High Court Rules Meta Can Be Sued in Kenya

The High Court has ruled that Meta, Facebook's parent company, can be sued in Kenya for its alleged role in facilitating the spread of content that incited ethnic violence in Ethiopia's Tigray region between 2020 and 2022. The landmark decision rejects Meta's argument that Kenyan courts lack jurisdiction because Meta isn't registered as a company in Kenya. The lawsuit, is one of three against Meta in Kenya on its content moderation practices, which it recently made major changes on in the US. It is yet to be seen whether the company will appeal the decision. Ministry launches inaugural 10-week Cybergame Challenge

Court says mandatory school fee payment via e-Citizen unlawful

The High Court has nullified the government’s directive requiring parents to pay school fees through eCitizen, saying it is unconstitutional. Justice Chacha Mwita also quashed a January 2024 circular issued by then Education Principal Secretary Belio Kipsang, which contained the directive. The court ruled that the directive was implemented without adequate public participation and partners’ engagement, thus violating constitutional provisions. Justice Mwita also found that the Sh50 convenience fee imposed on transactions on e-Citizen has no legal basis. TikTok profiting from sexual livestreams involving children in Kenya

TikTok is profiting from sexual livestreams performed by teens as young as 15, the BBC has been told. BBC spoke to three women in Kenya who said they began this activity as teenagers. They told us they used TikTok to openly advertise and negotiate payment for more explicit content that would be sent via other messaging platforms. TikTok bans solicitation but the company knows it takes place, moderators have told the BBC. TikTok takes a cut of about 70% from all livestream transactions, we have previously found <https://www.bbc.com/news/world-63213567>. TikTok told the BBC it has "zero tolerance for exploitation". Livestreams from Kenya are popular on TikTok - each night over the course of a week, we found up to a dozen in which women performers danced suggestively, watched by hundreds of people around the world. Call for Proposals: Data Governance in Africa Research Fund

Dear listers, Mozilla Foundation and the Deutsche Gesellschaft für Internationale Zusammenarbeit GmbH (GIZ), African Union, under the Data Governance in Africa Initiative have collaborated in a project to increase awareness on and support the domestication of the African Union Data Policy Framework (AU-DPF). The AU-DPF was endorsed by the Executive Council of the Commission at its 40th Ordinary Session in February 2022. The framework aims to boost the development of human rights-respecting, sustainable and inclusive data-driven economies through the creation of a common data space and interoperable data governance mechanisms. They are looking to recruit four (4) African-based researchers to undertake research that will respond to current data governance trends in the region and identify policy recommendations in one of the four topic areas listed under the scope of work. Dear Listers, A critical situation unfolding in Nairobi that's causing widespread disruption: the ongoing dispute between Nairobi County and Kenya Power. As you may have heard/ read, Nairobi County officials have taken the drastic step of cutting fiber optic cables from Kenya Power's utility poles. This action has resulted in significant internet service disruptions affecting businesses, schools, and homes across the capital. The core of the issue stems from an unpaid electricity bill of approximately $23.1 million (KES 3 billion) owed by Nairobi County to Kenya Power. However, the county government argues that Kenya Power owes them an even larger sum in unpaid land rates, wayleave fees, and parking charges. This counter-claim has escalated tensions and led to a hostile standoff. The Communications Authority (CA) has condemned these actions, emphasising that ICT infrastructure falls under national government jurisdiction. So, here are the six recommendations for organizations to efficiently implement upskilling and reskilling programs for their workforce be it in-person, remote and hybrid. 1. Create a culture of learning Organizations can empower employees to become better versions of themselves by investing in their training and development. With the right culture, employees can find opportunities to acquire new skills and share them with colleagues, setting off a ripple effect of learning and growth. Employers who foster a culture of continuous learning in the workplace demonstrate concern for their employees and the value they provide to the organization. When employees acquire new skills in their work setting, they feel more appreciated, productive, engaged, and devoted to their employer. 2. Build a larger skill set Investing in the upskilling and reskilling of employees is an important step in ensuring employees are equipped with the skills necessary to perform their job successfully. This investment in their development will benefit the company in the long run, as they will become better equipped to tackle new challenges and take on additional responsibilities. These training efforts through corporate training programs enable employees to move into new roles or take on extra responsibilities that increase their productivity and effectiveness on the job. 3. Create personal development plans Personal development plans offer a unique way for employees to track their progress and set specific goals, while employers can identify strengths and weaknesses in an employee’s performance. It provides a clear understanding of expectations for employees, enabling them to be successful and realize their career aspirations. This includes not just quality standards but also deadlines for deliverables and other expectations for completing the job. 4. The problem is that this approach to learning will lead to low completion rates and a decline in information retention owing to learners’ isolation. Blended learning with engaging learning content will help enhance learner engagement, participation, and experience. 5. Evaluate and refine content as per requirement The optimal practice for L&D professionals would be to evaluate the effectiveness of upskilling and reskilling techniques periodically. Consequently, organizations can make necessary adjustments and better align training goals with the business’ and employees’ demands. In turn, it may foster a culture of continuous learning that is more adaptable to the continually changing demands of an organization. 6. Allow employees to direct their professional growth Investing in the employees by offering upskilling and reskilling opportunities will help organizations retain them. Still, it will also help improve the organization’s and employees’ performance. SHA to have Access to Citizen Data in Several Government Databases

Dear Listers, According to media reports, the Social Health Authority (SHA) will soon have access to various databases, including mobile money transactions, Kenya Power payments, KRA records, National Transport and Safety Authority (NTSA), the immigration department, the Kenya Agricultural Management and Information System (KIAMIS), Kenya National Bureau of Statistics (KNBS), Hustlers Fund, the Insurance Regulatory Authority, and the Communications Authority for mobile phone data. This initiative aims to ensure fair contributions and increase the average monthly premiums paid by self-employed Kenyans to KSh880. SHA's new algorithm under development will use data triangulation from these databases to improve the accuracy of means testing. The Kenya Internet Governance Forum (KIGF) is an annual multistakeholder platform that brings together diverse groups to discuss ICT and Internet policy issues. While the forum generates soft policy outcomes, its primary role is to serve as a knowledge-sharing platform that informs and inspires policy actors across the public and private sectors. KIGF also contributes to regional and global Internet Governance Forums (IGFs) through a structured reporting and representation process. This ensures that Kenya’s perspectives are integrated into broader policy discussions, fostering a bottom-up approach to Internet governance and strengthening the connection between global and local policies. This year's Kenya IGF theme is *Tech for Human Development: **Policy, Innovation, and Inclusive Governance.* The KIGF 2025 program will be developed in line with the following sub-themes, though participants are encouraged to propose topics that resonate with Kenya’s unique context: 1. Championing Home-grown Tech Solutions for Societal Impact Fostering innovation ecosystems that empower local tech talent to develop solutions addressing Kenya’s unique societal challenges. 2. Dear Listers. Greetings. Our Organization, Young Women Growing Initiative - Kenya, recently enrolled 30 students for a Grade 3 ICT course by NITA in Ezesha Plus College, Kayole. NAWIRI Program is building capacity in youth, young women, teenage parents and marginalized minorities, through ICT skills, to elevate their participation in community growth and participation in governance. The 30 students are in for a 6 months long course and will sit in for their exams. Ahead of their certification, the students have requested for an information and technology resource Hub to aid in their learning. We request for collaborations to see this come to fruition. Greetings listers and Happy New Year! KICTANet wishes to invite volunteers from the different stakeholder groups to assist in the preparation of the Kenya Internet Governance Forum (KIGF) 2024. The Kenya Internet Governance Forum (KIGF) is an annual meeting that brings together various stakeholder groups to dialogue on ICT and Internet policy. The Steering Team otherwise known as the Multistakeholder Advisory Group (MAG) role is to assist in convening the Kenya IGF by preparing the programme and schedule and to improve the IGF process through community consultations, outreach and stakeholder engagement. MAG members volunteer and serve in their personal capacity, and are expected to have established linkages with their respective stakeholder groups. What is DeepSeek and why is it disrupting the AI sector?

Chinese startup DeepSeek's launch of its latest AI models, which it says are on a par or better than industry-leading models in the United States at a fraction of the cost, is threatening to upset the technology world order. The company has attracted attention in global AI circles after writing in a paper last month that the training of DeepSeek-V3 required less than $6 million worth of computing power from Nvidia H800 chips. DeepSeek's AI Assistant, powered by DeepSeek-V3, has overtaken rival ChatGPT to become the top-rated free application available on Apple's App Store in the United States. New Starlink POP to Improve Latency and Capacity

Dear Listers, Starlink, SpaceX's satellite internet service, is significantly improving latency for users in Africa by routing them through a new "point of presence" (POP) in Nairobi, Kenya, reducing latency from 100-200ms to around 30ms. The POPs connect the Starlink satellite network to terrestrial internet infrastructure and are crucial for enhancing both capacity and latency; the closer a user is to a POP, the faster their connection speed. Currently, Starlink operates 37 POPs globally, with a concentration in North America but expanding rapidly into other regions like Africa and Europe to meet growing demand and improve service in underserved areas. Kenya’s President Wades Into Meta Lawsuits

Now I can report to you that we have changed the law, so nobody will take you to court again on any matter.” Ruto said Sama had planned to relocate to Uganda “because many of us were giving them trouble.” The article discusses two lawsuits in Kenya that challenge the liability of Big Tech companies, specifically Meta, for alleged abuses at an outsourcing company, Sama, which was contracted to moderate content. Medical students and researchers will need to pay to access data collected under SHIF. These charges which will require independent medical researchers to pay Kes. 30,000 to access the health data are contained in the proposed Digital Health Information Management Regulations, 2024, part of what will effect the Digital Health Act No. 15 of 2023, currently under public participation. It's been 72hrs and Telegram is not currently available in Kenya unless you are using a VPN or proxy. An article by Kictanet https://posts.kictanet.or.ke/tele-gone-telegram-down-is-it-an-internet-shut… noted this same time last year. Is it a coincidence? Some say it's to STOP exam cheating, others say it's a show of the government's mighty power. Partinet questions were asked on the article but since we did not get answers, it is back. No consequences. But I ask the same questions again. "After Telegram, what else will be shut down? What will be the next excuse? What direction do we want to take as a country?" On the matter of cheating in exams

Friends, It looks like this is a worldwide phenomenon. On our part in Kenya, many students and graduates of Kenya universities earn pretty well from writing papers for folks worldwide. I am not sure whether anyone has formally studied this. According to the attached document (it's long) an American professor laments the change in attitude towards cheating. She argues that, while in the past people could be ashamed of being caught cheating and that folks were proud of the 'sweat of their labour' that is no longer the case. In my view, cheating happens because all around us people are cheating and (apparently) getting ahead of others; even those who get caught manage to game the system and get away with it. It is happening everywhere: in homes, churches, schools, government, private sector, etc. ... Name it! Gaming the system and beating it is a triumph for many! Second, in the old days, some taboos limited people's will to act beyond certain limits. A person could, for instance, fear that a curse might befall them! ... No more: people are cheating, getting ahead and no curse seems to come their way! All this has eroded the work ethic where folks could be proud that 'the sweat of their labour' has made them attain success. So just because someone works hard, has integrity and 'gives to Caesar what belongs to Caesar' does not underlie the person's status in that society. Thieves and scoundrels (and just because they are loaded with mbesha, regardless of how it was earned) seem to win!
