One notable difference from South Africa that is emerging in the Kenyan case is that the Kenyan regulator intends to assume its regulatory oversight over the dot.KE name space. This is as per the amended, Kenya Information Communication Act, 2009 and as recently emphasized in a post to the KICTAnet list by the CCK communication manager, Mr. Christopher Wambua. It will be interesting to see what role KENIC will be left to play, once this de-facto, self-regulation practice is taken away.In yet another posting to the KICTAnet list, Prof. Jimmy Macharia, the current KENIC Chairman envisions KENIC retaining its administrative control over both the ccTLD and the Second Level Domains. Network operators in Italy have concrete plans to cover roughly 50% of the Italian population with fast broadband based on FTTCab/VDSL2 technology between now and roughly 2017. In contrast to the recent past, these plans are credible, and deployment is demonstrably moving forward. Given Italy's favourable characteristics (i.e. a network structure with short sub-loop lengths), these lines will be able to deliver well in excess of the 30 Mbps required by the second of the DAE broadband objectives. There are risks that the plans will not be carried through to completion. There are serious operational and regulatory challenges. Nonetheless, we consider the plans to be credible overall. In and of themselves, these plans will not achieve the DAE Objectives. * There are no solid commitments to cover more than 50% of the population with fast or ultrafast broadband. * The current plans of the network operators do not address 100 Mbps service; with expected improvements in technology, however, it is likely achievable. * Even if most lines were able to provide 100 Mbps service (and bearing in mind that 50% penetration requires considerably more than 50% coverage), there are problems with consumer demand that would need to be addressed in order for the adoption target (DAE Objective 3) to be achieved. In the absence of committed, energetic and sustained attention by the Italian government, DAE goals will not be fully achieved. We therefore urge the Italian government to take proportionate, appropriate steps to deal with each of the gaps within the authority available to it, with due respect for the respective competencies and independence of the European Union and of Italian regulatory and competition authorities. The following would be appropriate: * Comprehensive analysis, planning and monitoring of the investment required and of investments made to achieve DAE broadband objectives, taking a balanced approach between fixed, mobile, fixed wireless, and even satellite resources, and also considering not only supply side factors but also the demand side. * Provision of sufficient additional funding to close coverage gaps, drawing on European Structural Funds and other sources, based on the results of the analysis, planning and monitoring function. Attention at regional level is warranted. Compatibility with European State Aid guidelines is required. * Measures to drive down deployment costs, including initiatives to enhance the radio spectrum and to enhance the efficiency of spectrum use; and promotion of infrastructure sharing, to the extent permissible under European State Aid and competition guidelines. * Measures to correct lagging demand for broadband services in Italy, including digital literacy programmes. I have consulted and wish to respond as follows; Save for what amounts to your consistent hate-speech against Cofek on diverse occasions, we do welcome your criticism in good faith. Our concern was on the commercial end of the stick and not the technical side where you are certainly an expert without question. We are not as good. But even as an IT expert, whenever you fall or will ever fall sick, you don't need a degree from medical school to rate medical services as a consumer of those services. On the issue of KENIC, where the rubber meets the road is not their back-end knowledge of the industry - but the pricing and quality of service as interpreted by the consumer(s). That it was a mistake for the regulator to have engaged in "business" as a shareholder of KENIC was wrong. We appreciate that CAK wish to have its unspecified volume of shares transferred to KICTA. You probably have seen a separate mail confirming that KENIC are housed by CAK (full-financed by the taxpayer) and have not been paying rent. Given the public interest, therefore, it is only fair that the Kenya National Audit Office will peruse the books of accounts of KENIC and make them public before the said transfer from CAK to KICTA. We are, therefore, ready to "embarrass" ourselves by demanding and ensuring, at all reasonable and lawful costs, that KENIC is made much more competitive and that the industry is opened up to other interested parties. That is all we were saying. Finally, allow me to urge that dissenting opinion is embraced on this list. We are ready to learn from each other but let us not dismiss others that they "know nothing ." which generalizations can't be proven scientifically. The kind of e-mob-justice is not healthy. Sound macro-economists will tell you, for free, that you don't protect KENIC market share by locking competitors out especially knowing that they have been there for a while. They possibly are only exploiting less than 5% of their market potential. Imagine if all Kenya "emailers" could dump the insecure Yahoo/Gmails for a Dot Ke . that would be big business for KENIC and her competitors! Dear Listers, As earlier communicated, the Communications Authority of Kenya (CAK) would like to clarify that the proposed licensing framework does not propose the dissolution of KENIC and thus the need for a re-delegation. If anything, the proposed framework seeks to strengthen the governance of KENIC by ensuring that the Board is representative of the local Internet community. The proposed licensing framework envisages an arrangement where KENIC remains as-is (a multi-stakeholder private public partnership) but with Government represented by another entity (Kenya ICT Authority). CAK will relinquish its positions in the KENIC Board and assume a regulatory oversight role. As far as commercialization is concerned, the CAK encourages a business model that will spur the growth of the Dot KE domain name space. It will be upon the new entity to devise such strategies. With regards to the transition, the relevant processes will be followed to ensure that the transition is not only smooth but within the law. I also wish to assure listers and stakeholders in general that CAK shall take into consideration all submissions made in respect to this public consultation. For an informed discussion, we request listers, and the public in general, to go through the draft licensing framework in detail in order to appreciate its context.
