Eric Your denial seems to be very much against the sentiments of Kenyans on social media and the Techweez blog. KENIC Confirms Takedown of isUhuruInKenya.co.ke Domain My sense is that this may very well be sensationalization. Maybe someone hacked the site? Be that as it may KeNIC needs to get ahead of this hullabaloo and assure all owners of .ke domains that you have laid down procedures for take down orders etc. My suggestion would be that:- 1. Immediately issue a denial and proof that you guys didn't do this. 2. Engage the community on the procedures of take down. 3. Clearly inform the public what constitutes a take down etc. KeNIC has done well over the last few years and you guys need to be seen as Politically Agnostic. Period. Net Neutrality violations can potentially have multiple categories of harms —* competition harms, free speech harms, privacy harms, innovation and ‘generativity’ harms, harms to consumer choice and user freedoms, and diversity harms* thanks to unjust discrimination and gatekeeping by Internet service providers. 2. Net Neutrality violations (including some those forms of zero-rating that violate net neutrality) can also have different kinds benefits — enabling the *right to freedom of expression*, and the *freedom of association*, especially when access to communication and publishing technologies is increased; *increased competition*[by enabling product differentiation, can potentially allow small ISPs compete against market incumbents];*increased access* [usually to a subset of the Internet] by those without any access because they cannot afford it, increased access [usually to a subset of the Internet] by those who don't see any value in the Internet,*reduced payments* by those who already have access to the Internet especially if their usage is dominated by certain services and destinations. 3. Given the magnitude and variety of potential harms, *complete forbearance from all regulation is not an option* for regulators nor is self-regulation sufficient to address all the harms emerging from Net Neutrality violations, since incumbent telecom companies cannot be trusted to effectively self-regulate. Therefore, *CIS calls for the immediate formulation of Net Neutrality regulation* by the telecom regulator [TRAI] and the notification thereof by the government [Department of Telecom of the Ministry of Information and Communication Technology]. CIS also calls for the eventual enactment of statutory law on Net Neutrality. All such policy must be developed in a transparent fashion after proper consultation with all relevant stakeholders, and after giving citizens an opportunity to comment on draft regulations. 4. Even though some of these harms may be large, CIS believes that a government cannot apply the precautionary principle in the case of Net Neutrality violations. *Banning technical innovations and business model innovations is not an appropriate policy option. *The regulation must toe a careful line *to solve the optimization problem: *refraining from over-regulation of ISPs and harming innovation at the carrier level (and benefits of net neutrality violations mentioned above) while preventing ISPs from harming innovation and user choice. ISPs must be regulated to limit harms from unjust discrimination towards consumers as well as to limit harms from unjust discrimination towards the services they carry on their networks. 5. Based on regulatory theory, we believe that a regulatory framework that is technologically neutral, that factors in differences in technological context, as well as market realities and existing regulation, and which is able to respond to new evidence is what is ideal. This means that we need a framework that has some bright-line rules based, but which allows for flexibility in determining the scope of exceptions and in the application of the rules. Candidate principles to be embodied in the regulation include: *transparency, non-exclusivity, limiting unjust discrimination*. 6. The *harms emerging from walled gardens can be mitigated in a number of ways*. *On zero-rating the form of regulation must depend on the specific model and the potential harms that result from that model. *Zero-rating can be: paid for by the end consumer or subsidized by ISPs or subsidized by content providers or subsidized by government or a combination of these; deal-based or criteria-based or government-imposed; ISP-imposed or offered by the ISP and chosen by consumers; Transparent and understood by consumers vs. non-transparent; based on content-type or agnostic to content-type; service-specific or service-class/protocol-specific or service-agnostic; available on one ISP or on all ISPs. Zero-rating by a small ISP with 2% penetration will not have the same harms as zero-rating by the largest incumbent ISP. For service-agnostic / content-type agnostic zero-rating, which Mozilla terms ‘*equal rating*’, CIS advocates for* no regulation.* 7. CIS believes that *Net Neutrality regulation for mobile and fixed-line access must be different* recognizing the fundamental differences in technologies. 8. *On specialized services CIS believes that there should be logical separation* and that all details of such specialized services and their impact on the Internet must be made transparent to consumers both individual and institutional, the general public and to the regulator. Further, such services should be available to the user only upon request, and not without their active choice, with the requirement that the service cannot be reasonably provided with ‘best efforts’ delivery guarantee that is available over the Internet, and hence requires discriminatory treatment, or that the discriminatory treatment does not unduly harm the provision of the rest of the Internet to other customers. 9. On incentives for telecom operators, CIS believes that the government should consider different models such as waiving contribution to the Universal Service Obligation Fund for prepaid consumers, and freeing up additional spectrum for telecom use without royalty using a shared spectrum paradigm, as well as freeing up more spectrum for use without a licence. 10. Net Neutrality Debate Observations

The NetNeutrality Debate in Kenya I have been keenly following the debate on NetNeutrality globally and especially the Kenyan one. The events of the last three weeks kicking off at the Internet governance Forum in Brazil and the KICTANet mailing list debate have been key and it is clear to me: There is a huge gulf between research numbers presented in defence or opposition towards Free Basics/Internet.org in the developing world. There is a limiting simplistic targeting of Facebook as the force of evil in this debate. In the period after the IGF, discussions in Kenya and publications have moved more towards Facebook’s Free Basics; some objective and critical, some clearly as general attacks on Facebook as a company and Free Basics as a product. It was absolutely great for Grace Githaiga to bring the Facebook Policy team in to ensure official positions are clarified and the members’ questions would be answered. My observations 1. The Net Neutrality debate we are having is quite limited. The focus on Free Basics is very much in order and I hope this kind of energy can go to other contentious NN issues like protocol and peering discrimination (like when Zuku caps your download speeds when you are downloading Game of Thrones from Pirate Sites or when streaming live matches) and IP discrimination (when coffee joints, universities or organizations block specific websites like YouTube, Facebook under the guise of productivity, obscenity or heavy-traffic balance). These are top-of the head examples. 2. Our Kenyan primary research on this area is a sham! I am saying this as a researcher myself at Strathmore Law School. That is why we cannot push back on the numbers and data presented to us. Mozilla, Facebook, Stanford Uni all presented some data. We have some opinion polls here and there but no substantive work has been done locally. I ask all of us to get our hands dirty and get the data out from the users in our country so we can have a solid case in these debates. We have a huge task ahead of us if we are to step into the global table of serious discussion. I cringed to hear an African participant at the IGF say that Africans should be included in the table discussing NN and issues affecting Africa and Internet. This is someone who had flown over 10,000 miles to Brazil yet claimed Africans (the generality) should be included in the discussion. I don’t think nobody ever blocked someone off from participating in the pre-IGF events and surely, playing that racism/underdeveloped/Africa/Poverty card is so lame. Unless we conduct our research, we will continue being consumers of knowledge, or whatever is presented as such. 3. The organizations which deal directly with masses of end user are critical in giving feedback to the listers: ElimuTv for example is a good case. Most listers here are trapped in the {Nairobi-global capitals’ conferences} and would profit from first hand experiences from the counties. 4. In Reconciling political and economic goals in the net neutrality debate <https://www.msu.edu/~bauerj/papers/bauer-obar-netneutrality-tis-2014.pdf> (PDF), the authors argue convincingly for combining instruments towards an open Internet that upholds Net Neutrailty. As it has always been clear, access to the Internet is not a simple technological issue that can fixed just by adding more tech to the problem. One more cable won’t solve the access problem. Definitely the tech is core but freedom of speech, economic independence, language issues and political participation at the local level matter as much. CIPIT (at Strathmore) looks forward to partnering with all those who are interested in this topic in conducting primary research, forums and policy making. Blatant attack on Facebook or Google or Apple or whatever as a company is very easy. Anyone can do it. However, serious matters like this need our critical energies to offer credible alternatives to connect our people to the Internet. The kind of Internet access that supports content creation requires all kinds of inputs (electricity, broadband, infrastructure) that Facebook alone is not solely equipped to provide in 192 countries around the world. It’s no coincidence that the countries with the most creators are countries with a) the most resources and b) the biggest government investment in infrastructure. As you know, it’s not Facebook that charges for Internet access in developing countries-it’s operators. Are operators willing to provide unlimited access, for free, to people? Should they? I think the primary thing to remember, per my email is that Free Basics is not, at all, meant to be a holistic answer to a complex issue. Dear Listers Greetings. I hope your week has started well. The topic of Net Neutrality has become an important global Internet Governance issue in the last two years, and has generated some interesting debates. In Kenya, Facebook has partnered with Airtel to offer users zero rated services, christened "free basics" which means that several websites have been selected (for lack of a proper word) to participate in the platform, where users access these websites for free. However, the same users cannot access any other website unless they pay for the data. Different positions depending on where their proponents stand have been shared. Those on the opposite side argue that zero rating stifles innovation, leads to customers lock-in, is anti competitive behavior, confuses the users on the true meaning of the Internet, denies users choice, and makes policy makers lazy in ensuring proper affordable internet is availed to the masses. Facebook's Head of Public Policy, Africa Ebele Okobi, and the Public Policy Manager, Africa Akua Gwekye have graciously agreed to respond to any queries the community has on zero rated services. The Process Please articulate your concerns and ask questions as we usually do when we have moderated debates. The facebook team will then look at the questions and respond to you on Wednesday Evening. Depending on how it goes, we can then see how to continue engaging with them. Friends This is a good discussion. I read somewhere about the emergence of Toyota and its global dominance. Back in time, American auto companies (then the world's largest) failed to embrace ideas proposed by the founder of Toyota (I believe Toyoda is the name). He went ahead to do exactly what had found resistance in North America and the rest is history. ... It took these auto companies close to 20 years to even measure to the quality standards of the 'new comer' in their space. ... there is a similar story to be told of IBM (in reference to Microsoft, Apple, etc.) or Western Union (in reference to Bell companies) ... If I were Safaricom, I would seriously consider acquiring those companies with innovative solutions as a way of staying ahead; with its deep pockets and influence in the market, you can bet the company can lead the way if it desires so. ... smothering and suffocating others can only come to bite later on as innovation would always find its way into the market. my 2 cents worth.
