Kuerbis on Wed 23 Nov 2011 10:57 AM EST An international law enforcement action against a large botnet will set an important legal precedent regarding regional Internet IP Address registries. At issue is the extent to which an IP address registries can be used as tools of transnational law enforcement.DNSChanger was a piece of malware that altered the Domain Name System (DNS) settings of computers so that all web page requests coming from those computers would be redirected to nameservers operated by criminals. The illicit DNS nameservers redirected some of their traffic to domains that would generate click-based payments to the perpetrators. DNSChanger is said to have infected about 4 million computers worldwide, and to have generated $14 million in illicit revenues. The Estonia-based group running the scam provoked a complex international, multi-agency investigation, dubbed Operation Ghostclick. The operation culminated in their arrest by Estonian police in early November.Ghostclick was a truly multi-stakeholder, transnational effort in networked governance, involving the U.S. FBI, the U.S. NASA’s Office of Inspector General (OIG), the Estonian Police and Border Guard Board, the National High Tech Crime Unit of the Dutch National Police Agency, Georgia Tech University, Internet Systems Consortium, Mandiant, National Cyber-Forensics and Training Alliance, Neustar, Spamhaus, Team Cymru, Trend Micro, University of Alabama at Birmingham, and members of an ad hoc group of experts known as the DNSChanger Working Group (DCWG).Once the scam had been uncovered and the perps arrested, however, the Ghostclick operation could not simply shut down the nameservers used by the botnet to generate the clickfraud. To do so would have incapacitated millions of innocent users, whose Internet access would cease to function due to a sudden, unexplained inability to resolve domain names. This would have also resulted in a flood of service calls to many hapless ISPs. So the FBI enlisted the Internet Systems Consortium (ISC) to run clean "replacement" nameservers that behaved properly, took over the address blocks used by the botnet's nameservers, and then assigned those address blocks to ISC's nameservers. In order to preserve this arrangement, the FBI needed to require the Regional Internet Registries (RIRs), the institutions who allocate and register Internet Protocol address holdings, to put a hold on the address blocks for several months. To effectuate this hold, as well as other actions, it obtained a Protective Order from a U.S. District Court. Judge William Pauly, who issued the Order, made it very clear that it applied to any and every RIR worldwide.ARIN, the RIR for the North American continent based in Virginia, seems to have cooperated with this U.S.-initiated order without any questions asked, as one might expect from an organization in U.S. jurisdiction. But the European RIR, RIPE-NCC, which is based in Amsterdam, Netherlands, has now sued the two Dutch police units and the Dutch public prosecutor's office over the ruling. RIPE wants a judge to decide whether they had sufficient legal ground to order the "lock" of the registration information. The order was based on a very generic legal provision from the Dutch Police Law that describes the mandate of the police, something like "defend the rule of law and assist those who need it."It has surprised legal experts that the order was based on this generic provision. There seem to be more applicable and specific provisions in the Law on Criminal Procedure. The Dutch Supreme Court has repeatedly struck down orders based on that generic provision in other areas of law enforcement. Only orders that merely implied "a marginal encroachment" on individuals' rights, have been upheld in court. The police will, of course, argue that the "lock" of the registration of the address blocks is indeed only a marginal encroachment of the rights of the defendants and RIPE-NCC.The Dutch order simply states that RIPE-NCC is to comply with the U.S. court order. The latter treats the address blocks as "forfeitable property." So not only did the Order come from a foreign jurisdiction but, ironically, RIPE-NCC, which is run by people who insist that IP addresses are not property, was served with a legal order that seems to classify addresses as property. RIPE-NCC's news release says, "The RIPE NCC is receiving independent legal advice and is in discussion with the appropriate authorities. It is the intention of the RIPE NCC to pursue this matter further in Dutch court to establish a precedent so that it is certain of its rights regarding such orders. In the interest of transparency, the RIPE NCC is working on full disclosure of the background documents. The RIPE NCC will update the community if and when any other publishable materials become available. The RIPE NCC is committed to acting in the best interest of its membership and will continue to inform the Internet community on this matter as it progresses. The RIPE NCC has not withdrawn, removed or reclaimed the address blocks in question; it has temporarily locked a registration of address blocks."Understandably, RIPE-NCC is concerned about the implications of embroiling its address registration functions in policy and governance issues. As IGP warned in a 2008 paper, it is inevitable that RIRs would become the target of those seeking to regulate the Internet, and thus the legal rights concerning forfeitures of address registrations and other types of law enforcement actions must be handled carefully, and with an eye toward due process protections and concern for human rights.The case is especially noteworthy given that it is occurring in the context of the ongoing attempt to add security to routing (i.e., RPKI and S-BGP). In rolling out this security improvement, a major sticking point for RIPE members has been whether the IP address registry issuing the address block certificates could rescind operators' routing rights by revoking the certificate, perhaps at the request of a law enforcement agency in some distant jurisdiction. In other words, the RPKI debate is exactly about the possibility of linking address registries to routing activity. In a future world, where every address allocation had a resource certificate and secure BGP was widely deployed, law enforcement agencies could, in theory, simply go to the RIR, have the certificate revoked so that the routes associated with that resource would no longer validate, and ISPs would not announce or accept them. The decision in the RIPE-NCC litigation may have some bearing on that possibility. Indeed this was a move in the right direction and there is need for sector specific Computer Incidence Response Teams to deal with emerging challenges such as the one listed which threaten to erode the gains we have achieved as a country in so far as e-commerce is concerned. I look forwad to the next workshop and i hope the local Interpol boss will be present to tap the knowledge of other stakeholders as was the case on Monday and Tuesday, Interpol alone cannot solve this issue , it will take concerted efforts from all stakeholders as was agreed during the just concluded regional workshop 'On Thursday, local Interpol boss Mary Kaol said that vehicle importation cartels in the business of defrauding innocent people were mushrooming.' “In fact, we are planning to involve the media in educating people on the tricks the conmen are using to steal from the public,” Ms Kaol said.' -- Barrack O. Interesting story. On an aside I miss the good old days when funerals were funerals and NOT political rallies. Today, even we forget the solemness of occasions of mourning and start doing political wrestling. If there were curses to come from the dead, it is time they did. I also miss the good old days of a good political rally, where we listened to rousing inspiring speeches of building a future on the defeat of colonialism. Add the bubbling optimism of a people set on nation building (education for kids, farming to increase produce, buying Kenyan to build Kenya, health care for all, ...) we loved it. Anyone know when funerals turn into political arenas? Who knows when they will ever come calling? It is on Wednesday 23rd November 2011, I left office (Ngong Road) with another appointment at 6pm in Nairobi West. To make it in time, I decide that Ngong road is not fast enough and clearly remembers the usability of an alternative "short-cut" route; the Southern Bypass. After all, it is still daytime. As I take my turn into the Southern Bypass, driving towards Langata, everything seems okay. Several on coming cars are seen. Actually the road is busy, many vehicles but nevertheless that is good for security and some great distances are covered pretty fast. One little hill done, then valley, then the next hill is approach, actually now mid way along this route. Suddenly, some vehicle is spotted parked on the right side of the road, doors wide open. I slow down a bit, avoiding to hit onto the doors of the other vehicle. Speed is reduced from an average of 100Km/h to 30 or 40Km/h, and the car is now positioned for the eventual overtaking. Suddenly a youthful Kenyan is spotted doing his nation building duties. He is standing in the middle of the road, about 30 meters away; with a gun in hand; pointing towards the on-coming car. I tries a U-turn on this "loose earth" road, impossible on this narrow road with deep trenches on both sides of the road . 2 gun shots in quick succession are fired towards me; and by now I realizes that the road is narrow and the u-turn cannot work at all. Cornered, un-armed and frightened, I surrenders and obeys. I jumps out of the car and my belly is welcomed flat on the dusty murram road. My feet landing directly on the muddy waterway on the side of the road. Not comfortable, but in situations like this; instincts quickly gathers that you do not complain! My pockets are frisked; the car is run-sacked; everything is taken away. out of curiosity I peep from under the car over the other sides and immediately notices a couple of other private cars (about 5 to 7 in total); occupants (both men women of stature); all sharing in my predicament on the surface of the murram road. I consoles myself that after all, it will be many murders, not just one. Something like this may definitely attract the governments attention to these matters of security. In a couple of minutes, the youth group (approximately 5 in total); invites everybody back to their cars as they dash into the nearby Ngong forest. In fact they shout thank you's to us for having chosen to travel this short-cut road without traffic jams and even encourages us to continue using it in the future. We are reminded that with no resistance, things can never get bloody... Indeed, very nice words for me by now... I collects himself from the ground, dusts off a little bit, but most of the mud is too stubborn. Luckily, the car engine is still running. About 500 meters from the scene, I notices several vehicles; private cars and public vans (buses and matatu's) parked on the road waiting for the ordeal happening just ahead to complete. Of course it is clear that they watched the whole episode. Some by-standers (about 10 to 15) as well are spotted by the road side, watching the episode. As I continue down the road about 2Km from the robbery scene, I spots two cops on patrol. I slow down and pulls over to the attention of the two cops armed to the teeth, each with an AK-47. I narrates the ordeal briefly and the cops asks for a quick ride to reach the scene and follow the gun-trotting youths. After all, I have lost so much; I agree to drive the cops. The car is now a police response vehicle. By now the cops are asking too many questions: How many were they?, did they have guns?, I heard some gun shots, was it there!, roughly how many people/cars were there? How much money did they take from you??? etc. I give rough estimates as we speed towards the scene, now beaming with confidence. After all, I am protected with two AK-47's (most probably loaded). The cops promises to get something back, if not everything, but at least the documents which they are sure will not be useful for these youthful Kenyans doing their part in the nation-building business. After some distance, I pull over and shows the two cops the presumed location of the incident, but they refuses to accept this location and points to some other location some 500 meters ahead. I drives further ahead and actually realizes that I was confused. The cops who were about 2-3 KM away from the scene of the incident knows better...!!! The cops disembark, heads towards the forest and urges him to proceed and report the incident at Karen police station. * The morale of the true story: The Southern Bypass in NOT safe anytime, day or night; with or without the police. Sambaza to your contacts. It is not an interesting thing to experience. Can media highlight such cases publicly on prime time news so that all Nairobians get to know these unsafe places?
