The proposed bill under the name of national security could have the same effect. If the US goes ahead and implements or even considers what will prevent other nations to do so. hi listers, I also believe the bill should define the appointment of the CEO and his or her qualifications just like the constitution did for inspector general of police service. I am sure we all know the effectiveness of the ICCK depend more on the CEO and the staff than the commissioners. Consitutions and Appointment of Commissioners to the Commission

Commissioners appointed by the President on the recommendation of the Public Service Commission (PSC). Cabinet secretary (not the president) should make appointments on recommendation of PSC. This would be in line with decentralization of power that has been at the core of the recently promulgated constitution. As requested, attached is an article from a Researcher (drawing on some of the research findings from IDRC funded work on policy and regulations) analyzing a similar "media spinning" strategy on claim of loss of revenue in the South African market. There's a brief mention of the Kenyan market and the recent price wars. As soon as I get hold of a 2nd article that was done, I will circulate it. It provides an analysis on "the impact of the reduction in the termination rates on pricing, and also specifically the dramatic reduction of retail prices by Bharti". The Researcher argues that "the retail price reduction will eventually force down Safaricom prices"...which is already witnessed. They further argue that "this is a good thing.... Safaricom is not going out of business soon.... though it will be useful to see the impact on EDBITAs this quarter" Soon, another piece of resaerch work on "pricing index" will be out in April and presented at an upcoming event in Nairobi (http://www.researchictafrica.net/training_1.php) The accompanying analysis in the "pricing index report" will have a substantial focus on the Kenyan market and the effects of the ongoing price wars in the market.....until then lets keep the debate alive. My point of reference is chapter 15 clause 248 (1&2) which establishes Commissions in this country. This proposed name does not appear to be among those listed. I have been pondering on whether or not this title can be in contravention to the Constitution and if another name like "Communications Regulatory Authority of Kenya" or something like that can be contemplated. I also wish to comment that independence of this body cannot be vested in the name but the powers conferred to by the law establishing it and that is why I discount the use of the word "Independent". Listers, Just wanted to share an observation that despite the hype that fibre had arrived on the Kenyan coast, it seems to be taking long for Broadband to arrive in residential homes! I see cable installation everywhere, but I have not come across a provider aggressively advertising to Kenyans for broadband to the homes. Am I living in my own world? Anyone has an idea of a reliable provider with clean bandwidth to homes (not the "bamba" type connections) Edith

That is a company somehow affiliated to KDN who installed the fibre in Runda and runs now the fibre network. Computer Donation

Dear Listers, There has been a great initiative by a young man called Daniel Ogola to give young girls who have dropped out of secondary school due to childbirth a chance to go back to school. Last year, Daniel managed to get like-minded people to build and equip a classroom to start one class of 40 inform one students ALL comprising of young girls who had given birth in primary school and had dropped out of school. The school has been approved by the Ministry of Education and is called Lifunga Secondary School. The girls have now moved on to form two after Daniel managed to develop another classroom for them to move forward. Now, a new in-take of another 40 such girls will be joining form one this month while the rest of the 40 have proceeded to Form 2. The young girls have gotten back their confidence and are really working hard to turn around their lives. You can only imagine how much this has impacted the 80 girls! Listers, I am asking anyone out there who has a computer and a printer to donate to this school so they can be typing out their termly examination papers in-house so as to save some money from working from a bureau. I am sure there is at least one person out there who can donate a computer and a printer for this worthwhile cause. Edwin, Very good points. I would say we need a working planned infrastructure with sufficient capacity to handle traffic needs, the discipline of drivers and law enforcement, useful information (much of which you outline) and more. I also think we can ease congestion using technology: have more telecommuting where people work close to where they live instead of enduring the jams, indiscipline on the roads, etc. It would be good for our stress levels and hearts. (Here is what I said to a delegation from Metropolitan Nairobi that came looking for ideas; they have never followed up on their promises. I guess they are waiting for some donor to fund the initiative.) BTW: much of what you have indicated is subject to a discussion held by some colleagues with people at OP; I am told that the leading interest is CCTV and border surveillance; see where the priorities are. One last comment: for good happen, one needs leadership that has clear goals and drives persistently to achieve those goals. The improvement of traffic condition under Michuki was deliberate and persistent. For this to work, I suggest the following to take place at the new County levels: 1. Digitize all driving records in the county, and register drivers based on their county of residence and to link the driver record to traffic offenses (point system for drunk driving, speeding, and any other traffic violations) 2. The digitized licenses should hold such information as a requirement to wear glasses when driving, etc 3. Provide a platform, and requisite training for traffic police to log and tag traffic offenses (real-time) to a central county database which the insurance companies can reference before renewing the drivers insurance policy. 4. Register vehicles (tags-number plates) based on the county of residence of the vehicle owner against the owners drivers license, renewable yearly (even through in an emissions test program-we'll all breathe easier and rid of jalopies) 5. Like Andrea has stated, dedicate lanes for trucks, high occupancy vehicles, etc 6. Implement a functional highway patrol department , that warn motorists of broken down vehicles, tow them away at a fee, rescue stranded motorists at a fee, etc (more revenue for the county) 7. With all the above in place, employ technology like red-light cameras that automatically takes a photo of the vehicle tags whenever you jump a light, and attach this to the vehicle records, and by default the primary registered driver of the vehicle, and the next time they try to renew, they be forced to pay the fines from their many offenses. 8. Do we have a new policy in this forum?

Dear Listers, I recently posted an enquiry/observation on KICTB on its seeming reluctance to inform the public on EOIs advertised. Somehow, this posting did get to my email, but not to other members who have a lot of interest in this subject. Below is the message I had posted: At the risk of no longer being invited to participate in events organized by the agency, it has been quite interesting to note that despite many queries on updates on EOIs issued by the KICTB, there seems to be very few updates on the progress of such. A case in point is the "EXPRESSION OF INTEREST (EOI) FOR CONSULTANCY SERVICES ON INTERNATIONAL IT INVESTMENT AND OUTSOURCING COUNTRY POSITIONING"- a subject that is critical to my organization and many in this forum. Myself and others have been asking whatever happened to this as there is very little communication around it. Was this EOI cancelled, awarded? It is interesting to note that despite the fact that KICTB is the ICT champion Kenya (with budgets), little information is available even on their website! I guess we'll keep wondering. So, was this message stripped and not delivered to members? Maybe the moderator can help out on this. Ed
