funding to support some of your group's activities (ALAC is applying for grant funding). What type of groups can be At-Large Structures? Any group that supports individuals' ability to share their views on ICANN issues, and that meets the few simple criteria listed on the ALAC's website, can apply to be an At-Large Structure. Types of groups that have expressed interest in being designated At-Large Structures include: a.. Professional societies (e.g. engineers, attorneys, etc.) b.. Academic and research organizations c..
