Listers, This is indeed good news. We have a lot of hope in Mucheru and Victor Kyalo industry veterans who have indeed worked their way through the trenches. Most importantly we hope to see the return of a multi stakeholder form of engagement in the sector which we have been yearning for in a while. I think as a sector we might need to prepare a wish list for our new leaders and most importantly commit to work with them towards achieving their mandate. The reshuffle is timely still it comes at the end of the year and will allow us to start 2016 on a new slate. Which laws will need to be amended when data protection bill is passed?

Dear listers, The above question follows another review of the proposed data protection bill that lists several laws which will require amendment when the law is enacted. For example the Registration of Persons Act (ID Card law) will need an additional provision on how data protection will apply to ID data. Other laws listed include: Registration of Persons Act; Births and Deaths Act; Capital Markets Act; and Access to Information Act. Are there other laws that are missing from this list? The new policy will home in on “dehumanizing” speech because “language that makes someone less than human can have repercussions off the service, including normalizing serious violence,” Twitter executives wrote in a blog post on Tuesday. If this was the position of one of the Government Agencies, the hue and cry on freedom of speech, freedom of expression etc would've been drowning. What should happen to personal data when someone dies?

Listers, As we continue to discuss the data protection bill, an issue that has come up and is not captured in the proposed laws is the issue of legacy. For example, a viral clipping in social media has a newspaper report stating that a woman who was recently murdered was HIV positive. Normally, HIV status is sensitive personal information that would not be disclosed. Which begs the question, what should happen to personal data on the death of a person? Should we treat data as property that is transferred during succession or should anyone with a legitimate interest be able to access it? Should data processors/controllers have to delete such data? Good evening Listers, Hope you are having a good weekend. => Ill be short and to the point: Say there is a large residential neighbourhood V.R. With a significantly large number of tenants: => Then a provider S, who wields considerable sway on the management of V.R. => Lets say there are clients , living in V.R who are interested in getting service from a different provider B. and B, on approaching V.R is told that they have signed an exclusive deal with S, to disallow anyone from accessing the market at V.R. It obviously can be argued either way considering there is a Willing Buyer, Willing Seller agreement there, But What exactly does CA have to say about this? I ask because some providers wield enough financial muscle to actually buy out my County and sign an exclusive deal with my Governor, preventing me from operating in my own backyard…. I could not trace the current constitution of KENIC to ascertain how the current chairman of the KENIC board is appointed but previously, KENIC has served as the best reference point for multi-stakeholder governance systems. Intermediary liability law in African countries (and the AU)

Greetings everyone, I am new to the channel, so apologies if I have missed any relevant discussion on this. I signed up to consult this group on recent developments on intermediary liability in Africa. As you might know, APC had a few papers in 2012 on intermediary liability in Nigeria, Kenya, South Africa and Uganda <https://www.apc.org/en/node/15623/>. I also wrote for them a report on best practices for intermediary liability in 2013 <https://www.apc.org/sites/default/files/APCInternetIntermediaryLiability_Be…>. Following from that, I have been recently contacted to write a chapter for an upcoming Oxford handbook on intermediary liability, which looks back into developments on the subject over the last few years in Africa (2012-2018). I want this to be as complete and accurate as possible, but the material I have been able to find online regarding new laws and court decisions is rather limited. I would therefore be very grateful to any of you who took the time to share, *in or off-list*, *notable developments in your country relating to liability of intermediaries* (in a broad sense: digital platforms, but also ISPs and other types of intermediaries, e.g. registrars and domain name operators, or payment companies). I would also be curious to hear of *any regulation or policy coordination relating to intermediaries in the context of the African Union*, which at the time I wrote the 2013 paper appeared to be a suitable forum to develop some common principles in this field. Has anything happened on that front? Thank you really very much in advance for anything you're able to contribute. Dear Listers, Here is an excerpt from the President’s Memorandum which is up for consideration before the National Assembly tomorrow. He proposes taxation of telephone and internet data services. Safaricom, Airtel, Telkom etc do you have a projection of what this could mean for your consumers? Now I am only but a simple lawyer, but I would think that this will enlarge the chasm between the haves and have nots in an already inequitable country. I wonder what this will mean for data costs, internet access and penetration levels, innovation, employment (esp for the youth) and generally keeping up with the new age. It was laughable when this was happening in Uganda, little did we know we were up next.
