There is certainly a lot of movement in the right direction in Kenya, but a whole lot is yet to be done especially around policy. I had a discussion recently with a leading private network operator who believes that there is a lot hidden demand for broadband in the East African market and are prepared to invest a lot of money in a combination fiber optic access networks and Wi-Max to bring broadband to cities of the region. The operator is also making advance plans to tap into the planned East African Submarine System (EASSy) and connect some cities of the region to the world via cost effective and high bandwidth fiber. It should soon be available at www.InternetGovernance.org November 23, 2005 An Assessment of the WSIS-2/Tunis '05 Outcomes The outcomes of the Tunis World Summit on the Information Society (WSIS) are significant -- and rather surprising. ICANN emerges from the summit both unchanged and significantly different. After WSIS it has a stronger claim to legitimacy. ICANN emerged unchanged, in that its institutional structures - most notably its mechanisms for political oversight - were not amended. ICANN continues to operate under the formal authority of a single government, the US. Such a unilateral globalization model is a novel arrangement, quite unlike what is used in other global sectors (e.g. telephony or communication satellites.) The US continues to exercise a kind of unipolar authority it does not have in physical space. But ICANN also emerges from WSIS radically different: it is now endowed with a greater degree of legitimacy. Over a period of four years the UN family of nations intensely scrutinized ICANN, Internet governance, and unilateral US oversight, and they came to a decision: they declined to change ICANN's structures. Whereas US control was previously the product of a unilateral assertion, it is now the outcome of a lengthy process of scrutiny by all nations. Thus ICANN's greatest weakeness - its lack of legitimacy and its related lack of support from governments around the world - is less after WSIS. From now on, governments that criticize ICANN are criticizing an arrangement that they themselves reviewed and left unchanged. The WSIS decision cannot really be called an endorsement of ICANN. The text nowhere mentions ICANN by name, and there is no real declaration of support. Still, the UN has decided not to act against the organization, and this collective inaction is the final word after years of debate. The Internet Governance Forum Another important WSIS outcome is the launch of the Internet Governance Forum (IGF). Two features characterize the IGF. First, it is a multi-stakeholder forum. Although a creation of the UN, the forum membership will include more than just UN member states; participating equally will be entities from the private sector and from civil society. Second, the forum has no concrete power. It is an advisory body. Its member will discuss and formulate collective recommendations, but those recommendations will not carry the weight of policy. Still, the forum could become powerful. A forum is a prerequisite for collective action at the global level, making possible communication, interest aggregation, bargaining, and decision. WSIS was itself a forum, and it made possible certain collective decisions of great political import. (For more on the functionality of forums see the article "Understanding WSIS" in the journal Information Technology and International Development.) If the new forum makes continued collective decision-making possible, it could be a powerful entity. Its recommendations could be formalized by national governments. Still one might ask, what is new about this forum? ICANN already has advisory committees for governments and for civil society members, and the private sector controls its board outright. Why create another mechanism for formulating advice? The answer is that this new forum will primarily have a policy focus. Whereas ICANN's bodies ostensibly focus on technical coordination, the IGF will focus on all issues of Internet governance. This dual arrangement formalizes the questionable division of Internet governance into two domains: ICANN's domain of technical coordination and the IGF's domain of public policy. It risks validating the inaccurate claim that ICANN is a purely technical body without policy-making content. Implications: ICANN and IGF In an earlier analysis entitled "ICANN Reform: Establishing the Rule of Law" I argued that ICANN needed a legislative mandate. It now has some of that. The Tunis documents are a major step in that direction. The locus of policy making will now shift. Fundamental disputes about ICANN's structures of policy-making have been settled (at least for now.) The next step is to work within those structures. WSIS defined two forums for policy making: ICANN, for matters of technical coordination, and the IGF, for everything else. In the short term, most Internet governance activity will switch to ICANN, where debates will occur within the ICANN structures. They will focus more on substantive issues relating to technical coordination. Of particular note is ICANN's Governmental Advisory Committee (GAC). The GAC is the forum where governments have the opportunity to look in on ICANN decision-making and offer their advice. It will likely become a much more important body - perhaps the most important body - in ICANN. At WSIS governments made it clear that they want a greater voice in ICANN decisions, and the GAC will be the vehicle for that. Thanks to WSIS governments now know a lot more about ICANN issues, so their participation should be more informed and effective. Civil society does not have a strong base within ICANN. The Non-Commercial Users Constituency (NCUC) operates at a disadvantage vis-à-vis the multiple commercial constituencies. Even weaker is ICANN's At Large Advisory Committee (ALAC), which is a pale shadow of the earlier user representation on the board. Ever since business and technical interests eliminated elections, civil society participation has been constrained. Outside of ICANN, the Internet Society (ISOC) is not a reliable home for civil society. Since 2002 business interests control ISOC by virtue of having rewritten its bylaws in a manner similar to ICANN. ISOC, however, still claims to be a civil society organization. What user organizations are in ALAC are mostly sub-units of ISOC. In summary, the situation for civil society in the post-WSIS ICANN is a major source of concern. A top priority for civil society should be reforming ALAC. With ICANN confirmed as the one operational institution for global Internet governance, civil society should develop a more effective voice there. Investing in ALAC and NCUC is one way to achieve that. The second forum emerging from WSIS is the Internet Governance Forum. The IGF can be thought of as a continuation of the WSIS, since it provides a place for multistakeholder discussion of a very large number of issues. The key question here is whether governments embrace it. With GAC already established and offering a rich agenda, some governments may question the utility of a second advisory forum. Industry interests are likely to be cool to the IGF, since they have so much more influence in ICANN. Civil society, with its weak base in ICANN, may have the most at stake in the IGF, but they may not be able to make it succeed without the commitment of those other stakeholders. Conclusion Before WSIS ICANN was a sort of Frankenstein organization created in the basement of the US Department of Commerce. No formal delegation of authority from the US Congress authorized its exercise of public powers. Nor did its global elections give it legitimacy, since they were canceled before full implementation. Now ICANN can claim some degree of public authority. Many people may regret the UN's implicit endorsement of ICANN, but no one can easily dismiss the validity of the process. ICANN is the same but different. The next step in the policy process will be to work within its structures. There is one additional possibility, not mentioned above, that looms over Internet governance: technology re-design. With WSIS leaving ICANN in place, those dissatisfied with ICANN are likely to move away from a political strategy. Instead, they may see more promise in trying to eliminate the single root. One example in this trend is the Open Root Server Network (orsn.org) which is creating a parallel network of servers that are autonomous of ICANN. With such innovations in place, the power in controlling the authoritative root server is reduced. In the near future, it will be interesting to see how many groups propose technical innovations that effectively decentralize the root. The initiative is derived from the need to build awareness about the internet and make it a global resource available to the public. The committee reaffirmed the commitment of governments to empower young people as key participants in building an inclusive information society. It also resolved to actively engage youths in innovative information and communication technology (ICT) development programmes. Delegates agreed to strengthen the protection of children from abuse on the internet and defend their rights in the context of ICTs. The Sub-Committees final document, the Tunis Commitment drafted as part of its deliberations, included a section emphasizing that the best interests of the child are a primary consideration. Officials also reaffirmed their commitment to build a people-centred inclusive and development-oriented information society. Discussing mechanisms to finance the development of ICTs, the Sub-Committee highlighted the need for adequate and sustainable investments in ICTs to bridge the digital divide. Delegates urged the international community to promote assistance to poor countries, by meeting the funding needs of the developing world, especially those facing stiff challenges in the development of ICT. The committee agreed that the transfer of technology and capacity building would work effectively over many years. They unanimously agreed on the efficacy of the Digital Solidarity Fund (DSF), established in Geneva, Switzerland, two years ago, as a voluntary mechanism for transforming the digital divide into a digital opportunity for the poor nations. Government ministers and senior officials have for the past three days been attending sessions at the Palexpo Kram in Tunis where the three-day World Summit on the Information Society begins today. WTO MC6: Whose Trade Organization? When WTO Director-General Pascal Lamy addressed us yesterday at the Inaugural Session of the WTO Sixth Ministerial Conference, he said he was impressed with the outstanding work Hong Kong had done to prepare for the conference. "The facilities, the logistics and most importantly, the hospitality have been quite extraordinary," he said. He noted reaching agreement in the WTO is difficult because it is a bottom-up process. A Tribute to Eng. Rege

Even as yesterday's cabinet list continuous to remain fluid, I wish to take this early opportunity to register my appreciation to one Eng. Rege who was until yesterday evening the Permanent Secretary at the Ministry of Information and Communication, Gov. of Kenya. Tremendous progress was made during his tenure - particularly of cultural nature where he cultivated an unprecedented Public-Private Sector relationship in within the ministry and the industry in general. Beyond just preaching transparency and accountability, he actually managed to practice it within an environment that has long been accustomed to hiding behind beauracratic protocols. Long live this spirit that he leaves behind at the Ministry of Info & Comm. walu.

Now that the pornographic .xxx domain seems to have been 'veto-ed' due to US-Bush influence I find myself wondering if this was good or bad. Don't get me wrong, I do not recommend porn, however, this veto-power that the US seems to hold over ICANN is what I believe got the rest of the world worried. Source: http://www.panos.org.uk/iwitness/summit/shanmugavelan.asp WSIS is over, but the debate has just begun Murali Shanmugavelan The big relief is that the debate around the information society no longer needs to be tied to the WSIS process, said communications expert David Souter at Panos Londons final briefing in Tunis. Very true. The information society is broader than the agenda of the World Summit on the Information Society (WSIS) could ever have hoped to cover. And the resulting non-binding Tunis Declaration has produced little in concrete terms for developing countries. Everyone knew this before the Tunis phase of WSIS even started. So why did some 20,000 delegates bother to turn up? At the end of the day, was it worth it? Was it worth it? There is no doubt that WSIS has provided a valuable backdrop for civil society organisations (CSOs) that have been working on information and communications issues for the last 25 years. Seán Ó Siochrú, spokesman for Communication Rights in the Information Society, pointed out that the Summit process has helped us to refine our communication rights arguments by learning from different CSOs around the world. The context offered by WSIS together with the very information and communication technologies (ICTs) that dominated the Summit have helped CSOs to share their experiences more than ever before. WSIS provided a unique platform for governments, donors, activists and practitioners to come together and understand each others points of view. The participation of various heads of state and high-level diplomats signified the political importance of WSIS. But the commitments adopted at the Summit are largely meaningless unless national governments take initiatives to implement them. Challenges such as promoting good governance and transparency through the use of ICTs, or increasing access to information for the poor and the marginalised, require clear policies and actions. An international meeting such as WSIS can provide ideas and encouragement. But it cannot force governments to fulfil their promises (the host countrys poor record on media freedom being a case in point). Changes at a national level require political will, and civil society has a crucial role in influencing governments and holding them accountable. Beyond technology This brings us to the next issue: the de-politicisation of information society issues. Most ICT projects from telecentres to community media centres are isolated from other social and political processes. But information and communication flows are all about democracy and participation, and not just about making technologies available and affordable. It is widely acknowledged that good governance is key to the success of Poverty Reduction Strategies and other development approaches. And ICTs can be instrumental in helping to eliminate intermediaries, increase transparency and hold local governments accountable. At the same time, the credibility and usefulness of ICT-enabled development projects can only be fully realised when the poor and marginalised are able to use these tools to voice their needs and access their entitlements. For example in some Indian states computerisation has greatly simplified the issuing of birth and death certificates, which would otherwise cost individuals two days (without pay) plus bribes for local civil servants. We need more examples of ICTs applied at the grassroots level to demonstrate the real power of the information society. Unfortunately the Tunis ICT 4 All exhibition failed to deliver on this front. Instead there was a fascination among both participants and exhibitors with cutting-edge technologies and gadgets one of highlights being a project that aims to provide every poor child with a laptop. The Economists annual foresight report is optimistic about this $100 laptop, saying that cheaper technology will bring hope to the worlds poorer countries in 2006. It is certainly a great idea, but we will have to wait and see if it works in practice. This is not a criticism of technologies per se. But there is, perhaps, a greater need to invest in infrastructure (including electricity and roads) and internet backbones to make the information society work. What lies ahead The so-called Summit of Solutions has failed to produce anything concrete, and in truth no one expected it to. In the end only one issue commanded substantive debate at WSIS: internet governance. It was agreed that the question of political legitimacy whether or not the US should control (or oversee) the internet be handed over to a new Internet Governance Forum, a partnership between governments, CSOs, business and inter-governmental organisations whose role remains vague. Meanwhile, on financing and infrastructure, WSIS was essentially used as a platform for donors and international agencies to launch new activities in rolling out investments in infrastructure. The real work lies ahead on two levels. Internationally, some of the debates emerging from WSIS, such as proprietary software and intellectual property rights, will be discussed in other intergovernmental forums such as the World Trade Organisation. Nationally, CSOs and others will have to take note of the fact that efforts to build an inclusive information society are influenced by many non-ICT policy instruments. For example, the right to equality has a direct bearing on womens participation in the information society. Similarly the right to assembly and free speech cannot be overcome by merely bridging the digital divide (as demonstrated by China, which has the largest number of mobile subscribers in the world), As with the first phase of WSIS, only lip-service was paid to the role of the media in the making of the information society. Indeed, Panos was one of the few organisations highlighting the importance of including the media in the debate. CSOs and others would do well to reflect on how they engaged with the media at WSIS. After all, freedom of expression and information and the fight against corruption have historically been core issues for the traditional media. Ultimately, for any of these issues to be moved forward, the media must be regarded as a key partner in the information society.
