DIGITAL HAILING TRANSPORT REGULATIONS

Greetings listers, NTSA has developed regulations for the the digital transport industry (the likes of ubber, taxify etc) The proposed regulations include: requiring the digital hailing companies to have a comprehensive data protection terms for their users, the drivers and the company will also have to register with NTSA as digital hailing operators, and it will also require the companies to give data to NTSA upon request. Contracts, purchase orders, letters of intent, IOU’s and many other instruments of business are increasingly not worth the paper they are printed on, even if created by and under the direction of legal counsel. Transacting business in Kenya, whether with an individual, SME, corporate and even government can be a game of chance, where your enterprise is better off getting what it can right out of the gate as future payments are not assured or the effort to get it on the books leaves teams adversely worn if the business is not already tittering on closure, having hedged every possible credit line to stay afloat and servicing errant customers. Dorcas Muthoni PhD Fellowship

The Dorcas Muthoni PhD Fellowship is a tribute to our Doctor Honoris Causa Dorcas Muthoni. Dorcas Muthoni, a Kenyan engineer and entrepreneur, CEO and founder of the company Openworld, received our University’s highest recognition on 15th December 2017 for her significant work in the promotion of engineering studies among young women in Africa, the mentoring of young people, and her social commitment in the fight against poverty. This scholarship is aligned with our university institutional commitment to the United Nations Sustainable Development Goals (SDG), it aims to contribute to quality education and gender equality for African Women. The first edition of this PhD Fellowship was opened in 2018. We are pleased to launch our second edition in 2020. The main objectives of this fellowship are: *(i) to promote gender equality & contribute to reduce the gender gap in ICT*; by facilitating more women pursuing scientific/technological/engineering careers and lowering the barriers women face when pursuing careers in STEM disciplines *(ii) to share excellent research with African female researchers during their PhD Studies*. Our ICT department <https://www.upf.edu/web/etic> consists of more than 20 research groups <https://www.upf.edu/web/etic/research-groups> who are very active in international research projects (e.g. currently active in 38 H2020 research projects) and nationally we have the Spanish research excellence seal Maria de Maeztu). Their business model relies on data and data monetization for growth. These are multi-sided, oligopolistic or monopolistic markets characterized by network effects, high economies of scale and scope, and increasing returns to scale, which together raise barriers for new entry. In digital markets, platforms compete for the market and not in the market. These features together with control over user data confer significant market power to incumbent platforms in their respective markets. This has raised concerns about competition and led the competition lawyers and economists reflect on ways to restore the lost competition in digital markets. This paper suggests adapting competition law tools and analysis to the realities of this new business model; reforming merger control regimes; focusing not only on free but also fair competition in digital markets; adopting regulatory measures such data openness and portability, interoperability between online platforms. Regulation is evolving. Or is it Regulators need to evolve? The Communication Authority of Kenya (CA) drops Finserve Africa, the successor to Equity Bank Limited’s Equitel from the roster of #mobilemoney service providers. The reasoning? It’s more a banking product than a mobile money product. #GoFigure. So basically, 1.88 million mobile money subscribers have disappeared into thin air. According to The CA.
