Patrick You raise an interesting issue. However that should not divert us from the main point that Victor is making. Are multi-nationals paying their fair share of taxes? Here' an interesting story that is related to this. Apple's tax headaches <https://www.forbes.com/sites/kellyphillipserb/2016/08/30/apple-found-to-hav…> This problem emanates from the Principle of Transfer Pricing. <https://en.wikipedia.org/wiki/Transfer_pricing> In a nutshell Transfer Price is the *price* at which divisions of a company transact with each other, such as the trade of supplies or labor between departments. *Transfer prices *are used when individual entities of a larger multi-entity firm are treated and measured as separately run entities. This is where it gets interesting:- So let's say Multi-National X has an operation in Kenya but all invoicing is done in say Ireland (sound familiar for those who deal with Multi-Nationals in the Tech Space?) but then the said Multi-National also invoices itself (ok, its 'subsidiary') for 'Management Fees' and other 'expenses'. The ultimate effect is that profits declared are at a minimum. And this practice is perfectly legal. :-) In Apple's case they even went ahead and negotiated a minimum tax of 3%!!! Safaricom and Internet Traffic Tampering

Hello listers. CIPIT has been conducting network measurements on Kenyan Internet Service Providers (ISPs) since June 2016 using assorted techniques. Between 6 – 10 February 2017, the data indicated the presence of a middle-box on the cellular network of one provider, Safaricom Limited (AS33771) that had not previously presented any signs of traffic manipulation. Middle-boxes assume dual-use character in that they can be used for legitimate functions (e.g., network optimisation) and can simultaneously be used for traffic manipulation, surveillance and aiding censorship. In light of such dual uses, this report makes clear that service providers operating middle-boxes must communicate to the public in a transparent manner the justification for such activity. This is especially relevant as government bodies announce plans to monitor and possibly censor the Internet during Kenya’s current electoral processes. Alex Mutuku: Computers and Cybercrime Bill

Assuming that Alex Mutuku managed to siphon KES 4B from KRA (and perhaps some from NTSA and any other govt computer system), I am at that point where I have to ask what is the role of the Govt ICT Services (there is a body like that, yes?) or it is that KRA/NTSA/Other govt agencies run their own ICT Services without a central coordinating agency that standardizes on procedures/policies? If it's true that there was this heist at KRA, then I see no reason not to suspect there are (will be) other heists in other govt agencies, hence my question. Secondly, I remember about the Computers and Cybercrime Bill 2016. I think it was shelved, or maybe just gathering dust somewhere, or was it ultimately signed into an Act? Did it become law and so forms the basis upon which Alex Mutuku is being charged?? During the Ndemo days, I would expect to get a comprehensive response to the two questions above in just a few hours. In this era Sammy Itemere+Victor Kyalo, it's just so silent. Using Third Party VPNs on Safaricom Mobile Data

So I’ve been testing use of my 3rd party VPN on Safaricom, and not been able to. Interestingly, this is what Safcom agents told me today: https://twitter.com/ninanjira/status/844115331421487104 <https://twitter.com/ninanjira/status/844115331421487104> Basically, that VPN use on Safcom is a provision that you pay for, and that is tailored for organizations. Additionally, this is apparently in the T&Cs; I’m awaiting more information on which specific clause addresses this. To me, this has interesting implications. That is, in the event of, say, a shutdown, one can’t bypass the block using their Safcom mobile data… If you are a VPN user, try it on your mobile data and let me know what happens. I can use VPN on other mobile data networks (e.g. Airtel). Listening.
