Digital to Analog Conversion

Hi, When the migration from analog to digital was initially raised fear was put into the public on how there would be no option but to throw away our analog TV sets and replace them with Digital. Now that digital transmission is finally here we need to look at how to make the migration as painless as possible while at the same time we do not disenfranchise any citizens. It has been mentioned that there are over 1 million TV sets in Kenya today, that means 1 million digital to analog converters will be required over the next 2-3 years. I believe this is a great opportunity for us to go into the electronic assembly business, I would like to propose that we 1st increase duty on converters from the current 35% to 250% so as to discourage the importation of the converters. Then exempt from duty and vat all assembly stations, test equipment and components for anyone who sets up a converter assembly plant, with a 3 year tax holiday. If you setup the plant more than 200 kilometers from Nairobi or Mombasa you receive an addition 2 years tax holiday. I believe this will sort out the issue of substandard converters and will also provide an opportunity for us to develop our electronic devices assembly skills. If you make a net profit of 1,000/- there is a clean 875,000,000/- to be made, close to what the government is spending on purchase of the Malili farm. This is assuming a standard device, there is still a market for those who want high end devices with recording, tuners, USB ports, etc which would mean that the returns could be much higher than projected above. So will we move away from juts being importers and retailers or do we have what it takes to do some value add? Music Piracy in Kenya - Government can Help

Bwana Daktari, The music industry in Kenya is unable to grow. Companies like mine and individuals are investing money in creating music but the same cannot be commercialized effectively. One of the main problems is organized piracy. Take for example the website WAPKID.COM, this website provides almost every Kenyan song FREE FOR DOWNLOAD. The website at the moment lists the following as popular tags - meaning these are the artists whose content is currently heavily being downloaded. I understand that this website is offering pirated content because Music works that is owned and copyright administered by myself is being offered for FREE here - the total investment I made for the songs on offer is Ksh. 5million over the last 2 years and now I have no way to recover my investment by sales since consumers can opt for free. Infact, at one point, one of the mobile operators even sent SMS advertisements to their subscribers urging them to access content from WapKid.com As an industry, we are bleeding and desperately in need of government support to stop this organized piracy that is benefiting local and international organization at the expense of our content and therefore killing and local development of content. As we seek your assistance, we are also doing something on our part. We will be meeting next week Wednesday 3rd October 3pm at Panafric as a music industry (Record labels, Kenya Copyright Board and Music Copyright Society of Kenya) to discuss and work out strategies that can help us especially in creating a clear licensing framework. We will also be announcing an Anti-Piracy Campaign called "iCareforMusic" whose aim is to educate the consumer on the benefits of getting music from licensed partners. We believe that either the government or the courts can issue an order blocking WAPKID.COM, MP3RAID.COM and any other website offering local music from being accessed and this is fairly easy at the ISP level. Before we take to the court route, we wish to seek a diplomatic route first. If we can stop this organized piracy, investing in a song would be worth it for the Artist, the Record Label and/or the music publisher. And in overall, KRA would collect tax from all of us. GSMA: Calls will remain high between African countries By Rebecca Wanjiku, Computerworld Kenya 29 Sep, 2011 The cost of telephone calls between African countries is likely to remain high and international call volumes will drop with the introduction of taxes, according to a report from the GSM Association. Senegal, Ghana, Congo Brazaville and Gabon have introduced taxes on incoming international calls, leading to higher costs for users and reduced revenue and call volumes for mobile operators. The taxes are also likely to reduce foreign direct investments because the costs of operating businesses such as call centers will probably go up. "The tax takes the form of an imposed fixed price that operators must charge for international inbound termination, of which the government takes a set amount," said the report, issued on the sidelines of the U.N. Internet Governance Forum in Nairobi. A private party measures international inbound minutes terminated by operators and bills them accordingly, it said. While the taxes are different in the four countries, the affect on the operators has been the same. In Senegal, call prices rose by 50 percent. In Ghana, prices rose by 58 percent while inbound traffic fell by 12 percent in the six months after the tax was introduced. In Congo Brazaville, the price of inbound calls rose by 111 percent while the volume fell by 36 percent. In Gabon, prices rose by 82 percent when the tax was introduced in August 2011. The report questioned the benefit of the tax on economies, given that half the money collected is shared with the third-party company that monitors the calls. "The main objective of this taxation is to raise revenues for governments, in this case by taxing users calling from abroad into the country, however, the government transfers approximately 50 percent of the revenue from the tax to the external call monitoring party," the report said. "This leakage should be taken into account when assessing the effectiveness and net benefit of this tax." The report projects that other African countries are likely to reciprocate by raising the cost of inbound calls. In Congo Brazaville, an operator reported that an operator in another African country raised call termination charges by 30 percent. while in Senegal, an operator reported that nine operators in other African countries raised rates by 23 to 80 percent, making the call costs very high. The GSMA further noted that many operators are not making profits because the cost of other services and maintaining rural telecoms infrastructure is high. In supporting its case to remove telecommunication taxes, the GSMA released another report that highlights the benefits that Kenya has gained since it zero-rated mobile handsets in June 2009. This year, the mobile communications industry will contribute US$300 million to the GDP and a further $100 million from intangible benefits to Kenyan consumers. The industry also employs 250,000 people in Kenya. "Since June 2009 when the tax was removed, handset purchases have increased by more than 200 percent and penetration rates have increased substantially from 50 percent to 70 percent, this successful policy confirms that consumption taxes can have a significant impact on consumer behavior in Kenya," said the report. ----------------------------------------------------------------------------------- If you have the strength to survive, you have the power to succeed. Hi Listers, I recently met a group of Russian developers who have a GSM base station that sells at a tenth of the mainstream ones as it is based on open source technology. The product could have a massive impact on many of Kenya's far-flung communities as it would allow them to set up community based communication networks especially where the ARPU is too low for the commercial operators to venture. For this to work we need to provide a license free GSM frequency such as the 2.5 ghz that is used for data networks, do you know if there is such a provision in the CCK regulations? Postal Corporation Closing Outlets - regurgitated

Hi, Yesterday PCK launched their payment platform which allows me to regurgitate a post, below, that I did in 2010 when I started my public campaign to be appointed the PMG. At the launch a clear statement was made on how the government will use the PCK infrastructure to deliver its services to the public a position that was many a times reiterated by Dr. Kate Getao the ICT Secretary, her strategy unlike many of the others seems like it will come to pass. The PASHA, Digital Village and most of the other initiatives have all fallen by the wayside and the one that was ever going to be sustainable has emerged victorious, which raises the question of what has changed in the last 100 days? 1. Dr. Ndemo is no longer in charge of the Information ministry (even though the former minister Hon. Pogisho was prominent at the PCK launch) 2. Mr. Paul Kukubo left the KICT Board 3. KICT Board to be placed under the e-Government docket 4. A digital focused President has taken up the reigns 5. This is an indication of a management that has no vision or ambition maybe as a result of using the corporation as a retirement centre. This will avoid the appointment of executives who are more interested in the supply of fuel, tyres and insurance as opposed to moving the organisations to new heights. Implementation of e-mail to mail systems would reduce the costs of transport incurred by PCK which makes up over 60% of their operational costs. Unfortunately most of those who have been appointed to the post of post master general have no appreciation of the role of the postal services in the development of the nation. Do not listen to the myopic stories about the death of the postal service because of e-mail, facebok and twitter as you and I know that a physical item can never be delivered electronically. I believe the appointment of the next post master general and by extension the chief executive of the Kenya ICTBoard and CCK need to include vetting and recommendations from the private sector with clearly defined performance indicators. Search for independent .ke administrator gathers pace (Where to KeNIC)

Listers The Communications Commission of Kenya (CCK) has delinked itself from the Kenya Network Information Centre (Kenic) setting stage for licensing of a new body that will manage and administer the country’s Internet addresses system. Read on:- http://www.businessdailyafrica.com/Search-for-independent--ke-administrator… Further to a blog posting by Wanjiku, this story that appeared online yesterday requires some attention from us as players in the industry. In the last AGM there was a promise to engage stakeholders to map a way forward on this issue. Stakeholder engagement is critical to ensure we don't run afoul of IANA and ICANN rules and regulations regarding redelegation (if it comes to that) of the .ke ccTLD. One thing that is coming out of this is definitely a positive and I salute CCK for moving boldly on this.This is the issue of Corporate Governance and whether as a regulator they should have a sit at the table in the running of KeNIC. Having said that, the unilaterally pronouncements from the CCK on the future of KeNIC doesn't auger well for the ccTLD. It is as if CCK has decided it is the 800 pound Gorilla (ok..admittedly it is by all intents and purposes) and what it says goes..and be damned the other stakeholders. Do I hear the word impunity? I urge the current KeNIC board (of which CCK is a member) to keep their promise of engagement and inclusiveness. They will be surprised at how receptive the community is to ensuring that .ke grows from strength to strength..if it means that this will be the end of KeNIC then so be it. Good morning Listers Further to the announcement we made last Friday, we now commence this one week discussion on the African Union Convention on Cyber Security(AUCC)http://pages.au.int/sites/default/files/AU%20Cybersecurity%20… on multiple lists of KICTANet and ISOC-KE, in Kenya and on I-Network list moderated by the Collaboration on International ICT Policy in East and Southern Africa (CIPESA) and ISOC -Uganda. Background to the African Union Convention on Cyber Security (AUCC) African Union (AU) convention (52 page document) seeks to intensify the fight against cybercrime across Africa in light of increase in cybercrime, and a lack of mastery of security risks by African countries. Further, that one challenge for African countries is lack of technological security adequate enough to prevent and effectively control technological and informational risks. As such “African States are in dire need of innovative criminal policy strategies that embody States, societal and technical responses to create a credible legal climate for cyber security”. The Convention establishes a framework for cybersecurity in Africa “through organisation of electronic transactions, protection of personal data, promotion of cyber security, e-governance and combating cybercrime” (Conceptual framework). As an additional reference to the earlier ones, please find attached a letter that was sent to the AU by the Center for Intellectual Property and Information Technology law and Strathmore University school of law. We begin the discussion with Part 1 on Electronic transactions. Today, we will discuss two out of four articles from this section. Section III: Publicity by electronic means Article I – 7: Without prejudice to Article I-4 any advertising action, irrespective of its form, accessible through online communication service, shall be clearly identified as such. It shall clearly identify the individual or corporate body on behalf of whom it is undertaken. Question: Should net anonymity be legislated? If so, what measures need to be or not be considered? Question: Should individuals or companies be obliged to reveal their identities and what are the implications? Article I – 8: The conditions governing the possibility of promotional offers as well as the conditions for participating in promotional competitions or games where such offers, competitions or games are electronically disseminated, shall be clearly spelt out and easily accessible. Question: Should an international (or should we call it regional) law legislate on promotional offers and competitions offered locally? Over to you Listers. @Liko, @Eng Karuiki, Recall that this local hosting/ cyber security is not my ideal position. Just a consensus understanding I picked from my long online argument on the same with Sammy B. But maybe we can use the defamation example. If I defamed someone on a blog hosted locally, it is easier to enforce a pull-down order from a local court as oppsed to if the content sits abroad and physically under a different jurisdiction. Enforcement is therfore easier because one can walk up to the server room and make arrests if the techies decline to implement an order. @Eng Kariuki, I think i have partly answered this in an earlier post. Basically, if the digital content is within your physical or geographic domain, it is easier to quickly deal with the security breach...e.g by locally implementing shutdown procedures. Bwana CS Incase you missed my last posting on this issue. Listers I little bird mentioned to me today that the ICT Ministry is about to sign the ITRs that Kenya declined to back in Dec 2012. As a member of the delegation that went to Dubai we fought hard to ensure that we didn't sign and that there was adequate representation across Government and the private sector. There were pre consultations both off and online and the CCK actively engaged with other stakeholders. Ultimately there were divergent views and the head of delegation declined to sign the ITRs. If it is true then I personally appeal to Dr. Matiangi as the head of the Ministry to please update us on this issue. Dear Dr. Matiangi and Listers, Please find the comments by DotConnectAfrica on the entire Draft African Union Convention on the establishment of a Credible Legal Framework for Cyber Security in Africa. DotConnectAfrica took initiative, analyzed and published these comments to the draft convention over a month ago in October 2013 and circulated it to interested stakeholders. Also the selection of the membership to the protection authority should allow composition from all stakeholders and not only government. ‘Sworn Agents’ should be well defined and described, their mode of selection, duties, responsibilities should be open to public accountability and transparency. The mechanism so established shall ensure that any data processing, in whatsoever form, respects the freedoms and fundamental rights of physical persons while recognizing the prerogatives of the State, the rights of local communities and the target for which the businesses were established. Question: What is the relevance of this article? What are these state prerogatives? And given the increased interest of state surveillance, how can states balance respect of FOE while recognising state prerogatives? Article II-6, II-7, 11-8, II-11, II-12, II-13 refer to a Protection Authority which is meant to establish standards for data protection. Article II – 14 provides for each Member State of the African Union to establish an authority with responsibility to protect personal data. Online debate on African Union Convention on Cyber Security (AUCC)

Good morning Listers We would like to propose an online discussion on the African Union Convention on Cyber Security(AUCC)http://pages.au.int/sites/default/files/AU%20Cybersecurity%20… on multiple lists of KICTANet and ISOC-KE, in Kenya and on I-Network list moderated by the Collaboration on International ICT Policy in East and Southern Africa (CIPESA) and ISOC -Uganda, starting from Monday 25th to Friday 29th November 2013. We have been in discussion with AUC and the drafters have accepted to receive our input despite having gone through this process two years ago with African governments. In light of this window of opportunity, we suggest we engage. AUC will discuss the convention during the AU ICT week scheduled for December 1-6, 2013http://www.africanictweek.org/ For Kenya, it is important that we engage, the reason being that if Kenya signs into this convention in January 2014, it will become binding as stipulated in Kenya’s 2010 Constitution Article 2 (6) which states: Any treaty or convention ratified by Kenya shall form part of the law of Kenya under this Constitution. The Convention is therefore more like a Bill of Parliament. 1. Background to the African Union Convention on Cyber Security (AUCC) African Union (AU) convention (52 page document) seeks to intensify the fight against cybercrime across Africa in light of increase in cybercrime, and a lack of mastery of security risks by African countries. Further, that one challenge for African countries is lack of technological security adequate enough to prevent and effectively control technological and informational risks. As such “African States are in dire need of innovative criminal policy strategies that embody States, societal and technical responses to create a credible legal climate for cyber security”. The Convention establishes a framework for cybersecurity in Africa “through organisation of electronic transactions, protection of personal data, promotion of cyber security, e-governance and combating cybercrime” (Conceptual framework). 2. Division of the Convention Part 1 Electronic transactions Section I: Definition of terms Section II: Electronic Commerce (Fields of application of electronic commerce, Contractual responsibility of the electronic provider of goods and services). Section III: Publicity by electronic means. Section IV: Obligations in electronic form (Electronic contracts, Written matter in electronic form, Ensuring the security of electronic transactions). Part II PERSONAL DATA PROTECTION Section I: Definition Section II: Legal framework for personal data protection (Objectives of this Convention with respect to personal data, Scope of application of the Convention, Preliminary formalities for personal data processing). Section III: Institutional framework for protection of personal data (Status, composition or organization, Functions of the protection authority). Section IV: Obligations relating to the conditions governing the processing of personal data (basic principles governing the processing of personal data, Specific principles governing the processing of sensitive data, Interconnection of personal data files). Section V: The rights of the person whose personal data are to be processed (Right to information, Right of access, Right of opposition, Right of correction or suppression). Section VI: Obligations of the personal data processing official (Confidentiality obligations, Security obligations, Conservation obligations, Sustainability obligations). PART III – PROMOTING CYBERSECURITY AND COMBATING CYBERCRIME Section 1: Terminology, National cyber security framework, Legislative measures, National cyber security system, National cyber security monitoring structures). Day 1 Monday 25/ 11/2013 We begin with Part 1 on Electronic transactions and pick on four articles which we will discuss on Monday (25/11) and Tuesday (26/11). Section III: Publicity by electronic means Article I – 7: Without prejudice to Article I-4 any advertising action, irrespective of its form, accessible through online communication service, shall be clearly identified as such. It shall clearly identify the individual or corporate body on behalf of whom it is undertaken. Question: Should net anonymity be legislated? If so, what measures need to be or not be considered? Question: Should individuals or companies be obliged to reveal their identities and what are the implications? Article I – 8: The conditions governing the possibility of promotional offers as well as the conditions for participating in promotional competitions or games where such offers, competitions or games are electronically disseminated, shall be clearly spelt out and easily accessible. Question: Should an international (or should we call it regional) law legislate on promotional offers and competitions offered locally? Day 2 Tuesday 26/11/13 Article I – 9: Direct marketing through any form of indirect communication including messages forwarded with automatic message sender, facsimile or electronic mails in whatsoever form, using the particulars of an individual who has not given prior consent to receiving the said direct marketing through the means indicated, shall be prohibited by the member states of the African Union. Article I – 10: The provisions of Article I – 9 above notwithstanding, direct marketing prospection by electronic mails shall be permissible where: 1) The particulars of the addressee have been obtained directly from him/her, 2) The recipient has given consent to be contacted by the prospector partners 3) The direct prospection concerns similar products or services provided by the same individual or corporate body. Question: Is this a realistic way of dealing with spam? Article I – 27 Where the legislative provisions of Member States have not laid down other provisions, and where there is no valid agreement between the parties, the judge shall resolve proof related conflicts by determining by all possible means the most plausible claim regardless of the message base employed. Question: What is the meaning of this article and is it necessary? Some clarity needed! Day 3 Wednesday 27 /11/13 Today, we move onto PART II: PERSONAL DATA PROTECTION and will deal with three questions. Objectives of this Convention with respect to personal data Article II – 2: Each Member State of the African Union shall put in place a legal framework with a view to establishing a mechanism to combat breaches of private life likely to arise from the gathering, processing, transmission, storage and use of personal data. The mechanism so established shall ensure that any data processing, in whatsoever form, respects the freedoms and fundamental rights of physical persons while recognizing the prerogatives of the State, the rights of local communities and the target for which the businesses were established. Question: What is the relevance of this article? What are these state prerogatives? And given the increased interest of state surveillance, how can states balance respect of FOE while recognising state prerogatives? Article II-6, II-7, 11-8, II-11, II-12, II-13 refer to a Protection Authority which is meant to establish standards for data protection. Article II – 14 provides for each Member State of the African Union to establish an authority with responsibility to protect personal data. It shall be an independent administrative authority with the task of ensuring that the processing of personal data is conducted in accordance with domestic legislations. In article II-17 states that ‘Sworn agents may be invited to participate in audit missions in accordance with extant provisions in Member States of the African Union’. Question: Considering that this article seems to be tied to the Protection Authority, what is its relevance? And who is a ‘sworn agent?’ What should this authority look like in terms of its composition? Article II – 20: …Members of the protection authority shall not receive instructions from any authority in the exercise of their functions. Article II – 21: Member States are engaged to provide the national protection authority human, technical and financial resources necessary to accomplish their mission. Question: It appears that this Data Protection Authority is envisaged to be fully government supported. Therefore, should we be talking of its independence? In what way should this article be framed so that it ensures independence of the Authority? Article II – 28 to II-34 outlines six principles governing the processing of personal data namely: Consent and of legitimacy, Honesty, Objective, relevance and conservation of processed personal data, Accuracy, Transparency and Confidentiality and security of personal data. Under each of the specific principles, detailed explanation of how each should be undertaken is offered. Question: Is this explanation and detailing of how to undertake each necessary in an international (regional) law necessary or needed? Is this legislation overkill? Day 4 Thursdsay 28/11/2013 Part III Day 4 will focus on PROMOTING CYBERSECURITY AND COMBATING CYBERCRIME Article III – 14: Harmonization 1) Member States have to undertake necessary measures to ensure that the legislative measures and / or regulations adopted to fight against cybercrime enhance the possibility of regional harmonization of these measures and respect the principle of double criminality. We have Kenyan companies building Highways in Botswana. They are led by Njoroges and Kamaus and Ochiengs. It is not a matter of local capacity but complacency and impunity. A contractor is paid according to milestones right? No delivered product no payment. Why would a contractor waste years if he is not getting paid? Best incentive in my opinion. Competition in Kenya’s telecommunications market three years ago triggered a price war, causing a sharp reduction in mobile-phone call rates that led companies to expand into new lines of data business to attract subscribers. “We will become a content provider to several forms of media including TV stations and YouTube,” Collymore said, without providing more details. “People want to decide when they want to consume, they don’t want you to tell them. That immediacy is, I think, how the future will be defined.” Sales growth from M-Pesa, Safaricom’s mobile phone money-transfer system, Internet and text-message services has outpaced revenue from voice for at least the past three years, according to the company’s latest annual report. Listers As Safaricom is in the news again accused of abusing its market power, this time in the mobile money space I think we should now start asking the tough questions:- Should Regulators force interoperability in the Mobile Money & Banking space? Will it spur more usage beyond the normal money transfer services towards a truly seamless and well oiled mcommerce revolution? What are the implications of this if at all the Regulator has the foresight and muscle to force this? How about IP Laws? Will this be unfair to Safaricom seeing as it is that they built this dominant position through sheer hard work and seamless execution of strategy? Listers I little bird mentioned to me today that the ICT Ministry is about to sign the ITRs that Kenya declined to back in Dec 2012. As a member of the delegation that went to Dubai we fought hard to ensure that we didn't sign and that there was adequate representation across Government and the private sector. There were pre consultations both off and online and the CCK actively engaged with other stakeholders. Ultimately there were divergent views and the head of delegation declined to sign the ITRs. If it is true then I personally appeal to Dr. Matiangi as the head of the Ministry to please update us on this issue. We do not believe that these provisions are consistent with basic principles of transparency, due process, accountability, proportionality and the rule of law. The leaked TPP Agreement is a complex set of rights and principles related to IPR and we believe that the current draft reflects a disproportionate balance of rights in favor of intellectual property owners. In addition to other issues, these provisions could also have important consequences for online privacy, a critical dimension in light of heightened awareness worldwide about the importance of protecting the privacy and security of end-users. In particular, with respect to intermediary liability, some of the articles appear to assign new levels of responsibility to private entities and create an environment where content will be subject to extensive filtering. Some draft provisions would impose an unparalleled set of conditions on intermediaries that would allow them to escape liability and could ultimately lead to content blocking and affect legitimate speech and online expression. Such measures are neither new nor original; they have appeared in similar forms in other national or international contexts. On the whole, these measures have proven to be inefficient or unworkable. They have failed to adequately address the stated problems or to provide sufficient answers to the existing challenges. The Internet Society has advocated for intellectual property discussions to adhere to minimum standards of process and substance. In June 2013, we released a paper in which we called on the international community to apply standards such as transparency, due process, accountability and compliance to the rule of law to all intellectual property discussions that relate to the Internet. Similarly, we have been vocal in advancing these principles in various fora, including the World Intellectual Property Organization (WIPO), the Internet Governance Forum (IGF) and the Organization for Economic Co-Operation and Development (OECD). We also joined other organizations (1) in a statement made in 2012, urging the negotiators of the TPP *“to make [the] process more transparent and inclusive, following the multistakeholder model, at least for those chapters of the agreement pertaining to the Internet.”* Throughout this process, the Internet Society has taken the position of not commenting on substantive issues based on leaked texts. At the time, we understood that the leaked texts provided only a snapshot of the issues while many provisions were omitted. The most recent leak, released by Wikileaks, appears to be the complete draft of the TPP’s Intellectual Property chapter and has made us reconsider our position. That we feel compelled to comment on leaked versions of the TPP demonstrates that these basic process standards have been ignored. In an era where the global economy depends on information and networks, we believe that discussions that affect the Internet and its users should reflect these basic principles of transparency and openness. Once again, the Internet Society calls upon the TPP negotiators to abide by standards of transparency as they complete this critical international agreement that will impact Internet users worldwide. We also urge the negotiating parties to reconsider the TPP’s intellectual property provisions and to ensure they don’t have a negative impact on innovation, creativity, prosperity and market participation. Photograph: Ian Waldie/Getty Images From databases to mobile phone apps and SMS systems, GPS tracking and humanitarian drones to biometric registration, new technologies are rapidly becoming central to the delivery of humanitarian and development aid. Refugees fleeing the Syrian conflict are having their irises scanned and their identity documents digitised. Nurses in Nigeria are using SMS systems to communicate HIV test results to health facilities. Cash is being delivered to those living in Kenya's slums through the M-Pesa mobile-phone banking system. The drive behind this technological and data evangelism is well intentioned. The usefulness of these tools has played out repeatedly on the humanitarian stage, be it through the use of Twitter analysis to map the spread of cholera in Haiti or the distribution of smart cards to flood-affected populations in Pakistan. New technologies have made delivering a id faster, easier and cheaper. Yet the technological revolution in foreign aid – like many other well-meaning innovations – is not without risk. A clear implication of adopting new technologies is the creation of previously unimagined amounts of data about the individuals who receive humanitarian and development assistance. Often, the collection and retention of data is an objective of the intervention – as with biometric identity registration systems in refugee camps, for example, or the establishment of a database of HIV-infected pregnant women to monitor transmission rates. But in many more cases, it is incidental to the use of technology. Mobile phones generate call and SMS records that not only contain troves of data, but produce dramatically larger stores of information about an individual's location, routines, contacts and network. When mobile phones are used in health-monitoring programmes, or for crisis mapping of human rights violations, they also facilitate the generation of particularly sensitive information. The collection, digitisation and dissemination of personal data raises serious issues about the ability of humanitarian organisations to protect such information. Organisations of this nature operate in complex environments with outdated information security practices and inconsistent access to electricity. Data protection standards are virtually non-existent and data is shared fluidly between organisations, agencies, donors, and NGOs. Most disconcertingly, data is also often shared with (or accessible by) two entities that do not necessarily operate under the same humanitarian ethics and with the same well-intentioned objectives – the private sector, and the state. There is a real danger that the aid community is laying the groundwork for pervasive – and potentially devastating – surveillance. By encouraging the sharing of incredibly sensitive information through insecure mobile networks, the establishment of national centralised databases of invasive biometric information, the analysis of location data derived from mobile phones, or the use of private-public partnerships to deliver mobile access to financial services, these organisations are providing the building blocks for surveillance states. If governments access this information – either because humanitarian partners provide it to them, or they demand access – they could build profiles based on data about location, ethnicity, religion, gender, land ownership, political affiliation, financial status or health. Victims who report human rights violations might be the subject of reprisals, people living with HIV could be exposed, members of particular ethnic groups monitored. Centralised identity databases have a tragic legacy of being used to facilitate mass human rights violations – look no further than the role of Rwanda's ID cards (pdf) in facilitating the 1994 genocide, or the way in which South Africa's 1950 Population Registration Act laid the foundations for apartheid. Imagine the implications of government access to the data collected by refugee agencies, peacekeeping forces, or NGOs monitoring violence against women. The use of these technologies for the collation of data is particularly worrying given the lack of any effective data protection framework in most developing countries. Of course, such programmes are only possible because of the absence of legal protections; it would be impossible for any European-based enterprise to collect location data on minorities, require SMS-reporting about drug adherence, or establish large databases of sensitive information without safeguards. This illustrates the curious double standard applied to the adoption of new technologies in developing countries and humanitarian emergencies. Whereas similar ID systems, biometric databases, and health registers have met serious resistance in the UK, Germany and Israel, and national condemnation of state surveillance reverberated around the US and Europe in the aftermath of the Snowden revelations, these same surveillance-facilitating technologies are being promoted by foreign aid donors hailing from western states. Funds have even been earmarked particularly for technology-based interventions by the US aid agency USAid, World Bank, the UK's Department for International Development (DfID) and EuropeAid. The very real danger of aid facilitating surveillance was highlighted by the revelation that EuropeAid, to which DfiD is a contributor, has been used to support the security forces of Belarus, Europe's last dictatorship, with the aim of enhancing border security. But the implications of aid are not always so obvious. Whether it might be helping to create a legacy of state surveillance in developing countries is a crucial question that needs to be asked of DfiD and other aid agencies. The road to surveillance may be paved with good intentions, but the warning signs are everywhere. The challenge now is to heed them. For example If money is the problem why not modify the project to fit 20B the budget? I still think 20B would be sufficient if this project was tilted and tweaked towards the form1 student labs or even university students. The idea was noble and timely but execution and target audience for me (not Yawe :-) has always been doubtful. Right now we are told suppliers asked for 32B Ksh and but we had 20B so cancel the project, no questions asked and perhaps wait for 2-3yrs later to read from the Auditor General about how the 20B was (mis?)used. I think the CS for ICT should make a pitch to salvage the project in the modified form - assuming ofcourse the project was truly intended. walu.

Hello All, As described in the introductory email yesterday , we're glad to kick off discussions on this important topic, and look forward to feedback from the wealth of knowledge and experience here. We imagine there's a lot to say on the *Status of Internet Freedom in African Countries, *but let's start with the summary of Freedom House's 2013 *Freedom on the Net *report, which shows the status in some African countries - Nigeria, Angola, South Africa, Zimbabwe, Malawi, Uganda, Kenya, Ethiopia, Sudan, Egypt, Libya, Tunisia and Morocco. As seen in the attached image (below), Sudan and Ethiopia are *not free*; Kenya and South Africa are *free*; while the rest are *partly free*. You can also see an interactive map of African (and other countries) and details of the measurement at http://freedomhouse.org/report-types/freedom-net. With this background, we'd like to start Week 1 by asking for your views on issues of online freedom of expression. However, we'll also look at themes such as Internet Intermediary Liability; censorship and surveillance incidents; regulations, laws and policies governing freedom of expression online; and perspectives on the African Convention on Cyber Security. Safaricom shuts down cash for Bonga Points platform

Safaricom has disabled a phone code that was being used to trade in Bonga Points by a Nairobi-based IT firm. Onfon Media developed the code, *981*400#, that it was using to buy the loyalty points from Safaricom subscribers at Sh0.20 each and selling them for Sh0.35, hence earning a return of 75 per cent. The increased availability of affordable marine fiber optic bandwidth, a rise in private sector investments, the popularity of social media and innovative applications, and increased use of the mobile phone to access the internet, are all enabling more people in Africa to get online. In turn, there are numerous purposes to which users in Africa are putting the internet‐from mobile banking, to connecting with fellow citizens and with leaders, tracking corruption and poor service delivery, innovating for social good, and just about everything else. The increasing usage of the internet, however, has in some countries attracted the attention of authorities, who are eager to provide caveats on the openness of the internet and the range of freedoms which citizens and citizens’ organisations enjoy online. The popularity of social media, the Wikileaks diplomatic cables saga and the Arab Spring uprisings have led many governments including those in Africa to recognise the power of online media. In a number of African countries, there are increasing legal and extra-legal curbs on internet rights, in what portends tougher times ahead for cyber security. *PIN and CIPESA work on Internet Freedom* The Collaboration on International ICT Policy in East and Southern Africa (CIPESA) and the Paradigm Initiative Nigeria (PIN) will co-host an online internet freedom forum during November and December 2013. The purpose of this forum will be to discuss key online safety matters in Africa. The forum aims to attract discussions from key ICT experts both within Africa and outside Africa. The outcomes of the discussions will feed into a report that will be presented at the first African Internet Freedom Forum to be held in 2014. Furthermore, it will inform the work of CIPESA, PIN and their partners that are working in the area of online freedoms. *Format of the discussions* Discussions will be hosted on selected online platforms in Uganda, Kenya, Nigeria and a mailing list comprising Africa Internet Governance experts. FYI Africa's Future is Clear: Youth, Technology & Broadband Technology is not an end unto itself. While it needs to reward shareholders and management, it has to address the improvement of human well-being. At its core it has to place the values of equity, justice and human dignity. Only then will it drive a revolution of ethics and morality that resolve the grand challenge of development in Africa and the world. The increasing disparities in wealth are causing rage worldwide, with global protests over corruption, bonuses, and tax evasion. Large numbers of unemployed youth fall outside formal markets and public services. People are demonstrating not only for democratic inclusion, but also to change the form of democratic inclusion - traditional multiparty politics is losing the ability to command younger populations, with party membership and voter participation going down worldwide. Still, there is a revolution going on in our world. The Internet and mobile phones were widely credited with the ‘death of distance’, and the rise of mobile broadband may be widely credited with the ‘death of geography’. Mass connectivity via mobile phones will exceed the global population of 7 billion in 2014. But where is Africa? I remember in the mid-90s as Minister of Communications in the Mandela Cabinet that there were 600,000 mobile phones in sub-Saharan Africa. Today it exceeds 750 million and is one of the fastest growing markets. No aid dollars drove this digital revolution. It was innovation; game changers like the prepaid card and demand for the right to communication from users. It was the appropriate policy and regulatory frameworks and freeing up of spectrum, that gave certainty and predictability to private investors. Most importantly it was getting our presidents out of the clutches of securocrats and to understand that communication as a right of citizens was our best protection of democracy. Today technology is changing our world - the way we live, work, educate ourselves, buy goods and services and transfer money. It determines the way in which our future societies will be organized. How do we ensure Africa rides the next wave of the digital revolution? What do we need to do to stop being left behind again in development? Half the population on our continent is under 25. It is our demographic dividend. While the populations of most continents are aging, ours grows younger. Are we hoping to be the factory or the farm of the future or the center of the global knowledge economy? What we do in this sector will decide our growth trajectory. Technology is driven by young people. They are the most connected generation in the history of humanity. So what are the key challenges we confront in Africa today and how can technology help us overcome them? Poverty confronts half our population who live on $1.25 a day. Education is one of the key pathways out of poverty. But half the children out of school live in Africa and the quality of public education is generally poor. Our infrastructure is weak and regional integration lags far behind the rest of the world. That reduces intra-African trade and the movement of goods and services. Although we are the richest continent we have not learnt to value our assets. We act as 54 separate countries and weaken our bargaining power with powerful economies and trading blocs. We have not benefitted from the commodities boom in the past decades. Now we can harness the digital broadband revolution to drive a entrepreneurial and livelihoods approach to our key assets; our land and agricultural potential to feed Africa and the world through a modern, technologically-savvy smallholder farmers model. Farmers, mainly women, have been incredibly empowered by being able to negotiate prices for their crops with middle men because they know market prices now. We can build on the incredible talent coming out of the technology hubs in Africa. In Nairobi, one of the cutting edges of new technology, public innovation, has produced some of the most successful applications. It is estimated that anywhere up to 20% of the Kenyan GDP is circulating on the back of mobile platforms like M-pesa, putting effective financial services into the hands of the previously unbanked. Over 17 million customers can deposit, withdraw and transfer money, pay bills, buy airtime from a network of agents that includes airtime resellers and retail outlets. Across Africa I see a multiplicity of such miracles are being born. We can use technology to drive education content and teaching and to deliver telemedicine. Public information on lifestyles, exercise, diets, breastfeeding and maternal and new-born care can be universally accessible and citizens empowered. We can begin to see our citizens as the greatest ally for good governance. Governments can improve outcomes on public expenditure by breaking down budgets and making it transparent for citizens to follow the money and demand accountability at a local level, in schools, clinics and local governments. Citizen engagement is essential for effective development, strengthening the quality of policymaking and the “science” of service delivery with improved social accountability. We live in the world of the ‘Internet of Things’, a universe of around 9 billion connected devices which could reach a trillion by 2025. Convergence of technology, a dream in my term in government, is now a reality. Mobile broadband is growing faster than any technology in human history averaging 30% per year. And it is driven by private sector investment. Five countries now have mobile broadband penetration in excess of 100 connections per capita (Singapore, Japan, Finland, Korea and Sweden). By the beginning of 2013, 32 economies had mobile-broadband subscription penetration in excess of one subscription for every two inhabitants, compared with just 13 countries at the beginning of 2012. There are more than 70 countries where more than half the population now has access to the Internet. While the impact of mobile over the past decade on our continent has been nothing short of a game-changer, there is a larger revolution for progress waiting. Just as we leapfrogged into the digital infrastructure of the mid-nineties we can today leapfrog the PC era into the marriage of mobile broadband and the Internet: we can be in the top league if we had the political will and build a smart partnership between government, the private sector, civil society and citizens. But we need to support an entrepreneurial approach to public innovation driven by public demand and needs. Today it is policy, regulatory and investment frameworks that will determine the future of Africa’s economic success: broadband licenses and spectrum are not cash cows for government in the short term. They are the foundations for long-term economic success. Otherwise broadband will remains out of reach in many countries in Africa. We need: Governments to lead through clear policies and regulations Each country needs a broadband rollout plan Clear policy and regulations that drive competition, attract private sector investment and drive down tariffs Introduce financial incentives that support entrepreneurs in public innovation Universal service obligations to subsidize education and rural internet access Local governments to drive connectivity and increase citizen access to public services and information Define incentives for operators and stakeholders in the broadband value chain While there is no single recipe that is likely to work for all countries - instead, countries need to relate the options they choose for universalising broadband to their market needs. None of this is rocket science. We need transparency in the way licenses are issued. We need predictability and certainty of policy and regulation. We need to drive digital literacy in our schools and communities. We need to eliminate any tariffs on the inputs into the broadband value chain. And Africa needs to use its bargaining power to ensure that we benefit in the manufacturing value chain from this broadband boom. Maybe the ICT CS could enlighten us on what exactly the issue is? Listers, I came across this ( http://www.nation.co.ke/business/marketing-Kenya-at-London-expo/-/996/20588… ) where Kenya tourism Board takes 50 firms in the Tourism & Hospitality industry to an international expo in London to showcase Kenya's Tourism opportunities. During some discussions we had at #140Friday sometime back, there was a good suggestion that the then Kenya ICT Board should sue at least 50% of their marketing budgets to actually marketing Kenya's firms, services & products in the ICT Sector. We know this currently doesn't happen as most of their (KICT Board) marketing budgets gets spent up in travelling per-diems to every other forum being held globally somewhere. One of the very many topics for panel discussions was coined as: "*Developing Smart infrastructure: Developing Ubiquitous, Secure and Sustainable ICT Infrastructure"* I must say the discussions were led by eminent panelists! But it is interesting to note that the critical resources of the Internet (Domains, IP - Addresses, AS numbers) continue to elude many people as part of the entire ICT infrastructure. Not many people gave this a thought, yet Africa is lagging behind in the uptake of some of these resources. It is widely assumed that Infrastructure is limited to Broadband Infrastructure! NSA Tapping into Google & Yahoo Networks? How is Kenya protected?

Listers, Just came across this http://www.washingtonpost.com/world/national-security/nsa-infiltrates-links… It looks like Google might have been caught by the NSA with their pants down since hacking into their Data Transport layer simply gives up all the secrets that encryption is supposed to be protecting. Now, moving on swiftly to the local setup, I am also concerned that even as we look to start pushing for National Standards of Encryption through the PKI project, whether we as a country have come together to review and see how to protect our countries intelligence and data. We also know for a fact that the US was busy tapping into World Leaders phones, and I can bet if there are a few presidents to be 'tapped' in Africa, ours should be way up on that ladder! However, more worrying would be, how protected are our internal networks from such tapping, even from locals? Could there be a guy who has tapped into Safaricoms internal network and is busy reading every email, chat that is flying through and perhaps selling such information to our erstwhile enemies the Al-Shabbab? I was once very surprised when a personal friend got a transcript of all his calls, and chat messages, word-for-word for the previous past 6 months, dug up from one of the local Telcos. The ease with which such information was availed appalled me as it clearly means that the Telcos clearly store all our chats, and such records in clear text months after we have used them and a guy with basic SQL knowledge just needs to hack into the network (easy) and call them up. The Battle for Power on the Internet

ListersThis is an interesting article and quite relevant in today's Internet debates. It is long though:). "On the Internet, data is power. To the extent the powerless have access to it, they gain in power. To the extent that the already powerful have access to it, they further consolidate their power. As we look to reducing power imbalances, we have to look at data: data privacy for individuals, mandatory disclosure laws for corporations, and open government laws. Today’s Internet is a fortuitous accident: a combination of an initial lack of commercial interests, government benign neglect, military requirements for survivability and resilience, and computer engineers building open systems that worked simply and easily.
